Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make companies that support venues and events eligible for grants under the shuttered venue operators grant program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Music Under Severe Income Crisis Act</short-title></quote>.</text></section><section id="idFE7491EF8A5844EAB8350C9C919814C9"><enum>2.</enum><header>Adding service and support companies to the shuttered venue operators grant program</header><subsection id="idABDF3292EDFF421C9EAE32111D847BD8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (title III of division N of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended—</text><paragraph id="idF9B87A5D6DB64BDE8B5E75FFA5B95762"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id43A5B2D42D2E4F79B4C70A138A261B03"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id8CC2FB10454843198790E8B3097842A5"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="id4BF41B48D8384CF9A081DA7DC1261916"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>a service and support company,</quote> after <quote>theatre operator,</quote>;</text></subclause><subclause id="id00E1C5D9AF5842CBBAAD05F1D478D8D5"><enum>(II)</enum><text>in clause (i)—</text><item id="idA48DAC1C36BF4CF19F250E762A053FFC"><enum>(aa)</enum><text>in the matter preceding subclause (I), by inserting <quote>the service and support company,</quote> after <quote>theatre operator,</quote>; and</text></item><item id="id2B8B57A021C046A8AE9287C80C081E18"><enum>(bb)</enum><text>in subclause (I), by inserting <quote>a service and support company,</quote> after <quote>theatre operator,</quote>; </text></item></subclause><subclause id="idCE44DEBE04C84870982DB86995479649"><enum>(III)</enum><text>in clause (ii)—</text><item id="id7831C5E7AF8640FDA2D57CB559DB8DE3"><enum>(aa)</enum><text>in subclause (III), by striking <quote>and</quote> at the end;</text></item><item id="id5F1FB4FEACA04930B19412180628CB11"><enum>(bb)</enum><text>in subclause (IV), by adding <quote>and</quote> at the end; and</text></item><item id="id0DE67589C723407884970EA0FF7B9D86"><enum>(cc)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id295E595E43EA4AD9A98EDBF5EA66204F"><subclause id="idB871756C82454064A7F0944E65D1C17F"><enum>(V)</enum><text>the service and support company is or intends to resume the services and activities described in paragraph (11);</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></item></subclause><subclause id="idE72CDA4387E241DFAD03DABB5AF92310"><enum>(IV)</enum><text>in clause (vi), by inserting <quote>the service and support company,</quote> after <quote>theatre operator,</quote> each place that term appears; and </text></subclause></clause><clause id="id0A5199900C7A4887A2B198448AC71C80"><enum>(ii)</enum><text>in subparagraph (B), by inserting <quote>service and support company,</quote> after <quote>theatre operator,</quote> each place that term appears; and</text></clause></subparagraph><subparagraph id="id46C16B45631349259205CFA6B5483825"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="idC1C59E0856034070AAA0B93C24F49660" display-inline="no-display-inline" style="OLC"><paragraph id="idFCB49032C63E4A42BF381596A7E50B6E"><enum>(11)</enum><header>Service and support company</header><text>The term <term>service and support company</term>—</text><subparagraph id="idD7B98B9114DD4453B93588B876D11880"><enum>(A)</enum><text>means an individual or entity—</text><clause id="idC46A9D51C61E449C9A002F7C97C317E4"><enum>(i)</enum><text>that is assigned a North American Industry Classification System code of 532490, 541410, 541420, 541430, 541490, 561920, 711190, 711300, or 711320, as appears on the most recent income tax filing or on the application for a loan under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) of the individual or entity, if applicable; and </text></clause><clause id="idD3C3C0481F374102999BC276475DBCD9"><enum>(ii)</enum><text>that—</text><subclause id="id40459ED8127349C498CFFBB14570D0E0"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id21C7E869CC5640C4B4EFDF0F35B07504"><enum>(aa)</enum><text>as the principal business of the individual or entity, provides stages, lighting, sound, casts, or other support for live performing arts events; and</text></item><item id="id04C09F991FB04C30B51C3CFF37CE0567" indent="up1"><enum>(bb)</enum><text>for which not less than 70 percent of the earned revenue generated through providing the support described in item (aa) is for live performing arts events organized, promoted, produced, managed, or hosted by an eligible person or entity described in paragraph (1)(A)(iii); or</text></item></subclause><subclause id="idB5E32E21FA8D4FA985228D0D688C5D04"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idD13D2E3202A24F238FD0776DD4D7581C"><enum>(aa)</enum><text>as the principal business of the individual or entity, showcases performers or pre-packaged productions to potential buyers; and</text></item><item indent="up1" id="idB4B3468FB4B7445FAF456D883C45F1C1"><enum>(bb)</enum><text>for which not less than 70 percent of the earned revenue generated through showcasing performers or pre-packaged productions described in item (aa) is for live performing arts events—</text><subitem id="idDBD438A6602F43B6941EAA5C54B3C602"><enum>(AA)</enum><text>organized, promoted, produced, managed, or hosted by an eligible person or entity described in paragraph (1)(A)(iii); or</text></subitem><subitem id="id87C486BA55E54F9AB0CEB90281653A62" commented="no"><enum>(BB)</enum><text>hosted in a hotel or convention center facility; </text></subitem></item></subclause></clause></subparagraph><subparagraph id="idb04e39460fb045688d2ed629b6edd40a"><enum>(B)</enum><text>includes an individual or entity described in subparagraph (A) that—</text><clause id="idCC2A3787F97D4D199F48A1E910F79E55"><enum>(i)</enum><text>operates for profit;</text></clause><clause id="id66186BE3D24E4E3584D13634C292C319"><enum>(ii)</enum><text>is a nonprofit organization; </text></clause><clause id="id31C2106778184970A0929A17EBBC398E"><enum>(iii)</enum><text>is government-owned; or</text></clause><clause id="id7DF51DE99EA145DD8F61F4CE82F861C1"><enum>(iv)</enum><text>is a corporation, limited liability company, or partnership or operated as a sole proprietorship; and</text></clause></subparagraph><subparagraph id="id3CF1925FDD4B4B5DAD3F8A57997873AC"><enum>(C)</enum><text>does not include—</text><clause id="idB6ED59392D7B4FA19D35B1549BC03F5E"><enum>(i)</enum><text>an individual or entity described in subparagraph (A) that—</text><subclause id="id7BA21B051A814507B6BEA5CF4E5A8A86"><enum>(I)</enum><text>employs more than 250 full-time employees; or</text></subclause><subclause id="id8A2D121AD64B44A5936FA8AF4510B06A"><enum>(II)</enum><text>is registered or operates outside of the United States; or</text></subclause></clause><clause id="idC01A3E565ABD477591D042A628EEBC06"><enum>(ii)</enum><text>an entity that is majority owned or controlled by an entity that is an issuer, the securities of which are listed on a national securities exchange under section 6 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78f">15 U.S.C. 78f</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id5A5462329E734BA0B488BF41175E48B8"><enum>(2)</enum><text>in subsection (b)(2)(B), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEE53A5A64B454F498C4B2B9A02F3104B"><clause id="id551C5DA585324F3CB1D57E9555D61FF7"><enum>(iii)</enum><header>Priority for awards to service and support companies</header><subclause id="id984CE372CE70408BBF29B017623206CE"><enum>(I)</enum><header>First priority in awarding grants</header><text>During the initial 14-day period during which service and support companies are eligible to receive a grant under this paragraph, in making awards to those companies, the Administrator shall only award grants to those companies with revenue during the period beginning on April 1, 2020, and ending on December 31, 2020, that is not more than 10 percent of the revenue of the company during the period beginning on April 1, 2019, and ending on December 31, 2019, due to the COVID–19 pandemic. </text></subclause><subclause id="id0AB5AD1F84A8498C9E6F904420D314CF"><enum>(II)</enum><header>Second priority in awarding grants</header><text>During the 14-day period immediately following the 14-day period described in clause (i), in making awards to service and support companies under this paragraph, the Administrator shall only award grants to those companies with revenue, during the period beginning on April 1, 2020, and ending on December 31, 2020, that is not more than 30 percent of the revenue of the company during the period beginning on April 1, 2019, and ending on December 31, 2019, due to the COVID–19 pandemic.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idBB80131A1B0F4A4082CA7A51C2210FE0"><enum>(b)</enum><header>Transfer of amounts from Coronavirus State and local fiscal recovery funds to Shuttered Venue Operators program</header><paragraph id="idd53c55a1bcac43f08bb3bead62a6b942"><enum>(1)</enum><header>Rescission</header><text>Of the unobligated balances of amounts appropriated under sections 602(a)(1) and 603(a) of the Social Security Act (as added by section 9901 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>)) on the date of enactment of this Act, $4,000,000,000 is rescinded, provided that amounts shall be rescinded from the unobligated balance of amounts appropriated under such section 602(a)(1) first, and amounts shall then be rescinded from the unobligated balance of amounts appropriated under such section 603(a) only if the unobligated balance of amounts appropriated under such section 602(a)(1) is less than $4,000,000,000. </text></paragraph><paragraph id="idffcc8a511b10415cb3f964fd84d23822"><enum>(2)</enum><header>Appropriation</header><text>There is appropriated for an additional amount, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, an amount equal to the amount rescinded under paragraph (1), to remain available until December 31, 2021, under the heading <quote>Small Business Administration—Shuttered Venue Operators</quote>, to make grants to service and support companies under section 324 of the Economic Aid to Hard Hit Small Businesses, Nonprofits, and Venues Act (title III of division N of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), as amended by subsection (a). </text></paragraph></subsection><subsection id="id59BB618D1F714C4CB24FCD95A31B845C"><enum>(c)</enum><header>Processing previously denied applications</header><text>If a service and support company, as defined in paragraph (11) of section 324(a) of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (title III of division N of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), as added by subsection (a), was denied a grant under such section before the date of enactment of this Act due to lack of eligibility but, as a result of the amendments made by subsection (a), is eligible for a grant under such section, the Administrator of the Small Business Administration shall reconsider and process the application of the service and support company. </text></subsection><subsection id="idA62186C2D3674AC39AB112F7B4084CCD"><enum>(d)</enum><header>Regulations</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to carry out this Act and the amendments made by this Act without regard to the notice requirements under section 553(b) of title 5, United States Code. </text></subsection><subsection id="id83b182c8a82743af9e20b6b76aaa32b1"><enum>(e)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Administrator of the Small Business Administration should—</text><paragraph id="id7C08AA0B85ED4E1DAF2974C611B8BA82"><enum>(1)</enum><text>issue guidance to ensure that entities whose principal business is to provide services and support to the live events industry remain eligible for the program established under section 324 of the Economic Aid to Hard Hit Small Businesses, Nonprofits, and Venues Act (title III of division N of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>); and</text></paragraph><paragraph id="id808C4930CBB74181AF2D23569BAEF2DE"><enum>(2)</enum><text>distribute funds appropriated for the program described in paragraph (1) not later than 120 days after the date of enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
