<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 273</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To improve the management of driftnet fishing.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id7fc4d856-c889-4314-afa7-6d23d621fa01"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Driftnet Modernization and Bycatch Reduction Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id1785e914-ff34-4054-9c3b-8e64527c8dce"><enum>2.</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="no-display-inline">Section 3(25) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802(25)</external-xref>) is amended by inserting <quote>, or with a mesh size of 14 inches or greater,</quote> after <quote>more</quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id9c7f0faf-ed8a-450e-9370-10927cd212c2"><enum>3.</enum><header display-inline="yes-display-inline">Findings and policy</header><subsection commented="no" display-inline="no-display-inline" id="id109da93b-f1bc-4512-b3ba-b08bad351dd7"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Section 206(b) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id147b76ee-6141-434b-9c96-d2dfbc766a05"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a5b26c4-f9f0-430e-ac15-3422776c7df3"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf37483e1-24bd-4359-be4d-9d284965f7ce"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id59ccf7f6-af9f-43ff-92c2-811c4b9169ba"><paragraph commented="no" display-inline="no-display-inline" id="ida3c2d996-2554-41ec-9b55-8f216db13ab1"><enum>(8)</enum><text display-inline="yes-display-inline">within the exclusive economic zone, large-scale driftnet fishing that deploys nets with large mesh sizes causes significant entanglement and mortality of living marine resources, including myriad protected species, despite limitations on the lengths of such nets.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id19163ffe-024b-455c-bf99-32360dfef871"><enum>(b)</enum><header display-inline="yes-display-inline">Policy</header><text display-inline="yes-display-inline">Section 206(c) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7f2610f8-2def-40c2-8658-66c469062af2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbae24b4-a906-45a3-9dc3-16b19ea65bf5"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10b5b216-6c4e-402c-983d-05baf5f218ae"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2a9010a1-9a58-418d-a49e-822d720ab08b"><paragraph commented="no" display-inline="no-display-inline" id="id47cae1a3-59c7-40db-8e09-ff4b219912b1"><enum>(4)</enum><text display-inline="yes-display-inline">prioritize the phase out of large-scale driftnet fishing in the exclusive economic zone and promote the development and adoption of alternative fishing methods and gear types that minimize the incidental catch of living marine resources.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6ea70b81-2058-40e1-a588-1b811ad6e71b"><enum>4.</enum><header display-inline="yes-display-inline">Transition program</header><text display-inline="no-display-inline">Section 206 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826</external-xref>) is amended by adding at the end the following—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfaab8c4e-56de-4ee6-b4e2-e033d9cb3cf0"><subsection commented="no" display-inline="no-display-inline" id="id41faeb03-c712-48fa-bdab-42488caead5d"><enum>(i)</enum><header display-inline="yes-display-inline">Fishing gear transition program</header><paragraph commented="no" display-inline="no-display-inline" id="id403a2457-b600-4cab-be5a-14c68db43073"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the 5-year period beginning on the date of enactment of the <short-title>Driftnet Modernization and Bycatch Reduction Act</short-title>, the Secretary shall conduct a transition program to facilitate the phase-out of large-scale driftnet fishing and adoption of alternative fishing practices that minimize the incidental catch of living marine resources, and shall award grants to eligible permit holders who participate in the program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3CD35F0D184445778832D67A2770D34A"><enum>(2)</enum><header display-inline="yes-display-inline">Permissible uses</header><text display-inline="yes-display-inline">Any permit holder receiving a grant under paragraph (1) may use such funds only for the purpose of covering—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB7CD95A1AF7443E0BC63E7DE9167C4C9"><enum>(A)</enum><text display-inline="yes-display-inline">any fee originally associated with a permit authorizing participation in a large-scale driftnet fishery, if such permit is surrendered for permanent revocation, and such permit holder relinquishes any claim associated with the permit;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA360D139DD5645AFBC70E8233262FDD0"><enum>(B)</enum><text display-inline="yes-display-inline">a forfeiture of fishing gear associated with a permit described in subparagraph (A); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id495DB71A81CE4951BD4E098AF9267A62"><enum>(C)</enum><text display-inline="yes-display-inline">the purchase of alternative gear with minimal incidental catch of living marine resources, if the fishery participant is authorized to continue fishing using such alternative gears.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBDF9DC53BE4C430590526FDAECBA14B8"><enum>(3)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">The Secretary shall certify that, with respect to each participant in the program under this subsection, any permit authorizing participation in a large-scale driftnet fishery has been permanently revoked and that no new permits will be issued to authorize such fishing.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id995f7246-d48a-48ee-b936-4d7f27d630a3"><enum>5.</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="no-display-inline">Section 307(1)(M) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857(1)(M)</external-xref>) is amended by inserting before the semicolon the following: “, unless such large-scale driftnet fishing—</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddcb52b4d-660a-4524-a7b1-b460b2e6891f"><clause commented="no" display-inline="no-display-inline" id="idf0f9405f-0677-429c-9c04-32f829b49af9"><enum>(i)</enum><text display-inline="yes-display-inline">deploys, within the exclusive economic zone, a net with a total length of less than two and one-half kilometers and a mesh size of 14 inches or greater; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf3f82942-8d2c-4f7e-8c79-979c0e092575"><enum>(ii)</enum><text display-inline="yes-display-inline">is conducted within 5 years of the date of enactment of the <short-title>Driftnet Modernization and Bycatch Reduction Act</short-title></text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id86DFD72BECF74EF2B593190B505BBAA8"><enum>6.</enum><header display-inline="yes-display-inline">Fees</header><subsection commented="no" display-inline="no-display-inline" id="id6e29ecebced849e389d08df92ba68433"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The North Pacific Fishery Management Council may recommend, and the Secretary of Commerce may approve, regulations necessary for the collection of fees from charter vessel operators who guide recreational anglers who harvest Pacific halibut in International Pacific Halibut Commission regulatory areas 2C and 3A as those terms are defined in part 300 of title 50, Code of Federal Regulations (or any successor regulations).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd785e10706e54fdfbc9c3a762722f26c"><enum>(b)</enum><header display-inline="yes-display-inline">Use of fees</header><text display-inline="yes-display-inline">Any fees collected under this section shall be available for the purposes of—</text><paragraph commented="no" display-inline="no-display-inline" id="id8AA0B3FEBC1C4D168946BA9FAE03C5CB"><enum>(1)</enum><text display-inline="yes-display-inline">financing administrative costs of the Recreational Quota Entity program;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id246AA2B8B13A448E8100E3CEF6905C3E"><enum>(2)</enum><text display-inline="yes-display-inline">the purchase of halibut quota shares in International Pacific Halibut Commission regulatory areas 2C and 3A by the recreational quota entity authorized in part 679 of title 50, Code of Federal Regulations (or any successor regulations);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98CE54E468C7457988C053310422ED43"><enum>(3)</enum><text display-inline="yes-display-inline">halibut conservation and research; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB80B6C5B31144FA2B2292D41B959D3DD"><enum>(4)</enum><text display-inline="yes-display-inline">promotion of the halibut resource by the recreational quota entity authorized in part 679 of title 50, Code of Federal Regulations (or any successor regulations).</text></paragraph></subsection><subsection id="id2f153e8a4cbb49f88485ad739062a9e0"><enum>(c)</enum><header>Limitation on collection and availability</header><text>Fees shall be collected and available pursuant to this section only to the extent and in such amounts as provided in advance in appropriations Acts, subject to subsection (d).</text></subsection><subsection id="id622edf506c7345be8e5f2b25eb87fe81" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Fee collected during start-up period</header><text>Notwithstanding subsection (c), fees may be collected through the date of enactment of an Act making appropriations for the activities authorized under this Act through September 30, 2022, and shall be available for obligation and remain available until expended.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210914" chamber="Senate">Passed the Senate September 14, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
