which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exclude vehicles to be used solely for competition from certain provisions of the Clean Air Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H70422E8368364E21A057BD5E565ECAEF"><section section-type="section-one" id="H83FCE7667D944FA3A97ADAA10162CB2B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recognizing the Protection of Motorsports Act of 2021</short-title></quote> or the <quote><short-title>RPM Act of 2021</short-title></quote>.</text></section><section id="id321189E329904CBAAE61F0E6DDCC1B2D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id80785437B2934F53AED8BF88D169FBDA"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" id="idD94317A65AAF4676BCC04CD32D4BD719"><enum>(2)</enum><header>Part or component</header><text>The term <term>part or component</term> is within the meaning of the term in section 203 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7522">42 U.S.C. 7522</external-xref>).</text></paragraph></section><section id="H34F4C6537CA64EA7B1B913A325C04F8F"><enum>3.</enum><header>Exemption from anti-tampering provisions</header><subsection id="H15EA778DB3D84A73B277B531F9C37EA6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7522">42 U.S.C. 7522(a)</external-xref>) is amended by adding at the end the following: <quote>No action with respect to any device or element of design described in paragraph (3) shall be treated as a prohibited act under that paragraph if the action is for the purpose of modifying a motor vehicle into a vehicle to be used solely for competition, and that vehicle is not authorized for operation on a street or highway.</quote>.</text></subsection><subsection id="H9D2179867ADD4512B3C27049A8B8CACA"><enum>(b)</enum><header>Implementation</header><text>In implementing the amendment made by subsection (a), the Administrator shall not—</text><paragraph id="H1D1D6F6828C84BB0ACF80E6D0EE848AB"><enum>(1)</enum><text>create a Federal database, or identify or require the creation of a State database, of vehicle registration information that is required to be consulted at the point of manufacture, sale, installation, or use of parts or components; and</text></paragraph><paragraph id="H1A5A94029C2548239136C9C45B91C362"><enum>(2)</enum><text>require the registration of a vehicle or a part or component of a vehicle by the manufacturer, seller, purchaser, installer, or user of the vehicle.</text></paragraph></subsection></section><section id="HDF0C609470C54D2B869290DA0BCB0132"><enum>4.</enum><header>Regulation</header><subsection id="id3102E964238B4079B644E2FE86C49848"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall finalize a regulation to implement the amendment made by section 3(a).</text></subsection><subsection id="idE0F64FAAF2D347FC9A0F7B89E721033F"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The regulation under subsection (a) shall—</text><paragraph id="H6D22D7B4AA9F4BA48B6A9CE1047E158D"><enum>(1)</enum><text display-inline="yes-display-inline">describe reasonable conditions for the applicability of the exemption under the amendment made by section 3(a) that are consistent with the requirements described in section 3(b);</text></paragraph><paragraph id="H2519DAF076944EADAC933ED433DB7B08"><enum>(2)</enum><text display-inline="yes-display-inline">provide that evidence of physical attributes of a vehicle to be used solely for competition may be sufficient to qualify for the exemption under the amendment made by section 3(a); and</text></paragraph><paragraph id="H126E508B5AAC4931929462DD98F7BF81"><enum>(3)</enum><text display-inline="yes-display-inline">provide that a manufacturer, seller, or installer of a part or component seeking to use the exemption under the amendment made by section 3(a) may not rely solely on unsupported declarations from the purchaser or owner of a vehicle about—</text><subparagraph id="idDB24AABB3A604C5287DED148F90EA653"><enum>(A)</enum><text display-inline="yes-display-inline">the legal status of the vehicle; or</text></subparagraph><subparagraph id="idE1B5BD4FAE654ACAA8A485B7FC3AE1D1"><enum>(B)</enum><text display-inline="yes-display-inline">the intended use of—</text><clause id="id8254E94F920D4A43ACDC0AA67F0D4B7F"><enum>(i)</enum><text display-inline="yes-display-inline">the part or component; or</text></clause><clause id="idEB0ED8A80B27462687FBE33D6A2F30B5"><enum>(ii)</enum><text display-inline="yes-display-inline">the vehicle.</text></clause></subparagraph></paragraph></subsection></section><section id="HB73193135CE54636B5D52956A113D4CA"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">Section 3, including the amendment made by section 3(a), takes effect on the date of enactment of this Act, without regard to whether a final regulation has been promulgated under section 4.</text></section></legis-body></bill>
