which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Federal Communications Commission to establish a program through which eligible individuals may obtain vouchers for the purchase of connected devices, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Device Access for Every American Act</short-title></quote>.</text></section><section id="id240f98bce31a488e8035461efd0db1e3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idFA47DFE1B2FD4DE9B538629DFAF4B387"><enum>(1)</enum><text display-inline="yes-display-inline">approximately 25 percent of adults in the United States do not own a computer;</text></paragraph><paragraph id="id5F037E0E3ED941699EDF5384DC689DE7"><enum>(2)</enum><text display-inline="yes-display-inline">4,400,000 households with students still lack consistent access to a computer, which prevents those students from completing schoolwork;</text></paragraph><paragraph id="id7093B71AE80049789DE7BF573A0A152C"><enum>(3)</enum><text display-inline="yes-display-inline">there are no reliable estimates about the number of students forced to share a computer with another member of their household, potentially forcing the household to choose between important online activities such as work and learning;</text></paragraph><paragraph id="idD8DF62A0439D4323803C703943585770"><enum>(4)</enum><text display-inline="yes-display-inline">for those households without a computer or tablet, most cannot afford one; and</text></paragraph><paragraph id="idC90430138CFF4827B2491DCCC78BD5C5"><enum>(5)</enum><text display-inline="yes-display-inline">while computer access is nearly ubiquitous among high-income households, 40 percent of low-income adults lack a computer. </text></paragraph></section><section id="idbdbc6f5ca8534f18b2f8e909c9d1f42a" commented="no"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ide04ba22b538a45bc89166f05015e3ac6" commented="no"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="id461978015b274c36b47449c8512d380b" commented="no"><enum>(2)</enum><header>Connected device</header><text>The term <term>connected device</term> means any of the following:</text><subparagraph id="id707d80048f284297b9c825839164d3f6" commented="no"><enum>(A)</enum><text>A desktop computer.</text></subparagraph><subparagraph id="id794219af9fed4bf8899aac79415a23fb" commented="no"><enum>(B)</enum><text>A laptop computer.</text></subparagraph><subparagraph id="id5a0124ea31364028b6e830c6b41d87b6" commented="no"><enum>(C)</enum><text>A tablet computer.</text></subparagraph><subparagraph id="id6db111fff9064d8f9683c3e058fea264" commented="no"><enum>(D)</enum><text>Any similar device (except for a telephone or smartphone) that the Commission determines should be eligible for the use of a voucher under the program.</text></subparagraph></paragraph><paragraph id="id6135b8203a16480cad69c52616af7576"><enum>(3)</enum><header>Eligible expenses</header><text>The term <term>eligible expenses</term> means, with respect to a connected device—</text><subparagraph id="ida2ac4b3abd2849c5812723f844a7a2c1"><enum>(A)</enum><text>the retail price of the connected device;</text></subparagraph><subparagraph id="idaefe6ffb9c1c4b7db0c44effdf86b81d"><enum>(B)</enum><text>any sales taxes collected by the retailer with respect to the sale of the connected device; </text></subparagraph><subparagraph id="id4dc76cf79c7b4969aa387d6c4cbf1fb2"><enum>(C)</enum><text>any shipping charges assessed by the retailer with respect to the connected device; and</text></subparagraph><subparagraph id="idFBB8CF09916C467089C9F2A5DE13B347"><enum>(D)</enum><text>any reasonable (as defined by the Commission) product warranty and technical support services.</text></subparagraph></paragraph><paragraph id="id4af545e04b8a470291441927f6e75bac"><enum>(4)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means an individual who is a member of an eligible household, as defined in section 904(a)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), except that—</text><subparagraph id="id675855f30ca348a189669fb17df7cb1b"><enum>(A)</enum><text>in determining under subparagraph (A) of such section 904(a)(6) for purposes of this paragraph whether at least 1 member of the household meets the qualifications in subsection (a) or (b) of section 54.409 of title 47, Code of Federal Regulations, or any successor regulation, paragraph (1) of such subsection (a) shall be applied by striking <quote>135 percent</quote> and inserting <quote>150 percent</quote>; and</text></subparagraph><subparagraph id="id68f3e33c34324f5385147fee6a43aea3"><enum>(B)</enum><text>subparagraphs (C) and (E) of such section 904(a)(6) shall not apply for purposes of this paragraph.</text></subparagraph></paragraph><paragraph id="id64d15ea8370c41978a10e86c29e7b6f6" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the program established under section 4. </text></paragraph></section><section id="iddeb04cfeba1e4887aa5e66677a015f84"><enum>4.</enum><header>Connected device voucher program</header><subsection id="id93edac4882e34acb9b108f9583d296d7"><enum>(a)</enum><header>Establishment; regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall establish, and promulgate regulations to implement in accordance with this section, a program through which—</text><paragraph id="id06f2c859732e41cd9f197e5dbcb91aad"><enum>(1)</enum><text>an eligible individual may obtain a voucher that can be applied toward the purchase of a connected device from a retailer; and</text></paragraph><paragraph id="iddba9c0e892f1492db2075843037f0be7"><enum>(2)</enum><text>the Commission reimburses the retailer in an amount equal to the lesser of—</text><subparagraph id="id7e2d2d3678d34d72a64315cc719c77a7"><enum>(A)</enum><text>the amount of the voucher; or</text></subparagraph><subparagraph id="idb4d7667bac3c4864aba90edaf598e0f9"><enum>(B)</enum><text>the eligible expenses with respect to the connected device.</text></subparagraph></paragraph></subsection><subsection id="idec7270e843bb45d3a068f6683f12d18a"><enum>(b)</enum><header>Amount of voucher</header><paragraph id="id83b788565d8a45dbaaed90489c823845"><enum>(1)</enum><header>In general</header><text>The amount of a voucher under the program shall be $400, as such amount may be adjusted by the Commission under paragraph (2).</text></paragraph><paragraph id="id1dd7074029834eaab6d5494bdb3f172e"><enum>(2)</enum><header>Reevaluation; adjustment</header><text>Not later than 3 years after the date on which the Commission promulgates regulations under subsection (a), and every 3 years thereafter, the Commission shall—</text><subparagraph id="idc12b0b795da2481497a277a0b55c24b1"><enum>(A)</enum><text>reevaluate the amount of the voucher; and</text></subparagraph><subparagraph id="ide90fca67b8eb4b45976173030011c1f0"><enum>(B)</enum><text>after conducting such reevaluation, if necessary to ensure that the voucher reflects the average amount of eligible expenses with respect to a connected device, adjust the amount of the voucher.</text></subparagraph></paragraph><paragraph id="id6d03d18693904465a065f293a5861276"><enum>(3)</enum><header>Price of connected device exceeding amount of voucher</header><text>If the eligible expenses with respect to a connected device exceed the amount of the voucher, an eligible individual may—</text><subparagraph id="id370c11e831b643f2be7784045b2af354"><enum>(A)</enum><text>apply the voucher to such expenses; and</text></subparagraph><subparagraph id="ide90d788a71ec4e528f9631413897fd16"><enum>(B)</enum><text>pay the remainder of such expenses to the retailer from other funds available to the individual.</text></subparagraph></paragraph></subsection><subsection id="id857f07e7e8724114805369074674ea16"><enum>(c)</enum><header>Number and frequency of vouchers</header><text>An eligible individual may obtain 1 voucher under the program every 4 years, except that not more than 2 eligible individuals per household may obtain a voucher under the program every 4 years.</text></subsection><subsection id="id3a4d69089988493bbc9519a8b530c7cf"><enum>(d)</enum><header>Minimum standards for connected devices</header><paragraph id="id3bde67cc82044cc1bb704a683a1e420c"><enum>(1)</enum><header>In general</header><text>A voucher under the program may not be applied toward the purchase of a connected device unless the connected device meets minimum standards to ensure that connected devices meet the needs of the average user, which the Commission shall establish in the regulations promulgated under subsection (a).</text></paragraph><paragraph id="id98bd6548cb51496fa9a9b610a837b02b"><enum>(2)</enum><header>Reevaluation; revision</header><text>Not later than 3 years after the date on which the Commission promulgates regulations under subsection (a), and every 3 years thereafter, the Commission shall—</text><subparagraph id="id474e8cbc4540438b9032e80fab4e2458"><enum>(A)</enum><text>reevaluate the minimum standards established under paragraph (1); and</text></subparagraph><subparagraph id="id4837ef1e207442a0bc39b0a4f2cda2fb"><enum>(B)</enum><text>after conducting such reevaluation, if necessary to ensure that connected devices continue to meet the needs of the average user, revise such minimum standards.</text></subparagraph></paragraph><paragraph id="idfa092d59f5084438b1a619087e05f0a9"><enum>(3)</enum><header>Standards for new and refurbished devices</header><text>The Commission may establish separate minimum standards under paragraph (1) for new connected devices and for refurbished connected devices.</text></paragraph></subsection><subsection id="idcf3c72b422ec4d7086eb421fa1d47251"><enum>(e)</enum><header>Collaboration with retailers</header><paragraph id="idb37b0c184e434e38b342b49cb2c98db0"><enum>(1)</enum><header>In general</header><text>The Commission shall collaborate with retailers to ensure the wide acceptance of vouchers and the wide availability of covered devices that will be free of charge to consumers after applying a voucher.</text></paragraph><paragraph id="ide888ff91afd74318bf889e7364d9062b"><enum>(2)</enum><header>Website</header><text>The Commission shall establish a website, which shall—</text><subparagraph id="id77580ECBEF0940DC9436321A53A5B941"><enum>(A)</enum><text>link to offerings by retailers of connected devices eligible for the use of a voucher under the program so that a consumer may initiate the purchase of such a device using the voucher through the website; and</text></subparagraph><subparagraph id="id8C360D2897354CFABCA0BEE861254F06"><enum>(B)</enum><text>if the number of vouchers available over a particular time period is limited, indicate the number of vouchers remaining.</text></subparagraph></paragraph><paragraph id="idee13bd2839c441069cc4c33e263161de"><enum>(3)</enum><header>Catalog</header><text>The Commission shall establish a catalog, which shall—</text><subparagraph id="idCD84233392344B88BFE772C2C2486C8D"><enum>(A)</enum><text>be accessible to consumers without internet access and include offerings by retailers of connected devices eligible for the use of a voucher under the program; and</text></subparagraph><subparagraph id="id09192DCDE9A54D439908ED25FB8E9DCC"><enum>(B)</enum><text>if the number of vouchers available over a particular time period is limited, indicate the number of vouchers remaining.</text></subparagraph></paragraph></subsection><subsection id="id19039fe4347b45b78621d2c436e77b91"><enum>(f)</enum><header>Advertisement of program</header><text>The Commission shall advertise the availability of the program, including by carrying out advertising campaigns in collaboration with retailers of connected devices.</text></subsection><subsection id="id51273eb8dc3b46e3a7a6b5ff4802b9c1"><enum>(g)</enum><header>Technical assistance</header><text>The Commission shall provide technical assistance to retailers, eligible individuals, and community-based organizations regarding participation in the program.</text></subsection><subsection id="id7a18dd7f5a9a4b648d2227c8a14a560b"><enum>(h)</enum><header>Enforcement</header><paragraph id="id20392A2FE580481EA27992FBFFFE9432"><enum>(1)</enum><header>In general</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) or a regulation promulgated under that Act. </text></paragraph><paragraph id="idF6DC1CBE9CB04709B7518082B3FFEC6D"><enum>(2)</enum><header>Manner of enforcement</header><text>The Commission shall enforce this section and the regulations promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) were incorporated into and made a part of this section.</text></paragraph></subsection><subsection id="id5b3e3d5bbf904da4a7ba55f26eee6df7"><enum>(i)</enum><header>Use of Universal Service Administrative Company permitted</header><text>The Commission shall have the authority to avail itself of the services of the Universal Service Administrative Company to implement the program, including developing and processing reimbursements and distributing funds.</text></subsection><subsection id="id23cabf9f1a144caf994d1c09b967c667"><enum>(j)</enum><header>Paperwork reduction act requirements</header><text>A collection of information conducted or sponsored under the regulations required under subsection (a) shall not constitute a collection of information for the purposes of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text></subsection><subsection id="id35ed63f2e94f4c15a30d6a63647fd4e0"><enum>(k)</enum><header>Privacy Act of 1974 requirements</header><text>The requirements to publish notices related to system of records notices or computer matching agreements of the agency before implementation required under paragraphs (4), (11), and (12) of section 552a(e) and to provide adequate advanced notice under section 552a(r) of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>), shall not apply when the matching program is necessary to determine eligibility under the program, except that the notices shall be—</text><paragraph id="idA820F35F77884CB3AFE794CB5C229439"><enum>(1)</enum><text>sent to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Oversight and Reform of the House of Representatives, and the Office of Management and Budget; and </text></paragraph><paragraph id="id4B286ED996454455AD9879C77AC110F1"><enum>(2)</enum><text>simultaneously submitted for publication in the Federal Register. </text></paragraph></subsection><subsection id="id5b8d3980307841819ab4f658ffc71c61" commented="no"><enum>(l)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Commission for fiscal year 2022, to remain available until September 30, 2026, $5,000,000,000 to carry out this section, of which not more than 3 percent may be used to administer and promote the program.</text></subsection></section></legis-body></bill>
