which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for a period of continuing appropriations in the event of a lapse in appropriations under the normal appropriations process, and establish procedures and consequences in the event of a failure to enact appropriations.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Government Shutdowns Act of 2021</short-title></quote>.</text></section><section id="id0f7df45af2da4982a088cf76a7db8cc0"><enum>2.</enum><header>Automatic continuing appropriations</header><subsection id="id8d3f7626c70c4daaa4b30cc8dbb31162"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/13">Chapter 13</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idA0C0F3E61F754681A54C27B62C505DC5"><section id="id79b8561ac1804d068fd2dd89badfaef1"><enum>1311.</enum><header>Automatic continuing appropriations</header><subsection id="id567C4ED754AA4C83B1452193844E3D43"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idB0EAEB3BEE46481AB25D1FFCA005FE38"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA5297662EDEA451B8DFE587FB715DEEA"><enum>(A)</enum><text>On and after the first day of each fiscal year, if an appropriation Act for such fiscal year with respect to the account for a program, project, or activity has not been enacted and continuing appropriations are not in effect with respect to the program, project, or activity, there are appropriated such sums as may be necessary to continue, at the rate for operations specified in subparagraph (C), the program, project, or activity if funds were provided for the program, project, or activity during the preceding fiscal year.</text></subparagraph><subparagraph id="id1d8a3c0fd5e742abad8c1d2abd7a6c88" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id4151501792414f62ac281a39a8ca060c"><enum>(i)</enum><text>Appropriations and funds made available and authority granted under subparagraph (A) shall be available for a period of 14 days.</text></clause><clause id="id638da89e6e2346638b3992a2037d94cc" indent="up1"><enum>(ii)</enum><text>If, at the end of the first 14-day period during which appropriations and funds are made available and authority is granted under subparagraph (A), and the end of every 14-day period thereafter, an appropriation Act for such fiscal year with respect to the account for a program, project, or activity has not been enacted and continuing appropriations are not in effect with respect to the program, project, or activity under a provision of law other than subparagraph (A), the appropriations and funds made available and authority granted under subparagraph (A) during the 14-day period shall be extended for an additional 14-day period. </text></clause></subparagraph><subparagraph id="id89A04DBADF284A19A02E33276C276F42" indent="up2"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id9CA2912C9B794FA4954EC439DFF1981C"><enum>(i)</enum><text>Except as provided in clause (ii), the rate for operations specified in this subparagraph with respect to a program, project, or activity is the rate for operations for the preceding fiscal year for the program, project, or activity—</text><subclause id="idbdfa43206b884a5dbc78ee831ef42292" indent="up1"><enum>(I)</enum><text>provided in the corresponding appropriation Act for such preceding fiscal year;</text></subclause><subclause id="id5562d52b3e314ef2b49975775f33dae7" indent="up1"><enum>(II)</enum><text>if the corresponding appropriation bill for such preceding fiscal year was not enacted, provided in the law providing continuing appropriations for such preceding fiscal year; or</text></subclause><subclause id="ida425f69f081e4ba29d3959e3ed98c4eb" indent="up1"><enum>(III)</enum><text>if the corresponding appropriation bill and a law providing continuing appropriations for such preceding fiscal year were not enacted, provided under this section for such preceding fiscal year.</text></subclause></clause><clause id="id0a3073b3c00a40c7a2da093f05a0eb10" indent="up1"><enum>(ii)</enum><text>For entitlements and other mandatory payments whose budget authority was provided for the previous fiscal year in appropriations Acts, under a law other than this section providing continuing appropriations for such previous year, or under this section, and for activities under the Food and Nutrition Act of 2008, appropriations and funds made available during a fiscal year under this section shall be at the rate necessary to maintain program levels under current law, under the authority and conditions provided in the applicable appropriations Act.</text></clause></subparagraph></paragraph><paragraph id="id7493609eabfd429c8a00b69e4d04f368" indent="up1"><enum>(2)</enum><text>Appropriations and funds made available, and authority granted, for any fiscal year pursuant to this section for a program, project, or activity shall be available, in accordance with paragraph (1)(B), for the period—</text><subparagraph id="id31B5C0A9E5364C0AB7C14910112EDB39"><enum>(A)</enum><text>beginning on the first day of any lapse in appropriations during such fiscal year; and </text></subparagraph><subparagraph id="id89FE8029EB5E42C6B0167F39405B9320"><enum>(B)</enum><text>ending on the date of enactment of an appropriation Act for such fiscal year with respect to the account for such program, project, or activity (whether or not such Act provides appropriations for such program, project, or activity) or a law making continuing appropriations for the program, project, or activity, as applicable. </text></subparagraph></paragraph><paragraph id="idF72C5473ECA842F4BED809AB555EFBB3" indent="up1"><enum>(3)</enum><text>Notwithstanding section 251(a)(1) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(a)(1)</external-xref>) and the timetable in section 254(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/904">2 U.S.C. 904(a)</external-xref>), for any fiscal year for which appropriations and funds are made available under this section, the final sequestration report for such fiscal year pursuant to section 254(f)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/904">2 U.S.C. 904(f)(1)</external-xref>) and any order for such fiscal year pursuant to section 254(f)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(f)(5)</external-xref>) shall be issued—</text><subparagraph id="id8DA4D666FA9540F6B956FBBC18D23CBC"><enum>(A)</enum><text>for the Congressional Budget Office, 10 days after the date on which appropriation Acts providing funding for the entire Federal Government through the end of such fiscal year have been enacted; and</text></subparagraph><subparagraph id="idAC628260D7EF44D4A28A272AA85471C6"><enum>(B)</enum><text>for the Office of Management and Budget, 15 days after the date on which appropriation Acts providing funding for the entire Federal Government through the end of such fiscal year have been enacted. </text></subparagraph></paragraph></subsection><subsection id="id5cb497517bc445ce9dcc42c63652658a"><enum>(b)</enum><text>An appropriation or funds made available, or authority granted, for a program, project, or activity for any fiscal year pursuant to this section shall be subject to the terms and conditions imposed with respect to the appropriation made or funds made available for the preceding fiscal year, or authority granted for such program, project, or activity under current law.</text></subsection><subsection id="idcc7ebd7925d9403e8d9174bcc4347168"><enum>(c)</enum><text>Expenditures made for a program, project, or activity for any fiscal year pursuant to this section shall be charged to the applicable appropriation, fund, or authorization whenever an appropriation Act for such fiscal year with respect to the account for a program, project, or activity or a law making continuing appropriations until the end of such fiscal year for such program, project, or activity is enacted.</text></subsection><subsection id="id4199db16763545b5aea0614879dc79df"><enum>(d)</enum><text>This section shall not apply to a program, project, or activity during a fiscal year if any other provision of law (other than an authorization of appropriations)—</text><paragraph id="id78db7376c4814452acf54db06b21078f"><enum>(1)</enum><text>makes an appropriation, makes funds available, or grants authority for such program, project, or activity to continue for such period; or</text></paragraph><paragraph id="idd66c26467be646b7ad04ca65b1439f47"><enum>(2)</enum><text>specifically provides that no appropriation shall be made, no funds shall be made available, or no authority shall be granted for such program, project, or activity to continue for such period.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idcd53a2713dd24499baac4ab108566ea3"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/13">chapter 13</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="id41e17634-86c7-4aa5-a1bb-946efd855542"><toc><toc-entry idref="id79b8561ac1804d068fd2dd89badfaef1" level="section">1311. Automatic continuing appropriations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id44C5661318BD4D1FB969FFAE1CEE4797"><enum>3.</enum><header>Timely enactment of appropriation Acts</header><subsection id="idFE05F52C77F24FB08D02FB60BB52E903"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idB6B608A81FC64265B7AFCC0727A231E3"><enum>(1)</enum><text>the term <term>covered officer or employee</term> means—</text><subparagraph id="id35B4F930549940C5BC4E074F6F692B12"><enum>(A)</enum><text>an officer or employee of the Office of Management and Budget;</text></subparagraph><subparagraph id="idB50F6275BE7745B7AE3E4D2E1C3510EB"><enum>(B)</enum><text>a Member of Congress; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12D70481E2FE4461B12537ABC64332BA"><enum>(C)</enum><text>an employee of the personal office of a Member of Congress, a committee of either House of Congress, or a joint committee of Congress;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5B377B23C9314A1F8DD306CA8B506DFA"><enum>(2)</enum><text>the term <term>covered period</term>— </text><subparagraph display-inline="no-display-inline" commented="no" id="id91F31E97EF1C41C185A7ECE35FF93C72"><enum>(A)</enum><text>means any period of automatic continuing appropriations; and</text></subparagraph><subparagraph id="iddc7137b6fa584dd2ab59b08077eceb10"><enum>(B)</enum><text>with respect to the legislative branch—</text><clause id="id536b8e25fc9e4fc9b149b715bd4c032d"><enum>(i)</enum><text>does not include any period of automatic continuing appropriations that occurs during the period—</text><subclause id="id9f656530c95448029e50bea9d0c34bbd"><enum>(I)</enum><text>beginning at the time at which general appropriations Acts providing funding for the entire Federal Government (including an appropriation Act providing continuing funding) have been enacted or passed in identical form by both Houses and transmitted to Secretary of the Senate or Clerk of the House for enrollment and presentment to the President for his signature; and</text></subclause><subclause id="id01b9278561d04d3eb624eaf69cb4aeda"><enum>(II)</enum><text>ending at the time at which 1 or more general appropriations Acts—</text><item id="id7f99e78f5ccb4ff4890be317fc247cd1"><enum>(aa)</enum><text>are vetoed by the President; or</text></item><item id="idc47957b5b4234285a9ca804192911eb3"><enum>(bb)</enum><text>do not become law without the President's signature under article I, section 7 of the Constitution of the United States based on an adjournment of the Congress; and</text></item></subclause></clause><clause id="id283b84b1df3746edac2e04bbcceac312"><enum>(ii)</enum><text>includes any period of automatic continuing appropriations that is not a period described in clause (i) and that follows a veto or a failure to become law (as described in item (bb) of clause (i)(II)) of 1 or more general appropriations Acts; </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC79D7C644A8243519CE1B7CDFE57A8B4"><enum>(3)</enum><text>the term <term>Member of Congress</term> has the meaning given that term in section 2106 of title 5, United States Code; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD8FFB84FD1DD4EE1AAA05FCE6292F903"><enum>(4)</enum><text>the term <term>National Capital Region</term> has the meaning given that term in section 8702 of title 40, United States Code; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB7C1B119DEF840C6BB86FB4697C3E8D3"><enum>(5)</enum><text>the term <term>period of automatic continuing appropriations</term> means a period during which automatic continuing appropriations under section 1311 of title 31, United States Code, as added by section 2 of this Act, are in effect with respect to 1 or more programs, projects, or activities.</text></paragraph></subsection><subsection id="id37797F82C27A447CA29F89C562184FDB"><enum>(b)</enum><header>Limits on travel expenditures</header><paragraph id="id44D73075B3F1488FADDBAA3E3DB34D4B"><enum>(1)</enum><header>Limits on official travel</header><subparagraph id="id62E72EA99A1141D59628AEABEAE52129"><enum>(A)</enum><header>Limitation</header><text>Except as provided in subparagraph (B), during a covered period no amounts may be obligated or expended for official travel by a covered officer or employee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA1B32B114479451D97B8A51108793D78"><enum>(B)</enum><header display-inline="yes-display-inline">Exceptions</header><clause commented="no" display-inline="no-display-inline" id="id59489898D5B7457AA480667E275EA837"><enum>(i)</enum><header display-inline="yes-display-inline">Return to DC</header><text display-inline="yes-display-inline">If a covered officer or employee is away from the seat of Government on the date on which a covered period begins, funds may be obligated and expended for official travel for a single return trip to the seat of Government by the covered officer or employee.</text></clause><clause commented="no" display-inline="no-display-inline" id="id9DEDF68D2DC746DEB8BD322E42F6D10D"><enum>(ii)</enum><header>Travel in National Capital Region</header><text>During a covered period, amounts may be obligated and expended for official travel by a covered officer or employee from one location in the National Capital Region to another location in the National Capital Region.</text></clause><clause commented="no" display-inline="no-display-inline" id="id13B4669A48AD4CC6807BBFA7A25308C6"><enum>(iii)</enum><header>National security events</header><text>During a covered period, if a national security event that triggers a continuity of operations or continuity of Government protocol occurs, amounts may be obligated and expended for official travel by a covered officer or employee for any official travel relating to responding to the national security event or implementing the continuity of operations or continuity of Government protocol.</text></clause></subparagraph></paragraph><paragraph id="id32505FEBB069484D892B45DC0380AFDF"><enum>(2)</enum><header>Restriction on use of campaign funds</header><text display-inline="yes-display-inline">Section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>) is amended—</text><subparagraph id="idD29D4CF285CB4CE3BC6F6A7FA9070528"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by striking <quote>for ordinary</quote> and inserting <quote>except as provided in subsection (d), for ordinary</quote>; and</text></subparagraph><subparagraph id="id06EAC5B78F6844948D221DD634936764"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD296B26A055641779143ED370259DD88"><subsection id="id63c2b9ae270841ec85562b2a89a17192"><enum>(d)</enum><header>Restriction on use of campaign funds for official travel during automatic continuing appropriations</header><paragraph id="idd944c06972aa48ecaa18ff185426f711"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), during a covered period (as defined in section 3 of the <short-title>Prevent Government Shutdowns Act of 2021</short-title>), a contribution or donation described in subsection (a) may not be obligated or expended for travel in connection with duties of the individual as a holder of Federal office.</text></paragraph><paragraph id="id2992314684594cbe801bb3d846e29c82"><enum>(2)</enum><header>Return to DC</header><text>If the individual is away from the seat of Government on the date on which a covered period (as so defined) begins, a contribution or donation described in subsection (a) may be obligated and expended for travel by the individual to return to the seat of Government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF6F5C2D829514D4C9995EBC26B225429"><enum>(c)</enum><header>Procedures in the Senate and House of Representatives</header><paragraph commented="no" display-inline="no-display-inline" id="id3DA55DCE782E4900B01656D476902BF7"><enum>(1)</enum><header>In general</header><text>During a covered period, in the Senate and the House of Representatives—</text><subparagraph commented="no" display-inline="no-display-inline" id="idA53359CA81C14D2F88B892B716AC89B7"><enum>(A)</enum><text>it shall not be in order to move to proceed to any matter except for—</text><clause commented="no" id="id241606CD33E24F83AC08884936B9704F"><enum>(i)</enum><text>a measure making appropriations for the fiscal year during which the covered period begins;</text></clause><clause commented="no" id="id71DDE489F6D240F1BF9E9E48E7AE615E"><enum>(ii)</enum><text>any motion required to determine the presence of or produce a quorum; or</text></clause><clause commented="no" id="idC49021F45A43494E88928316BAF4B67F"><enum>(iii)</enum><text>on and after the 30th calendar day after the first day of a covered period—</text><subclause id="id28b1dd953bda42b5a49e96e39daf3b23"><enum>(I)</enum><text>the nomination of an individual—</text><item id="id827c95b81e644b5586fd670fb76fee9c"><enum>(aa)</enum><text>to a position at level I of the Executive Schedule under section 5312 of title 5 of the United States Code; or</text></item><item commented="no" id="id0425633FC79B427DAA598B53CACFB355"><enum>(bb)</enum><text>to serve as Chief Justice of the United States or an Associate Justice of the Supreme Court of the United States; or</text></item></subclause><subclause commented="no" id="idE0E568D2E50B4B64BE907BAAF492F60C"><enum>(II)</enum><text>a measure extending the period during which a program, project, or activity is authorized to be carried out (without substantive change to the program, project, or activity or any other program, project, or activity) if—</text><item commented="no" id="id3445968FC392465BBE230D382A8087D1"><enum>(aa)</enum><text>an appropriation Act with respect to the program, project, or activity for the fiscal year during which the covered period occurs has not been enacted; and</text></item><item commented="no" id="id4D4049A9FB4246C88CADC9BFF19905A3"><enum>(bb)</enum><text>the program, project, or activity has expired since the beginning of such fiscal year or will expire during the 30-day period beginning on the date of the motion;</text></item></subclause></clause></subparagraph><subparagraph id="id39575BD927F2485F98C912B33C145E1B"><enum>(B)</enum><text>it shall not be in order to move to recess or adjourn for a period of more than 23 hours; and</text></subparagraph><subparagraph id="idF82DDC300C5C4A35B87C9132D81531DF"><enum>(C)</enum><text>at noon each day, or immediately following any constructive convening of the Senate under rule IV, paragraph 2 of the Standing Rules of the Senate, the Presiding Officer shall direct the clerk to determine whether a quorum is present.</text></subparagraph></paragraph><paragraph id="idA91B380C2A164251A2DDEC28F168B54F"><enum>(2)</enum><header>Waiver</header><subparagraph id="id172BB68D14F9411CB1FBC6E2E18C435D"><enum>(A)</enum><header>Limitation on period</header><text>It shall not be in order in the Senate or the House of Representatives to move to waive any provision of paragraph (1) for a period that is longer than 7 days.</text></subparagraph><subparagraph id="idEDADAEB8FBF446A0A58FC6EF2A142EA5"><enum>(B)</enum><header>Supermajority vote</header><text>A provision of paragraph (1) may only be waived or suspended upon an affirmative vote of two-thirds of the Members of the applicable House of Congress, duly chosen and sworn.</text></subparagraph></paragraph></subsection><subsection id="idcb614b5938e848e4800e6d9b87ddc220"><enum>(d)</enum><header>Motion To proceed to appropriations</header><paragraph id="idD946C8C9CF2A4951B0FC8E1D0232CCA7"><enum>(1)</enum><header>In general</header><text>On and after the 30th calendar day after the first day of each fiscal year, if an appropriation Act for such fiscal year with respect to a program, project, or activity has not been enacted, it shall be in order in the Senate, notwithstanding rule XXII or any pending executive measure or matter, to move to proceed to any appropriations bill or joint resolution for the program, project, or activity that has been sponsored and cosponsored by not less than 3 Senators who are members of or caucus with the party in the majority in the Senate and not less than 3 Senators who are members of or caucus with the party in the minority in the Senate.</text></paragraph><paragraph id="idA3DBF790286D405D9C38BBFCB659491A"><enum>(2)</enum><header>Consideration</header><text>For a bill or joint resolution described in paragraph (1)—</text><subparagraph id="id4BB10879C6AF45A4A5BBB159C31DD223"><enum>(A)</enum><text>the bill or joint resolution may be considered the same day as it is introduced and shall not have to lie over 1 day; and</text></subparagraph><subparagraph id="id728C0701932B4889852D824A7E136B19"><enum>(B)</enum><text>the motion to proceed to the bill or joint resolution shall be debatable for not to exceed 6 hours, equally divided between the proponents and opponents of the motion, and upon the use or yielding back of time, the Senate shall vote on the motion to proceed.</text></subparagraph></paragraph></subsection></section><section id="id29048c1464014529a28a78d3a638d083"><enum>4.</enum><header>Budgetary effects</header><subsection id="id17c2ab7d09494285af3fb5a809be849a"><enum>(a)</enum><header>Classification of budgetary effects</header><text>The budgetary effects of this Act and the amendments made by this Act shall be estimated as if this Act and the amendments made by this Act are discretionary appropriations Acts for purposes of section 251 of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>).</text></subsection><subsection id="id43e00546cf8f47d1b564eb90468554ec"><enum>(b)</enum><header>Baseline</header><text>For purposes of calculating the baseline under section 257 of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/907">2 U.S.C. 907</external-xref>), the provision of budgetary resources under section 1311 of title 31, United States Code, as added by this Act, for an account shall be considered to be a continuing appropriation in effect for such account for less than the entire current year.</text></subsection><subsection id="id7adf506d5bde4322a5605de4a4f1344a"><enum>(c)</enum><header>Enforcement of discretionary spending limits</header><text>For purposes of enforcing the discretionary spending limits under section 251(a) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(a)</external-xref>), the budgetary resources made available under section 1311 of title 31, United States Code, as added by this Act, shall be considered part-year appropriations for purposes of section 251(a)(4) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(a)(4)</external-xref>).</text></subsection></section><section id="idAA33C64F3BDA4969A398A445CA31C90A"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on September 30, 2021.</text></section></legis-body></bill>
