which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that an authorization to use military force, a declaration of war, or any similar authority shall not authorize the detention without charge or trial of a citizen or lawful permanent resident of the United States, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Due Process Guarantee Act</short-title></quote>.</text></section><section id="idBF5589F725AD4001BE1DD3C676104B98"><enum>2.</enum><header>Prohibition on the indefinite detention of citizens and lawful permanent residents</header><subsection id="idE68332A7FEC74DBC8AA070C3D5F017EF"><enum>(a)</enum><header>Limitation on detention</header><paragraph id="id74B87FA01CE447B2830F5D26F3966A8B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4001(a) of title 18, United States Code, is amended—</text><subparagraph id="idC1BA7F111ADB4FC09B773B440B02E981"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>No citizen</quote> and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id92CADEBBB47745DA8AF1A0BC8F723D14"><paragraph id="idBE10B5C608FA4F278BAEF02E9449BBC5" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">No citizen or lawful permanent resident of the United States</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id12A967F9E3F04605ACC8920A663A0E79"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD732B755A02048CB80F9F5A187A18D1F"><paragraph id="id623658E43F7D473291B5B33BFEAFFED4" indent="up1"><enum>(2)</enum><text>Any Act of Congress that authorizes an imprisonment or detention described in paragraph (1) shall be consistent with the Constitution and expressly authorize such imprisonment or detention.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idAC453F85C7674C9BA09AA7E5782B85A2"><enum>(2)</enum><header>Applicability</header><text>Nothing in section 4001(a)(2) of title 18, United States Code, as added by paragraph (1)(B), may be construed to limit, narrow, abolish, or revoke any detention authority conferred by statute, declaration of war, authorization to use military force, or similar authority effective prior to the date of the enactment of this Act.</text></paragraph></subsection><subsection id="id3DEFE1281D9F44098A6DBBB805770F03"><enum>(b)</enum><header>Relationship to an authorization To use military force, declaration of war, or similar authority</header><text>Section 4001 of title 18, United States Code, as amended by subsection (a) is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id088E268E2C36471FBDCC3759E5E4B84D"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFE53F35798A2498FB130ED381A904285"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5FFC5C5B26544D97978FDE60D4C29236"><subsection commented="no" display-inline="no-display-inline" id="idB6B4F8F9C277413F8CD993A73222116B"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idFC057EC51BCF4DFDB25B3F85EFFFF6B6"><enum>(1)</enum><text display-inline="yes-display-inline">No United States citizen or lawful permanent resident who is apprehended in the United States may be imprisoned or otherwise detained without charge or trial unless such imprisonment or detention is expressly authorized by an Act of Congress.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C9F76900F8040B99A309A8ED6FAB8E5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A general authorization to use military force, a declaration of war, or any similar authority, on its own, may not be construed to authorize the imprisonment or detention without charge or trial of a citizen or lawful permanent resident of the United States apprehended in the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1910D2F6D51A44F3A837767ACD3C6FAA" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (2) shall apply to an authorization to use military force, a declaration of war, or any similar authority enacted before, on, or after the date of the enactment of the <short-title>Due Process Guarantee Act</short-title>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7CD5E6619DFA4D1AB4114D0E588F6BEB" indent="up1"><enum>(4)</enum><text>This section may not be construed to authorize the imprisonment or detention of a citizen of the United States, a lawful permanent resident of the United States, or any other person who is apprehended in the United States.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
