<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2713</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210913">September 13, 2021</action-date><action-desc><sponsor name-id="S309">Mr. Casey</sponsor> (for himself, <cosponsor name-id="S307">Mr. Brown</cosponsor>, and <cosponsor name-id="S366">Ms. Warren</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 to require that any trade agreement subject to expedited procedures under that Act contain certain requirements relating to the origination of goods in nonmarket economy countries.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Market Economy Sourcing Act</short-title></quote>.</text></section><section id="id224360517049470FB313256FD4BFB7E9"><enum>2.</enum><header>Limitation on trade authorities procedures relating to requirements on content of goods from nonmarket economy countries</header><text display-inline="no-display-inline">Section 106(b) of the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4205">19 U.S.C. 4205(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5BB4423EFF41417085905EFE4F047F6D"><paragraph id="id5F01E6DC57484CC7A4FED3FC99A7CEBF"><enum>(7)</enum><header>Limitations on procedures relating to origination of content of goods from nonmarket economy countries</header><subparagraph id="idB620768807E44B28A6F5F24804FD92E7"><enum>(A)</enum><header>In general</header><text>The trade authorities procedures shall not apply to an implementing bill submitted with respect to a trade agreement or trade agreements entered into under section 103(b) unless the rules of origin requirements under such agreement or agreements—</text><clause id="id3B08E59C045F42128C475895BBF42284"><enum>(i)</enum><text>with respect to rules of origin based on value content of a good, require that, of the content of a good qualifying for preferential treatment under the agreement or agreements that does not originate (as specified in those rules) in a country that is party to the agreement or agreements—</text><subclause id="idD01776DB2F39475A95B81391424CA9D9"><enum>(I)</enum><text>during the 5-year period following the entry into force of the agreement or agreements, not more than 20 percent of that content may originate in a nonmarket economy country; and</text></subclause><subclause id="idDF252463838F44ECB50A62D994310BF1"><enum>(II)</enum><text>after the period specified in subclause (I), not more than 10 percent of that content may originate in a nonmarket economy country; and</text></subclause></clause><clause id="idb55460f14b3c4935a677a72f40739bc1"><enum>(ii)</enum><text>with respect to rules of origin that are not based on value content of a good, are consistent with the requirements under clause (i) based on processing requirements or tariff shifts as opposed to value content.</text></clause></subparagraph><subparagraph id="id9DBD041785944D15A013B84BA07834D2"><enum>(B)</enum><header>Nonmarket economy country defined</header><text>In this paragraph, the term <term>nonmarket economy country</term> has the meaning given that term in section 771(18) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677(18)</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
