Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 and the Elementary and Secondary Education Act of 1965 to provide rules of construction that nothing in those Acts requires the use, teaching, promotion, or recommendation of any academic discipline, program, or activity that holds that the United States is a Nation founded on white supremacy and oppression, or that these forces are at the root of American society.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Local Curriculum Act</short-title></quote>.</text></section><section id="idC9689F1277D4490DBCEF0A0B4789AF46"><enum>2.</enum><header>Rules of construction on requirements of teaching</header><subsection id="idDF705C74A6DB432BBFC49F6354A3C8E2"><enum>(a)</enum><header>Higher education</header><text display-inline="yes-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id758FDE47DAC046779CC4CFCF8945C9C8"><section id="idECC5F2F35D444C6F81C67686AFE6AE11"><enum>124.</enum><header>Rule of construction on requirements of teaching</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to require the use, teaching, promotion, or recommendation of any academic discipline, program, or activity that holds the following: </text><paragraph id="idd5c59265477b41d59316198db95bc734"><enum>(1)</enum><text>The United States is a Nation founded on white supremacy and oppression, or that these forces are at the root of American society.</text></paragraph><paragraph id="idb6a65ee98cb8479ea119a60d4324d403"><enum>(2)</enum><text>One race or sex is inherently superior to another race or sex.</text></paragraph><paragraph id="id40b1d38ee58f400c803756eeffca6bc6"><enum>(3)</enum><text>The United States is fundamentally racist or sexist.</text></paragraph><paragraph id="idf77f41c64b8d4a67a04ebb390b2da737"><enum>(4)</enum><text>An individual, by virtue of his or her race or sex, is inherently racist, sexist, or oppressive, whether consciously or unconsciously.</text></paragraph><paragraph id="idbe014f38de394792be3000a3472a1240"><enum>(5)</enum><text>An individual should be discriminated against or receive adverse treatment solely or partly because of his or her race or sex.</text></paragraph><paragraph id="ided3a1aea088748d083646ccb5eb94357"><enum>(6)</enum><text>Members of one race or sex cannot and should not attempt to treat others without respect to race or sex.</text></paragraph><paragraph id="ida0b56c99057840b5902afa69ee15579e"><enum>(7)</enum><text>An individual’s moral character is necessarily determined by his or her race or sex.</text></paragraph><paragraph id="id1738e4639bf7428aa75011c7b083e86a"><enum>(8)</enum><text>An individual, by virtue of his or her race or sex, bears responsibility for actions committed in the past by other members of the same race or sex.</text></paragraph><paragraph id="idd055d6ceeb014e57887d437f650d37b4"><enum>(9)</enum><text>Any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of his or her race or sex.</text></paragraph><paragraph id="idbd7eccf049c443bd9c76fc5353b7c3df"><enum>(10)</enum><text>Meritocracy or traits such as a hard work ethic are racist or sexist, or were created by a particular race to oppress another race.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0F41C0A33F864E50914591BDF82517ED"><enum>(b)</enum><header>Elementary and secondary education</header><text>Subpart 2 of part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id318C8BAE85AE4353BD138496A723BFA7"><section id="id39083BB4AB6A4F83BBE0201D63935B18"><enum>8549D.</enum><header>Rule of construction on requirements of teaching</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to require the use, teaching, promotion, or recommendation of any academic discipline, program, or activity that holds the following: </text><paragraph id="idd1d2f80dc54c4be789b052a50ba7a96a"><enum>(1)</enum><text>The United States is a Nation founded on white supremacy and oppression, or that these forces are at the root of American society.</text></paragraph><paragraph id="ida1da2e6edc524b31a7bffcdb088ad21a"><enum>(2)</enum><text>One race or sex is inherently superior to another race or sex.</text></paragraph><paragraph id="id427361394ecc4059b393bae60f2fd988"><enum>(3)</enum><text>The United States is fundamentally racist or sexist.</text></paragraph><paragraph id="id1ef9523f10ac404a8ddb6205e903f2cf"><enum>(4)</enum><text>An individual, by virtue of his or her race or sex, is inherently racist, sexist, or oppressive, whether consciously or unconsciously.</text></paragraph><paragraph id="ida01b96397ece4fbd9e553b247af16e21"><enum>(5)</enum><text>An individual should be discriminated against or receive adverse treatment solely or partly
