Board of Education National Historic Site in the State of Kansas, and for other purposes</quote> to provide for inclusion of additional related sites in the National Park System, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="id6aa787da6c98414d8338dd92578fe046" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brown v. Board of Education National Historical Park Expansion and Redesignation Act</short-title></quote>.</text></section><section id="id43c94d91f3194f7083a174f73fdf147f" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Redesignation of the Brown v. Board of Education National Historical Park</header><subsection id="id7faaf3f31d87445c95955a0c5e5e2548" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Brown v. Board of Education National Historic Site established by section 103(a) of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3439) shall be known and designated as the <quote>Brown v. Board of Education National Historical Park</quote>.</text></subsection><subsection id="idf97bbbceacdd4dc98315430b82be3504" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">References</header><text display-inline="yes-display-inline">Any reference in any law, regulation, document, record, map, or other paper of the United States to the Brown v. Board of Education National Historic Site shall be considered to be a reference to the <quote>Brown v. Board of Education National Historical Park</quote>.</text></subsection><subsection id="id756C4B2CDA98463393A1509F7F0323CC" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Title I of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3438) is amended—</text><paragraph id="idD456ABF9050843A0B2AD971E6C66381C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the title heading, by striking <quote><header-in-text style="OLC" level="title">historic site</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="title">historical park</header-in-text></quote>;</text></paragraph><paragraph id="idB291F695D385474FAB49806301B7E5E9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in sections 101(2) and 103(a), by striking <quote>National Historic Site</quote> each place it appears and inserting <quote>National Historical Park</quote>; </text></paragraph><paragraph id="id04F9D9DCA3284B8AA1FAC4E9EBEE7D4A" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in the section heading for each of sections 103 and 105, by striking <quote><header-in-text style="OLC" level="section">historic site</header-in-text></quote> each place it appears and inserting <quote><header-in-text style="OLC" level="section">historical park</header-in-text></quote>; and</text></paragraph><paragraph id="idD7E5A4965C68471190984BF23FE32067" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>historic site</quote> each place it appears and inserting <quote>historical park</quote>.</text></paragraph></subsection></section><section id="idb3d56b40b5b54b2084c1a5d5306b3c72" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Expansion of the Brown v. Board of Education National Historical Park and establishment of affiliated areas</header><subsection id="idE6086C538C21422392363864736CFDDB" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to honor the civil rights stories of struggle, perseverance, and activism in the pursuit of education equity.</text></subsection><subsection id="idE98CA2A10AD94E7094CF4CC2E4AEECC3" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 101 of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3438) (as amended by section 2(c)) is amended—</text><paragraph id="id1F918F6845104AC1A7F7C43CD457BCA5" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>As used in this title—</quote> and inserting <quote>In this title:</quote>; </text></paragraph><paragraph id="id94183A066D804F8A9552FE7B7A735E0F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>the term</quote> and inserting the <quote>The term</quote>;</text></paragraph><paragraph id="id3F3084520C4E47ADA80CDEF8AB31B665" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in each of paragraphs (1) and (2), by inserting a paragraph heading, the text of which is comprised of the term defined in that paragraph;</text></paragraph><paragraph id="idC45955EA363943CFB420F12D4217001E" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as paragraphs (3) and (2), respectively, and moving the paragraphs so as to appear in numerical order; and</text></paragraph><paragraph id="id58277787E91D47F3A5C8E952B2BCB565" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDC926EA137CD402C8669D0E1AFE5D495"><paragraph id="id83ed47fdc7284556be201abe08d9dd3d" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Affiliated area</header><text display-inline="yes-display-inline">The term <term>affiliated area</term> means a site associated with a court case included in Brown v. Board of Education of Topeka described in paragraph (8), (9), or (10) of section 102(a) that is designated as an affiliated area of the National Park System by section 106(a).</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id835aa647063640e592b13fd02046a3d6" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Section 102(a) of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3438) is amended—</text><paragraph id="id22952af6350c482ab5e57bc4e2f0217e" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3) and (4) as paragraphs (5) and (6), respectively;</text></paragraph><paragraph id="id8c0d6b7201ec4b51bd4b573caf25f361" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc1a6f1b9b0ac4bada22ab3f7e15f4f86"><paragraph id="id3f67f2a8faef4c1186a1cf82f86ee101" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The Brown case was joined by 4 other cases relating to school segregation pending before the Supreme Court (Briggs v. Elliott, filed in South Carolina, Davis v. County School Board of Prince Edward County, filed in Virginia, Gebhart v. Belton, filed in Delaware, and Bolling v. Sharpe, filed in the District of Columbia) that were consolidated into the case of Brown v. Board of Education of Topeka.</text></paragraph><paragraph id="id452e5cd1186949658956a4f2d661736c" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">A 1999 historic resources study examined the 5 cases included in Brown v. Board of Education of Topeka and found that each case—</text><subparagraph id="id1C32888123E2462581FCE79601AA4ADC" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">is nationally significant; and </text></subparagraph><subparagraph id="id8FBE6A396CC44C0FA01618220D88AB0B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">contributes unique stories to the case for educational equity.</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="id30c4ddd4bb1c47a0b1c3ad00940ae26b" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (6) (as so redesignated), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96635a9f23844b8196c5de1b9e566d28"><paragraph id="iddff67c4e943245e9a25df93c855d7adb" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">With respect to the case of Briggs v. Elliott—</text><subparagraph id="idAF06374B41C749CAB925102B49DCB814" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Summerton High School in Summerton, South Carolina, the all-White school that refused to admit the plaintiffs in the case—</text><clause id="idB70D99DA425A4EB59AC086BC52FED548" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">has been listed on the National Register of Historic Places in recognition of the national significance of the school; and</text></clause><clause id="id80822B5D066C4229A3C6B8C17F619B2E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">is used as administrative offices for Clarendon School District 1; and</text></clause></subparagraph><subparagraph id="id82698331AC874E8E85A7FF35DB416C47" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the former Scott’s Branch High School, an <quote>equalization school</quote> in Summerton, South Carolina constructed for African-American students in 1951 to provide facilities comparable to those of White students, is now the Community Resource Center owned by Clarendon School District 1.</text></subparagraph></paragraph><paragraph id="idcf0e90de94b64fb386519182d195e34b" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">Robert Russa Moton High School, the all-Black school in Farmville, Virginia, which was the location of a student-led strike leading to Davis v. County School Board of Prince Edward County—</text><subparagraph id="idCDD6450CE72D4CFD8FC6189FF4035A02" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">has been designated as a National Historic Landmark in recognition of the national significance of the school; and</text></subparagraph><subparagraph id="id7954AF1829F34968AEEDBA4EA8F79B65" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is now the Robert Russa Moton Museum, which is administered by the Moton Museum, Inc., and affiliated with Longwood University.</text></subparagraph></paragraph><paragraph id="idcb07d32716fc43028565865c34515f77" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">With respect to the case of Belton v. Gebhart—</text><subparagraph id="id599815703BCE4726AE3C0FCDC2666BFB" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Howard High School in Wilmington, Delaware, an all-Black school to which the plaintiffs in the case were forced to travel—</text><clause id="id5376C68BA22646BEB08F1F102EC71674" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">has been designated as a National Historic Landmark in recognition of the national significance of the school; and</text></clause><clause id="idC3945138FAFE4838A7FC0091716D77F9" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">is now the Howard High School of Technology, an active school administered by the New Castle County Vocational-Technical School District; </text></clause></subparagraph><subparagraph id="id4FF81120865347639C2E92E9898B540A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the all-White Claymont High School, which denied admission to the plaintiffs, is now the Claymont Community Center administered by the Brandywine Community Resource Council, Inc.; and </text></subparagraph><subparagraph id="idC514E1CBBBCF42D682A4DE998C305E10" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Hockessin School #107C (Hockessin Colored School)—</text><clause id="id93ABD91ACCD84477AC3B6999520C535A" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">is the all-Black school in Hockessin, Delaware, that 1 of the plaintiffs in the case was required to attend with no public transportation provided; and</text></clause><clause id="id9F0393B909DA4D3F86E010DFD306B8D3" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">is now used as a community facility by Friends of Hockessin Colored School #107, Inc.</text></clause></subparagraph></paragraph><paragraph id="id251d113e1e92495fb1a38d049ebef124" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">John Philip Sousa Junior High School in the District of Columbia, the all-White school that refused to admit plaintiffs in Bolling v. Sharpe—</text><subparagraph id="idBA3B3DD778E04A8181D82D7706B0EDCF" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">has been designated as a National Historic Landmark in recognition of the national significance of the school;</text></subparagraph><subparagraph id="id50DEDA8D9C8544DD8261EE3C9519565E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is now known as the <quote>John Philip Sousa Middle School</quote>; and </text></subparagraph><subparagraph id="idD1ACC0BBBAA74FF683A8DB26C6AE20DC" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">is owned by the District of Columbia Department of General Services and administered by the District of Columbia Public Schools.</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6ccaf28a3d7a446f928d83e03e389a81" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">Section 102(b)(3) of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3438) is amended— </text><paragraph id="id8111671ab67244ecbcb9067ba2a2f8aa" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>, protection,</quote> after <quote>preservation</quote>;</text></paragraph><paragraph id="id07a9c1d205464680865369649f6be875" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>the city of Topeka</quote> and inserting <quote>Topeka, Kansas, Summerton, South Carolina, Farmville, Virginia, Wilmington, Claymont, and Hockessin, Delaware, and the District of Columbia</quote>; and</text></paragraph><paragraph id="id1d061c23fba74052a053fd871c31dd7e" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting <quote>and the context of Brown v. Board of Education</quote> after <quote>civil rights movement</quote>.</text></paragraph></subsection><subsection id="idea8b7beebbc54c5bb336a46bc2888de5" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Boundary adjustment</header><text display-inline="yes-display-inline">Section 103 of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3439) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idC363150A14C5439BBADCEB2B84F1E3C2"><subsection id="id3bc9cf407dab4949b7de399ebe0c9811" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Boundary adjustment</header><paragraph id="id6bdec5c30fea45669d51bf7fe160ad5a" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Additions</header><text display-inline="yes-display-inline">In addition to the land described in subsection (b), the historical park shall include the land and interests in land, as generally depicted on the map entitled <quote>Brown v. Board of Education National Historical Park Boundary Additions and Affiliated Areas</quote>, numbered 462/178,449, and dated February 2022, and more particularly described as—</text><subparagraph id="id9a04f86936aa472eb406949643fa59eb" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Summerton High School site in Summerton, Clarendon County, South Carolina;</text></subparagraph><subparagraph id="id88806d9882a94c5a9995ed34f3d3e994" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the former Scott’s Branch High School site in Summerton, Clarendon County, South Carolina; and</text></subparagraph><subparagraph id="id9b4b5a7c50bc4bee900a35ead3109e06" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">approximately 1 acre of land adjacent to Monroe Elementary School in Topeka, Shawnee County, Kansas.</text></subparagraph></paragraph><paragraph id="id51eaf41cba854df3999687a9b47e840d" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Map</header><text display-inline="yes-display-inline">The map described in paragraph (1) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="idc6a6338059ed4429b3a09a1f9fa6f9b5" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Property acquisition</header><text display-inline="yes-display-inline">Section 104 of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3439) is amended— </text><paragraph id="id9690dc24e41f4fcd9ce9f4f7860c13d1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>section 103(b)</quote> and inserting <quote>subsections (b) and (c) of section 103</quote>;</text></paragraph><paragraph id="id9234361d3cc04efab92118dc3d2d6e96" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>States of Kansas</quote> and inserting <quote>State of Kansas or South Carolina</quote>; and</text></paragraph><paragraph id="iddb6bb005438a4c3fbdcf7777562c03a4" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in the proviso—</text><subparagraph id="idEBBE6EEF17A3493584419CD2945F26CE" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>: <italic>Provided, however</italic>, That the</quote> and inserting <quote>. The</quote>; and</text></subparagraph><subparagraph id="idd0a9636e555d43208f04a9d9840a1bb6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>or by condemnation of any land or interest in land within the boundaries of the historical park</quote> after <quote>without the consent of the owner</quote>. </text></subparagraph></paragraph></subsection><subsection id="id9c67f1b879404e4392617e9d2ad934ae" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">General management plan</header><text display-inline="yes-display-inline">Section 105 of <external-xref legal-doc="public-law" parsable-cite="pl/102/525">Public Law 102–525</external-xref> (106 Stat. 3439) is amended by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD49FE61C3BB843F4B0B817A1AF1FC640"><subsection id="ida4c1a1526df1446bbc258342a4f3064a" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Amendment to general management plan</header><text display-inline="yes-display-inline">The Secretary shall prepare and submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives an amendment to the management plan for the historical park to include the portions of the historical park in Summerton, Clarendon County, South Carolina.</text></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id73041d5af7b749a187391d4b67e32d8d" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Affiliated areas</header><text display-inline="yes-display-inline">Public Law 102–525 (106 Stat. 3438) is amended—</text><paragraph id="id6bb02a1822434bd79c68adbb6bf3c165" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 106 as section 107; and</text></paragraph><paragraph id="id7a05c80b012f4c5895a87ab10f57ac66" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 105 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida90da29120394ad29f89c3a345d1118c"><section id="id79db905d6bf64f76bdd70966eb30acb0" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Establishment of the Brown v. Board of Education affiliated areas</header><subsection id="id06f5225e1c734efa93912ad95439cf1a" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On the date on which the Secretary determines that an appropriate management entity has been identified for the applicable affiliated area, as generally depicted on the map described in section 103(c)(1), the following shall be established as affiliated areas of the National Park System:</text><paragraph id="id713e84ac70734d06ba675d14eecf05a9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Robert Russa Moton Museum in Farmville, Virginia.</text></paragraph><paragraph id="id539021da222141fe9f275292fcd243ce" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The Delaware Brown v. Board of Education Civil Rights Sites, to include—</text><subparagraph id="id5f26d98f92ab4ecbb6388b469ae62e00" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the former Howard High School in Wilmington, Delaware;</text></subparagraph><subparagraph id="ide6d0c8020e6c4ce8b2e021120c4efd13" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Claymont High School in Claymont, Delaware; and</text></subparagraph><subparagraph id="idf8ac11eefc9b45c2bd1d8cd127f74941" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Hockessin Colored School #107 in Hockessin, Delaware.</text></subparagraph></paragraph><paragraph id="iddf553c593caa46a799ad605e1da51a77" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The John Philip Sousa Middle School in the District of Columbia.</text></paragraph></subsection><subsection id="idf5c43d9f1ca243168ae07d5b1a048643" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Each affiliated area shall be managed in a manner consistent with—</text><paragraph id="id540734078ff44cc8bc8377a6b7b1c6ff" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">this title; and</text></paragraph><paragraph id="idd76543eca2ba47dda754b3ee02368fbb" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the laws generally applicable to units of the National Park System.</text></paragraph></subsection><subsection id="id92968edc910b49579267a3aa9543a887" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Management plans</header><paragraph id="id89b387731fbe47959c01d902237910f0" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the management entity for the applicable affiliated area, shall develop a management plan for each affiliated area.</text></paragraph><paragraph id="idAB0D6809606F45689BFC6E21CAA1E06B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A management plan under paragraph (1) shall—</text><subparagraph id="id9129cce1bbdf4e7cb859b81b2c87c68f" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">be prepared in consultation and coordination with interested State, county, and local governments, management entities, organizations, and interested members of the public associated with the affiliated area;</text></subparagraph><subparagraph id="id94e2da68f4c949d4847bc091546917b8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">identify, as appropriate, the roles and responsibilities of the National Park Service and the management entity in administering and interpreting the affiliated area in a manner that does not interfere with existing operations and continued use of existing facilities; and</text></subparagraph><subparagraph id="id56fd5ec4c2714ba3af621b0132c6466b" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">require the Secretary to coordinate the preparation and implementation of the management plan and interpretation of the affiliated area with the historical park.</text></subparagraph></paragraph><paragraph id="iddaa991a58683459b9aa2e22f78265970" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Public comment</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="id0b70ac448af241af852e307b9bc54f31" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">hold not less than 1 public meeting in the general proximity of each affiliated area on the proposed management plan, which shall include opportunities for public comment; and</text></subparagraph><subparagraph id="idbd07fffcc20741918af898b63cd40b37" commented="no" display-inline="no-display-inline"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idD2AAEE5DFBB449C09CCA3D569B111510"><enum>(i)</enum><text display-inline="yes-display-inline">publish the draft management plan on the internet; and </text></clause><clause id="id4149A2FA06874DBE83C1EBBE11C6F074" indent="up1" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">provide an opportunity for public comment on the draft management plan.</text></clause></subparagraph></paragraph><paragraph id="id2574b64f2ea54e62a2b18d6034b69b02" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Submission</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives the management plan for each affiliated area developed under paragraph (1).</text></paragraph></subsection><subsection id="idf7597039ab6a4f9fae128d37d3d062b3" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Cooperative agreements</header><text display-inline="yes-display-inline">The Secretary may provide technical and financial assistance to, and enter into cooperative agreements with, the management entity for each affiliated area to provide financial assistance for the marketing, marking, interpretation, and preservation of the applicable affiliated area.</text></subsection><subsection id="idda3cff788e664c46a29bfe4d8763caeb" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Land use</header><text display-inline="yes-display-inline">Nothing in this section affects—</text><paragraph id="id056289D5CE6342AF8810C303E11F5283" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">land use rights of private property owners within or adjacent to an affiliated area, including activities or uses on private land that can be seen or heard within an affiliated area; or</text></paragraph><paragraph id="id58ECC6C7AB0E496DB71C1B1678320F84" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the authority of management entities to operate and administer the affiliated areas.</text></paragraph></subsection><subsection id="id83efd7f444d24ce6944573a9d103f272" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Limited role of the secretary</header><paragraph id="idD903315B6392406987BDFAEEB140D338" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this section authorizes the Secretary—</text><subparagraph id="id785AF137735A43A8909D655204E2DB63" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to acquire land in an affiliated area; or </text></subparagraph><subparagraph id="idF04B9A4817F343D0A44D4A859C878C13" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to assume financial responsibility for the operation, maintenance, or management of an affiliated area.</text></subparagraph></paragraph><paragraph id="id0416decb38cf4ed8a3303fc0fad2b82f" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Ownership</header><text display-inline="yes-display-inline">Each affiliated area shall continue to be owned, operated, and managed by the applicable public or private owner of the land in the affiliated area.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220406" chamber="Senate">Passed the Senate April 6, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
