which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 12, 2022</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for greater consultation between the Federal Government and the governing bodies and community users of land grant-mercedes in New Mexico, to provide for a process for recognition of the historic-traditional uses of land grant-mercedes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H795524ADDBCC4B289BFB3366396636AC"><section section-type="section-one" id="HED6CFCA1483344C38A9777EAD943AE47"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Land Grant-Mercedes Traditional Use Recognition and Consultation Act</short-title></quote>.</text></section><section id="HA18E036E01834255B3F9DFB305A88682"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF2BD0D70EE284D22B58D9BFC4EE8D8A0"><enum>(1)</enum><header>Community user</header><text>The term <term>community user</term> means an heir (as defined under the laws of the State) of a qualified land grant-merced.</text></paragraph><paragraph id="H7BDF29BEAB8B4532A5F91F61837A14D4"><enum>(2)</enum><header>Governing body</header><text>The term <term>governing body</term> means the board of trustees authorized under State law with the control, care, and management of a qualified land grant-merced.</text></paragraph><paragraph id="H16E0D29977174DC586D0867B1BF603BD"><enum>(3)</enum><header>Historical-traditional use</header><text>The term <term>historical-traditional use</term> means, for a qualified land grant-merced, for noncommercial benefit—</text><subparagraph id="HEFB9234B73A24605A380EE0C0EE26CC6"><enum>(A)</enum><text>the use of water;</text></subparagraph><subparagraph id="H65FE319C35594106B4C061792D13499A"><enum>(B)</enum><text>religious or cultural use and protection;</text></subparagraph><subparagraph id="HADCF5F52A6E646F2886340D917DF9249"><enum>(C)</enum><text>gathering herbs;</text></subparagraph><subparagraph id="H70A721E5079648AB80CC6EE0492341B9"><enum>(D)</enum><text>gathering wood products;</text></subparagraph><subparagraph id="HE5F89FDDD0D54857B6307015AF5CED43"><enum>(E)</enum><text>gathering flora or botanical products;</text></subparagraph><subparagraph id="H94FF2C392F42498B8073E45CBE904508"><enum>(F)</enum><text>grazing, to the extent that grazing has traditionally been carried out on the land, as determined by the Secretary concerned in consultation with the governing body of the affected land grant-merced;</text></subparagraph><subparagraph id="H16031F18553940B493A0BAC8CE0C1836"><enum>(G)</enum><text>hunting or fishing;</text></subparagraph><subparagraph id="HD12BDA0CB13E4161B49C329F7B529C55"><enum>(H)</enum><text>soil or rock gathering; and</text></subparagraph><subparagraph id="HBD5E72D550744840A76A700C50F785F0"><enum>(I)</enum><text>any other traditional activity for noncommercial benefit that—</text><clause id="HE1C81509034C42E68083FAD2BE635B21"><enum>(i)</enum><text>has a sustainable beneficial community use, as determined by the Secretary concerned in consultation with the governing body of the affected land grant-merced;</text></clause><clause id="H699059B328594A36B050E212F1EF0140"><enum>(ii)</enum><text>supports the long-term cultural and socioeconomic integrity of the community, as determined by the Secretary concerned in consultation with the governing body of the affected land grant-merced; and</text></clause><clause id="HB1AAFE78B4D842DDA4E8D44F1F15E492"><enum>(iii)</enum><text>is agreed to in writing by the Secretary concerned and the governing body of the qualified land grant-merced.</text></clause></subparagraph></paragraph><paragraph id="H3C2472E9546D4519983E4DFF9F198ECE"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H3183E7C327804D79A3964D2BEF413BBC"><enum>(5)</enum><header>Qualified land grant-merced</header><text>The term <term>qualified land grant-merced</term> means a community land grant issued under the laws or customs of the Government of Spain or Mexico that—</text><subparagraph id="H8072A79FAE1540E7BF4A740B6847C6EA"><enum>(A)</enum><text>is recognized under New Mexico Statutes Chapter 49 (or a successor statute); and</text></subparagraph><subparagraph id="HC40C327BB931464CB35DCF69578C335D"><enum>(B)</enum><text>has a historic or cultural record of use of lands under the jurisdiction of a Secretary concerned or their original or patented exterior boundaries are located adjacent to land under the jurisdiction of a Secretary concerned.</text></subparagraph></paragraph><paragraph id="H2BF52C94AEBB443997383F7D782BE171"><enum>(6)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means the relevant Secretary of the Department of Agriculture or the Department of the Interior, with respect to land under the jurisdiction of that Secretary.</text></paragraph><paragraph id="HE31A96D1F9D94DB89ED35CC707996489"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico.</text></paragraph></section><section id="H54F89E0C869B4FA28F235E1C37252371"><enum>3.</enum><header>Guidance on permit requirements for qualified land grant-mercedes</header><subsection id="HB538E41CBC0E435DABCADB3E80364EAD"><enum>(a)</enum><header>In general</header><text>In accordance with all relevant laws, including subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>) and all applicable environmental laws, and not later than 2 years after the date of the enactment of this Act, the Secretary concerned, acting through the appropriate officials of the Department of Agriculture and Department of the Interior in the State, in consultation with the New Mexico Land Grant Council, the governing bodies of qualified land grant-mercedes, and Indian Tribes, shall issue the written guidance described in subsection (b).</text></subsection><subsection id="H13CDDAD6A89A4E1EAF25A14F55A955D5"><enum>(b)</enum><header>Contents of guidance</header><paragraph id="H0CECCF6BAD85413FA8A70AE7F6FBE383"><enum>(1)</enum><header>In general</header><text>Written guidance issued under subsection (a) shall include—</text><subparagraph id="HD9A25F11EFD7474288CCE05D71808FCF"><enum>(A)</enum><text>a description of the historical-traditional uses that—</text><clause id="H52944694C95841BF9E5DF3DC0E40D940"><enum>(i)</enum><text>a community user or a governing body of a qualified land grant-merced may conduct for noncommercial use on land under the jurisdiction of the Secretary concerned; and</text></clause><clause id="H7C80E56A1FA74F2F85592980F6E0DB19"><enum>(ii)</enum><text>require a permit from the Secretary concerned;</text></clause></subparagraph><subparagraph id="H1C2FA3B782E44F83804BB78D5888DCC5"><enum>(B)</enum><text>administrative procedures for obtaining a permit under subparagraph (A);</text></subparagraph><subparagraph id="H4810F8B9C7D849E98BEC9F11FF8D098C"><enum>(C)</enum><text>subject to subsection (c), the fees required to obtain that permit; </text></subparagraph><subparagraph id="H3204A06DFE514D0FB7E69FE3868944E7"><enum>(D)</enum><text>the permissible use of motorized and nonmotorized vehicles and equipment by a community user or the governing body of a qualified land grant-merced for noncommercial historical-traditional use on land under the jurisdiction of the Secretary concerned;</text></subparagraph><subparagraph id="H0279C0C3CE7A422BA47DF3D912FE024C"><enum>(E)</enum><text>the permissible use of mechanized vehicles or equipment by a community user or governing body of a qualified land grant-merced for historical-traditional use on land under the jurisdiction of the Secretary concerned; and</text></subparagraph><subparagraph id="H5E5F8424209347AA89CBDC2E1784AAA2"><enum>(F)</enum><text>the permissible use of non-native material by a community user or the governing body of a qualified land grant-merced for any of the uses covered in paragraphs (2) and (3) on land under the jurisdiction of the Secretary concerned.</text></subparagraph></paragraph><paragraph id="H05614237550A4269804EA91F682405C2"><enum>(2)</enum><header>Routine maintenance and minor improvements</header><text>Written guidance issued under subsection (a) shall address routine maintenance and minor improvements of infrastructure owned or used by a qualified land grant-merced on land under the jurisdiction of the Secretary concerned, including—</text><subparagraph id="HB686D21B10844D988C4A8DAF1475FBCB"><enum>(A)</enum><text>cleaning, repair, or replacement-in-kind of infrastructure;</text></subparagraph><subparagraph id="HC1C11422AD074C27BB5038C5F1765982"><enum>(B)</enum><text>maintenance and upkeep of a trail, road, cattle guard, culvert, or fence;</text></subparagraph><subparagraph id="H4F7601BAF34F4B8E871B5AF3A0C45C04"><enum>(C)</enum><text>maintenance and upkeep of a monument or shrine;</text></subparagraph><subparagraph id="HE611C2BC5A12492AB640F6CD6F57CC76"><enum>(D)</enum><text>maintenance and upkeep of a community cemetery;</text></subparagraph><subparagraph id="HCA780CAFD81A405495F93C11A8D6DEF2"><enum>(E)</enum><text>maintenance and upkeep of a livestock well, water lines, water storage container, or water tank; and</text></subparagraph><subparagraph id="HADBD207426E748788396A2D19734C40D"><enum>(F)</enum><text>any other routine maintenance or minor improvement associated with historical-traditional uses identified by any of the entities described in subsection (a) in the process of developing the guidance.</text></subparagraph></paragraph><paragraph id="H8B46C4F61C5F4B919D4039D8A77BFC14"><enum>(3)</enum><header>Major improvements</header><text>Written guidance issued under subsection (a) may describe the process for managing major improvements of infrastructure owned or used by a qualified land grant-merced on land under the jurisdiction of the Secretary concerned, including—</text><subparagraph id="HCB2E8D37CE114829A618F4D3B04CA5DA"><enum>(A)</enum><text>construction or expansion of a community water or wastewater system;</text></subparagraph><subparagraph id="HA906568B070C400B8CB6808724F65733"><enum>(B)</enum><text>construction or major repair of a livestock well, water lines, water storage container, or water tank;</text></subparagraph><subparagraph id="H788E39C71FCD414CAAC06492EF1AB005"><enum>(C)</enum><text>construction or major repair of a monument or shrine;</text></subparagraph><subparagraph id="H28B53F79B5B846F9850DCFE815077720"><enum>(D)</enum><text>installation of a cattle guard;</text></subparagraph><subparagraph id="H234F444BA8204EDF95138956C8ABC7B9"><enum>(E)</enum><text>construction of a trail, road, or fence;</text></subparagraph><subparagraph id="HAEAE1FC5444341EA8D10A60ED7B7153E"><enum>(F)</enum><text>construction or expansion of a cemetery; and</text></subparagraph><subparagraph id="HCA87417F34114A7D93FBA63FC5FA68A4"><enum>(G)</enum><text>any other major improvement associated with historical-traditional uses, as determined by the Secretaries concerned.</text></subparagraph></paragraph><paragraph id="HDF5D4225EB37460AB8775CA3D49DC869"><enum>(4)</enum><header>Notice and comment</header><text>Written guidance issued under subsection (a) shall set forth the policies and procedures for notice and comment on planning decisions, routine engagement, and major Federal actions that could impact historical-traditional uses of a qualified land grant merced, and methods of providing notice under subsection (a), including—</text><subparagraph id="HAA1E0BD9734B42F589B7BA46E882AC9F"><enum>(A)</enum><text>online public notice;</text></subparagraph><subparagraph id="HD610FC397C764F069FD487DC9E0D5B8E"><enum>(B)</enum><text>printed public notice;</text></subparagraph><subparagraph id="HCBCBCD1730B84D21AF2B40B2F16A5B30"><enum>(C)</enum><text>mail, including certified mail, and email notifications to governing bodies through a listserv; and</text></subparagraph><subparagraph id="H4DB13BA6958C452E9A41CDB67B1A963E"><enum>(D)</enum><text>mail, including certified mail, and email notifications to the Land Grant Council.</text></subparagraph></paragraph></subsection><subsection id="H0675160799B44B4690E9EDA367A1A816"><enum>(c)</enum><header>Fees for qualified land grant-Mercedes</header><text>Where the Secretary concerned is authorized to consider the fiscal capacity of the applicant in determining whether to reduce or waive a fee for a permit for historical-traditional uses, the Secretary shall consider—</text><paragraph id="HFB06DF20A9174F038E7F4D6894D37C07"><enum>(1)</enum><text>the socioeconomic conditions of community users; and</text></paragraph><paragraph id="H09FA043F044A4F3AA2FA060DE2EE8247"><enum>(2)</enum><text>the annual operating budgets of governing bodies of qualified land grant-mercedes.</text></paragraph></subsection></section><section id="H36C9D5F899EB4FCDBA9A0ED165C9972E"><enum>4.</enum><header>Consideration of historical-traditional use in land management planning</header><text display-inline="no-display-inline">In developing, maintaining, and revising land management plans pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>) and section 6 of the National Forest Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>), as applicable, the Secretary concerned shall, in accordance with applicable law, consider and, as appropriate, provide for and evaluate impacts to historical-traditional uses by qualified land grants-mercedes.</text></section><section id="H3F7AACAB9AC1442FAF66A4260EFA7E71"><enum>5.</enum><header>Savings</header><text display-inline="no-display-inline">Nothing in this Act shall be construed—</text><paragraph id="HA89EE306339641F18B2D0BCEAE1EA6FB"><enum>(1)</enum><text>to impact the State’s authority to regulate water rights, in conformance with all State and Federal laws and regulations;</text></paragraph><paragraph id="H9E58B0D5196C413AB1BA8CF80794E49D"><enum>(2)</enum><text>to impact the State’s authority to regulate the management of game and fish, in conformance with all State and Federal laws and regulations;</text></paragraph><paragraph id="H293368A4C965438F8EFB422EF0F64928"><enum>(3)</enum><text>to impact any valid existing rights or valid permitted uses, including grazing permits;</text></paragraph><paragraph id="HF6D834F24DD341E7A933AD2ADC8CB0A8"><enum>(4)</enum><text>to create any implicit or explicit right to grazing on Federal lands; or</text></paragraph><paragraph id="HC7AB4A43AF8948048A5B13321027746E"><enum>(5)</enum><text>to alter or diminish any rights reserved for an Indian Tribe or members of an Indian Tribe by treaty or Federal law.</text></paragraph></section></legis-body><endorsement><action-date>December 12, 2022</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
