which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 to require insurance agents who sell flood insurance policies under the National Flood Insurance Program to take certain continuing education courses, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flood Insurance Continuing Education and Training Act</short-title></quote>.</text></section><section id="id3EF6409691874FBB83F8F926BD0B2D78"><enum>2.</enum><header>Continuing education for insurance agents</header><subsection id="id706A9CE426F44F3FA60F0DF4E4CE3F21"><enum>(a)</enum><header>In general</header><text>The Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/264">Public Law 108–264</external-xref>; 118 Stat. 712) is amended—</text><paragraph id="idADCF8D4F57DE46A1BD3D1B0718EDA1AD"><enum>(1)</enum><text>in section 201 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> note)—</text><subparagraph id="id796712CB49404607846C23A080E36505"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Director of the</quote> and inserting <quote>Administrator of the</quote>; and</text></subparagraph><subparagraph id="idC883AB2DFC744F8EA6AE0EC678303BBF"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>4001</quote> after <quote>U.S.C.</quote>; and</text></subparagraph></paragraph><paragraph id="idDD3FE04BEA3846CE9B9105C3F47AA51C"><enum>(2)</enum><text>by striking section 207 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> note) and inserting the following:</text><quoted-block style="OLC" act-name="" id="id91ABCE21C39745DEB8BDBCB080C325FA"><section id="idE6FC92D5609F4196A0584AE77EFDB0F7"><enum>207.</enum><header>Continuing education requirements for insurance agents</header><subsection id="id9789738A146D41A1A441114E452343F2"><enum>(a)</enum><header>In general</header><text>The Director shall require each insurance agent who sells flood insurance policies to, once every 2 years, complete a 3-hour continuing education course that—</text><paragraph id="id2CE1D4B6D27F4C168CD4E39093BE09F0"><enum>(1)</enum><text>subject to subsection (c), is approved by the insurance commissioner of the State in which the agent is a legal resident; and</text></paragraph><paragraph id="id4BBC91D0A5C749BBACD6AC5120077435"><enum>(2)</enum><text>focuses on issues with respect to the Program.</text></paragraph></subsection><subsection id="id4FFA0FADF47F477BA7A6F367EF932ACD"><enum>(b)</enum><header>Failure To complete course</header><text>If an insurance agent who sells flood insurance policies does not complete a continuing education course required under subsection (a), the agent, until the date on which the agent completes the course in accordance with the requirements of this section, may not—</text><paragraph id="idAEDC707CF531439EB868E1F77674D1D8"><enum>(1)</enum><text>sell flood insurance policies; or</text></paragraph><paragraph id="idC33200348E9943FFA76F1B26063E5BF0"><enum>(2)</enum><text>perform any duties with respect to the Program.</text></paragraph></subsection><subsection id="idD5D753792B78499EB87B3CD4C0555B4F"><enum>(c)</enum><header>Agents licensed in multiple States</header><paragraph id="id520B8E00E37E4E0ABFBF3B721F6BD6B5"><enum>(1)</enum><header>In general</header><text>If an insurance agent who sells flood insurance policies is licensed to sell insurance in more than 1 State—</text><subparagraph id="id00D740425BE64313BF768FE6A0758AE0"><enum>(A)</enum><text>the agent shall submit proof of completion of a continuing education course required under subsection (a) to the insurance commissioner of each State in which the agent is licensed; and</text></subparagraph><subparagraph id="idD65BB01AE7414B6FBD472D387DCC5040"><enum>(B)</enum><text>each insurance commissioner to whom an insurance agent submits a proof of completion under subparagraph (A) may determine whether the course to which that proof of completion relates meets the minimum standards established by that insurance commissioner.</text></subparagraph></paragraph><paragraph id="id24EFA03A00604BF2B7A8667EEB744145"><enum>(2)</enum><header>Effect of denial</header><text>If an insurance commissioner of a State (referred to in this paragraph as the <quote>rejecting commissioner</quote>) determines under paragraph (1)(B) that a continuing education course taken in another State by an insurance agent who sells flood insurance policies does not meet the minimum standards established by the rejecting commissioner, the insurance agent may not take any action described in paragraph (1) or (2) of subsection (b) until the agent satisfies the minimum requirements established by the rejecting commissioner.</text></paragraph></subsection><subsection id="id439B17E8E77A4CD686E6910C9C915385"><enum>(d)</enum><header>Rule of construction</header><text>Any reference in this section to an insurance commissioner of a State shall be construed as a reference to an equivalent official with respect to any State in which there is no official who has the title of insurance commissioner.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id180F3F9D8DFD449EB3019B42F7B52988"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents for the Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/264">Public Law 108–264</external-xref>;
