which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Small Business Administration to license new lending institutions to make loans under section 7(a) of the Small Business Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access to Affordable Credit for Small Businesses Act</short-title></quote>.</text></section><section id="idCCC6C20027E54C309E6413DC3BBC6632"><enum>2.</enum><header>Licensing of small business lending companies</header><subsection id="id5E326126F96C4DCAB0B2F457ACF919B5"><enum>(a)</enum><header>In general</header><text>Section 7(a)(17) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(17)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3E0DE16F9665488F9E4595A0651EA7E9"><paragraph id="idD978D466592846538715F50D03A127B7"><enum>(17)</enum><header>Licensing of small business lending companies</header><subparagraph id="id8E6D0EC10B6F48A3AA740CA149C185A9"><enum>(A)</enum><header>In general</header><text>The Administration shall authorize lending institutions and other entities, including small business lending companies, non-Federally regulated lenders, and non-depository lending institutions, in addition to banks to make loans authorized under this subsection.</text></subparagraph><subparagraph id="idB7C376A6E6C247C6B67111287AAAB585"><enum>(B)</enum><header>Criteria</header><text>In authorizing lending institutions and other entities under subparagraph (A), the Administration shall ensure that each such institution or other entity—</text><clause id="id4CE828AE1EAF4BA289E61703AEFBD611"><enum>(i)</enum><text>provides an independent audit by a third party or internal independent audit department that examines adherence to all applicable Federal anti-money laundering, terrorist financing, sanctions, and financial crimes laws and regulations; and</text></clause><clause id="id523732F0038A4C409BF670B71EC937A9"><enum>(ii)</enum><text>has in place a compliance program that is designed to be in conformance with all relevant anti-money laundering laws and regulations expectations described in the Federal Financial Institutions Examination Council Bank Secrecy Act/Anti-Money Laundering Examination Manual and other regulatory guidance, including—</text><subclause id="idbd868fc5a7da494480f85bd5d84b1958"><enum>(I)</enum><text>an annual financial crimes risk assessment;</text></subclause><subclause id="idba8a327582c04770bd71948ef8ff0594"><enum>(II)</enum><text>designation of an anti-money laundering Officer;</text></subclause><subclause id="id57ba8d6a23b545ea80af8d6250a505e1"><enum>(III)</enum><text>a customer identification program;</text></subclause><subclause id="id8e487cd3feee46449c08635fb3085103"><enum>(IV)</enum><text>customer due diligence and enhanced due diligence;</text></subclause><subclause id="idca65b476481f4244bfb0bfb033b24acf"><enum>(V)</enum><text>suspicious activity monitoring and reporting;</text></subclause><subclause id="id2e72e62a28cd497fa367aa7aee3ae940"><enum>(VI)</enum><text>information sharing;</text></subclause><subclause id="id6a73916e3ed64045b8666615b55ad2fe"><enum>(VII)</enum><text>record retention;</text></subclause><subclause id="id5571e1ebfc5447d8bfbdef46acdf8466"><enum>(VIII)</enum><text>sanctions implemented by the Office of Foreign Assets Control;</text></subclause><subclause id="id32acdd42548a4428a6d2f9fb97ab2eb3"><enum>(IX)</enum><text>annual employee training, including general training and job-specific training; and</text></subclause><subclause id="id9de09232662149ee8ed24e56d508b47d"><enum>(X)</enum><text>monitoring and testing. </text></subclause></clause></subparagraph><subparagraph id="id96CBB8F3BD834431814C3B1E1D2E1046"><enum>(C)</enum><header>Prohibition on moratorium</header><text>The Administration may not impose a moratorium on the licensing of lending institutions described in subparagraph (A).</text></subparagraph><subparagraph id="id6A7424687B064AD092A8B3BD0C40E272"><enum>(D)</enum><header>New applicants</header><text>Not later than 1 year after the date of enactment of the <short-title>Expanding Access to Affordable Credit for Small Businesses Act</short-title>, the Administration shall begin accepting applications for the licensing of lending institutions described in subparagraph (A).</text></subparagraph><subparagraph id="idBA9071E7CA0B4024B8090496DEC99152"><enum>(E)</enum><header>Reports</header><text>Not later than 1 year after the date of enactment of the <short-title>Expanding Access to Affordable Credit for Small Businesses Act</short-title>, and annually thereafter, the Administration shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report that includes, with respect to the year preceding the report—</text><clause id="id49AD242A5CF5489ABF7AA69FCE7EABBE"><enum>(i)</enum><text>the number of lending institutions and other entities described in subparagraph (A) that applied to make loans under this subsection;</text></clause><clause id="id7B25BB4D31A94033843093D1D4F9AC00"><enum>(ii)</enum><text>the number of lending institutions and other entities described in subparagraph (A) that the Administration approved to make loans under this subsection;</text></clause><clause id="idA577360E0DBB4258832ED827B833D012"><enum>(iii)</enum><text>if the application of a lending institution or other entity described in subparagraph (A) was denied, the reason why for each such denial;</text></clause><clause id="idF039C70F592F496C80B68807345A80CD"><enum>(iv)</enum><text>the number and total amount of loans made by under this subsection by lending institutions and other entities described in subparagraph (A); and</text></clause><clause id="id0CC2EC9C7FFB46D3859220900508F03B"><enum>(v)</enum><text>demographic information on the recipients of the loans described in clause (iv). </text></clause></subparagraph><subparagraph id="idEF15D421684B4F51BD5963DFFDA7C4E3"><enum>(F)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to provide authority to the Administration to regulate small business lending companies, non-Federally regulated lenders, or non-depository lending institutions.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id87E0BA50EFF8486F923C1363532B9041"><enum>(b)</enum><header>Funding</header><text>There is authorized to be appropriated for the Office of Credit Risk Management of the Small Business Administration such sums as may be necessary to conduct oversight of lenders authorized under section 7(a)(17) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(17)</external-xref>).</text></subsection></section></legis-body></bill>
