which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect certain whistleblowers seeking to ensure accountability and oversight of the Nation’s COVID–19 pandemic response, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF33983B0281543238AA918544827B5F3"><section section-type="section-one" id="HBC270350F96144488E430024344B5C62"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Whistleblower Protection Act</short-title></quote>.</text></section><section id="H8BA52EBACA3848E48F1A11753DA4ABF4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="H7236BB2E16494AA6BA8CFF783E2BDA3C"><enum>(1)</enum><text>the term <term>abuse of authority</term> means an arbitrary and capricious exercise of authority by a contracting officer or employee that adversely affects the rights of any individual, or that results in personal gain or advantage to the officer or employee or to preferred other individuals; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16621A3434654824944E87130AFC5E11"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>CARES Act</term> means the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>); </text></paragraph><paragraph id="H4E4CB58A06B940A89016C25EE154581F"><enum>(3)</enum><text>the term <term>Coronavirus pandemic-related program, project, or activity</term>—</text><subparagraph id="H939832381CE9418598DF0FC39B3BF198"><enum>(A)</enum><text>means a program, project, or activity of the executive branch of the Federal Government authorized under or carried out using amounts made available under an Act to respond to or to provide aid or assistance to address, relief from, or funding to address the outbreak of COVID–19 that is enacted before, on, or after the date of enactment of this Act; and</text></subparagraph><subparagraph id="HA93FE474ECD4419AAF87DFDA132D82A0"><enum>(B)</enum><text>includes any program, project, or activity of the executive branch of the Federal Government authorized under or carried out using amounts made available under—</text><clause id="HA9C3C14C3EBA4CC0AA3792656A6068C0"><enum>(i)</enum><text>the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>), or an amendment made by that Act;</text></clause><clause id="H2F1819451C4842748A0AD6EA13A263B8"><enum>(ii)</enum><text>the CARES Act, or an amendment made by that Act;</text></clause><clause id="H8F6954A9638E47EDBA2E02D92B6FB258"><enum>(iii)</enum><text>the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>), or an amendment made by that Act;</text></clause><clause id="H21F5DA3FF57349CE848DA3FE7E9B7583"><enum>(iv)</enum><text>the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>), or an amendment made by that Act; or</text></clause><clause id="id7B2CF90E2C4B4B3B9D0367FC76D56CD8"><enum>(v)</enum><text>division M or N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), or an amendment made by that division;</text></clause></subparagraph></paragraph><paragraph id="H148C5813B7984F8F888830A8AA494FF6"><enum>(4)</enum><text>the term <term>covered funds</term> means any contract, subcontract, grant, subgrant, loan, loan guarantee, or other payment for which—</text><subparagraph id="HD25D6DEED0CF40469FAA0C4FED4A7B51"><enum>(A)</enum><text>the Federal Government provides any portion of the funds or property that is provided, requested, or demanded; and</text></subparagraph><subparagraph id="H063D8AD8B2C94D52B4BABD113535BE6F"><enum>(B)</enum><text>any portion of the funds are appropriated or otherwise made available under or to carry out a Coronavirus pandemic-related program, project, or activity; </text></subparagraph></paragraph><paragraph id="H0B3941E7AF0E4CB694754E74277966FE"><enum>(5)</enum><text>the term <term>employee</term>—</text><subparagraph id="H2F96DCE311A542B085B849064144DC4F"><enum>(A)</enum><text>except as provided under subparagraph (B), means an individual performing services on behalf of an employer, including any individual working for an employer under a contract with such employer (including a contractor, subcontractor, or agent of an employer); and </text></subparagraph><subparagraph id="HE73FAF101D29419A9389E4D3801070EA"><enum>(B)</enum><text>does not include any Federal employee or member of the uniformed services (as that term is defined in section 101(a)(5) of title 10, United States Code); </text></subparagraph></paragraph><paragraph id="HE4739A1227924D48AD957F5F83FC0AE4"><enum>(6)</enum><text>the term <term>non-Federal employer</term>—</text><subparagraph id="H904E83BECD1445BD85C2FDAA364DC20B"><enum>(A)</enum><text>means any employer—</text><clause id="HDEE483B835BD4577BB494626A99556FD"><enum>(i)</enum><text>with respect to covered funds—</text><subclause id="HB59348D019B1428EB2E033FA9E5CF529"><enum>(I)</enum><text>the contractor, subcontractor, grantee, subgrantee, or recipient, as the case may be, if the contractor, subcontractor, grantee, subgrantee, or recipient is an employer; and </text></subclause><subclause id="HF6FD67ABB64C4383BCA0F57DE9FC840B"><enum>(II)</enum><text>any professional membership organization, certification or other professional body, any agent or licensee of the Federal Government, or any person acting directly or indirectly in the interest of an employer receiving covered funds; or </text></subclause></clause><clause id="HCFA253F7750C4977AC847E84A11BE75B"><enum>(ii)</enum><text>with respect to covered funds received by a State or local government, the State or local government receiving the funds and any contractor or subcontractor of the State or local government; and</text></clause></subparagraph><subparagraph id="H643EE2B51CCE42EB9D8496C4FC0E3F2B"><enum>(B)</enum><text>does not mean any department, agency, or other entity of the Federal Government; </text></subparagraph></paragraph><paragraph id="H9535F454CD82453A84ED9977A6B0FF74"><enum>(7)</enum><text>the term <term>protected individual</term> means—</text><subparagraph id="H05887CBDFA1244F68B3A17B61552AD09"><enum>(A)</enum><text>an employee of, former employee of, or individual seeking employment with, any non-Federal employer receiving covered funds; or </text></subparagraph><subparagraph id="H9D7DDC572C7D44B480E4B8948AC0942E"><enum>(B)</enum><text>a Federal personal services contractor receiving covered funds, former such Federal personal services contractor, or applicant for a Federal personal services contract involving such funds;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H358287D510394E138A24383F8461353F"><enum>(8)</enum><text> the term <term>reprisal</term> means an action (or, as applicable, inaction) that is discharging, demoting, blacklisting, or acting or failing to take an action in a manner prejudicial against, or otherwise discriminating against in any way (including in the hiring process and including by the threat of any such action or inaction) a protected individual as described in section 3(a)(1) for a reason described in subparagraph (A) or (B) of such section; and</text></paragraph><paragraph id="H6BC8B0BDFFA541F0B14534A1ADAC3BAD"><enum>(9)</enum><text>the term <term>State or local government</term> means—</text><subparagraph id="HB1C6C104570045C8A7E862654FA854AB"><enum>(A)</enum><text>the government of each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Commonwealth of the Northern Mariana Islands, or any other territory or possession of the United States; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H17E2D5B563D5471483C56041DB34FB79"><enum>(B)</enum><text>the government of any political subdivision of a government listed in subparagraph (A). </text></subparagraph></paragraph></section><section id="H1847A8DB6645426AB252E99489DCEDFC"><enum>3.</enum><header>Protecting whistleblowers</header><subsection commented="no" id="HEE51700FC22D40B19A98D62CCD9B8599"><enum>(a)</enum><header>Prohibition of reprisals</header><paragraph commented="no" id="HA5840395879A41DABB39B841167E40B9"><enum>(1)</enum><header>In general</header><text>A protected individual may not be discharged, demoted, blacklisted, prejudiced by any action or lack of action, or otherwise discriminated against in any way (including in the hiring process and including by the threat of any such action or inaction) for—</text><subparagraph commented="no" id="H00835533841F42AFAF279CA58B74C104"><enum>(A)</enum><text>disclosing, being perceived as disclosing, or preparing to disclose (including assisting in disclosing, being perceived as assisting in disclosing, or preparing to assist in disclosing and including a disclosure made in the ordinary course of the duties of the protected individual) to an officer or entity described in paragraph (2) information that the protected individual reasonably believes is evidence of misconduct that violates, obstructs, or undermines any statute, rule, or regulation with respect to any Coronavirus pandemic-related program, project, or activity, including—</text><clause id="H56FF82EB29C6446FBA35AFF9C9618F39"><enum>(i)</enum><text>gross mismanagement of an agency contract, subcontract, grant, or subgrant relating to covered funds;</text></clause><clause id="H028C5870A2694A0FB5B3BB311D4D71BF"><enum>(ii)</enum><text>a gross waste of covered funds;</text></clause><clause id="H18CC68AC87114F8DAD9739FA5C741EAA"><enum>(iii)</enum><text>a substantial and specific danger to public health or safety;</text></clause><clause id="HC32D1F667B1F4BCEBF28ECD97DBAACF0"><enum>(iv)</enum><text>an abuse of authority related to the distribution, implementation, or use of covered funds, including conflict of interest or partiality; and</text></clause><clause id="HCFE8DF63060B4F8988CD386EE084D5AB"><enum>(v)</enum><text>a violation of any statute, rule, or regulation related to an agency contract, subcontract (including the competition for or negotiation of a contract or subcontract), grant, or subgrant, awarded or issued relating to covered funds; or</text></clause></subparagraph><subparagraph id="H21523C2F79CC45E7B6F5C8583FAE8F36"><enum>(B)</enum><text>refusing to obey an order that the protected individual reasonably believes would require that individual to violate a statute, rule, or regulation with respect to any Coronavirus pandemic-related program, project, or activity. </text></subparagraph></paragraph><paragraph id="H8CE3B3A6E0754C10A1095E31A59B8FFF"><enum>(2)</enum><header>Officers and entities</header><text>The officers and entities described in this paragraph are—</text><subparagraph id="HDBF8A3802B6C40DEB439CE5525AFCE68"><enum>(A)</enum><text>the Pandemic Response Accountability Committee; </text></subparagraph><subparagraph id="HA0203806E0DC4D8490A5910B125A5718"><enum>(B)</enum><text>an inspector general, including the Special Inspector General for Pandemic Relief; </text></subparagraph><subparagraph id="H63D535DB18C24B7EBAF3999A9CC80487"><enum>(C)</enum><text>the Congressional Oversight Commission; </text></subparagraph><subparagraph id="H8ED6F75FBFB448D4A83A4B7103F5350F"><enum>(D)</enum><text>the Comptroller General of the United States; </text></subparagraph><subparagraph id="HBC311AF52FF54516AEDB76868208E11C"><enum>(E)</enum><text>a Member of Congress; </text></subparagraph><subparagraph id="H0585775F092C4A6DA15BF053BF15742A"><enum>(F)</enum><text>a congressional committee; </text></subparagraph><subparagraph id="H89CF9CE02BAE417894BFABBA2290CCDF"><enum>(G)</enum><text>a State or Federal regulatory or law enforcement agency; </text></subparagraph><subparagraph id="HC7D6F1F14DEA40A98E7CCDB16DE3B1EE"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="H3ED6FE4053FA4D8B95FF63DADC51D863"><enum>(i)</enum><text>an individual with supervisory authority over a protected individual; or</text></clause><clause id="H6FFA5E24FCD144FC8D8ED55C11A07CD6" indent="up1"><enum>(ii)</enum><text>another individual who—</text><subclause id="H877F029AC7164113B4B3807B2239B350"><enum>(I)</enum><text>has authority to investigate, discover, or terminate misconduct; and</text></subclause><subclause id="HB71F31ABDECC4B168DA9DD4064FD66AC"><enum>(II)</enum><text>works for the non-Federal employer (in the case of a protected individual described in section 2(7)(A)), or the Federal Government (in the case of a protected individual described in section 2(7)(B));</text></subclause></clause></subparagraph><subparagraph id="H1F7F0AD071A746CF8822F4B1E485FA1A"><enum>(I)</enum><text>a court or grand jury; </text></subparagraph><subparagraph id="HC7942ECCA7CA49CEB8BDD284EFFD1D34"><enum>(J)</enum><text>an officer or representative of a labor organization; or</text></subparagraph><subparagraph id="H96AD22E17F5F4C19AD0CEFCE5F7FB863"><enum>(K)</enum><text>the head of a Federal agency or a designee of such a head.</text></subparagraph></paragraph><paragraph id="H8CE0AFB8077D4C83A7D6287A01367E32"><enum>(3)</enum><header>Application</header><subparagraph id="HA534076580774C1388D01C1F14C994B9"><enum>(A)</enum><header>In general</header><text>For the purposes of paragraph (1)—</text><clause id="H5F4133010C334F92BF67B24A2CA48E0A"><enum>(i)</enum><text>a protected individual who initiates or provides evidence of misconduct by a contractor, subcontractor, grantee, or subgrantee in any judicial or administrative proceeding relating to waste, fraud, or abuse in connection with a Federal contract or grant shall be deemed to have made a disclosure covered by such paragraph; and</text></clause><clause id="H0CEB30E77CC5469CAE67D3E8586687B6"><enum>(ii)</enum><text>any discharge, demotion, discrimination, or other reprisal described in paragraph (1) is prohibited even if it is undertaken at the request of an executive branch officer or employee, unless the request takes the form of a non-discretionary directive and is within the authority of the executive branch official making the request.</text></clause></subparagraph><subparagraph id="HB10D134C3A274017AF0B067403DA6C08"><enum>(B)</enum><header>Protection of whistleblower identity</header><clause id="H365B4944E1F641039DCF6E93560AA0A5"><enum>(i)</enum><header>In general</header><text>Except as required by law, an officer or entity described in paragraph (2) that receives information under paragraph (1) and any individual or entity to which the officer or entity discloses the information may not disclose the identity or identifying information of the protected individual providing the information without explicit written consent of the protected individual.</text></clause><clause id="HDC34B408B48F4C49917B8FCC7476B728"><enum>(ii)</enum><header>Notice</header><text>If disclosure of the identity or identifying information of a protected individual providing information under paragraph (1) is required by law, the recipient shall provide timely notice of the disclosure to the protected individual.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H65A2D9DE88DB4399A8A2331BC1435AB8"><enum>(b)</enum><header>Investigation of complaints</header><paragraph commented="no" id="H6F0330386C7D4BC49B4BDE60F401D73D"><enum>(1)</enum><header>Complaints</header><subparagraph commented="no" id="H734B360BA2D44804BAFB3ED2687D9FBD"><enum>(A)</enum><header>In general</header><text>A protected individual who believes that the individual has been subjected to a reprisal prohibited under subsection (a) may, within 3 years after learning of the alleged reprisal, submit a complaint regarding the reprisal to the Secretary of Labor in accordance with paragraph (2). </text></subparagraph><subparagraph commented="no" id="H3994E11275D64EC38A3D96B9A51574A8"><enum>(B)</enum><header>Response</header><text>Not later than 60 days after the submission of a complaint under subparagraph (A), the applicable non-Federal employer (or the applicable agency head in the case of a Federal personal services contract involving covered funds) shall submit an answer to the complaint to the Secretary of Labor.</text></subparagraph></paragraph><paragraph id="HF660C1EF0BBC409AA23AF6F53ECB5485"><enum>(2)</enum><header>Remedy and enforcement authority</header><subparagraph id="H1EFCC328E5F04AC1BADD89B775A6D572"><enum>(A)</enum><header>Rules and procedures</header><text>Except to the extent provided otherwise in this section, any action alleging a reprisal prohibited under subsection (a) shall be governed, to the maximum extent practicable, by the rules and procedures for administrative and judicial enforcement, including for investigations, civil actions, appeals, and relief, set forth under <external-xref legal-doc="usc" parsable-cite="usc/26/7623">section 7623(d)</external-xref> of the Internal Revenue Code of 1986. </text></subparagraph><subparagraph id="H3899CED9F83E4C97ACC108340FF6DFE8"><enum>(B)</enum><header>Burden of proof</header><text>The Secretary of Labor, or the officer presiding in a judicial or administrative proceeding, shall apply the legal burdens of proof specified in section 1221(e) of title 5, United States Code, in determining whether a reprisal prohibited under subsection (a) has occurred in accordance with the rules and procedures under subparagraph (A). </text></subparagraph><subparagraph id="H846D4BEE2BA5418A88EDAC81BE4CF674"><enum>(C)</enum><header>Access to investigative file of the Secretary of Labor</header><clause id="H866B40C9F2414E8BA6F78F7ED65FAD39"><enum>(i)</enum><header>In general</header><text>A protected individual alleging a reprisal under this section shall have access to the investigation file of the Secretary of Labor in accordance with section 552a of title 5, United States Code (commonly referred to as the <quote>Privacy Act</quote>). The investigation of the Secretary of Labor shall be deemed closed for purposes of disclosure under such section when an individual files an appeal to an agency head or a court of competent jurisdiction.</text></clause><clause id="H98E41453F30240A182FD3B6B3CCE3314"><enum>(ii)</enum><header>Civil action</header><text>In the event a protected individual alleging a reprisal under this section brings a civil action under this subsection, the protected individual and the non-Federal employer (or the head of the applicable agency in the case of a Federal personal services contract involving covered funds), if applicable, shall have access to the investigative file of the Secretary of Labor in accordance with section 552a of title 5, United States Code.</text></clause><clause id="HBEB562127F7944F6A41AD4EFF543EFED"><enum>(iii)</enum><header>Exception</header><text>The Secretary of Labor may exclude from disclosure—</text><subclause id="HE4D2A91E8CAC4CE791B7E67C136CD23C"><enum>(I)</enum><text>information protected from disclosure by a provision of law; and</text></subclause><subclause id="HA312D2885CC641639B8D9A4E87F2C0DD"><enum>(II)</enum><text>any additional information the Secretary of Labor determines disclosure of which would impede a continuing investigation, if such information is disclosed once such disclosure would no longer impede such investigation, unless the Secretary of Labor determines that disclosure of law enforcement techniques, procedures, or information could reasonably be expected to risk circumvention of the law or disclose the identity of a confidential source.</text></subclause></clause><clause id="HEED589DD31024C8A8FDD0353AEBF9E3F"><enum>(iv)</enum><header>Privacy of information</header><text>The Secretary of Labor investigating an alleged reprisal under this section may not respond to any inquiry or disclose any information from or about any protected individual alleging such reprisal, except in accordance with the provisions of section 552a of title 5, United States Code, or as required by any other applicable Federal law.</text></clause></subparagraph></paragraph></subsection><subsection id="H49BA7E6F4457499CAAC75B6304592F5F"><enum>(c)</enum><header>General provisions</header><paragraph id="H84B4444606D14858BB501FE402FBADCC"><enum>(1)</enum><header>Rights retained by employee</header><text>Nothing in this section shall diminish the rights, privileges, or remedies of any protected individual under any Federal or State law, or under any collective bargaining agreement.</text></paragraph><paragraph id="HE7BF9FC634A242E1AE0B63CDAA8D3901"><enum>(2)</enum><header>Liability</header><text>Notwithstanding any other provision of law, a protected individual shall be immune from civil and criminal liability with respect to a disclosure by the individual if the individual would be protected from reprisal under subsection (a) for making the disclosure. The protected individual shall bear the burden of proving that the individual would be protected from reprisal under subsection (a) for making the disclosure.</text></paragraph><paragraph id="H59D033CDA5FF4C48AAA200E38A920E8F"><enum>(3)</enum><header>Nonenforceability of certain provisions waiving rights and remedies or requiring arbitration of disputes</header><subparagraph id="H66D75AD6D95844C78884149D7027F67D"><enum>(A)</enum><header>Waiver of rights and remedies</header><text>Except as provided under subparagraph (C), the rights and remedies provided for in this section may not be waived by any public or private agreement, policy, form, or condition of employment, including by any predispute arbitration agreement. </text></subparagraph><subparagraph id="HAA98AB9E64674E4BA6A4E96D64514C14"><enum>(B)</enum><header>Predispute arbitration agreements</header><text>Except as provided under subparagraph (C), no predispute arbitration agreement shall be valid or enforceable if it requires arbitration of a dispute arising under this section.</text></subparagraph><subparagraph id="H54ECCEA3DCDA4B38B6BCD54D53BA3F69"><enum>(C)</enum><header>Exception for collective bargaining agreements</header><text>Notwithstanding subparagraphs (A) and (B), an arbitration provision in a collective bargaining agreement shall be enforceable as to disputes arising under the collective bargaining agreement.</text></subparagraph></paragraph><paragraph id="HB5E643654F654E9B9337637F469BA78F"><enum>(4)</enum><header>Requirement to post notice of rights and remedies</header><text>Any non-Federal employer receiving covered funds (and the head of the applicable agency in the case of a Federal personal services contract involving covered funds) shall post notice of the rights and remedies provided under this section.</text></paragraph></subsection><subsection id="H9634069D67DD4F2E918E5B0CDE6584F9"><enum>(d)</enum><header>Rules of construction</header><paragraph id="H146F36F4BB784EBE966D064F0EDEBE89"><enum>(1)</enum><header>No implied authority to retaliate for non-protected disclosures</header><text>Nothing in this section may be construed to—</text><subparagraph id="H4843093D1FBE4E1B9A4B3105F4ED0DDA"><enum>(A)</enum><text>authorize the discharge of, demotion of, or discrimination or other reprisal against a protected individual for a disclosure other than a disclosure protected by subsection (a); or </text></subparagraph><subparagraph id="H432DE8FFDD814220B87589B28600FB69"><enum>(B)</enum><text>modify or derogate from a right or remedy otherwise available to the protected individual.</text></subparagraph></paragraph><paragraph id="H4B5BD270225544EC9D4A598DF083A08C"><enum>(2)</enum><header>Relationship to State laws</header><text>Nothing in this section may be construed to preempt, preclude, or limit the protections provided for public or private employees under State whistleblower laws.</text></paragraph></subsection><subsection id="H2A4C7B9337F846B582797F763BCCC6E1"><enum>(e)</enum><header>Complaint portal</header><text>The Special Inspector General for Pandemic Relief, the Pandemic Relief Accountability Committee, and the Congressional Oversight Commission shall each establish a public website where any individual who believes that the individual has been subjected to a reprisal prohibited under subsection (a) may submit a complaint regarding the reprisal. Such complaints shall be transmitted to the Secretary of Labor for enforcement in accordance with this section.</text></subsection><subsection id="HC6CDB01CA0DA4869A818EDC54C4420E6"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Labor to carry out this Act $20,000,000 for fiscal year 2021, to remain available until expended. </text></subsection></section></legis-body></bill>
