which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XXXIII of the Public Health Service Act with respect to flexibility and funding for the World Trade Center Health Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id70AE520BF37345B5B24328B4C6CCE783"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>9/11 Responder and Survivor Health Funding Correction Act</short-title></quote>.</text></section><section id="id6B13309C4F6E4FA7802C57CAE76CDF88"><enum>2.</enum><header>Flexibility for certifications under the World Trade Center Health Program</header><subsection id="id1285d6655e0c4a6a9db0f9131616597d"><enum>(a)</enum><header>In general</header><text>Section 3305(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-4">42 U.S.C. 300mm–4(a)</external-xref>) is amended—</text><paragraph id="id49A2367EE922404492E9C68C5D75DD71"><enum>(1)</enum><text>in paragraph (2)(A)(ii), by inserting <quote>subject to paragraph (6),</quote> before <quote>for</quote>; and</text></paragraph><paragraph id="idC7DA76E779994F87944A31AE914F1907"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77a086428a3649728110d64d17feb1c9"><paragraph id="id521711bfb493434a9f908d11914078b2"><enum>(6)</enum><header>Licensed health care provider flexibility</header><subparagraph id="idE230983B915C4802957C89B7AFA2A1EC"><enum>(A)</enum><header>In general</header><text>For purposes of an initial health evaluation described in paragraph (2)(A)(ii) (including any such evaluation provided under section 3321(b) or through the nationwide network under section 3313), such evaluation may be conducted by a physician or any other licensed health care provider in a category of health care providers determined by the Secretary under subparagraph (B).</text></subparagraph><subparagraph id="idBDFAC62DB33646D48232650A71B0816F"><enum>(B)</enum><header>Categories of licensed health care providers</header><text>Not later than 60 days after the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act</short-title>, the WTC Program Administrator shall issue regulations for the categories of licensed health care providers who, in addition to licensed physicians, may conduct evaluations under subparagraph (A) and make determinations under section 3312(b).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAB3C6389FA674E3CB20A736B548031A3"><enum>(b)</enum><header>Flexibility for WTC responders</header><text display-inline="yes-display-inline">Section 3312(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-22">42 U.S.C. 300mm–22(b)</external-xref>) is amended—</text><paragraph id="idB5ADA9E5BD3842D99D3DD836AB54FE33"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>physician</quote> each place it appears and inserting <quote>physician or other licensed health care provider in a category determined by the Secretary under section 3305(a)(6)(B)</quote>;</text></paragraph><paragraph id="id1C406C917662465E9688360BB205351C"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="idCC894A22B2DE40FABE35C76137F5DB51"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id7AC4832AD0E84747A3EA42E41AEA83DA"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>physician</quote> and inserting <quote>physician or other licensed health care provider in a category determined by the Secretary under section 3305(a)(6)(B)</quote>;</text></clause><clause id="id4B8231C7FC7D49468304E6DF3F51DA8B"><enum>(ii)</enum><text>in clause (i), by striking <quote>physician</quote> and inserting <quote>physician or other licensed health care provider</quote>; and</text></clause><clause id="idE168FE1B5AD94483B6263D9B91DA929C"><enum>(iii)</enum><text>in clause (ii), by striking <quote>such physician's determination</quote> and inserting <quote>the determination of such physician or other licensed health care provider</quote>; and</text></clause></subparagraph><subparagraph id="id61A63A11F3F444D18098CBF2D8BF8378"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id8DBEE81E8E1D42929322B49D8C564454"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>physician determinations</quote> and inserting <quote>determinations by physicians or other licensed health care providers in categories determined by the Secretary under section 3305(a)(6)(B)</quote>; and</text></clause><clause id="idC839F6B7C70542AC8D73CFCCD1555681"><enum>(ii)</enum><text>in clause (i), by striking <quote>physician panel</quote> and inserting <quote>panel of physicians or other licensed health care providers in categories determined by the Secretary under section 3305(a)(6)(B)</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id9906C25A6A9D410BA62CA0EC27D110B5"><enum>(3)</enum><text>in paragraph (5), by striking <quote>examining physician</quote> and inserting <quote>examining physician or other licensed health care provider in a category determined by the Secretary under section 3305(a)(6)(B)</quote>.</text></paragraph></subsection></section><section id="idC65F6162788242209D6C30F399B02254"><enum>3.</enum><header>Criteria for credentialing health care providers participating in the nationwide network</header><text display-inline="no-display-inline">Title XXXIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm et seq.</external-xref>) is amended—</text><paragraph id="idCE40F8CA113F4E2B9EF6953DF95B7AE8"><enum>(1)</enum><text>in section 3305(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-4">42 U.S.C. 300mm–4(a)(2)</external-xref>)—</text><subparagraph id="id900EA5D2D92F4556BFB5C20641124183"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><clause id="id63FC97D888CA450F8F750E739FC59325"><enum>(i)</enum><text display-inline="yes-display-inline">by striking clause (iv); and</text></clause><clause id="id606BDFDECD1240F181FADFD1E587AA81"><enum>(ii)</enum><text>by redesignating clauses (v) and (vi) as clauses (iv) and (v), respectively;</text></clause></subparagraph><subparagraph id="id2E881BCCB9DA4FE3A376DE90CD83AEB9"><enum>(B)</enum><text>by striking subparagraph (B); and</text></subparagraph><subparagraph id="idA55CC1C3DF0C46BD8697D498DC6832FD"><enum>(C)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (B) and (C), respectively; and</text></subparagraph></paragraph><paragraph id="id467BEE9F9F1F41C081B87DEC7DDCEA15"><enum>(2)</enum><text>in section 3313(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-23">42 U.S.C. 300mm–23(b)(1)</external-xref>), by striking <quote>Data Centers</quote> and inserting <quote>WTC Program Administrator</quote>.</text></paragraph></section><section id="id4f0ba58619494bf29c41b0762356f7ba"><enum>4.</enum><header>Clarifying calculation of enrollment</header><subsection id="id011c2e9ed3d74803b9953d259f872b8a"><enum>(a)</enum><header>Responders</header><text>Section 3311(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-21">42 U.S.C. 300mm–21(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4176C9731460442B9AB1E2E742191FC9"><paragraph id="id3c5b4de268ca40b8bf0d8ffdb7e062d3"><enum>(6)</enum><header>Deceased WTC responders</header><text>An individual known to the WTC Program Administrator to be deceased shall not be included in any count of enrollees under this subsection or section 3351.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6649413f3bad42fc8c3da69330c4e436"><enum>(b)</enum><header>Survivors</header><text>Section 3321(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-31">42 U.S.C. 300mm–31(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id478019E0DD7A43249F8FEA0235F386A6"><paragraph id="id6bdc5b82fe3f454397ecc9ee8c6e51b6"><enum>(5)</enum><header>Deceased WTC survivors</header><text>An individual known to the WTC Program Administrator to be deceased shall not be included in any count of enrollees under this subsection or section 3351.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1CBFED935B0B459DBF24E8D32AF8C419"><enum>5.</enum><header>Funding for the World Trade Center Health Program</header><text display-inline="no-display-inline">Section 3351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-61">42 U.S.C. 300mm–61</external-xref>) is amended—</text><paragraph id="idA26C4270703D4753A6F5CA02260CEF32"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2)(A)—</text><subparagraph id="id58AFF5F424A4482AA16CFF2F6A705C7D"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (x), by striking <quote>$570,000,000; and</quote> and inserting <quote>$689,130,000;</quote>; and</text></subparagraph><subparagraph id="id03CB326CD60349D6899ED7BEA25F99EB"><enum>(B)</enum><text display-inline="yes-display-inline">by striking clause (xi) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id847EE0E8011840A681E8B132492A0D3E"><clause id="id66851A3E658A4E188293A839CDB9A9D0"><enum>(xi)</enum><text>for fiscal year 2026, $930,325,500;</text></clause><clause id="idA7D49365F9AB4E4CBD050C75C4CA10CC"><enum>(xii)</enum><text>for fiscal year 2027, $1,004,751,540;</text></clause><clause id="id6C086DE6D3DB417092E536B127CAD9FB"><enum>(xiii)</enum><text>for fiscal year 2028, $1,085,131,663;</text></clause><clause id="id1730B79BD61D4D478A35FAB8C1CAB3C3"><enum>(xiv)</enum><text>for fiscal year 2029, $1,139,388,246;</text></clause><clause id="id675E3D4487814860975777FECA40A6FA"><enum>(xv)</enum><text>for fiscal year 2030, $1,196,357,659;</text></clause><clause id="idB312E994872A40C7A1FAFF7E05EA4E95"><enum>(xvi)</enum><text>for fiscal year 2031, $1,256,175,542; and</text></clause><clause id="id4B333FE6737B4C7FAF550A4E33C80F8D"><enum>(xvii)</enum><text>for each subsequent fiscal year through fiscal year 2090— </text><subclause id="id37FAB8B0B8E745C9B896526C183865E9"><enum>(I)</enum><text>the amount determined under this subparagraph for the previous fiscal year multiplied by 1.05; multiplied by</text></subclause><subclause id="id9E057D169CD14A94A0C860CE75B43806"><enum>(II)</enum><text>the ratio of—</text><item id="idCC35920E493440A6BB9BA7BAC821F66B"><enum>(aa)</enum><text>the total number of individuals enrolled in the WTC program on July 1 of such previous fiscal year; to </text></item><item id="idCF64AA2223444BF7A6727C3EF10E3421"><enum>(bb)</enum><text>the total number of individuals so enrolled on July 1 of the fiscal year prior to such previous fiscal year; plus</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0C89529455FE471CA9FBD9CED9055E5D"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idD63341B27F0D4FE1A638CDE3C473444E"><enum>(A)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8F132D45AE2D45E49D2CE5C536CC1CEE"><paragraph id="idC1F92EE31E354E97A032957E7593C503"><enum>(3)</enum><header>Education and outreach</header><text>For the purpose of carrying out section 3303—</text><subparagraph id="id14B02AEC2C074E9BA03C704E54498749"><enum>(A)</enum><text>for each of fiscal years 2016 through 2021, $750,000; and</text></subparagraph><subparagraph id="idB7352D0F567741BFADE3723D66A881AF"><enum>(B)</enum><text>for fiscal year 2022 and each subsequent fiscal year, $2,000,000.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id93478704642049BEB3A0A1BA16D18CEE"><enum>(B)</enum><text>in paragraph (4)—</text><clause id="idF9B206C0D369491AB4E2A462DAE8440F"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89CD3FD188E74FDA93D570CE81432DC8"><subparagraph id="id96E59F7E9BBC41DCBF1FD563EEA8CBCA"><enum>(A)</enum><text>for fiscal year 2021, the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act</short-title></text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id0044F898D36C49DFAD68165D7CCB21AD"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>2017, $15,000,000</quote> and inserting <quote>2022, $20,000,000</quote>; and</text></clause></subparagraph><subparagraph id="idFEA71597D95A4BCAB8128BA957F24186"><enum>(C)</enum><text>in paragraph (5)—</text><clause id="id147711251A1B4DC99DD3D796DE0BADBA"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD9521804C4AD4265B9A7AA101D38C708"><subparagraph id="id0035A652ED024DE3A177E6A1500D7388"><enum>(A)</enum><text>for fiscal year 2021, the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act</short-title>;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idC7109A4B970C43D18907DCB6EE295F6D"><enum>(ii)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></clause><clause id="id7E90270151934FBCAB85D1E73156A026"><enum>(iii)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88EB192252DF47788385A56C28E1F6D8"><subparagraph id="id453E18D0276D448283C38CD0F293CE54"><enum>(B)</enum><text>for fiscal year 2022, $20,000,000; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section><section id="idED1B12739BF34550827D04D16311941F"><enum>6.</enum><header>Research cohort for emerging health impacts on youth</header><subsection id="idB66DE3D4576549838CB9111708726301"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3341 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-51">42 U.S.C. 300mm–51</external-xref>) is amended—</text><paragraph id="id3939A1AC42334E039261E385CE3B8269"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="id1C88607731284EBE94C29528A05624F6"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id558963360D054BA0A02072230738912B"><subsection id="id7131F07679E340E09DD3C4B77B72996B"><enum>(c)</enum><header>Research cohort for emerging health impacts on youth</header><text>The WTC Program Administrator shall establish a research cohort of sufficient size to conduct research studies on the health and educational impacts of exposure to airborne toxins, or any other hazard or adverse condition, resulting from the September 11, 2001, terrorist attacks on the population of individuals who were 21 years of age or younger at the time of exposure and who are enrolled in the WTC Program or otherwise eligible for enrollment in the Program under section 3321.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5595F9AA90C14B7886C7E0FC849B3ED5"><enum>(b)</enum><header>Spending limitation exemption</header><text>Section 3351(c)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-61">42 U.S.C. 300mm–61(c)(5)</external-xref>) is amended in the matter preceding subparagraph (A), by inserting <quote>(other than subsection (c) of such section)</quote> after <quote>section 3341</quote>.</text></subsection><subsection id="idD88B4F45B80E4EDA957A9555A119F2E5" commented="no"><enum>(c)</enum><header>Conforming amendment</header><text>Section 3301(f)(2)(E) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm(f)(2)(E)</external-xref>) is amended by striking <quote>section 3341(a)</quote> and inserting <quote>subsection (a) or (c) of section 3341</quote>.</text></subsection></section></legis-body></bill>
