which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the Federal share of operating costs for certain projects that receive grants under the Formula Grants to Rural Areas Program of the Federal Transit Administration.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id89AC1FFDB50744B0A0BFD235BA12C8E5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investments in Rural Transit Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Increased Federal share of operating costs for certain areas</header><text display-inline="no-display-inline">Section 5311(g)(2)(B) of title 49, United States Code, is amended—</text><paragraph id="idF313D62503664215870A49337D8BB8AA"><enum>(1)</enum><text display-inline="yes-display-inline">in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="USC">Exception</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="USC">Exceptions</header-in-text></quote>;</text></paragraph><paragraph id="idF09B9CE4005E4EECA0FBA3EDB630AF47"><enum>(2)</enum><text>by striking <quote>A State</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA984A2BD68C8400E841C2D1FB285853C"><clause id="id79F062285B0D4FDD8FC7D54B5FBD4298"><enum>(i)</enum><header>States with nontaxable Indian lands or public domain lands</header><text>Subject to clause (ii), a State</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id0C78D0672108445C9E6795982FDB8CF8"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC85C4D61A7C44255B3E99706C6089AFA"><clause id="id62EE47DE93234899AEBEC8A990EB6179"><enum>(ii)</enum><header>Areas with particular needs</header><subclause id="idCDA710FF0B5049098E6558014989FDFE"><enum>(I)</enum><header>Definition</header><text>In this clause, the term <term>area of persistent poverty</term> means—</text><item id="id45a9cf5e9b06432184e74364ecafad5b"><enum>(aa)</enum><text>any county in which not less than 20 percent of the population has lived in poverty during the most recent 30-year period, as measured by—</text><subitem id="id31604C5BEF284B698083DDA98ED89C95"><enum>(AA)</enum><text>the second and third most recent decennial censuses; and</text></subitem><subitem id="id6A45672EE62A4ABBABAE089DFBC7A414"><enum>(BB)</enum><text>the Small Area Income and Poverty Estimates of the Bureau of the Census for the most recent year for which the Estimates are available; or</text></subitem></item><item id="id8205ff64646b4fcd92f6e532ea839bcf"><enum>(bb)</enum><text>any census tract with a poverty rate of not less than 20 percent, as measured by most recent 5-year data series available from the American Community Survey of the Bureau of the Census.</text></item></subclause><subclause id="id1812CA888C0C4E3898BBC0E157C35BD1"><enum>(II)</enum><header>Increased Federal share</header><text>A grant made under this section for operating assistance to an operator of public transportation that serves an area that meets one or more of the criteria under subclause (III) shall be for 80 percent of the net operating costs of the project, as determined by the Secretary.</text></subclause><subclause id="id936C1F7E65374155AEEF7129A5CCB687"><enum>(III)</enum><header>Criteria</header><text>The criteria referred to in subclause (II) are that an area—</text><item id="id7F85CFBA0AA94AD7B0466A46E2301F01"><enum>(aa)</enum><text>is an area of persistent poverty;</text></item><item id="id44EE15C061874233A7D82AF4E9535044"><enum>(bb)</enum><text>is a county in which not less than 25 percent of residents are age 65 or older, according to the most recent 5-year estimate of the American Community Survey of the Bureau of the Census;</text></item><item id="idB6FF99AEDE5942FE9D26A949236DD40C"><enum>(cc)</enum><text>is a county that, or is a county that includes a site that—</text><subitem id="id2C77C8A44E8F48318270BB92BF13AF3E"><enum>(AA)</enum><text>has been designated by the Secretary of Health and Human Services as a health professional shortage area under section 332(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e(a)</external-xref>) on the basis of a primary care or mental health care shortage; and</text></subitem><subitem id="id727AA8B0BD8C444E832E3582B18C2AB4"><enum>(BB)</enum><text>received a health professional shortage area score for the most recent program year, with respect to primary care or mental health care, that was not less than the lowest minimum score, as designated by the Secretary of Health and Human Services for that program year, necessary for the site to be eligible for the assignment of National Health Service Corps members providing primary care or mental health care, respectively, for fulfillment of obligated service under the National Health Service Corps Scholarship Program; or</text></subitem></item><item id="id29EF8EBEE22A44B5A8445D42F97EF73A"><enum>(dd)</enum><text>is a county with a population density of not more than 20 persons per square mile of land area, based on the most recent decennial census.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
