Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Health and Human Services to use authorities under the Defense Production Act of 1950 to prioritize contracts necessary to promote pandemic preparedness and response, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Health Emergency Production Act of 2021</short-title></quote>.</text></section><section id="id9CA4239607D54C1DBB03428FD87CF66B"><enum>2.</enum><header>Prioritization of contracts necessary to promote pandemic preparedness and response</header><subsection id="idF7332BF24012401FA7CF5363C32985C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511</external-xref> et seq.) is amended by inserting after section 101 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id49ED658DE90B405C981261AA32F62D3B"><section id="id3BE4A6B28E554D53B41C2EC88A6C56A1"><enum>101A.</enum><header>Prioritization of contracts necessary to promote pandemic preparedness and response</header><subsection id="id4782F9BB37A642028C1E0C2276505DEB"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services shall—</text><paragraph id="idDD897F44A2044D43AA4FB50FD662833C"><enum>(1)</enum><text>require that performance under contracts or orders (other than contracts of employment) that the Secretary deems necessary or appropriate to promote preparedness for and response to a pandemic shall take priority over performance under any other contract or order; </text></paragraph><paragraph id="id6F09293763DB40FEBB73C81F991E6F14"><enum>(2)</enum><text>for the purpose of assuring such priority, require acceptance and performance of such contracts or orders in preference to other contracts or orders by persons the Secretary finds to be capable of their performance; and</text></paragraph><paragraph id="id8CDB57AE5C784591A7E3823781023826"><enum>(3)</enum><text>allocate materials, services, and facilities in such manner, upon such conditions, and to such extent as the Secretary shall deem necessary or appropriate to promote the public health.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4C97BFA583A74FFB89F7F6C2AE4019C5"><enum>(b)</enum><header>Use of authority</header><text display-inline="yes-display-inline">The powers granted by this section shall be used to control the general distribution of a material in the civilian market if the Secretary finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="id40C9DA45511648DC909A33C8D6E81BE6"><enum>(1)</enum><text display-inline="yes-display-inline">such material is a scarce and critical material essential to public health; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9400B2836A19444DA8E62CB8F12624B3"><enum>(2)</enum><text display-inline="yes-display-inline">the requirements of public health for such material cannot otherwise be met without creating a significant dislocation of the normal distribution of such material in the civilian market to such a degree as to create appreciable hardship.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA3B7D268E5194F3992EE663256425A66"><enum>(b)</enum><header>Conforming amendments</header><text>The Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4501">50 U.S.C. 4501</external-xref> et seq.) is amended—</text><paragraph id="idD6E71B31D72A46D8B2C4863EDB813F90"><enum>(1)</enum><text>in section 102 (<external-xref legal-doc="usc" parsable-cite="usc/50/4512">50 U.S.C. 4512</external-xref>), in the last sentence, by inserting <quote>, 101A,</quote> after <quote>sections 101</quote>; and</text></paragraph><paragraph id="idD78830BCBBA9422ABE4C510EA910F9B1"><enum>(2)</enum><text>in section 701(e) (<external-xref legal-doc="usc" parsable-cite="usc/50/4551">50 U.S.C. 4551(e)</external-xref>), by inserting <quote>or the Secretary of Health and Human Services makes a determination to exercise any authority to allocate any material pursuant to section 101A,</quote> after <quote>section 101,</quote>.</text></paragraph></subsection></section><section id="idF0B63269A6C94C2891A638BD0987A7EE"><enum>3.</enum><header>Reporting of actions taken under title I of Defense Production Act of 1950 in Federal Procurement Data System</header><text display-inline="no-display-inline">Title I of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCF0156CDCF324BCC9CFF3632B1A6CDF2"><section id="id540AB1F39E0641C69C0A0F5C23756B0B"><enum>109.</enum><header>Reporting of actions in Federal Procurement Data System</header><text display-inline="no-display-inline">Any action taken under section 101 or 101A shall be reported in the Federal Procurement Data System.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id70D9512A19C64D118C501A12FE1D0602"><enum>4.</enum><header>Use of Defense Production Act Fund for pandemic preparedness and response</header><text display-inline="no-display-inline">Section 304 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4534">50 U.S.C. 4534</external-xref>) is amended—</text><paragraph id="idB75BDB4917AA4BFB9E97AAFDEE6A52AE"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFA8A8E262534482B88E80106083FD765"><subsection commented="no" display-inline="no-display-inline" id="ID555CE8C3D4B34B96B6C71F994AA064D6"><enum>(c)</enum><header display-inline="yes-display-inline">Use of fund</header><paragraph commented="no" display-inline="no-display-inline" id="id14FC3BA2DC074355A9F40EA4FA03F8F8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Fund shall be available to carry out the provisions and purposes of this title, subject to the limitations set forth in this Act and in appropriations Acts.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id589D6832FB8B48569799F772AE54EB4F"><enum>(2)</enum><header>Distribution</header><text display-inline="yes-display-inline">The Fund manager designated under subsection (e) shall ensure that amounts in the Fund are fairly distributed to the office established under section 305 and all other Federal agencies with responsibility for carrying out the provisions and purposes of this title.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id538940E9D4B8449BAD91CE7F75253701"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (e);</text></paragraph><paragraph id="id49BCDA3AA4FC4A578B551CF5600D6492"><enum>(3)</enum><text>by redesignating subsections (f) and (g) as subsections (e) and (f), respectively;</text></paragraph><paragraph id="idAA03F5FA4FC94FC985FDFE4A8B331FAD"><enum>(4)</enum><text>in subsection (e), as redesignated by paragraph (3)—</text><subparagraph id="idF21341B95B3E49898A84EDE065E82025"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id3D04FF8819B6459DA5FBED373979696F"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id3302471616DB4E36B43FE3E420DC3259"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14A4850142F445C8B8E4681382641853"><paragraph id="id79E6C920EA854A43A364E1619A186B06"><enum>(4)</enum><text>coordinating with other Federal agencies to ensure that amounts in the Fund are made available to agencies other than the agency of the Fund manager, especially for public health programs.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id71480684732F4B2CA08D1FB2047125F9"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id949C0B2F8D0F4D498236A801CAE1E5BD"><subsection id="id38FF759C93344576ADA282FC57FDD49B"><enum>(g)</enum><header>Interagency rotation program</header><paragraph id="id63F15204E579414993287C97D80AE3CA"><enum>(1)</enum><header>In general</header><text>The Secretary of Health and Human Services and the Secretary of Defense shall establish an interagency rotation program that provides for personnel of the components of the Department of Health and Human Services specified in paragraph (2) to take rotational assignments within the Office of the Deputy Assistant Secretary of Defense for Industrial Policy, and for personnel of that Office to take rotational assignments within such components, for the purposes of—</text><subparagraph id="id3DEDA2FB558A4F43859E7BA37072E1C0"><enum>(A)</enum><text>strengthening working relationships between agencies; </text></subparagraph><subparagraph id="id83E6DD0E651C467D9BFBB7FCCB2E0166"><enum>(B)</enum><text>promoting interagency experience; and </text></subparagraph><subparagraph id="idFA1926480EDC4AAABE0A79978E88DD7B"><enum>(C)</enum><text>ensuring the amounts in the Fund enable the use of highly tailored economic incentives to boost the manufacturing of critical public health resources that are vital to effective pandemic preparedness and response in the United States.</text></subparagraph></paragraph><paragraph id="idBF62DFB8CAB54C08910910BCCCEE6113"><enum>(2)</enum><header>Components specified</header><text>The components of the Department of Health and Human Services specified in this paragraph are the following:</text><subparagraph id="id5D7AA94F7EC54278BE038EFEEE3988FA"><enum>(A)</enum><text>The Office of the Assistant Secretary for Preparedness and Response. </text></subparagraph><subparagraph id="id29DD456363F44EE5940B97A04CF38CDC"><enum>(B)</enum><text>The Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="id2F7B13FF0FF84978A1130C24C9F1CBC2"><enum>(C)</enum><text>The National Institutes of Health.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id7D8DA173B5E3466E880A6D6140E05661"><enum>5.</enum><header>Establishment of office in Department of Health and Human Services to administer title III of Defense Production Act of 1950</header><subsection id="id00E8812DA36C4421B75CA67F1EB6A431"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4531">50 U.S.C. 4531</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9945D2079F344C779FB99969BFFEB774"><section id="idF55E032A3ED34B77B091A9022203CF73"><enum>305.</enum><header>Establishment of office in Department of Health and Human Services</header><subsection id="id678613D5247A4CD8930FE2BFA9CFB0FC"><enum>(a)</enum><header>In general</header><text>There is established in the Office of the Assistant Secretary for Preparedness and Response of the Department of Health and Human Services an office (in this section referred to as the <quote>office</quote>) to be responsible for planning for the use of, reporting on, and implementation of authorities of the Department under this title and other provisions of this Act.</text></subsection><subsection id="id9AE4D4230FDE48FFA275414D71C989AA"><enum>(b)</enum><header>Pandemic preparedness and response</header><text>In planning for the use of and implementing authorities under subsection (a), the office shall use highly targeted economic incentives authorized under this Act to boost the manufacturing of critical public health resources that are vital to effective pandemic preparedness and response.</text></subsection><subsection id="idC12F49B215D14665B33C69A460762E6F"><enum>(c)</enum><header>Head of office</header><paragraph id="id5FC3DB62ABCE44DFBB2EADC69A107CB9"><enum>(1)</enum><header>Appointment</header><text>The Secretary of Health and Human Services shall appoint an official of the Department, at the level of Deputy Assistant Secretary or the equivalent, to be the head of the office.</text></paragraph><paragraph id="idDED18D20E4B8408CBBF8407AE3245F85"><enum>(2)</enum><header>Defense Production Act Committee representative</header><text>The head of the office appointed under paragraph (1) shall serve as the representative of the Department of Health and Human Services on the Defense Production Act Committee under section 722.</text></paragraph></subsection><subsection id="id4ee6b3968e6149bf93e60b289671bccd"><enum>(d)</enum><header>Waiver of certain requirements</header><text>The requirements of sections 301(d)(1)(A), 302(d)(1), and subparagraphs (B) and (C) of section 303(a)(6) are waived for purposes of the use of authorities under this Act by the office. </text></subsection><subsection id="id3F3BDD0CFBF44C919B44A416085FA613"><enum>(e)</enum><header>Report required</header><text>Not less frequently than annually, the head of the office shall submit to Congress, and make available on a publicly accessible internet website of the office, a report that includes—</text><paragraph id="id3ec7d935d399410abcdf6d4973ba73a9"><enum>(1)</enum><text>a summary of the work and plans of the office to expand productive capacity and supply responsibilities under this Act during the year preceding submission of the report;</text></paragraph><paragraph id="id9c3b2228b568401eae550ead31eb064b"><enum>(2)</enum><text>an assessment of the elements of the industrial base and technology base in the United States;</text></paragraph><paragraph id="idea89f485e432470eb76d09bd9f846807"><enum>(3)</enum><text>recommendations for appropriate remedial actions under this Act or regulations prescribed to carry out this Act to supply the emerging technologies needed to achieve robust pandemic preparedness and response;</text></paragraph><paragraph id="idd3ca6ad2f02943d68e5e293313cb2060"><enum>(4)</enum><text>recommendations for legislation, regulations, executive orders, or other action by the Federal Government necessary to improve the use of the authorities provided by this Act;</text></paragraph><paragraph id="id5666e5d2949e4a60a54eb862355683c6"><enum>(5)</enum><text>a summary of the findings and recommendations for improving information sharing between departments, agencies, and independent establishments of the Federal Government relating to all aspects of this Act; and</text></paragraph><paragraph id="id613582fae0624d808672b2b0016022dc"><enum>(6)</enum><text>any additional findings or recommendations the office considers appropriate.</text></paragraph></subsection><subsection id="id2D857149C53A4D00928545D07625E809"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary for the establishment of the office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idEBF98AA55DFB4744B6D6BBF4AE497E71"><enum>(b)</enum><header>Conforming amendment</header><text>Section 722(b)(1)(A) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4567">50 U.S.C. 4567(b)(1)(A)</external-xref>) is amended by inserting <quote>except as specified in section 305(c)(2),</quote> before <quote>the head of</quote>.</text></subsection></section><section id="id26CFB737A4C04271B23235B7C5A11543"><enum>6.</enum><header>Report on use of Defense Production Act of 1950 authorities to respond to COVID–19 pandemic</header><subsection id="idDBF86A1A73264E51BA526A791F065F55"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not less frequently than once a month during the period described in subsection (b), the Defense Production Act Committee established under section 722 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4567">50 U.S.C. 4567</external-xref>) shall submit to the appropriate congressional committees and make available on a publicly accessible internet website a report—</text><paragraph id="id94247D2C8CFD42D6BEADECF2F88FAB13"><enum>(1)</enum><text display-inline="yes-display-inline">describing activities carried out under titles I and III of that Act related to efforts to respond to the coronavirus disease 2019 (commonly referred to as <quote>COVID–19</quote>) pandemic; and</text></paragraph><paragraph id="id97C8333732054192BC6815B870C9EA92"><enum>(2)</enum><text>assessing the effectiveness of interagency coordination and the use of resources to respond to the pandemic.</text></paragraph></subsection><subsection id="id849BFFF5286A4B2C837EC172F460CB73"><enum>(b)</enum><header>Period described</header><text>The period described in this subsection is the period—</text><paragraph id="idCABC48AD510643FC964941BE67C69073"><enum>(1)</enum><text>beginning on the date of the enactment of this Act; and</text></paragraph><paragraph id="idC9AA9ECF6345439FA19258779708BA6C"><enum>(2)</enum><text>ending on the date on which the national emergency declared under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to COVID–19 terminates.</text></paragraph></subsection><subsection id="id2FE3E53AA4CC4CC18273E47043F9FE1A"><enum>(c)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives</text></subsection></section></legis-body></bill>
