which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 to repeal a certain disqualification to receive benefits under title IV of the Social Security Act and benefits under the Food and Nutrition Act of 2008; and to amend the Food and Nutrition Act of 2008 to provide that incarcerated individuals who are scheduled to be released from an institution within 30 days shall be considered to be a household for purposes of such Act.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0A7907F49B444AD0AA0D07A6CB73DD28"><section section-type="section-one" id="HEC04DB3EFDDD40A585E8915B03DB99C2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Essentials Available and Lawful (MEAL) Act of 2021</short-title></quote>.</text></section><section id="H302921AA877E4C39B67442F551CCEE83"><enum>2.</enum><header>Tanf assistance and SNAP benefits</header><subsection id="H18D3F6252A0D4C52BFEA73E419A203AA"><enum>(a)</enum><header>Repeal of ban on assistance</header><text>Section 115 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a</external-xref>) is repealed.</text></subsection><subsection id="H3CE78033359B4DECAA9AB03C7A935319"><enum>(b)</enum><header>Effect on State elections To opt out or limit period of prohibition</header><paragraph id="H74A43E98AE854DF3802CB799875AE0BA"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="H8F8F0F4E11F64E56B6B9A3FC052E7021"><enum>(A)</enum><text>the term <quote>State</quote> has the meaning given the term in section 115(e) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a(e)</external-xref>) (as in effect on the day before the date of enactment of this Act); and</text></subparagraph><subparagraph id="H3BFFED92137F4A5DA77C4D67FC2E86F9"><enum>(B)</enum><text>the term <quote>TANF assistance or SNAP benefits</quote> means assistance or benefits referred to in section 115(a) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (as in effect on the day before the date of enactment of this Act).</text></subparagraph></paragraph><paragraph id="HE3CDF1E8EEAC403782413224B3652E61"><enum>(2)</enum><header>Effect on State policies</header><text display-inline="yes-display-inline">Any law enacted by a State under the authority under subparagraph (A) or (B) of subsection (d)(1) of section 115 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a</external-xref>), and any State law, policy, or regulation that imposes conditions on eligibility for the supplemental nutrition assistance program and temporary assistance for needy families program based on an individual’s conviction of an offense related to a controlled substance, shall have no force or effect.</text></paragraph></subsection></section><section id="HD8E44E1ED9EA486C883E42FDB214DC4B"><enum>3.</enum><header>Modification of definition of household for the purpose of determining SNAP benefits</header><text display-inline="no-display-inline">Section 3(m)(5) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(m)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H75875243EE894DA0B89D6E441D22D1DD"><subparagraph id="HDD8329B812AE4552BC258D2F8C35D69B"><enum>(F)</enum><text display-inline="yes-display-inline"> Incarcerated individuals who are scheduled to be released from an institution within 30 days. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
