which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Utility Regulatory Policies Act of 1978 to require the consideration of a standard requiring electric utilities to offer community solar programs to ratepayers.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Establishment of Community Solar Programs Act of 2021</short-title></quote>.</text></section><section id="H34A3D300DF9F4216A1941BF86FDEE2D9"><enum>2.</enum><header>Establishment of community solar programs</header><subsection id="HC27BAA9EE435463D961F9F218E9A4045"><enum>(a)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HF0A0528756DA4FC3A207316F1B7843F0" style="OLC"><paragraph id="HFA8CE19786504C75A3C5866CDFB50E03"><enum>(20)</enum><header>Community solar programs</header><subparagraph id="id33011F3C24DF49D79AA1249C3E14640B"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="idF1202D0A947248BB8F34B5935DA8AC43"><enum>(i)</enum><header>Community solar facility</header><text>The term <term>community solar facility</term> means a solar power generating photovoltaic system (including any related onsite equipment, such as 1 or more energy storage devices) that—</text><subclause id="id5A40ED1094D54E6B96B3A1A88D0E39BB"><enum>(I)</enum><text>has multiple subscribers who receive financial benefits directly attributable to the system;</text></subclause><subclause id="idB495726493524D4391015A3CD2415B81"><enum>(II)</enum><text>is connected to a local distribution circuit of the electric utility;</text></subclause><subclause id="id35D6C67D72D04CE9920B210E72F3720F"><enum>(III)</enum><text>is located either on or off the property of the applicable electric consumers; and</text></subclause><subclause id="id3D1EC6979F954400BF90CE2D1031A1CA"><enum>(IV)</enum><text>may be owned by an electric utility, an electric consumer, or a third party. </text></subclause></clause><clause id="idC3E9C02A02F84CC194B9108E71943433"><enum>(ii)</enum><header>Community solar program</header><text>The term <term>community solar program</term> means a service provided by an electric utility to an electric consumer served by the electric utility through which the full value of electricity generated by a community solar facility may be used to offset charges billed to the electric consumer by the electric utility.</text></clause></subparagraph><subparagraph id="idEB1879CE87694F93ADF2AF57D5E6F813"><enum>(B)</enum><header>Standard</header><clause id="id1EDDABB33ABB4070A4213BA2ADFB4BE9"><enum>(i)</enum><header>Non-Tribal utilities</header><text display-inline="yes-display-inline">Each electric utility that is not a Tribal utility shall offer a community solar program to which all ratepayers of the electric utility, including low-income ratepayers, have equitable and demonstrable access.</text></clause><clause id="id0F86B862E89E4F5DA78C2717C07CDBED"><enum>(ii)</enum><header>Tribal utilities</header><subclause id="idCDD399F43EFA49EF910DD4CC6519B307"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A Tribal utility may offer a community solar program.</text></subclause><subclause id="id4F24D314413C4AE2A90586774C859CE8"><enum>(II)</enum><header>Resources</header><text display-inline="yes-display-inline">A Tribal utility that offers a community solar program may leverage the resources made available to the Tribal utility under this Act to carry out that community solar program.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H501D8BFCEF334C22AC4F235FB1C32B6B"><enum>(b)</enum><header>Compliance</header><paragraph id="H08BF7DBE9979441A9DED6EDBFFFC24B8"><enum>(1)</enum><header>Time limitations</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H3DB67F02603946A5B51416974D1F36FA" style="OLC"><paragraph id="H326048E1539547A481D8BA6D83BD809F"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5AF83CCB76D44D8AB7DD96DF2500B542"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated electric utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph><subparagraph id="H06D5360ADA2B4C8F8C32774524C106E8" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2BC47AA3FFD14CF8B0B64C9717713408"><enum>(2)</enum><header>Failure to comply</header><subparagraph id="H8C08753F47A340F294CA62BB5A177FBE"><enum>(A)</enum><header>In general</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended—</text><clause id="HED9A39A04B244CBABDB64B38656D0C36"><enum>(i)</enum><text>by striking <quote>such paragraph (14)</quote> and all that follows through <quote>paragraphs (16)</quote> and inserting <quote>such paragraph (14). In the case of the standard established by paragraph (15) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (15). In the case of the standards established by paragraphs (16)</quote>; and</text></clause><clause id="HFB3749E754A3424187104ACBF046C0E8"><enum>(ii)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (20).</quote>.</text></clause></subparagraph><subparagraph id="HE9D8FE72BCB6403F993B4C5F1C9BBED7"><enum>(B)</enum><header>Technical correction</header><clause id="H4FDE384C5553414B98737E4D4E7E223B"><enum>(i)</enum><header>In general</header><text>Section 1254(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 971) is amended—</text><subclause id="H1D34B8426B4E411387E76B8CE34333A5"><enum>(I)</enum><text>by striking paragraph (2); and</text></subclause><subclause id="H78B08312C69843578FE797F4AB81DDEB"><enum>(II)</enum><text>by redesignating paragraph (3) as paragraph (2).</text></subclause></clause><clause id="H062ACBD65F9942FC8262008052058110"><enum>(ii)</enum><header>Treatment</header><text>The amendment made by paragraph (2) of section 1254(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 971) (as in effect on the day before the date of enactment of this Act) is void, and section 112(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(d)</external-xref>) shall be in effect as if that amendment had not been enacted.</text></clause></subparagraph></paragraph><paragraph id="HD49F6587244843ADB2C328AF3562611D"><enum>(3)</enum><header>Prior State actions</header><subparagraph id="HA88709842DDA457D9726DE56453B91E9"><enum>(A)</enum><header>In general</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H168974EC0AB844D9BB2C69BE9EE218C4" style="OLC"><subsection id="H9A6DAE2C440945E2A8392E88BF268C88"><enum>(g)</enum><header>Prior State actions</header><text>Subsections (b) and (c) shall not apply to the standard established by paragraph (20) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="H14D04F9258834D4296359B5A0D981801"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="H77856BAA17E24D118EF3E997E1921A09"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="HA5613928D96F4955A9B888168D4AD235"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5468CF1C50A640FCB5DF1B2A3917C8EE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Cross-reference</header><text>Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended—</text><clause display-inline="no-display-inline" commented="no" id="idCFC9DA7C0F7E4A1AB619ED9F0588A0A4"><enum>(i)</enum><text>by striking <quote>this subsection</quote> each place it appears and inserting <quote>this section</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id63E3AF28E06D471E9B17D9CD0E4F1D55"><enum>(ii)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this section to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (20).</quote>. </text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
