which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the National Oceanic and Atmospheric Administration to award grants to certain entities for purposes of carrying out climate-resilient living shoreline projects that protect coastal communities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id051D968D2DFC46CC8AF6462D42572E3A"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration. </text></paragraph><paragraph id="idD04D6D57E79A4D288D469CF674740BA5"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" id="id862FEDBA1CC84FBE900925AB13970B76"><enum>(3)</enum><header>Nature-based infrastructure</header><text>The term <term>nature-based infrastructure</term> means a feature that is created by human design, engineering, and construction to provide risk reduction in coastal areas by acting in conjunction with natural processes.</text></paragraph><paragraph id="idA45EAEC0EDF040DB9B249EAFC3C35BC5" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph></section><section section-type="subsequent-section" id="id913A7688C5024A19B14B34C0CA2E343F"><enum>2.</enum><header>Living shoreline grant program</header><subsection id="idaa86fc56aa3949879af8e3b39700fd4c"><enum>(a)</enum><header>Establishment</header><text>The Administrator shall award grants to eligible entities for purposes of—</text><paragraph id="id20787e0171584770936cea20fc74e123"><enum>(1)</enum><text>designing and implementing large- and small-scale, climate-resilient living shoreline projects; and</text></paragraph><paragraph id="ide48b1ef236854bf8a08bf55e00504705"><enum>(2)</enum><text>applying innovative uses of natural materials and systems to protect coastal communities, habitats, and natural system functions.</text></paragraph></subsection><subsection id="idC46BB6F0B05641E5B675B0D45D80D082"><enum>(b)</enum><header>Eligible entities</header><text>For purposes of this section, an eligible entity is any of the following: </text><paragraph id="idE884C141D0DF444F972EAC51CA95EF2C"><enum>(1)</enum><text>A unit of a State or local government.</text></paragraph><paragraph id="id0EFBE5F1AF56446BA4AA267AD6404F2D"><enum>(2)</enum><text>An organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 that is exempt from taxation under section 501(a) of such Code.</text></paragraph><paragraph id="idEC459B8CEAF742B6BE13C927FD8D0FAF" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>An Indian Tribe. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id92D36843E7904FDCA154C6EC2F1EFB83"><enum>(c)</enum><header>Living shoreline projects</header><paragraph display-inline="no-display-inline" commented="no" id="idB116CBC5BDF0448DBE0A5953E84968FA"><enum>(1)</enum><header>In general</header><text>For purposes of this section, a living shoreline project is a coastal natural infrastructure project that—</text><subparagraph id="idF2D12E2D74554475857BBA6E65CB8A85"><enum>(A)</enum><text>restores or stabilizes a shoreline using predominately natural materials to create buffers to attenuate the impact of coastal storms, currents, flooding, and wave energy and to prevent or minimize shoreline erosion while providing a net ecological and climate benefit to ecosystems and habitats; </text></subparagraph><subparagraph id="id0D9CBA976E574BF6A79AD0B2E3E08E9E" commented="no"><enum>(B)</enum><text>to the extent possible, maintains or restores existing natural slopes and connections between uplands and adjacent wetlands or surface waters; </text></subparagraph><subparagraph id="idD2EF43E5B0034C61AE426FF5B6EC541B" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>as necessary, can retrofit hardened structures or surfaces to create blended projects that combine living shoreline elements with hardened techniques; and </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id212A1F03A3B746B98B7D4E45EA3D9784"><enum>(D)</enum><text>meets such minimum standards as the Administrator shall develop. </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idA808AB22F50644ED87D729DAA4A54F5E"><enum>(2)</enum><header>Minimum standards</header><subparagraph display-inline="no-display-inline" commented="no" id="idFAB3F33A7A0547DD95EC24594F21E68F"><enum>(A)</enum><header>In general</header><text>In developing minimum standards applicable to living shoreline projects under paragraph (1)(D), the Administrator shall take into account—</text><clause id="idEE965FE6D94E4C5C8926FB52EAC6E953"><enum>(i)</enum><text>the considerations described in subsection (e)(2); and </text></clause><clause id="id94DE31941EC5411FA0B43B864B657874" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the need for the standards to be general enough to accommodate concerns related to specific project sites. </text></clause></subparagraph><subparagraph id="idDC4D87610B7144B1874D6148AC95B406"><enum>(B)</enum><header>Consultation; input</header><text>In developing minimum standards applicable to living shoreline projects under (1)(D), the Administrator may—</text><clause id="idE5DB6D0DC0CE453AA5CB6ED19E84FC64"><enum>(i)</enum><text>consult with—</text><subclause id="id0F63F740EA0246A4946988FA0E943308"><enum>(I)</enum><text>State coastal management agencies; </text></subclause><subclause id="id3D66A92E4ABB4DF28BD36EFC8F129C16"><enum>(II)</enum><text>Indian Tribes and Tribal organizations; and</text></subclause><subclause id="idA2FCDFD813CE4D3B958D8D4F7F72E4D2"><enum>(III)</enum><text>relevant interagency councils, such as the Estuary Habitat Restoration Council; and </text></subclause></clause><clause id="id170C5367C5204BCF8997FA75F1FAD68E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>seek input from relevant nongovernmental organizations. </text></clause></subparagraph></paragraph></subsection><subsection id="id9561a6ac659443a59ff98cb8fb41fab0"><enum>(d)</enum><header>Project proposals</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Administrator a proposal for a living shoreline project that includes— </text><paragraph id="idE4FA94921A93402FA96183621FA065AC"><enum>(1)</enum><text>monitoring, data collection, and measurable performance criteria with respect to the project; and</text></paragraph><paragraph id="id46d0941581c0473c9ce84ace39d86f06"><enum>(2)</enum><text>an engagement or education component that seeks and solicits feedback from the local or regional community most directly affected by the proposal.</text></paragraph></subsection><subsection id="idEF74131CFA8546DEA7C361D180A1D6FC"><enum>(e)</enum><header>Selection</header><paragraph id="id1C59AE5F33FA4135AFF50F1F808573D7"><enum>(1)</enum><header>In general</header><text>The Administrator shall select eligible entities to receive grants under this section to carry out living shoreline projects based on criteria developed by the Administrator.</text></paragraph><paragraph id="idd1bf1764b7a941988e251d4d33ff4144"><enum>(2)</enum><header>Considerations</header><text>In developing criteria under paragraph (1), the Administrator shall take into account—</text><subparagraph id="idf2c068e768bb40c2aef141f4d5cfb473"><enum>(A)</enum><text>the potential of the project proposed by the eligible entity to protect the community and maintain the viability of the environment, such as through protection of ecosystem functions, environmental benefits, or habitat types, in the area where the project is to be carried out;</text></subparagraph><subparagraph id="idfe34e2c38a8f4c70aaf856849d045256"><enum>(B)</enum><text>the historic and future environmental conditions of the project site, particularly those environmental conditions affected by climate change;</text></subparagraph><subparagraph id="id4234a6d6c22d40ce9aa028f6a2720bb4"><enum>(C)</enum><text>the net ecological benefits of the project, including the potential of the project to contribute to carbon sequestration and storage;</text></subparagraph><subparagraph id="id49fefa7c46164806bbb01fb524d8be2f"><enum>(D)</enum><text>the ability of the entity proposing the project to demonstrate the potential of the project to protect the coastal community where the project is to be carried out, including through—</text><clause id="id243eea936791447ba67e1b27853fdcee"><enum>(i)</enum><text>mitigating the effects of erosion;</text></clause><clause id="id8566149ee84b472b8f8eb0e18c2231fe"><enum>(ii)</enum><text>attenuating the impact of coastal storms and storm surge;</text></clause><clause id="idc567f7946cfc40eaa2ee8a3767f75b77"><enum>(iii)</enum><text>mitigating shoreline flooding;</text></clause><clause id="id8b79ff8aa60b4d3580452691cdd8ac3f"><enum>(iv)</enum><text>mitigating the effects of sea level rise, accelerated land loss, and extreme tides;</text></clause><clause id="ide1551be28c8a4c17a444cfce1b8ecdf9"><enum>(v)</enum><text>sustaining, protecting, or restoring the functions and habitats of coastal ecosystems;</text></clause><clause id="idb9684f3bc53641a6b02c8c36a70bafdb"><enum>(vi)</enum><text>protecting important cultural sites or values;</text></clause><clause id="id10b6e8704bcb45099b1d11cf48bb9cac"><enum>(vii)</enum><text>protecting low-income communities, communities of color, Tribal communities, Indigenous communities, and rural communities;</text></clause><clause id="idb5f53ee876484519a68e305b2446742d"><enum>(viii)</enum><text>sustaining, protecting, or restoring the functions and habitats of marine protected areas; or</text></clause><clause id="idd499a28581474b7b8fcce65a12c9285b"><enum>(ix)</enum><text>such other forms of protection as the Administrator considers appropriate; and</text></clause></subparagraph><subparagraph id="id7f2ea0ed7b824731bd128ec30aa5a5c6"><enum>(E)</enum><text>the potential of the project to support climate resiliency at a military installation or community infrastructure supportive of a military installation (as such terms are defined in section 2391 of title 10, United States Code).</text></subparagraph></paragraph></subsection><subsection id="idb084e1af49cc4dccbf3968d4e6e352ea"><enum>(f)</enum><header>Use of funds</header><text>A grant awarded under this section to an eligible entity to carry out a living shoreline project may be used by the eligible entity only—</text><paragraph id="id114d5f22b29147fe8b70fbddfc336090"><enum>(1)</enum><text>to carry out the project, including administration, design, permitting, entry into negotiated indirect cost rate agreements, and construction;</text></paragraph><paragraph id="id69b2c6cc8bca48b3b6ef1d8d56cbd280"><enum>(2)</enum><text>to monitor, collect, and report data on the performance (including performance over time) of the project, in accordance with the standards developed by the Administration under subsection (c)(1)(D); or</text></paragraph><paragraph id="id256508df119844a9a7e207b786b62b07"><enum>(3)</enum><text>to incentivize landowners to engage in living shoreline projects.</text></paragraph></subsection><subsection id="id5274f3161ab4421c9387fef5221a426e"><enum>(g)</enum><header>Monitoring and reporting</header><paragraph id="id722c1f8f2a0349fe80ecf56f00cf8867"><enum>(1)</enum><header>In general</header><text>The Administrator shall require each eligible entity that receives a grant under this section to carry out a living shoreline project (or a representative of the entity)—</text><subparagraph id="idde5db98a56984273809b1d47dd9be267"><enum>(A)</enum><text>to monitor the project and to collect data on— </text><clause id="id0C27D4EB665740E88A3C84F0BD0FA382"><enum>(i)</enum><text>the ecological, climate, and economic benefits of the project; and </text></clause><clause id="idBCA0767FB6E64735AF31A011D8885228"><enum>(ii)</enum><text>the protection provided by the project for the coastal community where the project is carried out; </text></clause></subparagraph><subparagraph id="id0204b938813549009714971b2b3c97ae"><enum>(B)</enum><text>to transmit to the Administrator data collected under the project; </text></subparagraph><subparagraph id="id0d276e8bb6744e069ebe915ec8fb921e"><enum>(C)</enum><text>to make data collected under the project available on a publicly accessible internet website of the National Oceanic and Atmospheric Administration; and</text></subparagraph><subparagraph id="idb7fcf6c54ffb410d8b2b3e624fb19f48"><enum>(D)</enum><text>upon the completion of the project, to submit to the Administrator a report on—</text><clause id="ide0e5595a302f428fba03cac478053d5a"><enum>(i)</enum><text>the monitoring and data collection activities carried out under subparagraph (A); and</text></clause><clause id="id446886744b7d484aba90ee7597f082a6"><enum>(ii)</enum><text>the effectiveness of the project in increasing protection of the coastal community where the project is carried out through living shorelines techniques, including—</text><subclause id="id2cf1ce5ff912459e8231d1fb65db8a02"><enum>(I)</enum><text>a description of—</text><item id="id555f81337ab246d9a3f8a2d2c1c99420"><enum>(aa)</enum><text>the project;</text></item><item id="id741bba53ea01444ebf808ac45d24acf3"><enum>(bb)</enum><text>the activities carried out under the project; and</text></item><item id="id610a8e17902f4177b482b60e1288bfda"><enum>(cc)</enum><text>the techniques and materials used in carrying out the project; and</text></item></subclause><subclause id="id83b81a55160c43c39b6f9241d416c983"><enum>(II)</enum><text>data on the performance of the project in providing protection to that coastal community.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id03a3f73508e74b3383ea384ce53bfb1a"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator $50,000,000 for each of fiscal years 2022 through 2026 for purposes of carrying out this section.</text></subsection></section><section id="id01a140f08fde47a687971bd4184c517f"><enum>3.</enum><header>Living shoreline and nature-based infrastructure research program</header><subsection id="ida562b9a1659e4ef49f5b4a6177e0a0ff"><enum>(a)</enum><header>Establishment</header><text>The Administrator shall award, on a competitive basis, research grants to eligible entities to carry out projects focused on developing and assessing the effectiveness of innovative approaches to nature-based infrastructure for the purposes of—</text><paragraph id="idd6dbb4814eda41a9b82a96e81ea93516"><enum>(1)</enum><text>preparing more climate-resilient, sustainable cities and climate-resilient communities;</text></paragraph><paragraph id="id313de921d262448a9edd7284c959e11e"><enum>(2)</enum><text>reducing the costs associated with climate-related disasters, the degradation of built infrastructure, and human relocation; and</text></paragraph><paragraph id="id1fb67fe951844b639b1efe22c1237215"><enum>(3)</enum><text>accomplishing improved climate resilience while maintaining ecosystem functions and habitats to the greatest extent possible.</text></paragraph></subsection><subsection id="id7ccbd66b645842429b57d42b0c09fe8b" commented="no"><enum>(b)</enum><header>Eligible entities</header><text>For purposes of this section, an eligible entity is any of the following: </text><paragraph commented="no" id="id665BD625BCB54E18B3E9DDE25980BD17"><enum>(1)</enum><text>An institution of higher education. </text></paragraph><paragraph commented="no" id="id2ED3609E180945D49AF96DF3BE86D9DC"><enum>(2)</enum><text>A nonprofit organization. </text></paragraph><paragraph commented="no" id="id7E10E41E5E9A49C5950CE5A13D462544"><enum>(3)</enum><text>A State, local, or Tribal government. </text></paragraph><paragraph commented="no" id="idA0A13EE8890948C0A147312A72FC09F5"><enum>(4)</enum><text>A for-profit organization. </text></paragraph><paragraph commented="no" id="idA601F2F0C5AB4EE4AE121342B29D45DF"><enum>(5)</enum><text>A United States territory. </text></paragraph><paragraph commented="no" id="idFA79E4C2B0114DC9BF762EC7D4E2FBAC"><enum>(6)</enum><text>A Federal agency that is authorized by statute to receive transfers of funds.</text></paragraph></subsection><subsection id="idfc4cdce731bc43ddb759980e7d62bdd8" commented="no"><enum>(c)</enum><header>Research priorities</header><text>The Administrator shall award grants to eligible entities for projects that focus on one or more of the following:</text><paragraph id="id684eee9e91b84527a1cabcd181757fa1" commented="no"><enum>(1)</enum><text>Assessing the effectiveness of installed nature-based infrastructure in addressing, as applicable, coastal resilience, shoreline erosion, storm damage, including windstorms, inland flooding, water quality, impact on local ecosystems, and such other criteria as the Administrator determines appropriate. </text></paragraph><paragraph id="id15380c1a3b50479f93b50ee03b5b360d" commented="no"><enum>(2)</enum><text>Novel approaches to nature-based infrastructure and living shorelines aimed at optimizing resilience to climate change, extreme weather, and ecosystem sustainability.</text></paragraph><paragraph id="idd0b735633ba0428daec40696b7653d95" commented="no"><enum>(3)</enum><text>Interdisciplinary research, including engineering, environmental and ecosystem sciences, biology, and social science.</text></paragraph><paragraph id="id3a440ea00da2404386e9a2b0fa2ae8de" commented="no"><enum>(4)</enum><text>Regional, community, and industry partnerships to create locally informed solutions.</text></paragraph></subsection><subsection id="id91d4adccca1f4aff8ca91706d105dabc"><enum>(d)</enum><header>Reports for informing grant selection</header><paragraph id="id15BC005753694AAFB6B4E58C3160D4B6"><enum>(1)</enum><header>Report required</header><text>An eligible entity that receives a grant for a project under this section shall, not later than the date on which such project concludes, submit to the Administrator a report summarizing the findings of the project. </text></paragraph><paragraph id="idFE406F1B898C43C68D3CB5131F2E2A43"><enum>(2)</enum><header>Use of reports</header><text>The Administrator shall use each report submitted under paragraph (1) to inform the selection and prioritization of living shoreline projects under section 2 and other nature-based infrastructure projects.</text></paragraph></subsection><subsection id="id55e68e7b7e9949b9bc1101f89319df17"><enum>(e)</enum><header>Use of programs</header><text display-inline="yes-display-inline">In carrying out this section, the Administrator is encouraged to use— </text><paragraph id="id6b29b67ae2e74d599d60b7a6d8b06cbd"><enum>(1)</enum><text>the National Oceanographic Partnership Program established under section 8931 of title 10, United States Code, as a means for collaboration and coordination to leverage partnerships between public institutions of higher education and Federal agencies;</text></paragraph><paragraph id="id20b3e239f16843d6814ce45b4faab2cf"><enum>(2)</enum><text>the Coastlines and People initiative of the National Science Foundation as a tool to use ongoing interdisciplinary research;</text></paragraph><paragraph id="id0b3f124fa4d4443c8942b1b2b8960a3f"><enum>(3)</enum><text>the National Sea Grant College Program maintained under the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1121">33 U.S.C. 1121 et seq.</external-xref>) as a resource to help foster collaboration between public institutions of higher education and Federal agencies; and</text></paragraph><paragraph id="id083667882d274696a0d6b470c5e8732d"><enum>(4)</enum><text>the Community Resilience Center of Excellence of the National Institute of Standards and Technology.</text></paragraph></subsection><subsection id="id2c154a3a72284ab0a9e83951f498463d"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator $5,000,000 for each of fiscal years 2022 through 2026 for purposes of carrying out this section. </text></subsection></section></legis-body></bill>
