<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2632</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210805">August 5, 2021</action-date></action><action><action-desc><sponsor name-id="S316">Mr. Whitehouse</sponsor> (for himself and <cosponsor name-id="S318">Mr. Wicker</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to include doping fraud as a predicate offense for racketeering and money laundering offenses, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guarantee Oversight and Litigation on Doping Act</short-title></quote> or the <quote><short-title>GOLD Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id654F71C07BAB4D21BF31339D6A718D3C"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="iddf0050daadcd4f24ac8744c95fa0677a"><enum>(1)</enum><text>the punishment of Russia for persistent decades-long state-run doping fraud by the international sport governance structure has been insufficient and Russia's competing status as <quote>ROC</quote> at Tokyo 2020 demonstrates to authoritarian states around the world that systematic doping will be tolerated; and</text></paragraph><paragraph id="id298e8e8737f24a86961582e1f870f25e"><enum>(2)</enum><text>aggressive enforcement of the Rodchenkov Anti-Doping Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/21/2401">21 U.S.C. 2401 et seq.</external-xref>) can create the deterrent required to curb doping fraud as the Foreign Corrupt Practices Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/15/78dd-1">15 U.S.C. 78dd–1 et seq.</external-xref>) curbed foreign bribery and the Department of Justice and the Federal Bureau of Investigation should prioritize enforcement of the Rodchenkov Anti-Doping Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/21/2401">21 U.S.C. 2401 et seq.</external-xref>).</text></paragraph></section><section id="id825B980B6A1F461F9ABB9F09509DD75D"><enum>3.</enum><header>Predicate offenses</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended—</text><paragraph id="id46317748455647158DA80E590A19F0CE"><enum>(1)</enum><text>in section 1956(c)(7)(D)—</text><subparagraph id="id7df381328137448d97dff792756c454d"><enum>(A)</enum><text>by striking <quote>or section 104(a)</quote> and inserting <quote>section 104(a)</quote>; and </text></subparagraph><subparagraph id="id0F3BDC96952740F498FE9125BC56500F"><enum>(B)</enum><text>by inserting after <quote>North Korea)</quote> the following: <quote>, or section 3 of the Rodchenkov Anti-Doping Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/21/2402">21 U.S.C. 2402</external-xref>) (relating to prohibited activities with respect to major international doping fraud conspiracies)</quote>; and</text></subparagraph></paragraph><paragraph id="idf11b9b3af7f8427c9a23c9312d3f817a"><enum>(2)</enum><text>in section 1961(1)—</text><subparagraph id="id8D26F2A9C8354E63904EF736516BD09B"><enum>(A)</enum><text>by striking <quote>or (G) any act</quote> and inserting <quote>(G) any act</quote>; and</text></subparagraph><subparagraph id="id70B02F0D64A04D4BA71F4D155522D0E6"><enum>(B)</enum><text>by inserting after <quote>section 2332(b)(g)(5)(B)</quote> the following: <quote>, or (H) any act that is indictable under section 3 of the Rodchenkov Anti-Doping Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/21/2402">21 U.S.C. 2402</external-xref>)</quote>. </text></subparagraph></paragraph></section></legis-body></bill>
