Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to improve assistance for veterans with travel necessary for counseling, mental health services, health care, and others services furnished by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Veterans Travel Enhancement Act of 2021</short-title></quote>.</text></section><section id="id320540012f3644d2809fb3848997648e"><enum>2.</enum><header>Making permanent authority for secretary of veterans affairs to transport individuals to and from department facilities</header><text display-inline="no-display-inline">Section 111A(a) of title 38, United States Code is amended—</text><paragraph id="id8414bb1ca7294561808d0e1a64b026d2"><enum>(1)</enum><text>by striking paragraph (2); and</text></paragraph><paragraph id="id03e0c8662d9545e2b26714d27e84c967"><enum>(2)</enum><text>in paragraph (1), by striking <quote>(1)</quote>.</text></paragraph></section><section id="id68d7c07a8570455a96aa57c8f4447639"><enum>3.</enum><header>Permanent extension of authorization of appropriations for grants for veterans service organizations for transportation of highly rural veterans</header><text display-inline="no-display-inline">Section 307(d) of the Caregivers and Veterans Omnibus Health Services Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/163">Public Law 111–163</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1710">38 U.S.C. 1710</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57a428ca73a24cafb7fdb00184cdc716"><subsection id="ideccc5df83f4449c584b9e7ee3db8ef82"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section amounts as follows:</text><paragraph id="id00370708c748458ebf7fd90364a7d6bc"><enum>(1)</enum><text>$3,000,000 for each of fiscal years 2010 through 2022.</text></paragraph><paragraph id="id43e91da5cc5e4625b338dacfd6413a3e"><enum>(2)</enum><text>Such sums as may be necessary for fiscal year 2023 and each fiscal year thereafter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id814f62e4e3244737ab8f7d4164685888"><enum>4.</enum><header>Comptroller General of the United States report on fraud, waste, and abuse of the Department of Veterans Affairs beneficiary travel program</header><subsection id="id37bb3083c1b14dad8b14744bf7dabea5"><enum>(a)</enum><header>Study and report required</header><text>Not later than three years after the date of the enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="idf91936cd0e194589aefb498c45ac7b05"><enum>(1)</enum><text>complete a study on fraud, waste, and abuse of the benefits furnished under section 111 of title 38, United States Code, that may have occurred during the five-year period ending on the date of the enactment of this Act; and</text></paragraph><paragraph id="id05f0ac7ef3be48529dbfb6ad96cf9dde"><enum>(2)</enum><text>submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the findings of the Comptroller General with respect to the study completed under paragraph (1).</text></paragraph></subsection><subsection id="id86c5851d17cd41f0a1e84f831f23b5e9"><enum>(b)</enum><header>Elements</header><text>Study conducted under subsection (a)(1) shall cover the following:</text><paragraph id="idbfe5d139481e4dee89914abbbf37c7b2"><enum>(1)</enum><text>The quantity and monetary amount of claims that have been adjudicated as fraudulent or improper, disaggregated, to the extent possible, by general health care travel and by special mode of transportation.</text></paragraph><paragraph id="id6eb627393cdb4a3eb5fbbec4ac6a7b61"><enum>(2)</enum><text>Instances of potential fraud or improper payments that may have occurred but were not detected, disaggregated, to the extent possible, by general health care travel and by special mode of transportation.</text></paragraph><paragraph id="idd1816d9ac24b410e812fc6547c8a1504"><enum>(3)</enum><text>The efforts of the Secretary of Veterans Affairs to mitigate fraud and the effectiveness of the efforts of the Secretary.</text></paragraph><paragraph id="id627ea8e4602f4e03b6c3926273fe09fe"><enum>(4)</enum><text>Assessment of communication and training provided by the Department of Veterans Affairs to employees and contractors handling claims filed under section 111 of such title regarding fraud.</text></paragraph><paragraph id="id161702cf54c14415bb10ac29e0555971"><enum>(5)</enum><text>Such recommendations as the Comptroller General may have for further mitigation of fraud, waste, and abuse.</text></paragraph></subsection></section><section id="id39699071993f461e9bf1864a838c6f86"><enum>5.</enum><header>Comptroller General study and report on effectiveness of Department of Veterans Affairs beneficiary travel program mileage reimbursement and deductible amounts</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="id0de82370eb764db7b817c69f9ddf01c5"><enum>(1)</enum><text>complete a study on—</text><subparagraph id="ide180afb916984e338f5723806e07a9dc"><enum>(A)</enum><text>the efficacy of the current mileage reimbursement rate under subsection (a) of section 111 of title 38, United States Code, in mitigating the financial burden of transportation costs for traveling to and from Department of Veterans Affairs medical facilities for medical care;</text></subparagraph><subparagraph id="id52013e40ac3b40a0ae0961eed1e705b6"><enum>(B)</enum><text>the origins of the amount of the deductible under subsection (c) of such section and its impact on the efficacy of the benefits provided under such section in mitigating financial burden on veterans seeking medical care; and</text></subparagraph><subparagraph id="idbfccbb5c73dc4cb5a4b97ee270f5ca6a"><enum>(C)</enum><text>developing such recommendations as the Comptroller General may have for how the this program or another transportation assistance program could further encourage veterans, especially low-income veterans, to seek medical care, especially mental health care; and</text></subparagraph></paragraph><paragraph id="id1525232aa7bc46f7b803d0ec18bd1621"><enum>(2)</enum><text>submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the findings of the Comptroller General with respect to the study completed under paragraph (1).</text></paragraph></section><section id="idc8291b5e59ba42d0b6b00ff2ec1bbb9e"><enum>6.</enum><header>Department of Veterans Affairs transportation pilot program for low income veterans</header><subsection id="id96ba9139a9d849b6b78c1566faf3e2f7"><enum>(a)</enum><header>Pilot program required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall commence carrying out a pilot program to assess the feasibility and advisability of providing payments authorized under subsection (a) of section 111 of title 38, United States Code, 48 hours in advance of travel to eligible appointments to veterans and other eligible individuals who are also eligible for a deduction waiver as provided by paragraphs (3) and (4) of subsection (c) of such section.</text></subsection><subsection id="idb874b1fe55c24b30808c0bc9f73bafb9"><enum>(b)</enum><header>Duration</header><text>The Secretary shall carry out the pilot program during the five-year period beginning on the date of the commencement of the pilot program.</text></subsection><subsection id="idE7333E79ABDE4DFFBF809A30E80FFCFE"><enum>(c)</enum><header>Locations</header><text>The Secretary shall carry out the pilot program at not fewer than five locations selected by the Secretary for purposes of the pilot program.</text></subsection><subsection id="idb678debdc03848c2ab147be8663e3452" commented="no"><enum>(d)</enum><header>Report</header><paragraph id="idceb4233d36714f3197871907dc20bbcf" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the completion of the pilot program, the Secretary shall submit to Congress a report on the findings of the Secretary with respect to the pilot program.</text></paragraph><paragraph id="id848b6787885a45339d1daf95be088e70" commented="no"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall include the following:</text><subparagraph id="id3dd47758c01345559111a97bd0d2afdc" commented="no"><enum>(A)</enum><text>The number of individuals who benefitted from the pilot program broken, disaggregated by geographic location, race or ethnicity, age, disability rating, and gender.</text></subparagraph><subparagraph id="idc0afb35c1c504a72a5ee76a8276d1c01" commented="no"><enum>(B)</enum><text>Average distance traveled by participants to appointments and average funds provided per appointment, disaggregated by geographic region.</text></subparagraph><subparagraph id="id6acd666f4bdb4dd7af308c1fe0dca2bc" commented="no"><enum>(C)</enum><text>A description of any impediments to carrying out the pilot program.</text></subparagraph><subparagraph id="ida150bdbee34349e0b4363858992ad072" commented="no"><enum>(D)</enum><text>An account of payments provided for travel that did not occur or was authorized incorrectly.</text></subparagraph><subparagraph id="id05b9fbdb56f44bf4952af1d62c0e9453" commented="no"><enum>(E)</enum><text>An account of any attempts to retrieve such payment.</text></subparagraph><subparagraph id="id58495c239083453e9e86d1f9696eaaff" commented="no"><enum>(F)</enum><text>Recommendations of the Secretary for legislative or administrative action to reduce improper payments.</text></subparagraph><subparagraph id="id2fc98ca1b5274215a6764c84dc819d67" commented="no"><enum>(G)</enum><text>An assessment of the feasibility and advisability of providing payments as described in subsection (a).</text></subparagraph></paragraph></subsection></section><section id="idae38bf226eb54d999de0d6952f6d4b36"><enum>7.</enum><header>Pilot program for travel cost reimbursement for accessing readjustment counseling services</header><subsection id="id0dd510ca83c4499488d828a25dba4802"><enum>(a)</enum><header>Pilot program required</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish and commence a pilot program, within the Readjustment Counseling Services of the Veterans Health Administration, to assess the feasibility and advisability of paying the actual necessary expenses of travel or allowances for travel to and from the nearest Vet Center.</text></subsection><subsection id="idB2C156BA3CD0456891C4D4924747B52C"><enum>(b)</enum><header>Participation</header><paragraph id="id92EBE6F7054C4F329444EFA271E7994F"><enum>(1)</enum><header>In general</header><text>In carrying out the pilot program required by subsection (a), the Secretary shall limit participation—</text><subparagraph id="id28B965E6A11548409B95E0AF1486643C"><enum>(A)</enum><text>by individuals pursuant to paragraph (2); and</text></subparagraph><subparagraph id="id520678201CA14D08B790E6F85350A248"><enum>(B)</enum><text>by Vet Centers pursuant to paragraph (3).</text></subparagraph></paragraph><paragraph id="id10F91546291445A0BB7B51E50D91BF20"><enum>(2)</enum><header>Participation by individuals</header><subparagraph id="idB4262CF1B8EE4CE7AE976936D772FD4F"><enum>(A)</enum><header>In general</header><text>The Secretary shall limit participation in the pilot program of individuals to individuals who are eligible for services at a participating Vet Center and experiencing financial hardship.</text></subparagraph><subparagraph id="idFAF3DE2671334CF6ADF79CDC92D2F17B"><enum>(B)</enum><header>Financial hardship</header><text>The Secretary shall determine the meaning of <quote>financial hardship</quote> for purposes of subparagraph (A).</text></subparagraph></paragraph><paragraph id="idca63334fc9a044bcae40138870a91842"><enum>(3)</enum><header>Participation of Vet Centers</header><text>Vet Centers participating in the program shall be chosen by the Secretary from among those serving individuals in areas designated by the Secretary as rural or highly rural or Tribal lands.</text></paragraph></subsection><subsection id="idA0B02FDC9464418983FC83DD89F564BD"><enum>(c)</enum><header>Travel allowances and reimbursements</header><paragraph id="id36020DDA54AE4C08AE9869E6651F3039"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), under the pilot program required by subsection (a), the Secretary shall provide a participating individual a travel allowance or reimbursement a minimum of 48 hours before the participating individual is scheduled to be at a participating Vet Center.</text></paragraph><paragraph id="idDC7E19DB67FD4D20B7DA6E3747B8169B"><enum>(2)</enum><header>Special case</header><text>For appointments scheduled less than 48 hours in advance, reimbursements shall be made available under the pilot program for a participating individual at the earliest time possible.</text></paragraph></subsection><subsection id="id9A1B006A46424FAE95908E765C2CD44D"><enum>(d)</enum><header>Duration</header><text>The Secretary shall carry out the pilot program required by subsection (a) during the five-year period beginning on the date of the commencement of the pilot program. </text></subsection><subsection id="id852866FB10CA47C4816079C191B025C8"><enum>(e)</enum><header>Locations</header><text>The Secretary shall carry out the pilot program at not fewer than five locations selected by the Secretary for purposes of the pilot program. </text></subsection><subsection id="id3c1d283cd00045859beb71bee4c84d37"><enum>(f)</enum><header>Annual reports</header><paragraph id="id70B7168309E348B694A506545342F1A3"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of the commencement of the pilot program required by subsection (a) and each year thereafter for the duration of the pilot program, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the findings of the Secretary with respect to the pilot program.</text></paragraph><paragraph id="id5dd88dd8c7c54b749c9e219a06f16763" commented="no"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include the following:</text><subparagraph id="id173E7C8795EC49E7817E2A323AB265A8" commented="no"><enum>(A)</enum><text>The number of individuals who benefitted from the pilot program, dis­aggregated by age, race or ethnicity, and gender, to the extent possible.</text></subparagraph><subparagraph id="id402FA805E5DC4192BFC11B2BABC37E36" commented="no"><enum>(B)</enum><text>The average distance traveled by each individual per each Vet Center.</text></subparagraph><subparagraph id="id9BD44913FC8345B2AE708C18750D44E7" commented="no"><enum>(C)</enum><text>The definition of financial hardship determined by the Secretary under subsection (b)(2)(B).</text></subparagraph><subparagraph id="idE9691A7E3644481882483C3AF75CC32A" commented="no"><enum>(D)</enum><text>A description of how the funds are distributed.</text></subparagraph><subparagraph id="id7ED68901D52046A5817DE22EBCFDE7C9" commented="no"><enum>(E)</enum><text>The average amount of funds distributed per instance, disaggregated by Vet Center.</text></subparagraph><subparagraph id="id20D7F41C8B24453B8E46AED4FB501D02" commented="no"><enum>(F)</enum><text>A description of any impediments to the Secretary in paying expenses or allowances under the pilot program.</text></subparagraph><subparagraph id="idA1F6A36BAC614A3EA760C8C33239AE4B" commented="no"><enum>(G)</enum><text>An assessment of any fraudulent receipt of payment under the pilot program and the recommendations of the Secretary for legislative or administrative action to reduce such fraud.</text></subparagraph><subparagraph id="id9988A922D80D498E90F1A9F317063345" commented="no"><enum>(H)</enum><text>Such recommendations for legislative or administrative action as the Secretary considers appropriate with respect to the payment of expenses or allowances.</text></subparagraph></paragraph></subsection><subsection id="id22f77b3a6bac42c690599da73e9a92cd"><enum>(g)</enum><header>Vet Center defined</header><text>In this section, the term <term>Vet Center</term> means a center for readjustment counseling and related mental health services for veterans under section 1712A of title 38, United States Code. </text></subsection></section><section id="idDC86C8C835D24547993B10812A2BAF8A"><enum>8.</enum><header>Pilot program on grants to improve public transportation services for veterans</header><subsection id="id54F53CAF0C7A4D2B911EFB71C9BB422A"><enum>(a)</enum><header>Grant program required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall commence carrying out a pilot program to assess the feasibility and advisability of awarding grants to eligible entities to improve public transportation services for veterans. </text></subsection><subsection id="id40702C46CE4B402882D5E1D880380263"><enum>(b)</enum><header>Duration</header><text>The Secretary shall carry out the pilot program during the five-year period beginning on the date on which the pilot program commences.</text></subsection><subsection id="id97602c732c4f47aab7b6701415c8e8db"><enum>(c)</enum><header>Locations</header><text>The Secretary shall carry out the pilot program at not fewer than five locations selected by the Secretary for purposes of the pilot program. </text></subsection><subsection id="id2F46C805DED94CBDB7324291D5F4385B"><enum>(d)</enum><header>Award of grants</header><paragraph id="id7DCFE842C6504787A367CAEDB19C6303" commented="no"><enum>(1)</enum><header>In general</header><text>In carrying out the pilot program, the Secretary shall award grants to eligible entities to expand, retain, or establish public transportation services that provide veterans access to locations of facilities or organizations that serve veterans, including—</text><subparagraph commented="no" id="idD1C3C9A7A0A145DFAA997D691D64C92D"><enum>(A)</enum><text>facilities of the Department of Veterans Affairs; and </text></subparagraph><subparagraph commented="no" id="id139BDCC643954B8EAFF01CD632286995"><enum>(B)</enum><text>organizations that provide services to veterans using funds provided by the Department. </text></subparagraph></paragraph><paragraph id="id8540A9DB0C814224B081EFE23BD2CBFB"><enum>(2)</enum><header>Eligible entities</header><text>For purposes of this section, an eligible entity is any State, Tribal, county, or city government that—</text><subparagraph id="idF9992C9B2E3B4037A3604F0F1F68125F"><enum>(A)</enum><text>is providing public transportation services as of the date on which the pilot program commences; or </text></subparagraph><subparagraph id="id69E39977320145C196C87350B5C2A1D6"><enum>(B)</enum><text>has a proven ability and intention to establish public transportation infrastructure. </text></subparagraph></paragraph><paragraph id="id299BCE6030CF4857B0F9A132CA47BB7D"><enum>(3)</enum><header>Intervals of payment and maximum grant amount</header><text>The Secretary may establish intervals of payment for the administration of grants under this section and a maximum grant amount to be awarded, in accordance with the services being provided and the duration of such services. </text></paragraph><paragraph id="id4B53E96F379F4C95A4BD3A8C4DEC2A40"><enum>(4)</enum><header>Coordination and consultation</header><text>In awarding grants under this section, the Secretary may coordinate and consult with the Secretary of Transportation. </text></paragraph><paragraph id="id02199CAA67164DFB95232A1B1F9824A2"><enum>(5)</enum><header>Equitable distribution</header><text>The Secretary of Veterans Affairs shall ensure that, to the extent practicable, grants awarded under this section are equitably distributed across geographic regions, including rural and Tribal communities.</text></paragraph></subsection><subsection id="idCE4B63A5E8C849E396C3779D2790B04E"><enum>(e)</enum><header>Grant application</header><paragraph id="idBF5F29FAC4934827BAFF45C4E8575CD9"><enum>(1)</enum><header>In general</header><text>An eligible entity seeking the award of a grant under this section shall submit to the Secretary an application therefor in such form, in such manner, and containing such commitments and information as the Secretary considers necessary to carry out this section. </text></paragraph><paragraph id="id8562DF8E51FD4A07890156307B90D631"><enum>(2)</enum><header>Contents of application</header><text>Each application submitted by an eligible entity under paragraph (1) shall contain the following: </text><subparagraph id="id2522660268D54CCA99E61A0A6534772C"><enum>(A)</enum><text>A description of the public transportation services that the entity intends to provide under the grant. </text></subparagraph><subparagraph id="idC15F9E72E24A46B597F1016775BA3AC7"><enum>(B)</enum><text>A list of all sites accessed by the public transportation services to be provided. </text></subparagraph><subparagraph id="idC61E6B54FA324F7CB3E436290EC07110"><enum>(C)</enum><text>The schedule of such services. </text></subparagraph><subparagraph id="id5170CF025A134FE78A07DB5246E85E3D"><enum>(D)</enum><text>A list of the locations of facilities and organizations that serve veterans that will be accessed by such services. </text></subparagraph><subparagraph id="id1D8A606B30EF4200A93C6BFF81BD2D12"><enum>(E)</enum><text>An estimate of the number of veterans that would use such services. </text></subparagraph><subparagraph id="idDEE17C1B71444C3990A953135443215D"><enum>(F)</enum><text>Evidence of the ability of the entity to provide such services. </text></subparagraph></paragraph></subsection><subsection id="id1CB2C8FEA17F4A3281D9C13D82CC592D"><enum>(f)</enum><header>Notification to veterans</header><text>Each eligible entity awarded a grant under this section shall notify veterans of the expansion or establishment of public transportation services to locations of facilities or organizations that serve veterans and that those services are available in whole or in part due to funds provided by the Department. </text></subsection><subsection id="id70935A49F02741B2A510359FD0118164" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Report on services provided</header><text>The Secretary shall require each eligible entity awarded a grant under this section to submit to the Secretary a report that describes the expansion, retention, or establishment of public transportation services provided with amounts under such grant. </text></subsection><subsection id="id3E0390A648ED48649737EC5F367D2059"><enum>(h)</enum><header>Report</header><paragraph id="id1E6C45F31C474508B853466C71763EEE"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date on which the first grant is awarded under this section, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the services provided under the pilot program. </text></paragraph><paragraph id="id1AF23BE886D84289AD6479D847E3853A"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include the following: </text><subparagraph id="id54294EB63ABD459E92E92A458722028B"><enum>(A)</enum><text>The geographic location of each recipient of a grant under this section.</text></subparagraph><subparagraph id="idD78600BB33EE490DAD7C3C35386D565F"><enum>(B)</enum><text>The estimated number of veterans served by each such grant recipient. </text></subparagraph><subparagraph id="idD5D49140679C421DA63AA874A2BC5FCE" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>An assessment of whether use of facilities of the Department has increased due to access to public transportation provided under grants awarded under this section, if information for such an assessment is available. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
