which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XVIII and XIX of the Social Security Act to provide for coverage of dental and oral health services, vision services, and hearing services under the Medicare and Medicaid programs.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1A94A2CBADCB4A248ABB96483D0FD2FE"><section section-type="section-one" id="HAF15C4D29AAA4CAB8CC448353EAA93EB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare and Medicaid Dental, Vision, and Hearing Benefit Act of 2021</short-title></quote>.</text></section><section id="HB78C18B156494852A4FB06E520956B0B"><enum>2.</enum><header>Dental and oral health services under Medicare</header><subsection id="H4D7225DCFC284F509836055745DA6729"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><paragraph id="HE0D120A1ADDF4B6098F738F4E3F0CEDE"><enum>(1)</enum><text>in subparagraph (GG), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph><paragraph id="H0857A83DD90F4B24B403DD5012EAB842"><enum>(2)</enum><text>in subparagraph (HH), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HA00F0C6A11204934AF528B93DE006B45"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6B91BBA15D7C43EC820033C2AA959012"><subparagraph id="H567A8CEA99B2428990A68A4383D78399" indent="up1"><enum>(II)</enum><text>dental and oral health services (as defined in subsection (lll));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFBEAE7E8C8184D84B3D6DF5AEA3331D3"><enum>(b)</enum><header>Dental and oral health services defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="other" display-inline="no-display-inline" id="H652CCE14419F4452A78B2B01F7A2E716" other-style="archaic"><subsection commented="no" display-inline="no-display-inline" id="HFBA2894E8EF84C6F9E45A871CBAC1094"><enum>(lll)</enum><header>Dental and Oral Health Services</header><text>The term <term>dental and oral health services</term> means—</text><paragraph id="HD58F7DE8FA914BA89605D800A53A855E"><enum>(1)</enum><text>routine dental cleanings and exams;</text></paragraph><paragraph id="H10CE8DEAD5674F63AD0AC844C55AD862"><enum>(2)</enum><text>basic dental services, such as fillings and crowns;</text></paragraph><paragraph id="H497E29FE702A4D21B9E5E2B64CA19232"><enum>(3)</enum><text>major dental services, such as root canals, and extractions;</text></paragraph><paragraph id="H797E304C9F30429AA54A79B77D0B682F"><enum>(4)</enum><text>emergency dental care; and</text></paragraph><paragraph id="H2E0CAF770852457A9B5C3E5A36688E00"><enum>(5)</enum><text>other necessary services related to dental or oral health (as defined by the Secretary).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCA5D3A68B35A4030A212CB55F8D9D6FD"><enum>(c)</enum><header>Payment; coinsurance; and limitations</header><paragraph id="H655B5B2C433C4EC7B2A08268CBAD7758"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="HB51230AB90A842B8A9F7F954B0B22CE6"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(DD)</quote>; and</text></subparagraph><subparagraph id="HBE03447CE6E94543B8D9528B0E563C02"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (EE) with respect to dental and oral health services (as defined in section 1861(lll)), the amount paid shall be the payment amount specified under section 1834(z)</quote>.</text></subparagraph></paragraph><paragraph id="HF1DEEC506A3A4D16915B1B92016B757B"><enum>(2)</enum><header>Payment and limits specified</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0EBB835939D34CB9B05EF8B1ABF885E4"><subsection id="H2B259A5EA3BB499AA4D750A712004367"><enum>(z)</enum><header>Payment and limits for dental and oral health services</header><paragraph id="H025BC44CE6324338A9BC55B77970E321"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for dental and oral health services (as defined in section 1861(lll)) shall be, subject to paragraph (3), the applicable percent (specified in paragraph (2)) of the lesser of the actual charge for the services or the amount determined under the payment basis determined under section 1848.</text></paragraph><paragraph id="HACA269ACEBF3440EB92ED7C311C61C3D"><enum>(2)</enum><header>Applicable percent</header><text>For purposes of paragraph (1), the applicable percent specified in this paragraph is—</text><subparagraph id="H8E4C1FDCB50B446D8F5A4E24D8DE6EFB"><enum>(A)</enum><text>for the first year beginning at least 6 months after the date of the enactment of this subsection, 0 percent;</text></subparagraph><subparagraph id="HECDCB5CB981D48CF8EC835890744F8DB"><enum>(B)</enum><text>for the year following the year specified in subparagraph (A) and each subsequent year through the seventh year following the year specified in subparagraph (A), the applicable percent specified in this paragraph for the previous year increased by 10 percentage points; and</text></subparagraph><subparagraph id="H23DD0DAF6A0C42C1AF490D9339DCD9B4"><enum>(C)</enum><text>for the eighth year following the year specified in subparagraph (A) and each subsequent year, 80 percent.</text></subparagraph></paragraph><paragraph id="H604F5843D5DF40BB87AB04356715883F"><enum>(3)</enum><header>Limitations and Secretarial authority</header><subparagraph id="H5D26F186848E4DF990D17DB3FCBD3576"><enum>(A)</enum><header>Frequency</header><text>With respect to dental and oral health services that are—</text><clause id="HD5049645314243B1BB7361EDE099487E"><enum>(i)</enum><text display-inline="yes-display-inline">routine dental cleanings, payment may be made under this part for only two such cleanings during a 12-month period; and</text></clause><clause id="H86AC8250955D41BA84D59E118A53116A"><enum>(ii)</enum><text>routine exams, payment may be made under this part for only two such exams during a 12-month period.</text></clause></subparagraph><subparagraph id="H612474C3DC294790859C944649C93FFE"><enum>(B)</enum><header>Secretarial authority</header><clause id="HC90E0D13C18B49CCB2D4DE369DC7A24A"><enum>(i)</enum><header>Authority to apply additional limitations</header><text display-inline="yes-display-inline">The Secretary may apply such other reasonable limitations on the extent to which dental and oral services are covered under this part, including through application of a prior authorization requirement.</text></clause><clause id="H05108147499440289809CCDF4890D894"><enum>(ii)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of dental and oral health services to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H562F2B6CED3244D7A96A37097AE79073"><enum>(d)</enum><header>Payment under physician fee schedule</header><text>Section 1848(j)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(j)(3)</external-xref>) is amended by inserting <quote>(2)(II),</quote> before <quote>(3)</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H9AD37FB12F3F45DBB09C7EEFE60524BC"><enum>(e)</enum><header>Dentures</header><paragraph id="H1569EDAE300143CEA5DA61554CB8AC23"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(s)(8) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(8)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8FA26203C78B44BEB1FEA25D2F4A01F9"><enum>(A)</enum><text>by striking <quote>(other than dental)</quote> and inserting <quote>(including dentures)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H78E01AE18B7849B489A4A960F17810C2"><enum>(B)</enum><text>by striking <quote>internal body</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDCF744B3DB0D40A9ADB6E6A62CACDE31"><enum>(2)</enum><header>Special payment rules</header><text>Section 1834(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2C5BB45A19794B2E94DC51ADA67072AE"><paragraph id="H09CD7A2D201E4D19A799B8D59F5BFDBA"><enum>(23)</enum><header>Payment and limits for dentures</header><subparagraph id="H3526217868594EFB8E570D6B6A51EB85"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for dentures shall be, subject to subparagraph (C), the applicable percent (specified in subparagraph (B)) of the amount otherwise payable for such dentures under this section.</text></subparagraph><subparagraph id="H26E3496BB9494CA6BAE9C62F150D8ED9"><enum>(B)</enum><header>Applicable percent</header><text>For purposes of subparagraph (A), the applicable percent specified in this subparagraph is—</text><clause id="H07A91A8E3EC04BECA5AF0DB766914A0F"><enum>(i)</enum><text>for the first year beginning at least 6 months after the date of the enactment of this paragraph, 0 percent;</text></clause><clause id="H7173E2DF56194173BA71F1678D8E0031"><enum>(ii)</enum><text>for the year following the year specified in clause (i) and each subsequent year through the seventh year following the year specified in clause (i), the applicable percent specified in this subparagraph for the previous year increased by 10 percentage points; and</text></clause><clause id="HAE3143A30D9E436A95DA24CA1110C690"><enum>(iii)</enum><text>for the eighth year following the year specified in clause (i) and each subsequent year, 80 percent.</text></clause></subparagraph><subparagraph id="HAE7417517E2244E591C00881B2C988DF"><enum>(C)</enum><header>Limitations and Secretarial authority</header><clause id="HE5BA8DEF6D934E1789E228360FB8D903"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Payment may be made under this part for an individual for—</text><subclause id="H60EC446B03D4410CAF6325EBAD39796B"><enum>(I)</enum><text display-inline="yes-display-inline">not more than one full upper and one full lower denture once every five years; and</text></subclause><subclause id="H7294272D0D6F4835A066F4A76DC2D799"><enum>(II)</enum><text display-inline="yes-display-inline">not more than one partial upper denture and one partial lower denture once every five years.</text></subclause></clause><clause id="H11891D8ACE194ACEB1F0009793588858"><enum>(ii)</enum><header>Secretarial authority</header><subclause id="HC26C69254550408E98F0ABF8AE263EF3"><enum>(I)</enum><header>Authority to apply additional limitations</header><text display-inline="yes-display-inline">The Secretary may apply such other reasonable limitations on the extent to which dentures are covered under this part, including through application of a prior authorization requirement.</text></subclause><subclause display-inline="no-display-inline" id="H7EF8CC1200C2462F9C4A48627A381860"><enum>(II)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of dentures to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA770256D9A9B4507A095F541B99536CE"><enum>(f)</enum><header>Repeal of ground for exclusion</header><text>Section 1862(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y</external-xref>) is amended by striking paragraph (12).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H3D94B5B0967347A89728B605D8B5351B"><enum>(g)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to services furnished on or after January 1 of the first year beginning at least six months after the date of the enactment of this Act.</text></subsection></section><section id="HEBCF48AD3D5446E48C3FD3F9BA235C07"><enum>3.</enum><header>Vision services under Medicare</header><subsection id="HCE50E71148DC47C2B332D52716D8D4FA"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>), as amended by section 2(a), is amended—</text><paragraph id="HBA8C4260851B4E9CBEA05592C48EB749"><enum>(1)</enum><text>in subparagraph (HH), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph><paragraph id="H8C6D15B8EAA24C9EB8B09ACD742EB0F3"><enum>(2)</enum><text>in subparagraph (II), by adding <quote>and</quote> after the semicolon at the end; and</text></paragraph><paragraph id="H0C003E77B56F47A98288244485C14570"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD82A64AEE72E44688CAC237AC508AA52"><subparagraph id="H5B85E98ADD0F4E5C9A3F0D1525D10A84" indent="up1"><enum>(JJ)</enum><text>vision services (as defined in subsection (mmm));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7959ACB591DA45DEAEDD1107CB4EC9E0"><enum>(b)</enum><header>Vision services defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>), as amended by section 2(b), is amended by adding at the end the following new subsection:</text><quoted-block style="other" display-inline="no-display-inline" id="H4A1FFE4E5E244D878171CAB181854C6B" other-style="archaic"><subsection commented="no" display-inline="no-display-inline" id="H069F81F7EEE846FDA728FDCEF3894614"><enum>(mmm)</enum><header>Vision Services</header><text display-inline="yes-display-inline">The term <term>vision services</term> means—</text><paragraph id="H8131F2029DAD4F288BF70475A1500B2B"><enum>(1)</enum><text>routine eye examinations and procedures performed (during the course of any eye examination) to determine the refractive state of the eyes; and</text></paragraph><paragraph id="HF87CD2FD116A413D8152A84FBC83BE8F"><enum>(2)</enum><text>other necessary services related to eye and vision health (as defined by the Secretary).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD24D5DEC94974480AFD5281048FB6022"><enum>(c)</enum><header>Payment; coinsurance; and limitations</header><paragraph id="H03EBACFC9D724930A27D59990D72C1DD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>), as amended by section 2(c)(1), is amended—</text><subparagraph id="H481DD336E7234EC7852A571B2A5EA32C"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(EE)</quote>; and</text></subparagraph><subparagraph id="HAE0FD5D1B9A7429389C82FD22F101F14"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (FF) with respect to vision services (as defined in section 1861(mmm)), the amount paid shall be the payment amount specified under section 1834(aa)</quote>.</text></subparagraph></paragraph><paragraph id="H5F9F8C8C5C684F3EAD5011B42B80B3DE"><enum>(2)</enum><header>Payment and limits specified</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>), as amended by section 2(c)(2), is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H653ED4F7EE504833AB71D36AEB577ACB"><subsection id="H96C853A8E87949218B74E5882F5F0AAB"><enum>(aa)</enum><header>Payment and limits for vision services</header><paragraph id="H82FF623EE64E4FB1A75FE3F18FF0471F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for vision services (as defined in section 1861(mmm)) shall be, subject to paragraph (3), the applicable percent (specified in paragraph (2)) of the lesser of the actual charge for the services or the amount determined under the payment basis determined under section 1848.</text></paragraph><paragraph id="H264EE6C12E9D473D90860DAB18120D50"><enum>(2)</enum><header>Applicable percent</header><text>For purposes of paragraph (1), the applicable percent specified in this paragraph is—</text><subparagraph id="H1FAFC06D68B04165B69806075C86E3BB"><enum>(A)</enum><text>for the first year beginning at least 6 months after the date of the enactment of this subsection, 0 percent;</text></subparagraph><subparagraph id="HA876FC2AFE1440EC988B3F02C57067AE"><enum>(B)</enum><text>for the year following the year specified in subparagraph (A) and each subsequent year through the seventh year following the year specified in subparagraph (A), the applicable percent specified in this paragraph for the previous year increased by 10 percentage points; In the previous sentence, the term <term>ordinary eyeglasses or contact lenses</term> means lenses that are intended to fully correct visual acuity or fully eliminate refractive error.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0273D4C330974C3BA93360294BD039D3"><enum>(f)</enum><header>Definition of durable medical equipment To include eyeglasses, contact lenses, and low vision devices</header><text>Section 1861(n) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(n)</external-xref>) is amended—</text><paragraph id="H066704223E8A40DBB02C7836D97161DB"><enum>(1)</enum><text>by striking <quote>and</quote> before <quote>eye tracking</quote> and inserting a comma; and</text></paragraph><paragraph id="H1F55757E145448E6ADFB321683BD229E"><enum>(2)</enum><text>by inserting <quote>, and eyeglass lenses, low vision devices (as defined in section 1834(a)(25)), eyeglass frames, and contact lenses</quote> before <quote>; except</quote>.</text></paragraph></subsection><subsection id="H0B4EC485CF3F45E1915A7575677289F5"><enum>(g)</enum><header>Repeal of ground for exclusion</header><text>Section 1862(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(7)</external-xref>) is amended by striking <quote>, eyeglasses (other than eyewear described in section 1861(s)(8)) or eye examinations for the purpose of prescribing, fitting, or changing eyeglasses, procedures performed (during the course of any eye examination) to determine the refractive state of the eyes</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H9EFE58D553B94913AF7E36EC10699FCA"><enum>(h)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to services furnished on or after January 1 of the first year beginning at least six months after the date of the enactment of this Act.</text></subsection></section><section id="H1F449DECB54147B583CE9CBDC8CDC9D7"><enum>4.</enum><header>Hearing services under Medicare</header><subsection id="H34AC4E6AF71A4D85B1764DF1D38090EA"><enum>(a)</enum><header>Coverage</header><paragraph id="H44606804165F4FA396E69E84CAB8F80D"><enum>(1)</enum><header>In general</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>), as amended by sections 2(a) and 3(a), is amended—</text><subparagraph id="H72CF4C0F681048B28765FEFC5D079E54"><enum>(A)</enum><text>in subparagraph (II), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HCB9F1CB24CF24D9583DEB57BF4BEB038"><enum>(B)</enum><text>in subparagraph (JJ), by inserting <quote>and</quote> at the end; and</quote> and inserting a semicolon;</text></clause><clause id="id0256FBD93F7A4D239336FD8D24BF54E2"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the semicolon and inserting <quote>; and</quote>; and</text></clause><clause id="id7FB67B4AE71B4E638B53C2BC1315BF84"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block style="traditional" act-name="" id="id45734C540DB74B3588E866DAF6E8B312"><subparagraph id="id6465F5D9A6C74453A6F762C557B15D26"><enum>(D)</enum><text display-inline="yes-display-inline">any service that is a vision service (as defined in section 1861(mmm)) or a hearing service (as defined in section 1861(ll)(5);</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id90BD71C7A1024C72B539BA7271F82DEA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>and (ii)</quote> and inserting <quote>(ii), and (jj)</quote>; and</text></paragraph><paragraph id="id08B3871864D24ADC8E304B8A1959EE1C"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text><quoted-block id="id777B06D212F94415868C859C7CF2643D" display-inline="no-display-inline" style="traditional" act-name=""><subsection id="idBE79F5046A1C4A21809D433B6C3C4DF4"><enum>(jj)</enum><header>Increased FMAP for expenditures for dental and oral health services, vision services, and hearing services</header><paragraph id="idB6862803CB634DAE86D469983F11C9ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), the Federal medical assistance percentage with respect to amounts expended by a State for medical assistance for services described in paragraph (2) shall be equal to 90 percent.</text></paragraph><paragraph id="idDDC20A96B7A44A6DAAB42336B3E75F94"><enum>(2)</enum><header>Services described</header><text display-inline="yes-display-inline">A service described in this paragraph is any service that—</text><subparagraph id="id0028D0F354574BFCA40073A6760BC3E4"><enum>(A)</enum><text display-inline="yes-display-inline">is furnished on or after January 1 of the first calendar year that begins at least 6 months after the date of the enactment of this subsection;</text></subparagraph><subparagraph id="id22AE16ADF0D643B38F385F5F493F7305"><enum>(B)</enum><text>is not furnished to an individual who is—</text><clause id="id2BD21E5E223C4A99BB1D3A907C3131D6"><enum>(i)</enum><text>under the age of 21; and</text></clause><clause id="id1FB1DE91372940AC9B4A5C8A638A4F3A"><enum>(ii)</enum><text>eligible for medical assistance for the services described in subsection (a)(4)(B); and</text></clause></subparagraph><subparagraph id="id63F66679AB8A4A14A634A30710723AFE"><enum>(C)</enum><text display-inline="yes-display-inline">is—</text><clause id="idF1BDDA614586449B9D275662750DD8F8"><enum>(i)</enum><text display-inline="yes-display-inline">a dental and oral health service (as defined in section 1861(lll));</text></clause><clause id="idEB1681ECF0A74B9BB9FC1C86647A8B94"><enum>(ii)</enum><text display-inline="yes-display-inline">a vision service (as defined in section 1861(mmm)); or</text></clause><clause id="idFD9D9410DA534C66931DA77F1F35056C" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a hearing service (as defined in section 1861(ll)(5)).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
