<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Livable Communities Act of 2021</short-title></quote>.</text></section> <section id="ID2c5a0d1a166d4545b55351b7564c016c"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="ID1ee8a14736ed4db2bbdf3ef4f871b6ab"><enum>(1)</enum><text>key Federal programs can boost economic growth at the local and regional level through better coordination of housing, transportation, and related infrastructure investments;</text></paragraph> <paragraph id="ID921461798c05461b830b24ead3e7318f"><enum>(2)</enum><text>Federal regulations and policies should support community efforts to implement and sustain progress toward the achievement of locally-defined development goals, in terms of—</text>
<subparagraph id="id8CE6D08540AB4F7FAF13F3BF0877F169"><enum>(A)</enum><text>geographic location and proximity to existing resources;</text></subparagraph> <subparagraph id="iddded675c303d4806a2f607c6374d002e"><enum>(B)</enum><text>developing transportation choices that serve the needs of all users and fit within the context of the community;</text></subparagraph>
<subparagraph id="idCCFC4FD14FCB4C2CAEAA2A128A6FD8BD"><enum>(C)</enum><text>maintaining structural and indoor environmental quality and minimizing health hazards; and</text></subparagraph> <subparagraph id="idf52ba72968b243f894b3c97670b87665"><enum>(D)</enum><text>ensuring that minority and low-income communities have greater access to existing and future transportation services and healthy and affordable housing resources; </text></subparagraph></paragraph>
<paragraph id="ID224193acf0164cc58baa2b82ff1e59c0"><enum>(3)</enum><text>greater coordination of public investment will provide direct support for immediate job creation and lay the groundwork for long-term resilience and prosperity by leveraging significant private sector and philanthropic investment to make the most of Federal funding; and</text></paragraph> <paragraph id="id0bd8492a69b24073bf13bae4b9abf8af"><enum>(4)</enum><text>improved coordination of Federal housing, transportation, water infrastructure, and climate and resiliency investments will strengthen local communities’ ability to plan for and respond to the effects of climate change. </text></paragraph></section>
<section id="IDe1cb935d90af411aa47dfefa495285c5"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> <paragraph id="ID0318be4a6601488a9c74364843eafbbc"><enum>(1)</enum><text>to strengthen rural, suburban, and urban economies by enabling communities to establish goals for the future and to chart a course for achieving such goals;</text></paragraph>
<paragraph id="ID986eb21b512446598d62c2791d491ccf"><enum>(2)</enum><text>to promote local leadership by encouraging communities to develop innovative solutions that reflect the unique economic assets and needs of the communities;</text></paragraph> <paragraph id="ID7c4bfae7267b4df2b9a5352abc80612f"><enum>(3)</enum><text>to maximize returns on Federal funding of housing, transportation, and environmental infrastructure and resiliency projects through the coordination of Federal grant programs and improving the efficiency and effectiveness of programs and policies of the Department of Housing and Urban Development, the Department of Transportation, the Environmental Protection Agency, and other Federal agencies, as appropriate; </text></paragraph>
<paragraph id="ID95d7bd9a40cb4bd6b072d6b2eac05a31"><enum>(4)</enum><text>to ensure that Federal funding supports locally defined long range development goals;</text></paragraph> <paragraph id="id622bf16170564c3495d1d23d978b03f0"><enum>(5)</enum><text>to make investments in housing, transportation, environmental, and resiliency projects in and for the benefit of historically disadvantaged or underserved minority and low-income communities; </text></paragraph>
<paragraph id="idc80e1851f203487a821c6d532550b09d"><enum>(6)</enum><text>to support a Federal initiative to support healthy housing and reduce the prevalence and severity of housing-related health hazards; and</text></paragraph> <paragraph id="id83c88121af6a4eea84df00f65086edee"><enum>(7)</enum><text>to support the efforts of local communities to address the impact of climate change, including increased resilience to extreme weather events.</text></paragraph></section>
<section id="ID01f6129d62b84d38afec8549b79e0999"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions shall apply:</text> <paragraph id="IDddd85a37056549d990a322b64e70ff88"><enum>(1)</enum><header>Affordable housing</header><text>The term <term>affordable housing</term> means housing, the cost of which does not exceed 30 percent of the income of low-, very low-, and extremely low-income families. </text></paragraph>
<paragraph id="IDd36463ef6d434ef7a331f9d0476c2270"><enum>(2)</enum><header>Comprehensive regional plan</header><text>The term <term>comprehensive regional plan</term> means a plan that—</text> <subparagraph id="ID39ff34224f264ca992044a135e99a397"><enum>(A)</enum><text>uses a cooperative, locally controlled, and inclusive public engagement process to identify needs and goals across a region and to integrate related planning processes;</text></subparagraph>
<subparagraph id="IDb619701713be467d8cf33709f7eb0c60"><enum>(B)</enum><text>prioritizes projects for implementation, including healthy housing projects; and</text></subparagraph> <subparagraph id="ID3b2d50e591d94391b76dbbb0180129fc"><enum>(C)</enum><text>is tied to capital improvement programs and annual budgets.</text></subparagraph></paragraph>
<paragraph id="ID2c974c8ce27d401d820502163103c7da"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph> <paragraph id="IDdc04769132e44a5aa121345dcef7dd1d"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Sustainable Housing and Communities established under section 5.</text></paragraph>
<paragraph id="IDd58c43f9136746319fb82a3002d4c4b8"><enum>(5)</enum><header>Extremely low-income family</header><text>The term <term>extremely low-income family</term> has the meaning given that term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>). </text></paragraph> <paragraph id="IDabaab555faa7410f93d8ff0fa35244c2"><enum>(6)</enum><header>Healthy housing</header><text>The term <term>healthy housing</term> means housing, including senior housing and residential care facilities, that is designed, constructed, rehabilitated, and maintained in a manner that supports the health of the occupants of the housing.</text></paragraph>
<paragraph id="id366f06e24f014b73a320c152179f0077"><enum>(7)</enum><header>High-poverty community</header><text>The term <term>high-poverty community</term> means a census tract with a poverty rate of not less than 25 percent, according to the most recent 5-year estimate of the American Community Survey of the Bureau of the Census. </text></paragraph> <paragraph id="id3D4A6640C4594BA3991BC8B947AAC388"><enum>(8)</enum><header>Housing-related health hazard</header><text>The term <term>housing-related health hazard</term> means any biological, physical, or chemical source of exposure or condition in, or immediately adjacent to, housing that could adversely affect human health.</text></paragraph>
<paragraph id="ID26ddacb62de74171a49b980b1e7dac5b"><enum>(9)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(e)</external-xref>). </text></paragraph> <paragraph commented="no" id="id0d72377c-6298-4021-a046-080468cd4eba"><enum>(10)</enum><header>Livable community</header><text>The term <term>livable community</term> means a metropolitan, urban, suburban, or rural community that—</text>
<subparagraph commented="no" id="id2bfca275-3fe1-4e32-8fc8-8af1d7c9de59"><enum>(A)</enum><text>provides transportation choices that are safe, reliable, affordable, accessible, and accommodative for individuals with disabilities;</text></subparagraph> <subparagraph commented="no" id="id975a66ac-b73c-4d34-a0d0-42bab78e256f"><enum>(B)</enum><text>provides long-term affordable housing that provides accessible, energy-efficient, and location-efficient choices for people of all ages, incomes, races, and ethnicities;</text></subparagraph>
<subparagraph commented="no" id="id21746711-49c4-48ed-87a8-251bbf1f0fdd"><enum>(C)</enum><text>supports, revitalizes, and encourages the growth of existing communities and maximizes the cost-effectiveness of existing infrastructure;</text></subparagraph> <subparagraph commented="no" id="idb4adef40-37ae-4210-af95-e06efd447a58"><enum>(D)</enum><text>promotes economic development and economic competitiveness;</text></subparagraph>
<subparagraph commented="no" id="iddf0c2617-3501-4408-be88-6d3698f76825"><enum>(E)</enum><text>preserves the environment and natural resources and increases community resilience to natural or anthropogenic environmental disasters;</text></subparagraph> <subparagraph commented="no" id="id841e37c1-a2a0-4202-a9be-8686029c2596"><enum>(F)</enum><text>protects agricultural land, rural land, and green spaces; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idb85d86e7-bca2-4d01-b5fc-f5b6b3bcb77a"><enum>(G)</enum><text>supports public health and improves the quality of life for residents of, and workers in, the community.</text></subparagraph></paragraph> <paragraph id="ID8a9bded8d7c24c51865afbfb5e75c98a"><enum>(11)</enum><header>Location-efficient</header><text>The term <term>location-efficient</term> characterizes mixed-use development or neighborhoods that integrate housing, transportation choices, commercial development, and facilities and amenities—</text>
<subparagraph id="IDb86a1e354e8947d1945b4e9efabe928e"><enum>(A)</enum><text>to lower living expenses for working families;</text></subparagraph> <subparagraph id="ID7ec931562d804fc08f877079a19ae7ab"><enum>(B)</enum><text>to enhance economic and physical mobility;</text></subparagraph>
<subparagraph id="IDbe77f6b671bd4c2e8d288d8185370e69"><enum>(C)</enum><text>to encourage private investment in transit-oriented development; and</text></subparagraph> <subparagraph id="IDeba68fef793a49129db9ba5fb76af145"><enum>(D)</enum><text>to encourage private sector infill development and maximize the use of existing infrastructure.</text></subparagraph></paragraph>
<paragraph id="id1312E360A217448D8E8F9EA1A498A3EE"><enum>(12)</enum><header>Long-term affordable housing</header><text>The term <term>long-term affordable housing</term> means housing that is affordable housing for a period of not less than 30 years.</text></paragraph> <paragraph id="ID6cdeeb63c9cb4505b9a193a25f417b0b"><enum>(13)</enum><header>Low-income family</header><text>The term <term>low-income family</term> has the meaning given the term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph>
<paragraph id="IDfe61ea6fb29b48d68161d2e3b19aed83"><enum>(14)</enum><header>Metropolitan planning organization</header><text>The term <term>metropolitan planning organization</term> means a metropolitan planning organization described in section 134(b) of title 23, United States Code or section 5303(b) of title 49, United States Code.</text></paragraph> <paragraph id="ID0a276cc1d5b64d05b216f62078033b56"><enum>(15)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Sustainable Housing and Communities established under section 5.</text></paragraph>
<paragraph id="ID56dbe9b55bd84db7bfd8361b3af7e131"><enum>(16)</enum><header>Regional council</header><text>The term <term>regional council</term> means a multiservice regional organization with State and locally defined boundaries that is—</text> <subparagraph id="IDe90238586cac4b189b6d5c9ce4361de4"><enum>(A)</enum><text>accountable to units of general local government;</text></subparagraph>
<subparagraph id="IDb57c8228fd954755ae2cc45993345135"><enum>(B)</enum><text>delivers a variety of Federal, State, and local programs; and</text></subparagraph> <subparagraph id="ID090aca722844442eab736f238f75d16d"><enum>(C)</enum><text>performs planning functions and provides professional and technical assistance.</text></subparagraph></paragraph>
<paragraph id="ID78c3a11c27dc440f8600c050fd01ab56"><enum>(17)</enum><header>Rural planning organization</header><text>The term <term>rural planning organization</term> means a voluntary regional organization of local elected officials and representatives of local transportation systems—</text> <subparagraph id="id7455C02CFE8345DBBFD12E7151B94ECA"><enum>(A)</enum><text>that—</text>
<clause id="id2F8B32B1CC4440A0AD8FC2872902A615"><enum>(i)</enum><text>works in cooperation with the department of transportation (or equivalent entity) of a State to plan transportation networks and advise officials of the State on transportation planning; and</text></clause> <clause id="ID5772daf941ad458ba90a748532b61a63"><enum>(ii)</enum><text>is located in a rural area—</text>
<subclause id="IDecac350f65e641928f8e3108caf69df5"><enum>(I)</enum><text>with a population of not less than 5,000; and</text></subclause> <subclause id="IDb4d03fb0294a44ec801543a36b69fcad"><enum>(II)</enum><text>that is not located in an area represented by a metropolitan planning organization; or</text></subclause></clause></subparagraph>
<subparagraph id="id8D972765663C44B3A2D2988E32FFE7A0"><enum>(B)</enum><text>that is a regional transportation planning organization, as defined in section 5303 of title 49, United States Code.</text></subparagraph></paragraph> <paragraph id="ID30300324de29419e9648fc0a21c864e9"><enum>(18)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph>
<paragraph id="IDf382dff9493d4ae49180cda42eb4d56b"><enum>(19)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 5302 of title 49, United States Code.</text></paragraph> <paragraph id="idd6d6d936a4c74ed2ac3c8c09da7d38a8"><enum>(20)</enum><header>Sustainable development</header><text>The term <term>sustainable development</term> means development that—</text>
<subparagraph id="idb0fbf302eeba44fd9601764ba53083ab"><enum>(A)</enum><text>fulfills a current and future social need of a community;</text></subparagraph> <subparagraph id="idaab20c23d88a40279e191cc5f694685e"><enum>(B)</enum><text>promotes economic competitiveness or growth and creates new economic opportunity; and</text></subparagraph>
<subparagraph id="ida2cb50e1adf14e87bf61ec1f9b64ea4c"><enum>(C)</enum><text>uses natural resources responsibly, minimizes ecological and environmental impacts, and improves community resilience to natural disasters while preserving the ability of future generations to meet their own needs. </text></subparagraph></paragraph> <paragraph id="IDfaf711d7800b46f3b51446b741c9fbee"><enum>(21)</enum><header>Transit-oriented development</header><text>The term <term>transit-oriented development</term> means high-density, walkable, accessible to individuals with disabilities, and location-efficient mixed-use development, including commercial development, and affordable and market-rate housing, that is within walking distance of and accessible to 1 or more public transportation facilities with frequent service.</text></paragraph>
<paragraph id="ID31ef47b9d06345a38f69d6fc98afd1af"><enum>(22)</enum><header>Unit of general local government</header><text>The term <term>unit of general local government</term> means—</text> <subparagraph id="ID7d284ff72bd84722b900a82be22b2242"><enum>(A)</enum><text>a city, county, town, township, parish, village, or other general purpose political subdivision of a State; or</text></subparagraph>
<subparagraph id="ID278170c4f2454b3396dd0753b048f689"><enum>(B)</enum><text>a combination of general purpose political subdivisions, as determined by the Secretary.</text></subparagraph></paragraph> <paragraph id="ID052131351fb14c1594f412c40a5e3723"><enum>(23)</enum><header>Unit of special purpose local government</header><text>The term <term>unit of special purpose local government</term>—</text>
<subparagraph id="ID532be8b2bbe4421982184f20bfa8d97a"><enum>(A)</enum><text>means a division of a unit of general local government that serves a special purpose and does not provide a broad array of services; and</text></subparagraph> <subparagraph id="ID58380c31645c4342bcbc3c44d143965b"><enum>(B)</enum><text>includes an entity such as a school district, a housing agency, a transit agency, and a parks and recreation district.</text></subparagraph></paragraph>
<paragraph id="IDee0c8cec2d02457995655d551878be9a"><enum>(24)</enum><header>Very low-income family</header><text>The term <term>very low-income family</term> has the meaning given the term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph></section> <section id="ID883fc6d87afb4e9cb70bf36fb1669834"><enum>5.</enum><header>Office of sustainable housing and communities</header> <subsection id="IDf2f7bc5bd42e460fb91bee435de69e1a"><enum>(a)</enum><header>Office established</header><text>There is established in the Department an Office of Sustainable Housing and Communities, which shall—</text>
<paragraph id="ID1c434e4686264c0b941d1dfc4c850e65"><enum>(1)</enum><text>coordinate the policies of the Department with those of other Federal agencies that—</text> <subparagraph id="ID12ea643cc6f04fa1aedf74f273331921"><enum>(A)</enum><text>encourage locally directed comprehensive and integrated planning and development at the State, regional, and local levels;</text></subparagraph>
<subparagraph id="IDaa9361773ab14cb6862d7f869dbf0145"><enum>(B)</enum><text>encourage coordinated public investments through the development of comprehensive regional plans;</text></subparagraph> <subparagraph id="IDa1f4ceb38b344b3b810df4871747a7c2"><enum>(C)</enum><text>provide long-term affordable housing that provides accessible, energy-efficient, healthy, and location-efficient choices for people of all ages, incomes, races, and ethnicities and individuals with disabilities, particularly for low-, very low-, and extremely low-income families; and</text></subparagraph>
<subparagraph id="ID7077d4a65be04b89a0e61b4cdc710e3b"><enum>(D)</enum><text>achieve other goals consistent with the purposes of this Act;</text></subparagraph></paragraph> <paragraph id="ID0e3cf0c0aa234727a259c1543e4a3326"><enum>(2)</enum><text>review Federal programs and policies to determine barriers to interagency collaboration and make recommendations to promote the ability of local communities, including high-poverty communities, to access resources in the Department and throughout the Federal Government and coordinate with and conduct outreach to Federal agencies, including the Department of Transportation and the Environmental Protection Agency, on methods to improve the efficiency and effectiveness of programs within the Department of Transportation, the Environmental Protection Agency, the Department of Agriculture, and the Department;</text></paragraph>
<paragraph id="id29191e7896a34867b0140bb6e70c8034"><enum>(3)</enum><text>review Federal programs and policies to—</text> <subparagraph id="idA93762903F644DADBB55AF120FB663DD"><enum>(A)</enum><text>identify barriers to high-poverty individuals and communities’ access to Federal State, local, and private resources; and</text></subparagraph>
<subparagraph id="idE89CEE818CF94B5FA68800F3146D042C"><enum>(B)</enum><text>make recommendations—</text> <clause id="id54D4E04774F24C5F86AB03B7AEA1B8F2"><enum>(i)</enum><text>to promote the ability of high-poverty communities to access resources in the Department and throughout the Federal Government and coordinate with and conduct outreach to Federal agencies, including the Department of Transportation and the Environmental Protection Agency; and</text></clause>
<clause id="idF94299F894724A0CAEDF32BB8C5E3A0A"><enum>(ii)</enum><text>for methods to improve the access of high-poverty communities to Federal resources and programs within the Department of Transportation, the Environmental Protection Agency, and the Department; </text></clause></subparagraph></paragraph> <paragraph id="ID1f5c63c4e3084f00a87d844d48b5fe62"><enum>(4)</enum><text>conduct research and advise the Secretary on the research agenda of the Department relating to coordinated development, in collaboration with the Office of Policy Development and Research of the Department;</text></paragraph>
<paragraph id="ID28669302f44e41aca2ddce753cd68821"><enum>(5)</enum><text>implement and oversee the grant programs established under this Act;</text></paragraph> <paragraph id="ID4ec05d44dcae42b9a80eb2546c350d67"><enum>(6)</enum><text>provide guidance, information on best practices, and technical assistance to communities seeking to adopt sustainable development policies and practices;</text></paragraph>
<paragraph id="ID8dff3691fc37411a8f7aee8a4a3b136d"><enum>(7)</enum><text>administer initiatives of the Department relating to the policies described in paragraph (1), as determined by the Secretary; and</text></paragraph> <paragraph id="ID91bad0ab2e5e421dac73ab02feb36694"><enum>(8)</enum><text>work with the Federal Transit Administration and the Federal Highway Administration of the Department of Transportation and other offices and administrations of the Department of Transportation, as appropriate—</text>
<subparagraph id="IDfc31827f0a854a10b8c0c0f94c186e64"><enum>(A)</enum><text>to encourage transit-oriented development; </text></subparagraph> <subparagraph id="IDa6f6594459ff4d54828d1fb3ae1dc874"><enum>(B)</enum><text>to coordinate Federal housing, community development, and transportation policies, including the policies described in paragraph (1); and</text></subparagraph>
<subparagraph id="idede7826ab0e140db9ab7deae1368fdf6"><enum>(C)</enum><text>to address combined household housing and transportation expenses in a coordinated manner.</text></subparagraph></paragraph></subsection> <subsection id="IDe6397af46122402baf0d9f81f09075b6"><enum>(b)</enum><header>Director</header><text>The head of the Office shall be the Director of the Office of Sustainable Housing and Communities.</text></subsection>
<subsection id="ID41d42991a9954494abd715aa43dc46e9"><enum>(c)</enum><header>Duties relating to grant programs</header>
<paragraph id="IDdef358499abc4863bb527ed9725a4d7c"><enum>(1)</enum><header>In general</header><text>The Director shall carry out the grant programs established under this Act.</text></paragraph> <paragraph id="IDae4eca7311be4557a18ba4ca866d5484"><enum>(2)</enum><header>Small and rural communities grant program</header><text>The Director shall coordinate with the Secretary of Agriculture to make grants to small and rural communities under sections 7 and 8.</text></paragraph>
<paragraph id="IDeb67e255610e4f0b92610882b0d3e1c7"><enum>(3)</enum><header>Technical assistance for grant recipients and applicants</header><text>The Director may—</text> <subparagraph id="ID501cd77d32bb471ab113bcc5aa292cd2"><enum>(A)</enum><text>coordinate with other Federal agencies to establish interagency and multidisciplinary teams to provide technical assistance to recipients of, and prospective applicants for, grants under this Act;</text></subparagraph>
<subparagraph id="ID0026df4243f4425b8cecb49c8b8ea5e8"><enum>(B)</enum><text>by Federal interagency agreement, transfer funds to another Federal agency to facilitate and support technical assistance; and</text></subparagraph> <subparagraph id="ID8eab34fd07ab4286aeef2dbc35b38ddb"><enum>(C)</enum><text>make contracts with third parties to provide technical assistance to grant recipients and prospective applicants for grants.</text></subparagraph></paragraph></subsection></section>
<section id="ID62054512cc114553b4181c734818d838"><enum>6.</enum><header>Comprehensive planning grant program</header>
<subsection id="IDd7bfbb1f751142aeb266cf5ce6117d22"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="ID554a27ac6da94ec6bdb59af4632e6521"><enum>(1)</enum><header>Consortium of units of general local governments</header><text>The term <term>consortium of units of general local governments</term> means a consortium of geographically contiguous units of general local government that the Secretary determines—</text>
<subparagraph commented="no" id="ID26e551547ab94eabbc80cf7d99fedbf9"><enum>(A)</enum><text>represents all or part of a metropolitan statistical area, a micropolitan statistical area, or a noncore area, as those terms are defined by the Office of Management and Budget;</text></subparagraph> <subparagraph id="ID523328b1e4a547dea66fb1d00328b440"><enum>(B)</enum><text>has the authority under State, Tribal, or local law to carry out planning activities, including surveys, land use studies, environmental or public health analyses, and development of urban revitalization plans; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID569332ca8a894e698a338b7206c0351d"><enum>(C)</enum><text>has provided documentation to the Secretary sufficient to demonstrate that the purpose of the consortium is to carry out a project using a grant awarded under this Act.</text></subparagraph></paragraph> <paragraph id="IDb99a2eae06654e1eae4ba243928d7c77"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>
<subparagraph id="IDb8947156ddd44c6ba3d27170c140009a"><enum>(A)</enum><text>a partnership between a consortium of units of general local government and an eligible partner, which shall designate a lead applicant to be the entity to establish the direct grant relationship with the Secretary; or </text></subparagraph> <subparagraph id="ID633abbabdff14413a404cca6149814a8"><enum>(B)</enum><text>an Indian tribe, if the Indian tribe has a Tribal entity that performs—</text>
<clause id="IDcdcca1d6f20445eb95aa609f9de20aed"><enum>(i)</enum><text> housing and land use planning functions; or</text></clause> <clause id="IDd8cce366dd0a473b80240913ccd78870"><enum>(ii)</enum><text>transportation or transportation planning functions.</text></clause></subparagraph></paragraph>
<paragraph id="ID96d73ff9d0ca4e0cb463df6d6c481414"><enum>(3)</enum><header>Eligible partner</header><text>The term <term>eligible partner</term> means—</text> <subparagraph id="IDe1a43c4b206448449f90386d04de6d0e"><enum>(A)</enum><text>a metropolitan planning organization, a rural planning organization, or a regional council; or</text></subparagraph>
<subparagraph id="IDaef29935e1bc4432ac9a2af9411a71cd"><enum>(B)</enum><text>a metropolitan planning organization, a rural planning organization, or a regional council, and—</text> <clause id="ID6d855c0118e2470386497a622d14acaf"><enum>(i)</enum><text>a State;</text></clause>
<clause id="IDbeb2efb3c90942fca626009fb2fa0768"><enum>(ii)</enum><text>an Indian Tribe;</text></clause> <clause id="ID65b06a8951284fa1abbdfec2a077a943"><enum>(iii)</enum><text>a State and an Indian Tribe; </text></clause>
<clause id="iddedfae31dfdd4ea0aacc779db0fbbf76" commented="no"><enum>(iv)</enum><text>a community development corporation; or</text></clause> <clause id="ID1bfbaa115037452c9a1813cd0912a488"><enum>(v)</enum><text>an institution of higher education.</text></clause></subparagraph></paragraph>
<paragraph id="IDfa867f5535ea436280cfde7af5f8a219"><enum>(4)</enum><header>Grant program</header><text>The term <term>grant program</term> means the comprehensive planning grant program established under subsection (b).</text></paragraph> <paragraph id="ID672f01bb342e4ed78fe06e22d8f58cf5"><enum>(5)</enum><header>Noncore area</header><text>The term <term>noncore area</term> means a county or group of counties that are not designated by the Office of Management and Budget as a micropolitan statistical area or metropolitan statistical area.</text></paragraph></subsection>
<subsection id="IDa4ca07a4c29143bb94b1136169cf1772"><enum>(b)</enum><header>Comprehensive planning grant program established</header><text>The Director shall establish a comprehensive planning grant program to make grants to eligible entities to carry out a project—</text> <paragraph id="IDc6bbeb4f4be14a2c893ccfb052dbddf6"><enum>(1)</enum><text>to coordinate locally defined planning processes across jurisdictions and agencies;</text></paragraph>
<paragraph id="ID9add6442c76c43da904c1cfbf95abdfa"><enum>(2)</enum><text>to identify regional partnerships for developing and implementing a comprehensive regional plan that advances the sustainability goals of the region;</text></paragraph> <paragraph id="ID8f510e36e07449d68470e608bf5d3b17"><enum>(3)</enum><text>to conduct or update assessments to determine regional needs and promote economic and community development;</text></paragraph>
<paragraph id="ID1cdae9a8db3a4e3b8f0078070889db06"><enum>(4)</enum><text>to develop or update—</text> <subparagraph id="ID35f869fed7e7441b9f324559dc06a92f"><enum>(A)</enum><text>a comprehensive regional plan; or</text></subparagraph>
<subparagraph id="ID633d63e9746b44218c519e4914b21a4b"><enum>(B)</enum><text>goals and strategies to implement an existing comprehensive regional plan and other related activities; and</text></subparagraph></paragraph> <paragraph id="ID70d8c2dfc8264a158efe4dcd43be85e0"><enum>(5)</enum><text>to identify local zoning and other code or policy changes necessary to implement a comprehensive regional plan and promote sustainable development and fair housing.</text></paragraph></subsection>
<subsection id="IDc1c9bdca08f34932bada1dea38499ff7"><enum>(c)</enum><header>Grants</header>
<paragraph id="ID3f00222129ba413b9e485614e979db3e"><enum>(1)</enum><header>Diversity of grantees</header><text>The Director shall ensure geographic diversity among and adequate representation from each of the following categories:</text> <subparagraph id="ID969572f56dc64b61b58c9d5d41186206"><enum>(A)</enum><header>Small and rural communities</header><text>Eligible entities that represent all or part of a noncore area, a micropolitan area, or a small metropolitan statistical area with a population of not more than 200,000.</text></subparagraph>
<subparagraph id="ID94dce95f49024e2fa67f4834df04652f"><enum>(B)</enum><header>Mid-sized metropolitan communities</header><text>Eligible entities that represent all or part of a metropolitan statistical area with a population of more than 200,000 and not more than 500,000.</text></subparagraph> <subparagraph id="IDe2c799dfd5244565828517602d7a0bee"><enum>(C)</enum><header>Large metropolitan communities</header><text>Eligible entities that represent all or part of a metropolitan statistical area with a population of more than 500,000.</text></subparagraph>
<subparagraph id="idC4FC9AC65C514BC8A76BCD67D96BF270"><enum>(D)</enum><header>Indian tribes</header><text>Eligible entities that are Indian tribes.</text></subparagraph></paragraph> <paragraph id="ID627c3dbc4723436c972c38ca8813765b"><enum>(2)</enum><header>Award of funds to small and rural communities</header> <subparagraph id="IDad9e2be4de534437a6b0396145afa627"><enum>(A)</enum><header>In general</header><text>The Director shall—</text>
<clause id="idFE3F7F293E7A40BBB67CE3781CB5A8A5"><enum>(i)</enum><text>award not less than 15 percent of the funds under the grant program to eligible entities described in paragraph (1)(A); and</text></clause> <clause id="idE4F68CF504234876AA63F77A4C00409B"><enum>(ii)</enum><text>ensure diversity among the geographic regions and the size of the population of the communities served by recipients of grants that are eligible entities described in paragraph (1)(A).</text></clause></subparagraph>
<subparagraph id="IDb2e2c489e65f47de9c1459f069a69544"><enum>(B)</enum><header>Insufficient applications</header><text>If the Director determines that insufficient approvable applications have been submitted by eligible entities described in paragraph (1)(A), the Director may award less than 15 percent of the funds under the grant program to eligible entities described in paragraph (1)(A).</text></subparagraph></paragraph> <paragraph id="iddfd932582f054b1d82f1b3b2b6969b8b"><enum>(3)</enum><header>Award of funds to high-poverty communities</header> <subparagraph id="id5250ba4241f64441b3394c7307ab2eaa"><enum>(A)</enum><header>In general</header><text>The Director shall award not less than 25 percent of the funds under the grant program to eligible entities within the jurisdiction of which there are not fewer than 3 census tracts with a poverty rate of not less than 25 percent, according to the most recent 5-year estimate of the American Community Survey of the Bureau of the Census.</text></subparagraph>
<subparagraph id="id2f7a48742ac343e0bf5c85efd6277c59"><enum>(B)</enum><header>Insufficient applications</header><text>If the Director determines that insufficient approvable applications have been submitted by eligible entities described in subparagraph (A)—</text> <clause id="idf9ccab81fd8749a8a83b623505e58e14"><enum>(i)</enum><text>the Director may award less than 25 percent of the funds under the grant program to eligible entities described in subparagraph (A);</text></clause>
<clause id="id0c7f450fa7b8491ab58fd2272830f5ad"><enum>(ii)</enum><text>the Office of the Director shall conduct further educational outreach to eligible entities within high-poverty communities;</text></clause> <clause id="id7003f9f40bb6475d90092736b015ad76"><enum>(iii)</enum><text>the Director shall keep an open application period until the Director determines there is an appropriate amount of approvable applications that can be awarded within the period of availability; and</text></clause>
<clause id="id2f898f2a21a84114a9c5ebb568cbc699"><enum>(iv)</enum><text>the Director shall provide technical assistance to eligible entities within the jurisdiction of which are high-poverty communities.</text></clause></subparagraph></paragraph> <paragraph id="ID8e34439ad7ff48e78974226b42c71886"><enum>(4)</enum><header>Availability of funds</header> <subparagraph id="IDe88c16d1ff4f48f0a89a75491b90df5e"><enum>(A)</enum><header>In general</header><text>An eligible entity that receives a grant under the grant program shall—</text>
<clause id="ID403fe1793865401ca1c3b0f123fb69c6"><enum>(i)</enum><text>obligate any funds received under the grant program not later than 1 year after the date on which the grant agreement under subsection (g) is made; and</text></clause> <clause id="ID7f8a55f7ccbd4b2d952d549555e911f0"><enum>(ii)</enum><text>expend any funds received under the grant program not later than 4 years after the date on which the grant agreement under subsection (g) is made.</text></clause></subparagraph>
<subparagraph id="IDbe656801f11b44c8987a6ffecd7a297b"><enum>(B)</enum><header>Unobligated amounts</header><text>After the date described in subparagraph (A)(i), the Secretary may—</text> <clause id="idcd2d3b968e71486ea08c746e9107856f"><enum>(i)</enum><text>grant an extension to the eligible entity if the eligible entity has—</text>
<subclause id="id59A814DB42D4444F81B125B20E4EBD0B"><enum>(I)</enum><text>demonstrated progress in executing the grant; and</text></subclause> <subclause id="idEA87B58F3FDB459B9C2A0CB6BF45BB0E"><enum>(II)</enum><text>certified that the eligible entity needs additional time to obligate grant funds; or </text></subclause></clause>
<clause id="idBA8E67C0AE534FAAAB6A2176F00D0F9E"><enum>(ii)</enum><text>award to another eligible entity, to carry out activities under this section, any amounts that an eligible entity has not obligated under subparagraph (A)(i).</text></clause></subparagraph></paragraph></subsection> <subsection id="ID1160ca0830bc4b5ab7821553a7d03f3b"><enum>(d)</enum><header>Application</header> <paragraph id="ID98cb628b6a764f07b069456478d46ee9"><enum>(1)</enum><header>In general</header><text>The lead applicant of an eligible entity that desires a grant under this section shall submit to the Director an application, at such time and in such manner as the Director shall prescribe, that contains—</text>
<subparagraph id="IDc64a9edb7d654a37a8df8f95aa705617"><enum>(A)</enum><text>a description of the project proposed to be carried out by the eligible entity;</text></subparagraph> <subparagraph id="ID3371c0e8be5348eeb82a5649cacb0068"><enum>(B)</enum><text>a budget for the project that includes the anticipated Federal share of the cost of the project and a description of the source of the non-Federal share;</text></subparagraph>
<subparagraph id="IDb44eae7a506c462f92e5443f9ab3abef"><enum>(C)</enum><text>the designation of lead applicant to receive and manage any funds received by the eligible entity under the grant program;</text></subparagraph> <subparagraph id="IDb96b56e1a20c483899e8e97ad9c71c13"><enum>(D)</enum><text>a signed copy of a memorandum of understanding among local jurisdictions, including, as appropriate, a State, an Indian tribe, units of general local government, units of special purpose local government, metropolitan planning organizations, rural planning organizations, and regional councils that demonstrates—</text>
<clause id="IDb523c4176d7a485797dc860bb607d681"><enum>(i)</enum><text>the creation of an eligible entity;</text></clause> <clause id="IDcd50f4cd4ecf4e3bb53bd0b291584274"><enum>(ii)</enum><text>a description of the nature and extent of planned collaboration between the eligible entity and any partners of the eligible entity;</text></clause>
<clause id="ID2c6f115dd52c4d1f9cdb0ad97a460e87"><enum>(iii)</enum><text>a commitment to develop a comprehensive regional plan; and</text></clause> <clause id="ID480f4d6def834e06931ca92c20888b3b"><enum>(iv)</enum><text>a commitment to implement the plan after the plan is developed;</text></clause></subparagraph>
<subparagraph id="IDa1a26e6f39bb472ea30db50a0cedaa0f"><enum>(E)</enum><text>a certification by the lead applicant that the eligible entity has—</text> <clause id="ID93260ff062ef4316a860aac3e09643bc"><enum>(i)</enum><text>secured the participation, or made a good-faith effort to secure the participation, of transportation providers and public housing agencies within the area affected by the comprehensive regional plan and the entities described in clause (ii); and</text></clause>
<clause id="ID1e36e51ed0fa49ea8b21e44a68e3cb7f"><enum>(ii)</enum><text>created, or will create not later than 1 year after the date of the grant award, a regional advisory board to provide input and feedback on the development of the comprehensive regional plan that includes representatives of a State, the metropolitan planning organization, the rural planning organization, the regional council, local jurisdictions, non-profit organizations, and others, as deemed appropriate by the eligible entity, given the local context of the comprehensive planning effort; and</text></clause></subparagraph> <subparagraph id="IDe021199feb864326851eb06f3b82cc39"><enum>(F)</enum><text>a certification that the eligible entity has solicited public comment on the contents of the project description under subparagraph (A) that includes—</text>
<clause id="ID140d41d5050f4eada86f007c2c781d6d"><enum>(i)</enum><text>a description of the process for receiving public comment relating to the proposal; and</text></clause> <clause id="IDc8305e18120f4fe49a403bddc89a2d29"><enum>(ii)</enum><text>such other information as the Director may require;</text></clause></subparagraph>
<subparagraph id="IDedda30ebfe774501983924cc65dcab7e"><enum>(G)</enum><text>a description of how the eligible entity will carry out the activities under subsection (f); and</text></subparagraph> <subparagraph id="ID78a16ccad1ef40eca656456bda171b10"><enum>(H)</enum><text>such additional information as the Director may require.</text></subparagraph></paragraph>
<paragraph id="ID50b2a61d95ce40e390ef92405f73a326"><enum>(2)</enum><header>Indian tribes</header><text>An eligible entity that is an Indian tribe is not required to submit the designation under paragraph (1)(C) or the certification under paragraph (1)(E).</text></paragraph></subsection> <subsection id="IDa41d58278f6a4458ab3faa59805eb1ce"><enum>(e)</enum><header>Selection</header><text>In evaluating an application for a grant under the grant program, the Director shall consider the extent to which the application—</text>
<paragraph id="IDd007395a30e34c44bb3943e31d53b6ca"><enum>(1)</enum><text>demonstrates that the eligible entity has or will have the legal, financial, managerial, and technical capacity to carry out the project;</text></paragraph> <paragraph id="IDf1451587d3ff4e96ba122f8dd476c17f"><enum>(2)</enum><text>demonstrates the extent to which the eligible entity has developed partnerships throughout an entire region, including, as appropriate, partnerships with the entities described in subsection (d)(1)(D);</text></paragraph>
<paragraph id="IDd416df596f2347c7bd1edcd91318a8ee"><enum>(3)</enum><text>demonstrates integration with local efforts in economic development and job creation;</text></paragraph> <paragraph id="IDe7c5c6e8298e4359ac0a4c3ae71fdd32"><enum>(4)</enum><text>demonstrates a strategy for implementing a comprehensive regional plan through regional infrastructure investment plans and local land use plans;</text></paragraph>
<paragraph id="ID34094026ae1d435c9c1c8bc45585128c"><enum>(5)</enum><text>promotes diversity among the geographic regions and the size of the population of the communities served by recipients of grants under this section;</text></paragraph> <paragraph id="IDb146bb2a65894069818653cb9a45629a"><enum>(6)</enum><text>demonstrates a commitment to seeking substantial public input during the planning process and public participation in the development of the comprehensive regional plan;</text></paragraph>
<paragraph id="idc856357d5dfa49dcb4a8e1648a4683b1"><enum>(7)</enum><text>demonstrates a strategy for connecting underserved, low-income, disabled, and minority community members with housing, transportation, and infrastructure resources; </text></paragraph> <paragraph id="iddd37be044c7c4b16ad787fb6d57a08b1"><enum>(8)</enum><text>demonstrates a commitment to implementing the plan upon completion, including securing funding to implement 1 or more elements of the plan; and </text></paragraph>
<paragraph id="IDc620546db4fa4b8e8b40fab33405ea65"><enum>(9)</enum><text>demonstrates such other qualities as the Director may determine.</text></paragraph></subsection> <subsection id="ID368ffab275b84324b1d0edec15cda35f"><enum>(f)</enum><header>Eligible activities</header><text>An eligible entity that receives a grant under this section shall carry out a project that includes 1 or more of the following activities:</text>
<paragraph id="ID7eb1a14320184fe18b136441da3708ed"><enum>(1)</enum><text>Coordinating locally defined planning processes across jurisdictions and agencies.</text></paragraph> <paragraph id="ID662c67f18dff4c539121ffd41d6fa033"><enum>(2)</enum><text>Identifying potential regional partnerships for developing and implementing a comprehensive regional plan.</text></paragraph>
<paragraph id="ID91f736582e5a4e5aad5b115b5dbafbe7"><enum>(3)</enum><text>Conducting or updating assessments to determine regional needs, including healthy housing, and promote economic and community development.</text></paragraph> <paragraph id="IDb39ab2f2f7fd4787aa38b1fca4fde66b"><enum>(4)</enum><text>Developing or updating—</text>
<subparagraph id="ID4b61b3fac4744cf9900fc4b78d6a1bb8"><enum>(A)</enum><text>a comprehensive regional plan; or</text></subparagraph> <subparagraph id="IDd75a02bd716c4226b72c38c138216d4e"><enum>(B)</enum><text>goals and strategies to implement an existing comprehensive regional plan.</text></subparagraph></paragraph>
<paragraph id="ID52e66ada66e440e4b622f466ab18dbe5"><enum>(5)</enum><text>Identifying and implementing local zoning and other policy or code changes necessary to implement a comprehensive regional plan and promote sustainable development and fair housing.</text></paragraph></subsection> <subsection id="IDb83c1e1327804516bebc12236e6070dd"><enum>(g)</enum><header>Grant agreement</header><text>Each eligible entity that receives a grant under the grant program shall agree to establish, in coordination with the Director, performance measures, reporting requirements, and any other requirements that the Director determines are necessary, that the eligible entity, through the lead applicant, shall meet at the end of each year in which the eligible entity receives funds under the grant program.</text></subsection>
<subsection id="ID3d1f4ec0b3dc4eabb4645d9529464109"><enum>(h)</enum><header>Public outreach</header>
<paragraph id="ID27b38c23353b4dc7b0df778149058ec5"><enum>(1)</enum><header>Outreach required</header><text>Each eligible entity that receives a grant under the grant program shall perform substantial outreach activities—</text> <subparagraph id="IDf0ede56bf7a64ad498b173b4f2c8b3c4"><enum>(A)</enum><text>to engage a broad cross-section of community stakeholders in the process of developing a comprehensive regional plan, including low-income families, minorities, disabled individuals, older adults, and economically disadvantaged community members; and</text></subparagraph>
<subparagraph id="ID2ec5ee01c2944d69a1a03668131cb571"><enum>(B)</enum><text>to create an effective means for stakeholders to participate in the development and implementation of a comprehensive regional plan.</text></subparagraph></paragraph> <paragraph id="IDe173f7def95e447eafb8b95c9e7b4d3f"><enum>(2)</enum><header>Finalization of comprehensive regional plan</header> <subparagraph id="IDa098f17bfc834863aa2bedcf8635b01e"><enum>(A)</enum><header>In general</header><text>An eligible entity that receives a grant under the grant program may not finalize a comprehensive regional plan before the eligible entity holds a public hearing to obtain the views of citizens, public agencies, and other interested parties.</text></subparagraph>
<subparagraph id="ID4a9281a70b8f4d68b69c2658abde2c3f"><enum>(B)</enum><header>Availability of information</header><text>Not later than 30 days before a hearing described in subparagraph (A), an eligible entity shall make the proposed comprehensive regional plan and all information relevant to the hearing—</text> <clause id="id6999A1455A8146DAB91B0FF894C5A521"><enum>(i)</enum><text>available to the public for inspection during normal business hours; and</text></clause>
<clause id="id43C2EC5D539A4D37932BA2E90876C7D5"><enum>(ii)</enum><text>available on a publicly accessible website.</text></clause></subparagraph> <subparagraph id="IDb4b32c1b72b54ea39f1be199efd86c63"><enum>(C)</enum><header>Notice</header><text>Not later than 30 days before a hearing described in subparagraph (A), an eligible entity shall publish notice—</text>
<clause id="ID32bdeb250d584e099a5f5d45efcd191e"><enum>(i)</enum><text>of the hearing; and</text></clause> <clause id="ID6449c23c04c540bea569878c3da40980"><enum>(ii)</enum><text>that the information described in subparagraph (B) is available.</text></clause></subparagraph></paragraph></subsection>
<subsection id="IDa9084f36c83749a18365eb878ba56a07"><enum>(i)</enum><header>Violation of grant agreement or failure To comply with public outreach requirements</header><text>If the Director determines that an eligible entity has not met the performance measures established in the grant agreement under subsection (g), is not making reasonable progress toward meeting such measures, is otherwise in violation of the grant agreement, or has not complied with the public outreach requirements under subsection (h), the Director may—</text> <paragraph id="ida015664987d34dd5a120f66d6c0506a6"><enum>(1)</enum><text>impose increased reporting and more stringent expenditure authorization requirements;</text></paragraph>
<paragraph id="idd94b0280afbe4df3bd0e2beff079d48b"><enum>(2)</enum><text>withhold financial assistance until the requirements under the grant agreement or under subsection (h), as applicable, are met;</text></paragraph> <paragraph id="id5a963169b1c24bcdbd8ffc82e25707d7"><enum>(3)</enum><text>wholly or partly suspend or terminate the grant agreement;</text></paragraph>
<paragraph id="id187b8073baf44c16811e5540526b822d"><enum>(4)</enum><text>refer the grantee to the appropriate office within the Department for further enforcement action; and</text></paragraph> <paragraph id="ida91fc36352894219b979c24ac30812d2"><enum>(5)</enum><text>take other remedies that may be legally available.</text></paragraph></subsection>
<subsection id="id83D17154D41F46A99C9EE4E49C161022"><enum>(j)</enum><header>Report on the comprehensive planning grant</header>
<paragraph id="idD2A8E484B57943A3871EFBE51ADBE280"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date on which the grant agreement under subsection (g) expires, an eligible entity that receives a grant under the grant program shall submit a final report on the project to the Secretary.</text></paragraph> <paragraph id="id9A36EF7B38C94E80AF17252A8244C09B"><enum>(2)</enum><header>Contents of report</header><text>The report shall include—</text>
<subparagraph id="idF20AE08F39D44AB8938909F0AB744431"><enum>(A)</enum><text>a detailed explanation of the activities undertaken using the grant, including an explanation of the completed project and how it achieves specific transit-oriented, transportation, housing, or sustainable community goals within the region;</text></subparagraph> <subparagraph id="idFA3C958084B04D32A7C91B544E0D0D3A"><enum>(B)</enum><text>a discussion of any obstacles encountered in the planning process and how the eligible entity overcame the obstacles;</text></subparagraph>
<subparagraph id="idE5A5A330ABE84905A45BF27839FD24F3"><enum>(C)</enum><text>an evaluation of the success of the project using the performance measures established in the grant agreement under subsection (g), including an evaluation of the planning process and how the project contributes to carrying out the comprehensive regional plan; </text></subparagraph> <subparagraph id="ide6f6bed648fb4e9ab845f527d22739c8"><enum>(D)</enum><text>an outline of any proposed follow-up activities to implement 1 or more elements of the plan, including commitments of additional planned public or private investments for such activities; and </text></subparagraph>
<subparagraph id="id61BAB13E02284F968955302D95BA2EB2"><enum>(E)</enum><text>any other information the Director may require.</text></subparagraph></paragraph> <paragraph id="idC643C5CB6CFD4738A84100A2A18AFD4C"><enum>(3)</enum><header>Interim reports</header><text>The Director may require an eligible entity to submit an interim report or reports before the date on which the project for which the grant is awarded is completed.</text></paragraph></subsection>
<subsection id="IDa763d8750b1244a8b3c2e065c4bbdab3"><enum>(k)</enum><header>Authorization of appropriations</header>
<paragraph id="ID62e14694bcd64e4fbd15c42f348f221b"><enum>(1)</enum><header>Authorization</header><text>There are authorized to be appropriated to the Secretary for the award of grants under this section, to remain available until expended—</text> <subparagraph id="IDe84b96074015479291b15169b0e3b463"><enum>(A)</enum><text>$570,800,000 for fiscal year 2022; and</text></subparagraph>
<subparagraph id="ID4993a01aeddb409ba3db9c125e25d615"><enum>(B)</enum><text>$707,300,000 for each of fiscal years 2023 through 2026.</text></subparagraph></paragraph> <paragraph id="IDbcb541a0686c4d61bb4c6682ecbedaa6"><enum>(2)</enum><header>Technical assistance</header><text>The Director may use not more than 2 percent of the amounts made available under this subsection for a fiscal year for technical assistance under section 5(c)(3).</text></paragraph></subsection></section>
<section id="ID8fb85f2fe2484604a85d5d0097808210"><enum>7.</enum><header>Community challenge grant program</header>
<subsection id="ID23415665f29342d8958d7d374e311549"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="IDfd80540735bd442bb4cb1b10d651020d"><enum>(1)</enum><text>the terms <term>consortium of units of general local governments</term>, <term>eligible entity</term>, and <term>eligible partner</term> have the meanings given those terms in section 6; and</text></paragraph>
<paragraph id="ID1c68c50185a6490fb1f9fd80ab2ec72f"><enum>(2)</enum><text>the term <term>grant program</term> means the community challenge grant program established under subsection (b).</text></paragraph></subsection> <subsection id="ID0e1a4aa2489043b39a954d3289622372"><enum>(b)</enum><header>Community challenge grant program established</header><text>The Director shall establish a community challenge grant program to make grants to eligible entities to—</text>
<paragraph id="ID3266b42190b848a69b83caa82dd959c1"><enum>(1)</enum><text>promote integrated planning and investments across policy and governmental jurisdictions; and</text></paragraph> <paragraph id="ID21ce4204003d46b88b13230beeb549c9"><enum>(2)</enum><text>implement projects identified in a comprehensive regional plan.</text></paragraph></subsection>
<subsection id="ID48a76cc5d6414e9e89023c38da3f0b36"><enum>(c)</enum><header>Grants</header>
<paragraph id="id614D7C5B595B4A64A8FCA41BBC248ADE"><enum>(1)</enum><header>Diversity of grantees</header><text>The Director shall ensure—</text> <subparagraph id="id194F24CE2F794E419A135127426223F4"><enum>(A)</enum><text>geographic diversity among and adequate representation from eligible entities in each of the categories described in section 6(c)(1); and</text></subparagraph>
<subparagraph id="id2860C3AF9FD443BBAC898593FBA9C0FF"><enum>(B)</enum><text>diversity among and adequate representation from eligible entities described in section 6(c)(3).</text></subparagraph></paragraph> <paragraph id="idFA52D552F998446C96C7DEF52F99F68B"><enum>(2)</enum><header>Terms and conditions</header><text>Except as otherwise provided in this section, a grant under the grant program shall be made on the same terms and conditions as a grant under section 6.</text></paragraph>
<paragraph id="IDa5c8fdedbb354dc0a38749eb9d1c8724"><enum>(3)</enum><header>Expending funds</header><text>An eligible entity that receives a grant under the grant program shall expend any funds received under the grant program not later than 5 years after the date on which the grant agreement under subsection (g) is made.</text></paragraph></subsection> <subsection id="ID05b4c2b6683d4371a4f5453b00ae9af2"><enum>(d)</enum><header>Application</header> <paragraph id="IDeddc658a5a0c49c0897c32293cb60e73"><enum>(1)</enum><header>Contents</header><text>An eligible entity that desires a grant under the grant program shall submit to the Director an application, at such time and in such manner as the Director shall prescribe, that contains—</text>
<subparagraph id="IDe690573fea094db5b9c58c25bbfc493b"><enum>(A)</enum><text>a copy of the comprehensive regional plan, whether developed as part of the comprehensive planning grant program under section 6 or developed independently;</text></subparagraph> <subparagraph id="IDc0a158afb315491c821a9317fa94c8e0"><enum>(B)</enum><text>a description of the project or projects proposed to be carried out using a grant under the grant program;</text></subparagraph>
<subparagraph id="ID3a27e0e84188464aa71df5ab0f85e68d"><enum>(C)</enum><text>a description of any preliminary actions that have been or must be taken at the local or regional level to implement the project or projects described under subparagraph (B), including the revision of land use or zoning policies;</text></subparagraph> <subparagraph id="id9dc750e66fff47af8923acb09184f700"><enum>(D)</enum><text>the designation of a lead applicant to be the entity to establish the direct grant relationship with the Secretary; </text></subparagraph>
<subparagraph id="IDacbd76ed534b440e8bc5fded2673c14b"><enum>(E)</enum><text>a signed copy of a memorandum of understanding among local jurisdictions, including, as appropriate, a State, units of general local government, units of special purpose local government, metropolitan planning organizations, rural planning organizations, and regional councils that demonstrates—</text> <clause id="IDe92261bb630a493780bbea3585fd6ff7"><enum>(i)</enum><text>the creation of a consortium of units of general local government; and</text></clause>
<clause id="ID4db5ee23500b4fa08029639f490dc604"><enum>(ii)</enum><text>a commitment to implement the activities described in the comprehensive regional plan; and</text></clause></subparagraph> <subparagraph id="IDf637a06fe432465b89243572c5a76109"><enum>(F)</enum><text>a certification that the eligible entity has solicited public comment on the contents of the project or projects described in subparagraph (B) that includes—</text>
<clause id="ID218156f11e1c48f1a614200bf8514b74"><enum>(i)</enum><text>a certification that the eligible entity made information about the project or projects available and afforded citizens, public agencies, and other interested parties a reasonable opportunity to examine the content of the project or projects and to submit comments;</text></clause> <clause id="IDfc0ab9a1b0f544de915fca1a316f76df"><enum>(ii)</enum><text>a description of the process for receiving public comment, and a description of the outreach efforts to affected populations and stakeholders;</text></clause>
<clause id="ID27734f1f9e794c34961996471be0f85f"><enum>(iii)</enum><text>a certification that the eligible entity—</text> <subclause id="ID173039630ca34b6b99a46f68524c2c0f"><enum>(I)</enum><text>held a public hearing to obtain the views of citizens, public agencies, and other interested parties;</text></subclause>
<subclause id="ID757c28d28795412b9370e849030b7b11"><enum>(II)</enum><text>made the proposed project or projects and all information relevant to the hearing available for inspection by the public during normal business hours not less than 30 days before the hearing under subclause (I); and</text></subclause> <subclause id="ID6dd1b77c525a490f904493ffb244ebb6"><enum>(III)</enum><text>published a notice informing the public of the hearing under subclause (I) and the availability of the information described in subclause (II); and</text></subclause></clause></subparagraph>
<subparagraph id="ID502bfae8705b4871b31823dcd70e1754"><enum>(G)</enum><text>a budget for the project or projects that includes the Federal share of the cost of the project or projects requested and a description of the source of the non-Federal share; and</text></subparagraph> <subparagraph id="ID7cf3405a07d24ca49e6013fa325de0f5"><enum>(H)</enum><text>such additional information as the Director may require.</text></subparagraph></paragraph>
<paragraph id="ID63cd93892f90466aadd993426564ef00"><enum>(2)</enum><header>Indian tribes</header><text>An eligible entity that is an Indian tribe is not required to designate a lead applicant under paragraph (1)(D) or submit a memorandum of understanding under paragraph (1)(E).</text></paragraph></subsection> <subsection id="IDeaaf47c21cad468f8bc0833a2ab6f7be"><enum>(e)</enum><header>Selection</header><text>In evaluating an application for a grant under the grant program, the Director shall consider the extent to which the application—</text>
<paragraph id="ID724b1545ec5a40e9803f606e23754a8d"><enum>(1)</enum><text>demonstrates that the eligible entity has or will have the legal, financial, managerial, and technical capacity to carry out the project;</text></paragraph> <paragraph id="ID29a0fe80cf7343cf8ac59a417b99ffb1"><enum>(2)</enum><text>demonstrates the extent to which the eligible entity has developed partnerships throughout an entire region, including partnerships with units of special purpose local government and transportation providers;</text></paragraph>
<paragraph id="ID8cfaa03bf2044044b9dda0256bbdfdde"><enum>(3)</enum><text>demonstrates clear and meaningful interjurisdictional cooperation and coordination of housing, including healthy housing, transportation, and environmental policies and plans;</text></paragraph> <paragraph id="ID38493070a68545b18cf62725279db9bd"><enum>(4)</enum><text>demonstrates a commitment to implementing a comprehensive regional plan and documents action taken or planned to implement the plan;</text></paragraph>
<paragraph id="ID2155100d40914bdeb52608325e1f6eec"><enum>(5)</enum><text>identifies original and innovative ideas to overcoming regional problems, including local land use, zoning, or other obstacles to carrying out the comprehensive regional plan;</text></paragraph> <paragraph id="ID6c98e4fe343f49d99c423826396c4d96"><enum>(6)</enum><text>promotes diversity among the geographic regions and the size of the population of the communities served by recipients of grants under the grant program;</text></paragraph>
<paragraph id="ID8d6031fb35ce43d5bed2de29414235a9"><enum>(7)</enum><text>demonstrates a commitment to substantial public input throughout the implementation process;</text></paragraph> <paragraph id="ID37ce2a725ccb445fbea6359a00dda29e"><enum>(8)</enum><text>demonstrates a strategy for connecting underserved, low-income, disabled, and minority community members with housing, transportation, and infrastructure resources; and</text></paragraph>
<paragraph id="IDf1cce7734b694b2daa8f56a27f1ede45"><enum>(9)</enum><text>demonstrates such other qualities as the Director may determine.</text></paragraph></subsection> <subsection id="IDa134673b659947e3b354cc5f2e7f5ce7"><enum>(f)</enum><header>Grant activities</header> <paragraph id="ID702454c953144d27b935870b95cd8c6c"><enum>(1)</enum><header>Planning activities</header> <subparagraph id="id75F416EEB6DF4F718C67E6B8F35CF94B"><enum>(A)</enum><header>In general</header><text>An eligible entity that receives a grant under the grant program may use not more than 10 percent of the grant for planning activities.</text></subparagraph>
<subparagraph id="id3EFE5E2DE2104A7D8040BA787848B818"><enum>(B)</enum><header>Limitation</header><text>Activities related to the updating, reform, or development of a local code, plan, or ordinance to implement projects contained in a comprehensive regional plan shall not be considered planning activities for the purposes of a grant under the grant program.</text></subparagraph></paragraph> <paragraph id="IDaae5f5b7488844d2baade453b9cb3d21"><enum>(2)</enum><header>Projects</header><text>An eligible entity that receives a grant under the grant program shall carry out 1 or more projects that are designed to achieve the goals identified in a comprehensive regional plan.</text></paragraph></subsection>
<subsection id="IDc421dd4c0aa74f6893a32ff38f94a435"><enum>(g)</enum><header>Grant agreement</header><text>Each eligible entity that receives a grant under the grant program shall agree to establish, through the lead applicant and in coordination with the Director, performance measures, reporting requirements, and any other requirements that the Director determines are necessary, that the eligible entity, through the lead applicant, shall meet at the end of each year in which the eligible entity receives funds under the grant program.</text></subsection> <subsection id="ID157a3fb535624dea999a36c22b3c54d8"><enum>(h)</enum><header>Violation of grant agreement</header><text>If the Director determines that an eligible entity has not met the performance measures established under subsection (g), is not making reasonable progress toward meeting such measures, or is otherwise in violation of the grant agreement, the Director may—</text>
<paragraph id="id2cd4f082ae50420e9a4eb74f35ccb675"><enum>(1)</enum><text>impose increased reporting and more stringent expenditure authorization requirements;</text></paragraph> <paragraph id="id975bf6a184a4412081083c17a65c4160"><enum>(2)</enum><text>withhold financial assistance until the requirements under the grant agreement are met;</text></paragraph>
<paragraph id="id2695fcf2417a439faf062797f5afef47"><enum>(3)</enum><text>wholly or partly suspend or terminate the grant agreement;</text></paragraph> <paragraph id="idbf6246383e144578821db35dbb0e02f7"><enum>(4)</enum><text>refer the grantee to the appropriate office within the Department for further enforcement action; and</text></paragraph>
<paragraph id="id914a8b73ef8644cdb451042ee7ba7b51"><enum>(5)</enum><text>take other remedies that may be legally available.</text></paragraph></subsection> <subsection id="ID96946468354f4fc0bd233795b9abd561"><enum>(i)</enum><header>Report on the community challenge grant</header> <paragraph id="ID86b1bdd8cf8b40368d914199eabcff12"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date on which the grant agreement under subsection (g) expires, an eligible entity that receives a grant under the grant program shall submit a final report on the project to the Secretary.</text></paragraph>
<paragraph id="IDe86aaf847a7a456791c10370a66ae9f7"><enum>(2)</enum><header>Contents of report</header><text>The report shall include—</text> <subparagraph id="IDe563af3685324e578b624ec21cd1bb54"><enum>(A)</enum><text>a detailed explanation of the activities undertaken using the grant, including an explanation of the completed project and how it achieves specific transit-oriented, transportation, housing, or sustainable community goals within the region;</text></subparagraph>
<subparagraph id="IDb33e7811210d4f31834891efc0bd3b75"><enum>(B)</enum><text>a discussion of any obstacles encountered in the planning and implementation process and how the eligible entity overcame the obstacles;</text></subparagraph> <subparagraph id="ID19a013a9268f4dbca6ba56c4aa0394c1"><enum>(C)</enum><text>an evaluation of the success of the project using the performance measures established under subsection (g), including an evaluation of the planning and implementation process and how the project contributes to carrying out the comprehensive regional plan; </text></subparagraph>
<subparagraph id="ida628079a07bf4e079017094464110862"><enum>(D)</enum><text>outline of any proposed follow-up activities including commitments of additional planned public or private investments; and </text></subparagraph> <subparagraph id="ID3f5dea14eab84ba18dd7132f54adb9a6"><enum>(E)</enum><text>any other information the Director may require.</text></subparagraph></paragraph>
<paragraph id="IDa9269df5c69545fa9ddd74eeeac35f63"><enum>(3)</enum><header>Interim reports</header><text>The Director may require an eligible entity to submit an interim report or reports before the date on which the project for which the grant is awarded is completed.</text></paragraph></subsection> <subsection id="IDbeaa76d2cd7541cb8bb07ebae28f49b0" commented="no"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary for the award of grants under this section, to remain available until expended—</text>
<paragraph id="ID87f8f3c45c8c4205ae7fc6bec1b344e7"><enum>(1)</enum><text>$175,350,000 for each of fiscal years 2022 through 2023;</text></paragraph> <paragraph id="IDbe2c3e025ef2413984e42526c4270fea"><enum>(2)</enum><text>$203,700,000 for fiscal year 2024;</text></paragraph>
<paragraph id="ID0a20218f77194ebdab0cc480a3ac74d2"><enum>(3)</enum><text>$233,100,000 for fiscal year 2025; and</text></paragraph> <paragraph id="ID2673fa13e407419fab7a4d49f4c9775b"><enum>(4)</enum><text>$262,500,000 for fiscal year 2026.</text></paragraph></subsection></section>
<section id="ID25d33cc18cbe40b39b9fa2c0fc988206"><enum>8.</enum><header>Credit facility to support transit-oriented development</header>
<subsection id="ID49e0fd2b707b4dcc8020d645694e438c"><enum>(a)</enum><header>Definitions</header><text>In this section, the following definitions shall apply:</text> <paragraph id="IDb80821c9c14646a4a56764db579e50da"><enum>(1)</enum><header>Eligible applicant</header><text>The term <term>eligible applicant</term> means a State or local governmental authority.</text></paragraph>
<paragraph id="ID7345912c334f4a5f99e67640a604c34e"><enum>(2)</enum><header>Eligible area</header><text>The term <term>eligible area</term> means the area within <fraction>½</fraction> mile of an existing or planned major public transportation facility.</text></paragraph> <paragraph id="ID2c0828559a9b4a7bbf3ee4240ae21a55"><enum>(3)</enum><header>Eligible borrower</header><text>The term <term>eligible borrower</term> means—</text>
<subparagraph id="IDe6f48a231c0e4223af79f72148dc5496"><enum>(A)</enum><text>a governmental entity, authority, agency, or instrumentality;</text></subparagraph> <subparagraph id="ID647de2bf6bc043049a2f92207e8c084e"><enum>(B)</enum><text>a corporation, partnership, joint venture, or trust on behalf of which an eligible applicant has submitted an application under subsection (c); or</text></subparagraph>
<subparagraph id="IDb36b717b966645d0828e17bdf9245716"><enum>(C)</enum><text>any other legal entity undertaking an infrastructure development project on behalf of which an eligible applicant has submitted an application under subsection (c).</text></subparagraph></paragraph> <paragraph id="ID1d9b4cf380e0463a9d5bf953902abbe0"><enum>(4)</enum><header>Major public transportation facility</header><text>The term <term>major public transportation facility</term> means—</text>
<subparagraph id="id439E3A0A4ED84EB7B017BC0BA3A73D61"><enum>(A)</enum><text>a fixed-guideway public transportation station;</text></subparagraph> <subparagraph id="id3757029AC6D84519A81C073816AEE2B4"><enum>(B)</enum><text>a high speed rail or intercity rail station connecting to public transportation;</text></subparagraph>
<subparagraph id="idFFBCC50F7DDE49CDBA8887F4F92C395E"><enum>(C)</enum><text>an intermodal facility connecting multiple public transportation lines; or</text></subparagraph> <subparagraph id="idC77B37018D1F4252B68EE4D8493DA322"><enum>(D)</enum><text>a public transportation center located in an area other than an urbanized area.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID89201cb67eb2405e98ccdadc524b9c2f"><enum>(5)</enum><header>Planned major public transportation facility</header><text>The term <term>planned major public transportation facility</term> means a major public transportation facility for which—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idB46369CD079844BABAFD73CD880AC1F2"><enum>(A)</enum><text>appropriate environmental reviews have been initiated or have been completed; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id75FE270D15824D4EBE1A9F7FE5A9ADA2"><enum>(B)</enum><text>funding for construction can be reasonably anticipated.</text></subparagraph></paragraph> <paragraph id="ID98d54d599f894518bf73bad77ab518bb"><enum>(6)</enum><header>Project</header><text>The term <term>project</term> means an infrastructure project that is used to support a transit-oriented development in an eligible area, including—</text>
<subparagraph id="IDddc1f9dbe0bf42869c9c033ecd346119"><enum>(A)</enum><text>property enhancement, including conducting environmental remediation, park development, and open space acquisition;</text></subparagraph> <subparagraph id="ID194d6a024370443f8e41ff03a7291c64"><enum>(B)</enum><text>improvement of physical mobility, including rehabilitating, or providing for additional, streets, public transportation stations, structured parking, walkways, and bikeways;</text></subparagraph>
<subparagraph id="id26EDD8B244184DCCBB98C1188E075B3E"><enum>(C)</enum><text>improve accommodations for individuals with disabilities;</text></subparagraph> <subparagraph id="IDc99e69923c2348288de9bd03b1274c4f"><enum>(D)</enum><text>utility development, including rehabilitating or relocating existing, or providing for new drinking water, wastewater, electric, and gas utilities; or</text></subparagraph>
<subparagraph id="ID50331d101969477d99db3474a2bff397"><enum>(E)</enum><text>community service facilities, such as child care centers.</text></subparagraph></paragraph> <paragraph id="id6E1D545668044736B1E5D5044D00A2CF"><enum>(7)</enum><header>Public transportation</header><text>The term <term>public transportation</term> has the meaning given that term in section 5302 of title 49, United States Code.</text></paragraph></subsection>
<subsection id="ID10366119f096414788ed65f03f357e52"><enum>(b)</enum><header>Loan program established</header><text>The Secretary, in consultation with the Secretary of Transportation, may make or guarantee loans under this section to eligible borrowers for projects.</text></subsection> <subsection id="ID88ed23114ee64ad2a69cf20e79577dbe"><enum>(c)</enum><header>Application</header> <paragraph id="ID1e006ef18c1045ebbc6c5cbe48fd4a9e"><enum>(1)</enum><header>In general</header><text>An eligible applicant may submit to the Secretary an application for a loan or loan guarantee under this section—</text>
<subparagraph id="IDb88ce5e907424d80ba0d6e37b5d5304b"><enum>(A)</enum><text>to fund a project carried out by the eligible applicant; or</text></subparagraph> <subparagraph id="ID1a0461543db94f29be0f783a89c16f69"><enum>(B)</enum><text>on behalf of an eligible borrower, to fund a project carried out by the eligible borrower.</text></subparagraph></paragraph></subsection>
<subsection id="ID6837a6b2bfc74200af3bd5aa0e96e912"><enum>(d)</enum><header>Selection criteria</header>
<paragraph id="ID83c0e7c9edbf4ee6a19f73c46ac707d5"><enum>(1)</enum><header>In general</header><text>The Secretary may make a loan or loan guarantee under this section for a project that—</text> <subparagraph id="IDf1b84ae22ffb427281d931b526edc9c1"><enum>(A)</enum><text>is part of a community-wide development plan, as defined by the Secretary;</text></subparagraph>
<subparagraph id="ID71b9ea2b1b3c4eeab9c76ae91c144aef"><enum>(B)</enum><text>promotes sustainable development; and</text></subparagraph> <subparagraph id="IDad4a69f4e084487887c84b9387dbce74"><enum>(C)</enum><text>ensures that not less than 20 percent of any housing units constructed or substantially rehabilitated as part of transit-oriented development supported by the project are affordable over the long-term to, and occupied at time of initial occupancy by—</text>
<clause id="idCD5FDAA49DC94DACB6D554ABE0849E19"><enum>(i)</enum><text>renters with incomes at or below 60 percent of the area median income; or</text></clause> <clause id="id4C48658C665D48A6A1C1190530C9450E"><enum>(ii)</enum><text>homeowners with incomes at or below 100 percent of the area median income.</text></clause></subparagraph></paragraph>
<paragraph id="IDea58afe13cac4b5eab47ad0336d80966"><enum>(2)</enum><header>Considerations</header><text>The Secretary, in consultation with the Secretary of Transportation, shall select the recipients of loans and loan guarantees under this section based on the extent to which—</text> <subparagraph id="IDccaca1a6a1fb4b6cb6e115519090e088"><enum>(A)</enum><text>the transit-oriented development supported by the project will encourage increased use of transit;</text></subparagraph>
<subparagraph id="ID4c9b1788a4904f62859e4ee0c3ba58d7"><enum>(B)</enum><text>the transit-oriented development supported by the project will create or preserve long-term affordable housing units in addition to the housing units required to be made available under paragraph (1)(C) or will provide deeper affordability than required under paragraph (1)(C);</text></subparagraph> <subparagraph id="IDaaf0a8f3ce9e441ab69354b24357a655"><enum>(C)</enum><text>the project will facilitate and encourage additional development or redevelopment in the overall public transportation station area;</text></subparagraph>
<subparagraph id="IDadbddaa34aef4ce19fbc6de1c0ad596f"><enum>(D)</enum><text>the local government has adopted policies that—</text> <clause id="ID9809ff55b1c1411491b76ecf717e33ae"><enum>(i)</enum><text>promote long-term affordable housing; and</text></clause>
<clause id="ID86afe9379a75489b8473e76f5e39aa08"><enum>(ii)</enum><text>allow high-density, mixed-use development near public transportation stations;</text></clause></subparagraph> <subparagraph id="IDdfafe26534d2455ca106585abb76a839"><enum>(E)</enum><text>the transit-oriented development supported by the project is part of a comprehensive regional plan;</text></subparagraph>
<subparagraph id="IDa0378272382444e6b8f78168017f02ab"><enum>(F)</enum><text>the eligible borrower has established a reliable, dedicated revenue source to repay the loan; and</text></subparagraph> <subparagraph id="ID2dbbe4b9d06e40dc9072ef0826d5f9f9"><enum>(G)</enum><text>a loan or loan guarantee under this section would be used in conjunction with non-Federal resources to fund the project.</text></subparagraph></paragraph></subsection>
<subsection id="ID24e0da41dd844c4aa010faced353c8da"><enum>(e)</enum><header>Eligible sources of repayment</header><text>A loan made or guaranteed under this section shall be repayable, in whole or in part, from dedicated revenue sources, which may include—</text> <paragraph id="ID2f99710b9f7440ddae6d57327c03a42c"><enum>(1)</enum><text>user fees;</text></paragraph>
<paragraph id="IDf83a38279d544fdf851222a8aadd2ed3"><enum>(2)</enum><text>property tax revenues;</text></paragraph> <paragraph id="ID03c248a1462c49cbbd4a79feace71685"><enum>(3)</enum><text>sales tax revenues;</text></paragraph>
<paragraph id="IDbafef217c9a945719f1470af515ac395"><enum>(4)</enum><text>other revenue sources dedicated to the project by property owners and businesses; and</text></paragraph> <paragraph id="IDf10982c56a25444199fec02d075c7688"><enum>(5)</enum><text>a bond or other indebtedness backed by one of the revenue sources listed in this paragraph.</text></paragraph></subsection>
<subsection id="IDbdad599b1428400baf1d3a808ac731be"><enum>(f)</enum><header>Interest rate</header><text>The Secretary shall establish an interest rate for loans made or guaranteed under this section with reference to a benchmark interest rate (commonly known as a <quote>yield</quote>) on marketable Treasury securities with a maturity that is similar to the loans made or guaranteed under this section.</text></subsection> <subsection id="ID8a180319f5c34ac5ac906c37d293f7c2"><enum>(g)</enum><header>Maximum maturity</header><text>The maturity of a loan made or guaranteed under this section may not exceed the lesser of—</text>
<paragraph id="ID444905e198c1473b96de87cb127e62db"><enum>(1)</enum><text>35 years; or</text></paragraph> <paragraph id="ID09dcc75a7314498680a329b78c83a531"><enum>(2)</enum><text>100 percent of the useful life of any project to be financed by the loan, as determined by the Secretary.</text></paragraph></subsection>
<subsection id="ID38b781b0e89748449760ebd18f9f079c"><enum>(h)</enum><header>Maximum loan guarantee rate</header>
<paragraph id="IDbf5db54cd27d435691e56deca78cd8a1"><enum>(1)</enum><header>In general</header><text>The guarantee rate on a loan guaranteed under this section may not exceed 75 percent of the amount of the loan.</text></paragraph> <paragraph id="IDe24f7ed3f0284292bf43754b20986ea1"><enum>(2)</enum><header>Lower guarantee rate for low-risk borrowers</header><text>The Secretary shall establish a guarantee rate for loans to eligible borrowers that the Secretary determines pose a lower risk of default that is lower than the guarantee rate for loans to other eligible borrowers.</text></paragraph></subsection>
<subsection id="ID3cb0355f55234dd2bd454be268d1909e"><enum>(i)</enum><header>Fees</header><text>The Secretary shall establish fees for loans made or guaranteed under this section at a level that is sufficient to cover all or part of the costs to the Federal Government of making or guaranteeing a loan under this section.</text></subsection> <subsection id="IDc13477681d2f4877b516070ebf1a4a22"><enum>(j)</enum><header>Nonsubordination</header><text>A loan made or guaranteed under this section may not be subordinated to the claims of any holder of an obligation relating to the project in the event of bankruptcy, insolvency, or liquidation.</text></subsection>
<subsection id="ID6614906deee54edcbaf475bcbc7c4e99"><enum>(k)</enum><header>Commencement of repayment</header><text>The scheduled repayment of principal or interest on a loan made or guaranteed under this section shall commence not later than 5 years after the date of substantial completion of a project.</text></subsection> <subsection id="ID2b0daccf2f0747cd94c6c1aadbdf5f3b"><enum>(l)</enum><header>Repayment deferral for loans</header> <paragraph id="ID60e877ef098e4245bb79ad7ebe4857d2"><enum>(1)</enum><header>In general</header><text>If, at any time after the date of substantial completion of a project, the Secretary determines that dedicated revenue sources of an eligible borrower are insufficient to make the scheduled loan repayments of principal and interest on a loan made or guaranteed under this section, the Secretary may, subject to criteria established by the Secretary, allow the eligible borrower to add unpaid principal and interest to the outstanding balance of the loan.</text></paragraph>
<paragraph id="IDa149ff2a0e784dcd9e3bd1498b3a6f99"><enum>(2)</enum><header>Treatment of deferred payments</header><text>Any payment deferred under this section shall—</text> <subparagraph id="IDe9bec112c9b04bfaa60a99be410a0791"><enum>(A)</enum><text>continue to accrue interest until fully repaid; and</text></subparagraph>
<subparagraph id="ID9b03e711d3134a018ff9879b327a980f"><enum>(B)</enum><text>be scheduled to be amortized over the remaining term of the loan.</text></subparagraph></paragraph></subsection> <subsection id="ide8e42d43b5584cafba2efc78ae32fba3"><enum>(m)</enum><header>Sanctions for performance deficiencies</header><text>If the Director determines that a recipient of a loan made or guaranteed under this section has performance deficiencies in the use of the loan funds under this section or is otherwise in violation of the loan or loan guarantee agreement, the Director may impose sanctions and undertake other remedies for noncompliance in accordance with section 111 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5311">42 U.S.C. 5311</external-xref>) and the implementing regulations of the Department.</text></subsection>
<subsection id="IDb06f84778811404b95b1b401935df2f8"><enum>(n)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for the cost of loans and loan guarantees under this section $110,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="idFAFAF1B2B2A94FD18CE4FC20C14BF9D4"><enum>9.</enum><header>Healthy homes</header> <subsection commented="no" display-inline="no-display-inline" id="idB1546CC5E9CA4CF09D87A10EF96D8E68"><enum>(a)</enum><header>Federal initiative To support healthy housing and substantially reduce housing-Related health hazards</header><text>The Secretary, acting through the Director of the Office of Lead Hazard Control and Healthy Homes and in consultation with the Secretary of Energy, the Administrator of the Environmental Protection Agency, the Secretary of Agriculture, the Secretary of the Treasury, the Director of the National Institute of Standards and Technology, the Director of the National Institute of Environmental Health Sciences, and the Director of the Centers for Disease Control, shall lead the Federal initiative to support healthy housing and substantially reduce the prevalence and severity of housing-related health hazards by—</text>
<paragraph id="idF44E850EFD7C41B783289A69F140CBCE"><enum>(1)</enum><text>identifying best practices and model programs, including practices and programs that link services for low-income families and services for health hazards;</text></paragraph> <paragraph id="idCA0CF4DAAEA94843BF06C562B087C1CA"><enum>(2)</enum><text>identifying best practices for finance products, building codes, and regulatory practices;</text></paragraph>
<paragraph id="idFD5491CA468F41EC851FE5498BEEDF98"><enum>(3)</enum><text>researching training programs and work practices that can accurately assess housing-related health hazards;</text></paragraph> <paragraph id="id4421A42E9CE5454B8503FF69B351813E"><enum>(4)</enum><text>promoting collaboration among Federal, State, local, and tribal agencies and non-governmental organizations; and</text></paragraph>
<paragraph id="idECB147CF662D4F2DA96A360AABD5AC83"><enum>(5)</enum><text>coordinating with all relevant Federal agencies.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id17881912DA3A49E8B888FBED6EC79783"><enum>(b)</enum><header>Assessment</header><text>The Secretary shall conduct a collaborative, interagency assessment of best practices for—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id7FF63BD40D274A76901CF71CB6B5C2FD"><enum>(1)</enum><text>coordinating activities relating to healthy housing; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idA5AA6E9C43474FF58D4DBDE687CCA441"><enum>(2)</enum><text>creating incentives in programs of the Federal Government to advance the complementary goals of improving environmental health, energy conservation, decarbonization, and the availability of housing.</text></paragraph></subsection>
<subsection id="idBEA4BA4ED96B4FBE94F32A6257B3A390"><enum>(c)</enum><header>Study and report on sustainable building features and indoor environmental quality in housing</header>
<paragraph id="id63FAD6F9BF4E4D059CE5EBB7ED07E01B"><enum>(1)</enum><header>Study</header><text>The Secretary, in consultation with the Secretary of Energy, the Director of the National Institute of Standards and Technology, the Director of the National Institute of Environmental Health Sciences, the Director of the Centers for Disease Control and Prevention, the Secretary of the Treasury, the Secretary of Agriculture, and any other Federal agency that the Secretary determines is appropriate, shall conduct a detailed study of how sustainable building features in housing, such as energy efficiency, affect—</text> <subparagraph id="id9E9D37D77B794C2B9B583F7D7E10F61B"><enum>(A)</enum><text>the quality of the indoor environment;</text></subparagraph>
<subparagraph id="id90B9F4B0A64D4C218AF68036FA70F273"><enum>(B)</enum><text>the prevalence of housing-related health hazards; and</text></subparagraph> <subparagraph id="id33A9C197439F4BC2B44912E0EBAEAD41"><enum>(C)</enum><text>the health of occupants of the housing.</text></subparagraph></paragraph>
<paragraph id="idB003D711E6AE47E1B88D2DEC43387D22"><enum>(2)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs and the Committee on Appropriations of the Senate and the Committee on Financial Services and the Committee on Appropriations of the House of Representatives a report containing the results of the study under paragraph (1).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id77977CE67FFC4EFE87B47F51BAECF96A"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section>
