<section id="H1B087A37E8054BC88E05049BBE9BA3EC"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> <paragraph id="H039BFAA24C6243C3A93238E278E9476A"><enum>(1)</enum><header>Adaptation</header><text>The term <term>adaptation</term> means the capacity of natural and human systems to adjust to climate change or its impacts in a matter that will reduce damage or take advantage of any beneficial aspects.</text></paragraph>
<paragraph id="HCCD8B25D3FF24ED886B4775934CD9B23"><enum>(2)</enum><header>Freely associated states</header><text>The term <term>Freely Associated States</term> means the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</text></paragraph> <paragraph id="H2D9CE78612B04512BA6F8FE422B8BD1C"><enum>(3)</enum><header>Insular areas</header><text>The term <term>Insular Areas</term> means the territories and Freely Associated States.</text></paragraph>
<paragraph id="H9CAA9C7954164CF1AE22F5B87863C2A5"><enum>(4)</enum><header>Mitigation</header><text>The term <term>mitigation</term> means measures and initiatives that would limit or reduce greenhouse gas emissions.</text></paragraph> <paragraph id="HEFAB86F15277490BB6478D675866E274"><enum>(5)</enum><header>Resilience</header><text>The term <term>resilience</term> means the capacity of natural and human systems to resist, assimilate, and recover from the effects of climate change in an efficient and timely manner, maintaining or restoring basic structures and essential functions.</text></paragraph>
<paragraph id="H749034542A374FB78B6001A127927EC9"><enum>(6)</enum><header>Renewable energy</header><text display-inline="yes-display-inline">The term <term>renewable energy</term> means energy that has been derived from Earth’s natural resources that are not finite or exhaustible, including solar, wind, hydroelectric, geothermal, and ocean (thermal and mechanics).</text></paragraph> <paragraph id="H42F66E71C0A34D83AFE0AF0264983D30"><enum>(7)</enum><header>Renewable energy system</header><text display-inline="yes-display-inline">The term <term>renewable energy system</term> includes off-grid or stand-alone systems, microgrids, nano grids, and virtual power plants systems based on renewable energy sources, including storage and other related ancillary equipment. These may also be referred to as <quote>eligible projects</quote>. Waste to energy are not considered as eligible projects. </text></paragraph>
<paragraph id="HF77FBDA662A64199B20D7B764EB64F47"><enum>(8)</enum><header>Territories</header><text>The term <term>territories</term> means American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, and the Virgin Islands of the United States.</text></paragraph> <paragraph id="H03EBC24C35BC45BFB2135B1871BF0368"><enum>(9)</enum><header>Territory</header><text display-inline="yes-display-inline">The term <term>territory</term> means American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, or the Virgin Islands of the United States.</text></paragraph></section>
<section id="H29B7BEA30AF040FA941F32862F1B42EF"><enum>4.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> <paragraph id="HD4E6714B2FCF45D8840C7E0D81FEED1C"><enum>(1)</enum><text>The Insular Areas are topographically and environmentally diverse and treasured by millions of individuals who call them home.</text></paragraph>
<paragraph id="H4A2FE9A638E649D1A5874EDE49AE9D04"><enum>(2)</enum><text>The territories in the Caribbean (Puerto Rico and the Virgin Islands of the United States) and the territories in the Pacific (American Samoa, the Commonwealth of the Northern Mariana Islands, and Guam) face many of the same climate change-related challenges. Freely Associated States face similar climate change-related vulnerabilities.</text></paragraph> <paragraph id="HCD8E2E3B4FED467C8B12BAF6BB96C72B"><enum>(3)</enum><text>Insular Areas are experiencing sea level rise, coastal erosion, and increasing storm impacts that threaten lives, critical infrastructure, ecosystems, and livelihood security.</text></paragraph>
<paragraph id="idAE3F539232624480870B024757DC0C9F"><enum>(4)</enum><text>Sea level rise from climate change poses an existential threat to low-lying Insular Areas, including the Republic of the Marshall Islands, the impacts of which could significantly undermine the strategic, economic, and defense interests of the United States.</text></paragraph> <paragraph id="H5A3D8FF66538448A9B471CC1D1CE2D55"><enum>(5)</enum><text>Temperature increases are likely to further create and intensify the length of droughts, reduce water supply, impact public health, and increase demand of freshwater in Insular Areas. In addition, temperature increases will drive coral reefs to extinction, eliminating a natural barrier against storm surge, increasing destruction of infrastructure, and threatening lives of the inhabitants of the islands.</text></paragraph>
<paragraph id="H2BCB82E77A7D48FCA56A2808079D964E"><enum>(6)</enum><text>In 2017, two major storms, Hurricane Irma and Hurricane Maria, impacted Puerto Rico and the Virgin Islands of the United States. Hurricane Maria caused thousands of deaths in Puerto Rico and the Virgin Islands of the United States and significant damage to their infrastructure, including Puerto Rico’s energy system. Hurricane Maria destroyed millions of trees in Puerto Rico and the Virgin Islands of the United States, which has significantly increased erosion and sediment transport. As a result, reservoirs have lost significant storage capacity and coral reefs are severely impacted.</text></paragraph> <paragraph id="HAA0BF8111DCE48118252EB0EAE9A0C2F"><enum>(7)</enum><text>In 2018, Typhoon Yutu impacted the Commonwealth of the Northern Mariana Islands and Guam, causing catastrophic destruction in those territories.</text></paragraph></section>
<title id="H5919494699FA462D93291AEE4004D3BE"><enum>I</enum><header>General Provisions </header>
<section id="H39F00A166B22424F9F4E1B7874D30D4B"><enum>101.</enum><header>Insular Area Climate Change Interagency Task Force</header>
<subsection id="HC2AB752B38F44D9A9EA7C817E159BEFE"><enum>(a)</enum><header>Establishment of task force</header><text>Not later than 90 days after the date of the enactment of this Act, the following shall jointly establish the <quote>Insular Area Climate Change Interagency Task Force</quote> (hereafter in this section referred to as the <quote>Task Force</quote>):</text> <paragraph id="HE00036FCE9C446A9B34EC6A5407B8894"><enum>(1)</enum><text>The Secretary of the Interior.</text></paragraph>
<paragraph id="HFAC9BF18C9B74A7DAF04D51DECF6A7D6"><enum>(2)</enum><text>The Secretary of Energy.</text></paragraph> <paragraph id="H3AD9D8DD72C24D29848178467F1C6F55"><enum>(3)</enum><text>The Secretary of State.</text></paragraph>
<paragraph id="HC710E88BF21D4F62B90F199FD8DA868F"><enum>(4)</enum><text>The Secretary of Housing and Urban Development.</text></paragraph> <paragraph id="H52BFA7812CCB4FA7A954F8185A775529"><enum>(5)</enum><text>The Secretary of Agriculture.</text></paragraph>
<paragraph id="HA9FCAAE3232B4F85A15757146B34F0FA"><enum>(6)</enum><text>The Secretary of Commerce.</text></paragraph> <paragraph id="H52ABCD92CC8E4832B7A0006DACD7AB55"><enum>(7)</enum><text>The Administrator of the Federal Emergency Management Agency.</text></paragraph>
<paragraph id="HCCB5DB60C3C04726A03A75285FE70239"><enum>(8)</enum><text>The Administrator of the Environmental Protection Agency.</text></paragraph></subsection> <subsection id="HF692B3370E7F43228428C5AFE682D683"><enum>(b)</enum><header>Chairperson</header><text>The Task Force shall be chaired by the Administrator of the Federal Emergency Management Agency.</text></subsection>
<subsection id="H000B36C6842545AAB978FAB39003FE77"><enum>(c)</enum><header>Duties</header><text>The Task Force shall—</text> <paragraph id="H276D83675E9144E59522772F213CE768"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate all Federal programs regarding ways to provide greater access to Federal programs and equitable baseline funding in relation to States, to territories for climate change planning, mitigation, adaptation, and resilience;</text></paragraph>
<paragraph id="H0AB549FDF865430784B42AEECC2F7B66"><enum>(2)</enum><text display-inline="yes-display-inline">identify statutory barriers to providing territories greater access to Federal programs and equitable baseline funding; and</text></paragraph> <paragraph id="H3A3F40460DFE42988BE6487978FE5BE9"><enum>(3)</enum><text>provide recommendations related to climate change in Insular Areas in consultation with local governments and non-governmental organizations in Insular Areas with expertise on climate change.</text></paragraph></subsection>
<subsection id="H6551F85A7C4B4A40B9C348A86F924719"><enum>(d)</enum><header>Comprehensive report</header><text>Not later than 1 year after the establishment of the Task Force, the Task Force, in consultation with Insular Area governments, shall issue a comprehensive report that—</text> <paragraph id="HE3F591CEAE454B02888DEE77C3011E69"><enum>(1)</enum><text display-inline="yes-display-inline">identifies Federal programs that have an impact on climate change planning, mitigation, adaptation, and resilience, but exclude territories in regard to eligibility, funding, and assistance, or do not provide equitable baseline funding in relation to States; and</text></paragraph>
<paragraph id="HFC0342CE4383459A98CD280A833BC78C"><enum>(2)</enum><text display-inline="yes-display-inline">provides advice and recommendations related to climate change in Insular Areas, such as new suggested Federal programs or initiatives.</text></paragraph></subsection> <subsection id="H00C9FD9102E74741BB010FC36365D2F8"><enum>(e)</enum><header>Publication; public availability</header><text>The Administrator of the Federal Emergency Management Agency shall ensure that the report required under subsection (d) is—</text>
<paragraph commented="no" id="H15B7F76456E248D49CA0AC74D84C618B"><enum>(1)</enum><text>submitted to the Committees on Energy and Commerce and Natural Resources of the House of Representatives, and Energy and Natural Resources of the Senate;</text></paragraph> <paragraph id="H3ED83E4EA5A34C3681DA2FEAB0D8285B"><enum>(2)</enum><text>published in the Federal Register for public comment for a period of at least 60 days; and</text></paragraph>
<paragraph id="H877F17473EA744B7BB1FC94B793ACDC7"><enum>(3)</enum><text display-inline="yes-display-inline">made available on a public website along with any comments received during the public comment period required under paragraph (2).</text></paragraph></subsection></section> <section id="H69260B91485344F3B096E2B4EB42ACFE"><enum>102.</enum><header>Non-Federal cost-share waiver</header><text display-inline="no-display-inline">Section 501 of <external-xref legal-doc="public-law" parsable-cite="pl/95/134">Public Law 95–134</external-xref> (commonly known as the <quote>Omnibus Territories Act of 1977</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/48/1469a">48 U.S.C. 1469a</external-xref>), is amended by adding at the end the following:</text>
<quoted-block style="OLC" id="HE3A510A9C5704FE0B64C72C9F79FF4AD">
<subsection commented="no" id="H8576D4628AF740BE8649A473F1CCD244"><enum>(e)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case of the Insular Areas, any department or agency shall waive any requirement for non-Federal matching funds under $750,000 (including in-kind contributions) required by law to be provided by those jurisdictions.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HBF8D7D160F8F4323859D6EF8495CA2D8"><enum>103.</enum><header>Coral reefs prize competitions</header> <subsection id="HB1389406C4544C3F9F82DB628E2AFDCB"><enum>(a)</enum><header>Prize competitions</header><text>The Director of the Office of Science and Technology Policy shall work with the head of each Federal agency represented on the U.S. Coral Reef Task Force established under Executive Order 13089 (63 Fed. Reg. 32701) to establish prize competitions, in accordance with section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>), that promote coral reef research and conservation in the Insular Areas, the State of Hawaii or Florida, or any other area in the United States or Insular Areas, as determined by the Director of the Office of Science and Technology Policy, facing a significant ecological threat due to coral reef die-offs.</text></subsection>
<subsection id="HAD0E3A97AAC9402C984323305FE3A6FE"><enum>(b)</enum><header>Waiver of matching requirement</header><text>Section 204(b)(2) of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6403">16 U.S.C. 6403(b)(2)</external-xref>) is amended—</text> <paragraph id="H6F33BB4BA2A546BE8267EEF7B91E8214"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the paragraph designation and all that follows through <quote>The Administrator</quote> and inserting the following:</text>

<paragraph id="H3620314099DE42B38EC225867C5CD8B4"><enum>(2)</enum><header>Waivers</header>
<subparagraph id="HD15084A9F95643C7AB56D793EF8F4E69"><enum>(A)</enum><header>In general</header><text>The Administrator</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HE9411E4FB5FE42AB9699314EA3D7D41B"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HA573B9349153405F874721400649C753">
<subparagraph id="H0CEF6BFFCD544D5581305E3DFD147AB6"><enum>(B)</enum><header>Sustaining coral reef management and monitoring</header><text display-inline="yes-display-inline">The Administrator shall waive the matching requirement under paragraph (1) for grants to implement State and territorial coral reef conservation cooperative agreements to sustain coral reef management and monitoring in the State of Florida or Hawaii, American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, the Commonwealth of Puerto Rico, or the United States Virgin Islands.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title> <title id="H5F9E8A061BC440B3BA96ADD7C635D193"><enum>II</enum><header>Department of the Interior</header> <section id="HEBF0CD866A1D451F9218DBEBB7F86400"><enum>201.</enum><header>Office of Insular Affairs Technical Assistance Program</header> <subsection id="H5EB7B931E74049378B98B4A6C630747A"><enum>(a)</enum><header>In general</header><text>The Secretary of the Interior, acting through the Office of Insular Affairs Technical Assistance Program, shall provide technical assistance for climate change planning, mitigation, adaptation, and resilience to Insular Areas under the jurisdiction of such Program.</text></subsection>
<subsection id="HE9DFB574DC7C456D86D1175D407B74C2"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary of the Interior to carry out this section $5,000,000 for each of the fiscal years 2022 through 2026.</text></subsection></section> <section id="HCF0D0CA444B844F2807F8C5A597D29B4"><enum>202.</enum><header>Runit Dome report and monitoring activities</header> <subsection id="H5A3B21A71B5B4791A0238B0C1BFF2198"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of the Interior shall submit to the Committees on Natural Resources and Energy and Commerce of the House of Representatives, and to the Committee on Energy and Natural Resources of the Senate, a report, prepared by independent experts not employed by the U.S. government, on the impacts of climate change on the <quote>Runit Dome</quote> nuclear waste disposal site in Enewetak Atoll, Marshall Islands, and on other environmental hazards in the vicinity thereof. The report shall include the following:</text>
<paragraph id="H23BBD28B398841C38EC01E326E47E435"><enum>(1)</enum><text>A detailed scientific analysis of any threats to the environment, and to the health and safety of Enewetak Atoll residents, posed by each of the following:</text> <subparagraph id="HB392AB73CD2245F796B598A82B212E16"><enum>(A)</enum><text>The <quote>Runit Dome</quote> nuclear waste disposal site.</text></subparagraph>
<subparagraph id="HB109FF9863254C1CB07542520FDE6364"><enum>(B)</enum><text>Crypts used to contain nuclear waste and other toxins on Enewetak Atoll.</text></subparagraph> <subparagraph id="H0AD67E20F7A3403F90D8543C19DF7832"><enum>(C)</enum><text>Radionuclides and other toxins present in the lagoon of Enewetak Atoll, including areas in the lagoon where nuclear waste was dumped.</text></subparagraph>
<subparagraph id="H4938D1F8F35D45588EB05E38CED57A79"><enum>(D)</enum><text>Radionuclides and other toxins, including beryllium, which may be present on the islands of Enewetak Atoll as a result of nuclear tests and other activities of the U.S. government, including tests of chemical and biological warfare agents, rocket tests, contaminated aircraft landing on Enewetak Island, and nuclear cleanup activities.</text></subparagraph> <subparagraph id="H7A18A7827EF547CCBD3EEC4E844A5452"><enum>(E)</enum><text>Radionuclides and other toxins that may be present in the drinking water on Enewetak Island or in the water source for the desalination plant.</text></subparagraph>
<subparagraph id="H174749BFD24A459D8BCABB4374D37196"><enum>(F)</enum><text>Radionuclides and other toxins that may be present in the groundwater under and in the vicinity of the nuclear waste disposal facility on Runit Island.</text></subparagraph></paragraph> <paragraph id="HD100D669B3BE49EA95491B2B1BADFA26"><enum>(2)</enum><text>A detailed scientific analysis of the extent to which rising sea levels, severe weather events and other effects of climate change might exacerbate any of the threats identified above.</text></paragraph>
<paragraph id="HEDF51C87CF664C6C9441B3FFF4CAF27A"><enum>(3)</enum><text>A detailed plan, including costs, to relocate all of the nuclear waste and other toxic waste contained in—</text> <subparagraph id="H32969FE96D2D4C7397A9CB5D76F20178"><enum>(A)</enum><text>the <quote>Runit Dome</quote> nuclear waste disposal site;</text></subparagraph>
<subparagraph id="H8E90976F5A264E9289249E16E4CA3304"><enum>(B)</enum><text>all of the crypts on Enewetak Atoll containing such waste; and</text></subparagraph> <subparagraph id="H803FFB0EFBB748FDB660EFFF11AEA51C"><enum>(C)</enum><text>the three dumping areas in Enewetak’s lagoon to a safe, secure facility to be constructed in an uninhabited, unincorporated territory of the United States.</text></subparagraph></paragraph></subsection>
<subsection id="H7AD88FB81E6C4B0CB6E5DC3B9449BDD8"><enum>(b)</enum><header>Marshallese participation</header><text>The Secretary of the Interior shall allow scientists or other experts selected by the Republic of the Marshall Islands to participate in all aspects of the preparation of the report required by subsection (a), including, without limitation, developing the work plan, identifying questions, conducting research, and collecting and interpreting data.</text></subsection> <subsection id="HF46B6B4C652547AB86AB71FA46F269EA"><enum>(c)</enum><header>Publication</header><text>The report required in subsection (a) shall be published in the Federal Register for public comment for a period of not fewer than 60 days.</text></subsection>
<subsection id="H83284B844BA24ADB8EB1F99131F14DB1"><enum>(d)</enum><header>Public availability</header><text>The Secretary of the Interior shall publish the study required under subsection (a) and results submitted under subsection (b) on a public website.</text></subsection> <subsection id="H1F010E73BEA3401F88DB7C674B344C34"><enum>(e)</enum><header>Authorization of appropriation for report</header><text>It is hereby authorized to be appropriated to the Department of the Interior, Office of Insular Affairs, for fiscal year 2022 such sums as may be necessary to produce the report required in subsection (a).</text></subsection>
<subsection id="HF14F3F1F8A9B4112BDC10F079883F61C"><enum>(f)</enum><header>Indefinite authorization of appropriation for Runit Dome monitoring activities</header><text>It is hereby authorized to be appropriated to the Department of Energy such sums as may be necessary to comply with the requirements of section 103(f)(1)(B) of the Compact of Free Association Amendments Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/1921b">42 U.S.C. 1921b(f)(1)(B)</external-xref>).</text></subsection></section></title> <title id="HF657DD50ABD847DA876FCC73D1F533A1"><enum>III</enum><header>National Oceanic and Atmospheric Administration</header> <section id="HBB9A682323FF499397C477A7A3810D91"><enum>301.</enum><header>Climate Change Insular Research Grant Program</header> <subsection id="HA99E0ACFFF754EC8BECEF993E56C85AE"><enum>(a)</enum><header>In general</header><text>The Administrator of the National Oceanic and Atmospheric Administration shall establish a Climate Change Insular Research Grant Program to provide grants to institutions of higher education, as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>), and nonprofit organizations in Insular Areas for monitoring, collecting, synthesizing, analyzing, and publishing local climate change data, including ocean temperature, sea level rise, ocean acidification, and altered ocean currents data.</text></subsection>
<subsection id="H84015DD694614A1B8CFB8E546674FFD3"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section there is authorized to be appropriated to the Administrator $5,000,000 for each of the fiscal years 2022 through 2026.</text></subsection></section> <section id="H9E3F5EB8DC4E4E3EAF101AFA57125660"><enum>302.</enum><header>Coastal management technical assistance and report</header> <subsection id="H0BAB45EA6FDB43E19E9ADA7DBF67FB19"><enum>(a)</enum><header>Technical assistance</header> <paragraph id="H14E54DF26A594A57A434564A646D26C7"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Oceanic and Atmospheric Administration, acting through the Director of the Office for Coastal Management, shall provide technical assistance to Insular Areas to enhance such entities’ coastal management and climate change programs.</text></paragraph>
<paragraph id="HA017187A1851414E84A67FB1A7CEC394"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this subsection there is authorized to be appropriated to the Administrator of the National Oceanic and Atmospheric Administration $5,000,000 for each of the fiscal years 2022 through 2026.</text></paragraph></subsection> <subsection id="HC962083357A64E2A9011E9236660B94A"><enum>(b)</enum><header>Annual report</header><text>The Administrator of the National Oceanic and Atmospheric Administration, acting through the Director of the Office for Coastal Management, shall submit an annual report to the Committee on Natural Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the status of—</text>

<paragraph id="HC078DE20C7204356861E4E4B58094976"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Oceanic and Atmospheric Administration, acting through the Director of the National Weather Service, shall provide technical assistance and outreach to Insular Areas through the San Juan, Tiyan, and Pago Pago Weather Forecast Offices of the National Weather Service. For the purposes of this section, the Administrator may also employ other agency entities as the Administrator deems necessary, in order to improve weather data collection and provide science, data, information, and impact-based decision support services to reduce hurricane, typhoon, droughts, tsunamis, tides, and sea level rise impacts in the Insular Areas.</text></paragraph> <paragraph id="H1DB43BB5D5044284BC293F84D612D485"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this subsection there is authorized to be appropriated to the Administrator $5,000,000 for each of the fiscal years 2022 through 2026.</text></paragraph></subsection>

<subsection id="H29DDA047973E49A796BBB33F76FF97EF"><enum>(a)</enum><header>Establishment</header><text>There is established within the Department an Office of Insular Area Energy Policy and Programs (referred to in this section as the <quote>Office</quote>). The Office shall be headed by a Director, who shall be appointed by the Secretary and compensated at a rate equal to that of level IV of the Executive Schedule under section 5315 of title 5, United States Code.</text></subsection> <subsection id="H0D813A7F7ED94B888B5B7CD6036A0B25"><enum>(b)</enum><header>Duties</header><text>The Office shall—</text>
<paragraph id="HB6895E755F1F45F997511AEC4841853B"><enum>(1)</enum><text>direct, coordinate, implement, and monitor energy planning, education, management, conservation, and delivery programs of the Department to—</text> <subparagraph id="HCC50E257401046429D8D381D3B1DB3E1"><enum>(A)</enum><text>assist Insular Areas in developing comprehensive energy plans;</text></subparagraph>
<subparagraph id="H513DFFDADDDB4E22B60EE3102A6F0BB3"><enum>(B)</enum><text>expand renewable energy and energy efficiency in Insular Areas;</text></subparagraph> <subparagraph id="HE1DDBABC5F0742AAB5F1575CAB8650F1"><enum>(C)</enum><text>reduce or stabilize energy costs in Insular Areas;</text></subparagraph>
<subparagraph id="H458CED477DB944CFBE54B557DE0AB670"><enum>(D)</enum><text>enhance and strengthen energy infrastructure in Insular Areas to withstand natural disasters; and</text></subparagraph> <subparagraph id="H76EA9496758C421898B35B31E942924E"><enum>(E)</enum><text>work with Insular Areas to develop improved regulatory and oversight conditions; and</text></subparagraph></paragraph>
<paragraph id="H5032BF534426431EA5FAE65CC68FC483"><enum>(2)</enum><text>centralize and align all ongoing Department of Energy efforts in the Insular Areas.</text></paragraph></subsection> <subsection id="H1854EB8CB5A14E6D9259C2550BCFAD2D"><enum>(c)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Director shall submit an annual report to the Committee on Natural Resources and the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate on the status of all projects undertaken and grants approved by the Office.</text></subsection>
<subsection id="H75FBD27FE59341FC9C31E8A789EDEE97"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $20,000,000 for each of the fiscal years 2022 through 2026.</text></subsection> <subsection id="HDE39B594C29345AC98DF0CF5D5ABF009"><enum>(e)</enum><header>Non-Federal Cost-Share waiver</header><text>Any funding made available to Insular Areas by the Office of Insular Area Energy Policy and Programs under this or any other Federal law shall not be subject to a non-Federal share funding requirement.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H53FD65FEF21044F89263F1B66B6A376E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Office of Insular Area Energy Policy and Programs in the Department of Energy, in consultation with the Office of Insular Affairs of the Department of the Interior, shall submit to the Committees on Energy and Commerce and Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report containing—</text> <paragraph id="HF1BD64DC1ADF47F3A2AD8205B1A25D5F"><enum>(1)</enum><text display-inline="yes-display-inline">the results of a study of the execution of the comprehensive energy plans required by section 9 of <external-xref legal-doc="public-law" parsable-cite="pl/113/235">Public Law 113–235</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1492a">48 U.S.C. 1492a</external-xref>), including—</text>
<subparagraph id="H237EAABD0C994A06B7A5EE9EE309839A"><enum>(A)</enum><text>initial, planned, and current sources of renewable energy;</text></subparagraph> <subparagraph id="H2A9D819E75944EBFA2CEB77C6A735F64"><enum>(B)</enum><text>initial, planned, and current energy imports; and</text></subparagraph>
<subparagraph id="H674B484F295148858FAE3A2F8594A1A7"><enum>(C)</enum><text>projected and actual energy needs during calendar year 2020 for each Insular Area;</text></subparagraph></paragraph> <paragraph id="H075124FE89CA4D35B2CF2D20AD2A75F8"><enum>(2)</enum><text>the lessons learned from the preparation of these plans;</text></paragraph>
<paragraph id="H8C268DA44D0A468CA7A03143F01CCFCA"><enum>(3)</enum><text>the date on which each plan was most recently updated; and</text></paragraph> <paragraph id="H0396247CFFC54099913A84C56811C4D7"><enum>(4)</enum><text>recommendations with respect to each Insular Area, on the need to update such plans.</text></paragraph></subsection>

<paragraph id="HA12E05B55078463990F63E331766C417"><enum>(2)</enum><text display-inline="yes-display-inline">the report required by subsection (a) and any comments received under subsection (b) are made available on a public website.</text></paragraph></subsection></section> <section id="H656CBCF2B7544144A7FAFAD986B1EFFC"><enum>403.</enum><header>Energy Efficient Product Rebate Program</header> <subsection id="H22E1862AF3014D30B4BA0749F4068FF9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H0A6418BEEE76437E804688AB6DB792BF"><enum>(1)</enum><header>Eligible territory</header><text>The term <term>eligible territory</term> means a territory that meets the requirements of subsection (c).</text></paragraph> <paragraph id="HA7216CFE1E9743F59D0D7E89379AC6A1"><enum>(2)</enum><header>Energy star program</header><text>The term <term>Energy Star program</term> means the program established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>).</text></paragraph>
<paragraph id="H7738E350E05D4870AC77159326A31EF8"><enum>(3)</enum><header>Residential Energy Star product</header><text>The term <term>residential Energy Star product</term> means a product for a residence that is rated for energy efficiency under the Energy Star program.</text></paragraph> <paragraph id="HCCA0A32F4DBE41AABC4B0A457D27E615"><enum>(4)</enum><header>Energy office</header><text>The term <term>energy office</term> means the government agency within the territory responsible for developing an energy conservation plan under section 362 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>).</text></paragraph>
<paragraph id="H3B213EDBA2B7480B95F7225A750FF2A0"><enum>(5)</enum><header>Rebate program</header><text>The term <term>rebate program</term> means an energy efficient product rebate program described in subsection (c)(1).</text></paragraph></subsection> <subsection id="HF019151136DF4EE2AE2DB6717FB73F10"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Energy shall establish a program, to be known as the <quote>Energy Efficient Product Rebate Program</quote>, under which the Director of the Office of Insular Area Energy Policy and Programs shall provide allocations to eligible territories in accordance with this section. </text></subsection>
<subsection id="HE5168324285E478CB157CF908364FFB0"><enum>(c)</enum><header>Eligible territories</header><text>A territory shall be eligible to receive an allocation under subsection (d) if the territory—</text> <paragraph id="H48F446716A9941C99F25BC8D92117B4F"><enum>(1)</enum><text>establishes (or has established) an energy efficient product rebate program to provide rebates to residential consumers for the purchase of residential Energy Star products to replace used products of the same type;</text></paragraph>
<paragraph id="HBFC7C5CD476D41F6B2688741BAC8EC36"><enum>(2)</enum><text>establishes clear requirements to prevent illegal dumping of old products and the overflow of landfills, and ensure environmental justice;</text></paragraph> <paragraph id="HB0C4DBD86B4749299D9F44D7D144C1C9"><enum>(3)</enum><text>submits an application for the allocation at such time, in such form, and containing such information as the Director of the Office of Insular Area Energy Policy and Programs may require; and</text></paragraph>
<paragraph id="H04D39C501A794C65815D55AE708EDD3F"><enum>(4)</enum><text>provides assurances satisfactory to the Director of the Office of Insular Area Energy Policy and Programs that the territory will use the allocation to supplement, but not supplant, funds made available to carry out the rebate program.</text></paragraph></subsection> <subsection id="H02A1FDBB9E524A60ADDA276C1006308F"><enum>(d)</enum><header>Amount of allocations</header> <paragraph id="HBDAEF66174DF484694902D0ADD7D28CC"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), for each of fiscal years 2022 through 2026, the Director of the Office of Insular Area Energy Policy and Programs shall allocate to the energy office of each eligible territory to carry out subsection (e) an amount equal to the product obtained by multiplying the amount made available under subsection (g) for the fiscal year by the ratio that the population of the territory in the most recent calendar year for which data are available bears to the total population of all eligible territories in that calendar year.</text></paragraph>
<paragraph id="HC7B0904F44A5436EA1D8970816F1604B"><enum>(2)</enum><header>Minimum allocations</header><text>For each fiscal year, the amounts allocated under this subsection shall be adjusted proportionately so that no eligible territory is allocated a sum that is less than an amount determined by the Director.</text></paragraph></subsection> <subsection id="HFB44FDCBFD1C454191BD32C3CD4098A1"><enum>(e)</enum><header>Use of allocated funds</header><text>An allocation to an energy office under subsection (d) may be used to pay not more than 75 percent of the cost of establishing and carrying out a rebate program.</text></subsection>
<subsection id="HBF762CEB70714A5FBABAA99D624E7100"><enum>(f)</enum><header>Issuance of rebates</header><text>The amount of a rebate provided under a rebate program shall be determined by the applicable energy office, taking into consideration—</text> <paragraph id="HFB986C159D1E44C494DD960C09099F8A"><enum>(1)</enum><text>the amount of the allocation to the energy office under subsection (d);</text></paragraph>
<paragraph id="HF5E4AEE61FC4421B9F790DF8CC284A6A"><enum>(2)</enum><text>the amount of any tax incentive available for the purchase of the residential Energy Star product; and</text></paragraph> <paragraph id="H1770CD670B704620A7DB9776B907794B"><enum>(3)</enum><text>the difference between the cost of the residential Energy Star product and the cost of a product that is not a residential Energy Star product, but is of the same type as, and is the nearest capacity, performance, and other relevant characteristics (as determined by the energy office) to, the residential Energy Star product.</text></paragraph></subsection>
<subsection id="HF4943DF03E4844FFB7B22B58354F4DA6"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $5,000,000 for each of the fiscal years 2022 through 2026.</text></subsection></section> <section id="HFD5F572B2A444203A93CD746A40E77F5"><enum>404.</enum><header>Renewable Energy Grant Program</header> <subsection id="H5C13E4F1494E4B8FA78A9143A2808A78"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H036D84EA49B04A1A831255E0C2C6D62C"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a not-for-profit organization determined eligible by the Secretary for purposes of this section.</text></paragraph> <paragraph id="HC72643395E664152A4F817AF686EDF2B"><enum>(2)</enum><header>Department of energy national laboratories</header><text>The term <term>Department of Energy national laboratories</term> has the same meaning as the term <term>National Laboratory</term> under section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph>
<paragraph id="H7320BF87C77E438BB2BBADE48EE14BED"><enum>(3)</enum><header>Microgrid</header><text>The term <term>microgrid</term> means an electric system—</text> <subparagraph id="H7C02FF588F984E53A88F4844A4502754"><enum>(A)</enum><text>that serves the local community with a power generation and distribution system; and</text></subparagraph>
<subparagraph id="H8E076236AC1241838D61626695128918"><enum>(B)</enum><text>that has the ability—</text> <clause id="H5743C776F1F44255A9F4EEF921CDA5F5"><enum>(i)</enum><text>to disconnect from a traditional electric grid; and</text></clause>
<clause id="H29D7D8AEE2CF451083FAE5202CD252D6"><enum>(ii)</enum><text>to operate autonomously when disconnected.</text></clause></subparagraph></paragraph> <paragraph id="H3F1CA502CCAD4BB7A6943A8A13253350"><enum>(4)</enum><header>Program</header><text>The term <term>Program</term> means the Renewable Energy Grant Program established under subsection (b).</text></paragraph>
<paragraph id="H452FBD9090184BB5B1C3EAAB930EF50A"><enum>(5)</enum><header>Smart grid</header><text>The term <term>smart grid</term> means an intelligent electric grid that uses digital communications technology, information systems, and automation to, while maintaining high system reliability—</text> <subparagraph id="H33DBC1B1F14F429284B8DC39F5DCA8A3"><enum>(A)</enum><text>detect and react to local changes in usage;</text></subparagraph>
<subparagraph id="H69DF58B7571A4D8CB015EBF9EF390C1E"><enum>(B)</enum><text>improve system operating efficiency; and</text></subparagraph> <subparagraph id="HCB4096BEAF60448884135C174708AA18"><enum>(C)</enum><text>reduce spending costs.</text></subparagraph></paragraph></subsection>
<subsection id="HE57000918457454BBBAF07ED1D09226A"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Insular Area Energy Policy and Programs (referred to in this section as the <quote>Director</quote>) shall establish a Renewable Energy Grant Program under which the Director may award grants to covered entities to facilitate projects in Insular Areas described in subsection (d).</text></subsection> <subsection id="H5EB2E5323F9E4B3F850D1D4941CBFFF2"><enum>(c)</enum><header>Applications</header> <paragraph id="id66BCEDB695084A39A0E10BB41A59ADF3"><enum>(1)</enum><header>In general</header><text>To be eligible for a grant under the Program, a covered entity shall submit to the Director an application at such time, in such form, and containing such information as the Secretary may require.</text></paragraph>
<paragraph id="id091F721328984697BE6DA82ABC86644F"><enum>(2)</enum><header>Priority</header><text>In providing grants under the Program, the Director shall give priority to proposed projects that, as determined by the Director—</text> <subparagraph id="idE2B710FCE39A404A824603A8AD6DEB28"><enum>(A)</enum><text>maximize public health benefits;</text></subparagraph>
<subparagraph id="id13D526F2A505408D83C9A5D0DFAE2256"><enum>(B)</enum><text>are the most cost-effective; and</text></subparagraph> <subparagraph id="id28E8951960484772AA0BC69D5ECFDD69"><enum>(C)</enum><text>serve areas with environmental justice communities—</text>
<clause id="id87C6E074003B4A10AB87A688D2D0E34C"><enum>(i)</enum><text>in rural areas; or</text></clause> <clause id="idC9EDF1944DFB40779240C9D67EA11403"><enum>(ii)</enum><text>that are poor air quality areas.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H2E5A237DDF904958B19E740D11BA5A8F"><enum>(d)</enum><header>Use of funds</header>
<paragraph id="H965582C59164407C9DE4BC005556C92C"><enum>(1)</enum><header>In general</header><text>A covered entity receiving a grant under the Program may use grant funds for a project, in territories of the United States—</text> <subparagraph id="H76F37700449E4E9CA521770ECD5C888A"><enum>(A)</enum><text>to develop or construct a renewable energy system;</text></subparagraph>
<subparagraph id="H4944B6E7ADCC411FA0B35A13538084C5"><enum>(B)</enum><text>to carry out an activity to increase energy efficiency;</text></subparagraph> <subparagraph id="HD90D707A4B5949E980A9DA8606D9E051"><enum>(C)</enum><text>to develop or construct an energy storage system or device for—</text>
<clause id="H753C09314B19445EB824FB7D379ED8C6"><enum>(i)</enum><text>a system developed or constructed under subparagraph (A); or</text></clause> <clause id="HAEF54F4647D6454CBAB2A3FEC5F8E46B"><enum>(ii)</enum><text>an activity carried out under subparagraph (B);</text></clause></subparagraph>
<subparagraph id="HD92FA82DA9474B6D973ECB8A5B63BDBD"><enum>(D)</enum><text>to develop or construct—</text> <clause id="HFEB55E41367346838459FBE912DCAF69"><enum>(i)</enum><text>a smart grid; or</text></clause>
<clause id="H3AFD539A4E884FF4B14D5928717753EF"><enum>(ii)</enum><text>a microgrid; or</text></clause></subparagraph> <subparagraph id="HD38FCA07B7E34801B014F5239F8A1D84"><enum>(E)</enum><text>to train residents of territories of the United States to develop, construct, maintain, or operate a renewable energy system.</text></subparagraph></paragraph>
<paragraph id="HE365D7C1F36F4AD7A96B01C24FA99787"><enum>(2)</enum><header>Limitation</header><text>A covered entity receiving a grant under the Program may not use grant funds to develop or construct a facility that generates electricity using energy derived from—</text> <subparagraph id="H49FA4DEC9DF44EC5A2F119C72EB936D0"><enum>(A)</enum><text>fossil fuels; or</text></subparagraph>
<subparagraph id="H90FFD80933504C35904EC330A62177D0"><enum>(B)</enum><text>nuclear power.</text></subparagraph></paragraph></subsection> <subsection id="H8E441F14C2BE43E3A8452D92B2B2DE72"><enum>(e)</enum><header>Technical assistance</header><text>The Director shall ensure that Department of Energy national laboratories offer to provide technical assistance to each covered entity carrying out a project assisted with a grant under the Program.</text></subsection>
<subsection id="HB4F138EAC3044A5C903DCD499EE86496"><enum>(f)</enum><header>Report</header><text>Not later than two years after the establishment of the Program, and on an annual basis thereafter, the Secretary shall submit to Congress a report containing—</text> <paragraph id="H20718C00C03C4FC582AFA7251C6F5B03"><enum>(1)</enum><text>an estimate of the amount of funds disbursed under the Program;</text></paragraph>
<paragraph id="HA495F85356CF4230A9F7F4C1BAEAE0CA"><enum>(2)</enum><text>an estimate of the energy conservation achieved as a result of the Program;</text></paragraph> <paragraph id="HD9832229F27840F1A78AD1B31763D6BB"><enum>(3)</enum><text>a description of challenges encountered in implementing projects described in subsection (d)(1); and</text></paragraph>
<paragraph id="H14B8899906BF4F5896AD087E48DAF36C"><enum>(4)</enum><text>any recommendations as to additional legislative measures to increase the use of renewable energy in territories of the United States, as appropriate.</text></paragraph></subsection> <subsection id="H361CDC5F2FCB47A99511F9496682E283"><enum>(g)</enum><header>GAO study and report</header> <paragraph id="HE5E1062BC9E84C1893C6DD2FA194F53E"><enum>(1)</enum><header>Study and report</header><text>Not later than 180 days after the date of enactment of this section, the Comptroller General of the United States shall—</text>
<subparagraph id="H07CFE860EF5045499538AEB047585D7A"><enum>(A)</enum><text>conduct a study regarding renewable energy and energy efficiency in territories of the United States; and</text></subparagraph> <subparagraph id="HB4CDFD12E3AA4838B9EC05E8C91BE923"><enum>(B)</enum><text>submit to Congress a report containing—</text>
<clause id="HD32D1E4046E24E22B266A16078217D31"><enum>(i)</enum><text>the findings of the study; and</text></clause> <clause id="H85E51609090B43C28DDB1D28B35F43BE"><enum>(ii)</enum><text>related recommendations.</text></clause></subparagraph></paragraph>
<paragraph id="H1B5A017A3B1843F48278E9A35298333D"><enum>(2)</enum><header>Components</header><text>The study conducted under paragraph (1) shall consider, in relation to territories of the United States, the potential—</text> <subparagraph id="H944FD82E41614D239D99F3E3E8F3EE68"><enum>(A)</enum><text>to modify existing electric power systems to use renewable energy sources;</text></subparagraph>
<subparagraph id="HE2601B7D12E344BB9A20AD679304FF1A"><enum>(B)</enum><text>to expand the use of microgrids; and</text></subparagraph> <subparagraph id="H82A1E9F785EC4346A60F8FFA0E65DD95"><enum>(C)</enum><text>to improve energy resiliency.</text></subparagraph></paragraph></subsection></section>
<section id="H47E7FC136CFF4AABB6D230253448C617"><enum>405.</enum><header>Offshore wind for the territories</header>
<subsection id="H0B7222C8FA414A6495009CCABC3CB6F2"><enum>(a)</enum><header>Application of outer continental shelf lands act with respect to territories of the united states</header>
<paragraph id="H25983917348E4BFFBF2B961E096BD214"><enum>(1)</enum><header>In general</header><text>Section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>) is amended—</text> <subparagraph id="H729FDAA7D8E1497088C4D1E264DC653D"><enum>(A)</enum><text>in subsection (a), by inserting <quote>or lying within the exclusive economic zone of the United States and the Outer Continental Shelf adjacent to any territory of the United States, except that such term shall not include any area conveyed by Congress to a territorial government for administration</quote> after <quote>control</quote>; </text></subparagraph>
<subparagraph id="H8F00280D8DF5490B891BF8F6941B9A1C"><enum>(B)</enum><text>in subsection (p), by striking <quote>and</quote> after the semicolon at the end;</text></subparagraph> <subparagraph id="HF4ADB75530EF4792B263221508A70760"><enum>(C)</enum><text>in subsection (q), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H3A8B3371CE5845F2BCCB505BC85A5AE9"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H5CE0BEEB3AFC4A908775FBF4724DB520"> <subsection id="HCE570A6CB141449AA765CD4D51D2EDA4"><enum>(r)</enum><text>The term <term>State</term> means the several States, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands of the United States, and the Commonwealth of the Northern Mariana Islands.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H912452EE4EAC4EBFA66CF98D0734A721"><enum>(2)</enum><header>Exclusions</header><text>Section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="idED356E10532F482198E9C45A8EE5F751" style="OLC" act-name=""> <subsection id="idE5D75EB7FE84489AA680635134ABDB40"><enum>(i)</enum><text>This section shall not apply to the scheduling of lease sales in the Outer Continental Shelf adjacent to the Territories of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HB44D4CF819D145A7983B244EEEABB92B"><enum>(b)</enum><header>Wind lease sales for areas of outer continental shelf</header><text>The Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H6BD9A34332DF4FD5A23E583525C64BAD"> <section id="HD4E6AA73DA3F4E27A5FE006D75413A5E"><enum>33.</enum><header>Wind lease sales for areas of Outer Continental Shelf</header> <subsection id="H76A5F9AF38BA4F6982688274E5F18A01"><enum>(a)</enum><header>Authorization</header><text>The Secretary may conduct wind lease sales on the Outer Continental Shelf.</text></subsection>
<subsection id="H20DA6EE63C944CB5BAD8CD50A61D8B01"><enum>(b)</enum><header>Wind lease sale procedure</header><text>Any wind lease sale conducted under this section shall be considered a lease under section 8(p).</text></subsection> <subsection id="HCFFE101599A140D2B76237F1DA6973E3"><enum>(c)</enum><header>Wind lease sales off coasts of territories of the United States</header> <paragraph id="HDD93EB4A33BB40D0A9A3A58D6B2F5236"><enum>(1)</enum><header>Study on feasibility of conducting wind lease sales</header> <subparagraph id="HEA7FD3EB7DAE4D09A89E65E88345C379"><enum>(A)</enum><header>In general</header><text>The Secretary shall conduct a study on the feasibility, including the technological and long-term economic feasibility, and the potential environmental effects of, conducting wind lease sales on an area of the Outer Continental Shelf within the territorial jurisdiction of American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, Puerto Rico, and the Virgin Islands of the United States.</text></subparagraph>
<subparagraph id="H4E94503AB985401FBBF15B66381375B7"><enum>(B)</enum><header>Consultation</header><text>In conducting the study required in subparagraph (A), the Secretary shall consult—</text> <clause id="HCF200CEE210A40A0A3015F983E918686"><enum>(i)</enum><text>the National Laboratories, as that term is defined in section 2 of the Energy Policy Act of 2005;</text></clause>
<clause id="HB76A55F4CBB5458FB939FFDD6849BBE9"><enum>(ii)</enum><text>the National Oceanic and Atmospheric Administration, including the Office of National Marine Sanctuaries and National Marine Fisheries Service; and</text></clause> <clause id="H277665DFE6904972BD1D9EEAE9017DFE"><enum>(iii)</enum><text>the Governor of each of American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands of the United States.</text></clause></subparagraph>
<subparagraph id="H066E8E037EEE4F49A556C4DF44BAEF7D"><enum>(C)</enum><header>Publication</header><text>The study required in subparagraph (A) shall be published in the Federal Register for public comment for a period of not fewer than 60 days.</text></subparagraph> <subparagraph id="H7BB18C21DDAB4922B5BA1BBE7C63EFFD"><enum>(D)</enum><header>Submission of results</header><text>Not later than 18 months after the date of enactment of this section, the Secretary shall submit the results of the study conducted under subparagraph (A) to—</text>
<clause id="HC7140BCB24B745EC84DC51D138FDF74C"><enum>(i)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></clause> <clause id="H29674B9E3B724243A2CEE422A9EF3382"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></clause>
<clause id="H5D758FBF58BE4A10AB8BAF5D7B9FADDF"><enum>(iii)</enum><text>each Delegate or Resident Commissioner to the House of Representatives from American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands of the United States.</text></clause></subparagraph> <subparagraph id="H2550DD652B004D1B833FCAAB92B5BBFE"><enum>(E)</enum><header>Public availability</header><text>The Secretary shall publish the study required under subparagraph (A) and results submitted under subparagraph (D) on a public website.</text></subparagraph></paragraph>
<paragraph id="HFBAA7D7515194D4DB25FF1D2BD64A3BF"><enum>(2)</enum><header>Call for information and nominations</header><text>The Secretary shall issue a call for information and nominations for proposed wind lease sales for areas determined to be feasible under the study conducted under paragraph (1).</text></paragraph> <paragraph id="HB66C4B2A9EF2460D874E4DD2C95AFFC2"><enum>(3)</enum><header>Conditional wind lease sales</header> <subparagraph id="H215AA31B8BAC4D0EA3101A9F4545C9AA"><enum>(A)</enum><header>In general</header><text>For each territory, the Secretary shall conduct not less than 1 wind lease sale on an area of the Outer Continental Shelf within the territorial jurisdiction of such territory that meets each of the following criteria:</text>
<clause id="H1799FCA25030405EA16CB43D0CDB3D1E"><enum>(i)</enum><text>The study required under paragraph (1)(A) concluded that a wind lease sale on the area is feasible.</text></clause> <clause id="H1F69BD5D29C34B05BDA1609EF42EAE7C"><enum>(ii)</enum><text>The Secretary has determined that the call for information has generated sufficient interest for the area.</text></clause>
<clause id="H63F695A965004D2383A95350736E388A"><enum>(iii)</enum><text>The Secretary has consulted with the Secretary of Defense and other relevant Federal agencies regarding such a sale.</text></clause> <clause id="H2E30DC57ECD047C8805111C64C0B00E5"><enum>(iv)</enum><text>The Secretary has consulted with the Governor of the territory regarding the suitability of the area for wind energy development.</text></clause></subparagraph>
<subparagraph id="HFAC64F3616F44577981FFADA21FE4AF9"><enum>(B)</enum><header>Exception</header><text>If no area of the Outer Continental Shelf within the territorial jurisdiction of a territory meets each of the criteria in clauses (i) through (iv) of subparagraph (A), the requirement under subparagraph (A) shall not apply to such territory.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H49CE98BAE07F4F9380C8A002EA74DE97"><enum>406.</enum><header>State Energy Program non-Federal cost-share waiver</header><text display-inline="no-display-inline">Funding made available to a territory under the Department of Energy’s State Energy Program (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>) shall not be subject to a non-Federal share funding requirement.</text></section></title>
<title id="HCE4E4A26446A4102B9AC4390F7E8BE50"><enum>V</enum><header>Environmental Protection Agency</header>
<section commented="no" id="H067560E8318D442AB72A28838316F49C"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph commented="no" id="H38EC705D0DC84403BDA61EE6764D9B88"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph>
<paragraph id="H4352CEE098CA43A0B383A82B6BD3A32D"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Insular Area National Program Office.</text></paragraph> <paragraph commented="no" id="HF627F7AD1CE742A8BB17C2D4F42D1EBA"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means each of the following:</text>
<subparagraph commented="no" id="HF24585CC8B794BC4868AD274ABA5F2DF"><enum>(A)</enum><text>A government, municipality, agency, or instrumentality of a territory.</text></subparagraph> <subparagraph commented="no" id="HB7127F02B401433180C9132E691DA459"><enum>(B)</enum><text>A private, nonprofit organization or institution.</text></subparagraph>
<subparagraph commented="no" id="H1F7EE18960AB4BB6B7445C4AC36E726D"><enum>(C)</enum><text display-inline="yes-display-inline">An institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>), except that such term does not include private, nonprofit institutions of higher education).</text></subparagraph> <subparagraph commented="no" id="H3C37F9BA9FFB47EABB95D1658CBB002F"><enum>(D)</enum><text>Any combination of entities described in subparagraphs (A) through (C), including partnerships and consortiums of local governments. </text></subparagraph></paragraph>
<paragraph commented="no" id="H3C17D762D6624326835337BEBC60C89B"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Insular Area National Program Office established by section 502. </text></paragraph> <paragraph commented="no" id="H85A135C0D71D44059BD6C3AEA256F730"><enum>(5)</enum><header>Renewable energy</header><text>The term <term>renewable energy</term> means energy that has been derived from Earth’s natural resources that are not finite or exhaustible, including solar, wind, hydroelectric, geothermal, ocean (thermal and mechanics).</text></paragraph></section>
<section commented="no" id="H830E80D209B74F53B4C812767E36382E"><enum>502.</enum><header>Insular Area National Program Office</header>
<subsection commented="no" id="H4A01CA1436CB4573B9F184D15DBF716D"><enum>(a)</enum><header>Establishment</header><text>There is established within the Environmental Protection Agency an office, to be known as the Insular Area National Program Office. The Office shall be headed by a Director, who shall be appointed by the Administrator and compensated at a rate equal to that of level IV of the Executive Schedule under section 5315 of title 5, United States Code.</text></subsection> <subsection id="H2689F4C47C9C443C8A5084480DBD7C06"><enum>(b)</enum><header>Duties</header><text>The Director shall—</text>
<paragraph id="HA6EA61CB0C7E48469BC416678D91B0DE"><enum>(1)</enum><text>direct, coordinate, implement, and monitor programs of the Environmental Protection Agency to—</text> <subparagraph id="H1013AC77D4CA4149B74DDDF68238CFAE"><enum>(A)</enum><text>build, enhance, and strengthen infrastructure in Insular Areas to withstand natural disasters;</text></subparagraph>
<subparagraph id="HC90400C57A2B4875825586EEAD9B3427"><enum>(B)</enum><text>expand renewable energy and energy efficiency in Insular Areas; and</text></subparagraph> <subparagraph id="HF5E335E839494367B68A60C5B8685178"><enum>(C)</enum><text>provide technical assistance in Insular Areas; and</text></subparagraph></paragraph>
<paragraph id="H6412883906574FF0A1F7CACBE63B35A3"><enum>(2)</enum><text>centralize and align all ongoing Environmental Protection Agency efforts in the Insular Areas.</text></paragraph></subsection> <subsection commented="no" id="H596F95BE87D240EF8C0DC61D809301AF"><enum>(c)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Director shall submit an annual report to the Committee on Natural Resources and the Committee on Energy and Commerce of the House of Representatives, and the Committee on Energy and Natural Resources of the Senate on the status of all projects undertaken and grants approved by the Office.</text></subsection>
<subsection commented="no" id="H249F539FCF91469C86056604C5D137ED"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">For the Insular Area National Program Office, there is authorized to be appropriated to the Administrator $20,000,000 for each of the fiscal years 2022 through 2026.</text></subsection> <subsection commented="no" id="HF67BED65D934498E8505A754079E9C64"><enum>(e)</enum><header>Non-Federal Cost-Share waiver</header><text>Any funding made available to Insular Areas by the Office shall not be subject to a non-Federal share funding requirement.</text></subsection></section>
<section commented="no" id="HB7463707872447068A980F97908BF752"><enum>503.</enum><header>Insular Area Sustainable Infrastructure Grant Program</header>
<subsection commented="no" id="H9386DDA2B843423FBF1E4CD459FEF2EF"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the Insular Area National Program Office shall establish and carry out a program, to be known as the Insular Area Sustainable Infrastructure Grant Program, to provide grants to eligible entities in the Insular Areas to build, enhance, and strengthen infrastructure systems in Insular Areas to withstand natural disasters, including drinking water systems, septic systems, stormwater systems, and solid waste systems.</text></subsection> <subsection commented="no" id="HAE940E346BFD4251863BC0FE4265FC92"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant for infrastructure system projects under the Insular Area Sustainable Infrastructure Grant Program may use such funds for—</text>
<paragraph commented="no" id="HB9EFD2687D9A44D8993CB5C902A95BEE"><enum>(1)</enum><text>development-phase activities, including planning, feasibility analysis (including any related analysis necessary to carry out an eligible project), revenue forecasting, environmental review, permitting, preliminary engineering and design work, and other preconstruction activities;</text></paragraph> <paragraph commented="no" id="H1F1619119FF94BDF91D3393443DF5B90"><enum>(2)</enum><text>construction, reconstruction, rehabilitation, and replacement activities; and</text></paragraph>
<paragraph commented="no" id="HBFE8738A79DC4309A770D5BF1C99634B"><enum>(3)</enum><text>the acquisition of real property or an interest in real property (including land relating to the project, and improvements to land), environmental mitigation, construction contingencies, and acquisition of equipment.</text></paragraph></subsection> <subsection commented="no" id="HBE688C174F8640EDBF651C4F4292875E"><enum>(c)</enum><header>Applications</header> <paragraph commented="no" id="HF970B86563A44ACAA8A70DD0E9905838"><enum>(1)</enum><header>Inclusions</header><text>An application under this subsection shall include—</text>
<subparagraph commented="no" id="H6AAB6207BDDF444E9388C60DD6A90DC0"><enum>(A)</enum><text>a description of the project proposed by the eligible entity;</text></subparagraph> <subparagraph commented="no" id="H29A1CB0903B942798172EFE5DF781D9B"><enum>(B)</enum><text>an evaluation (using methodology approved by the Director) of the quantifiable and unquantifiable benefits of the proposed project;</text></subparagraph>
<subparagraph commented="no" id="HF20EB8E280C04E828FB02D830283128C"><enum>(C)</enum><text>an estimate of the cost of the proposed project; and</text></subparagraph> <subparagraph commented="no" id="H5E21E51F515041479FA5D8B18FC9F3F2"><enum>(D)</enum><text display-inline="yes-display-inline">a description of the age and expected lifetime of the infrastructure system funded by the project.</text></subparagraph></paragraph>
<paragraph commented="no" id="H8350B3B70BD34AA898AF9549B1E1B1FF"><enum>(2)</enum><header>Priority</header><text>In providing grants under this section, the Director shall give priority to proposed projects that, as determined by the Director—</text> <subparagraph commented="no" id="HE8376E08DB8841BBAAFDB72AED42BB30"><enum>(A)</enum><text>maximize public health benefits;</text></subparagraph>
<subparagraph commented="no" id="HCDDABABD06364E67AE0654E89EEA75F6"><enum>(B)</enum><text>are the most cost effective; and</text></subparagraph> <subparagraph commented="no" id="H2255C2B07AB547DCA5787F2CDFEF5498"><enum>(C)</enum><text>serve areas with environmental justice communities—</text>
<clause commented="no" id="H085718925AAE451B9AC30DB0C01E723F"><enum>(i)</enum><text>in rural remote areas; or</text></clause> <clause commented="no" id="H7BD3E745AC8D4BE993096EF451FED09A"><enum>(ii)</enum><text>that have challenged environmental conditions.</text></clause></subparagraph></paragraph>
<paragraph commented="no" id="HF6F18CB0F6E54F10AEBBA62568A285EE"><enum>(3)</enum><header>Application Guidance and Processes</header><text>The Director shall provide Insular Areas—</text> <subparagraph commented="no" id="H548D22EC0B2241318E72C94552FE9A25"><enum>(A)</enum><text>guidance for use in applying for grant funds under this section, including information regarding—</text>
<clause commented="no" id="H224CCF18C3674EF5BCD01ACCA8F4039D"><enum>(i)</enum><text>the process and forms for applications;</text></clause> <clause commented="no" id="HAE46B41391474683BA0BAF0A707B5131"><enum>(ii)</enum><text>permissible uses of funds received; and</text></clause>
<clause commented="no" id="H71AF15D72D9141D1915944C6EDF538BC"><enum>(iii)</enum><text>an annual deadline for submission of the applications;</text></clause></subparagraph> <subparagraph commented="no" id="HA6A25BA5F550433B9DA41ACEE62829E9"><enum>(B)</enum><text>a process by which the Director shall approve or disapprove each application; and</text></subparagraph>
<subparagraph commented="no" id="H8023B40B5D034A5EA81F8D8AB37CEBDA"><enum>(C)</enum><text>a streamlined process by which an Insular Area may renew an application described in subparagraph (A) for subsequent fiscal years.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="H580BC0D8AD834884B53E31A19AF49864"><enum>(d)</enum><header>Limitation on use of funds</header> <paragraph commented="no" id="H13F41E77EC07429EB75253B29D1147C4"><enum>(1)</enum><header>Office</header><text>The Director shall use 100 percent of the funds made available to carry out this section to provide grants, on a competitive basis, to eligible entities in Insular Areas.</text></paragraph>
<paragraph commented="no" id="H750DC3B2A83547EF94D03ACD1910A3F6"><enum>(2)</enum><header>Grant recipient</header><text display-inline="yes-display-inline">An eligible entity may use not more than 10 percent of a grant provided under this section for administrative expenses of an approved project.</text></paragraph></subsection> <subsection commented="no" id="HAF11F423747B4174B367E10EEBF59BBB"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section there is authorized to be appropriated to the Administrator $50,000,000 for each of the fiscal years 2022 through 2026.</text></subsection></section>
<section commented="no" id="H449F6F53228B4A8EB8326DEDD250A126"><enum>504.</enum><header>Insular Area Renewable Energy Grant Program</header>
<subsection commented="no" id="H6ABE87F4BA5042658BE2E1FB23ADA1AA"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Insular Area National Program Office shall establish and carry out a program, to be known as the Insular Area Renewable Energy Grant Program to provide grants to eligible entities in the Insular Areas to expand renewable energy and energy efficiency in the Insular Areas. </text></subsection> <subsection commented="no" id="HBA833889EFAD4778A13DE9B74EFE2EB6"><enum>(b)</enum><header>Eligibility</header> <paragraph commented="no" id="HD4F3DF0FB41E44E5A2528F42221C1AF6"><enum>(1)</enum><header>Projects eligible for assistance</header><text>The following projects may be carried out with amounts made available under this section:</text>
<subparagraph commented="no" id="H7D569D3689EB41E1BBA34AD3DE53409B"><enum>(A)</enum><text>Construction of a new renewable energy system.</text></subparagraph> <subparagraph commented="no" id="H283B98E783574901872ECCB1462A56A6"><enum>(B)</enum><text>A project for energy redundancy and resilience based on renewable energy and for hurricane and storm damage reduction on renewable energy systems that the Director determines is technically sound, economically justified, and environmentally acceptable.</text></subparagraph>
<subparagraph commented="no" id="H98C7C9DA95604EDC8A526FEDA050B8D4"><enum>(C)</enum><text>A project for enhanced energy efficiency in the operation of infrastructure that belongs to an eligible entity.</text></subparagraph> <subparagraph commented="no" id="HC1B3E80A65254D89960F3652B553CD8B"><enum>(D)</enum><text>A project for repair, rehabilitation, or replacement of a renewable energy system.</text></subparagraph>
<subparagraph commented="no" id="H585770B3BB6F45DB9E35A7529BC3C3BF"><enum>(E)</enum><text>A project to prevent, reduce, or mitigate the effects of hurricanes or storms, including projects that enhance the resilience of renewable energy systems.</text></subparagraph> <subparagraph commented="no" id="H0F7A30335AB8496D88CA24556842AA7A"><enum>(F)</enum><text>Acquisition of real property or an interest in real property—</text>
<clause commented="no" id="H347513630E8D4730A46FA6E9B2EB4E3C"><enum>(i)</enum><text>if the acquisition is integral to a project described in subparagraphs (A) through (D); or</text></clause> <clause commented="no" id="H55F7B0752974451BB3196F279B916CD8"><enum>(ii)</enum><text>pursuant to an existing plan that, in the judgment of the Director, as applicable, would mitigate the environmental impacts of renewable energy system infrastructure projects.</text></clause></subparagraph>
<subparagraph commented="no" id="H828451A0DD02486A9046C2555B1C4C5D"><enum>(G)</enum><text>A combination of projects under subparagraphs (A) through (F).</text></subparagraph></paragraph> <paragraph commented="no" id="H2249DD41F0BB42AAAB6138C8007B8146"><enum>(2)</enum><header>Activities eligible for assistance</header><text display-inline="yes-display-inline">An eligible entity may use a grant provided under this section for, with respect to an eligible project—</text>
<subparagraph commented="no" id="HFDC60CFA852C45608B6C92BA40523AC2"><enum>(A)</enum><text>development-phase activities, including planning, feasibility analysis (including any related analysis necessary to carry out an eligible project), revenue forecasting, environmental review, permitting, preliminary engineering and design work, and other preconstruction activities;</text></subparagraph> <subparagraph commented="no" id="H82811355F1FB455FBC268320F93CDF1A"><enum>(B)</enum><text>construction, reconstruction, rehabilitation, and replacement activities; and</text></subparagraph>
<subparagraph commented="no" id="H054727FE14B34416A49E0E4A6DA92556"><enum>(C)</enum><text>the acquisition of real property or an interest in real property (including land relating to the project, and improvements to land), environmental mitigation, construction contingencies, and acquisition of equipment.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="HD252DBD6E56A4550A9EBBCDEC958797F"><enum>(c)</enum><header>Applications</header> <paragraph commented="no" id="H193DE6BC4A3E4A309A63332743E401A5"><enum>(1)</enum><header>Inclusions</header><text>An application under this subsection shall include—</text>
<subparagraph commented="no" id="H8D9C41AA374C4D209A79D4C8B3C8A3D4"><enum>(A)</enum><text>a description of the project proposed by the eligible entity;</text></subparagraph> <subparagraph commented="no" id="H5D2109FCA9F647FBB8BAF4C003F4C8A4"><enum>(B)</enum><text display-inline="yes-display-inline">an evaluation (using methodology approved by the Director) of the quantifiable and unquantifiable benefits of the proposed project;</text></subparagraph>
<subparagraph commented="no" id="H89AB9E9A44CB4DD09018D22B970EF25A"><enum>(C)</enum><text>an estimate of the cost of the proposed project; and</text></subparagraph> <subparagraph commented="no" id="HDCB61BBC4B5B47128BF856EFA0CA512A"><enum>(D)</enum><text display-inline="yes-display-inline">a description of the age and expected lifetime of a renewable energy or energy efficiency system funded by the project.</text></subparagraph></paragraph>

<clause commented="no" id="H93B892C2D3624178B53892244CD6DB49"><enum>(i)</enum><text>in rural remote areas; or</text></clause> <clause commented="no" id="H56E7CDAC73CC4BA0BD22CF1D33BDB733"><enum>(ii)</enum><text>that are poor air quality areas.</text></clause></subparagraph></paragraph>
<paragraph commented="no" id="H370F94E724074C1F96141040FB4055C8"><enum>(3)</enum><header>Application Guidance and Processes</header><text>The Director shall provide Insular Areas—</text> <subparagraph commented="no" id="HA1BD2521375B4659ABD9BF2E0B4588CF"><enum>(A)</enum><text>guidance for use in applying for grant funds under this section, including information regarding—</text>

<clause commented="no" id="H23C885956243413497D83933446DCE01"><enum>(iii)</enum><text>an annual deadline for submission of the applications;</text></clause></subparagraph> <subparagraph commented="no" id="H89499BB8DE534D4EBEF29912EB2B6A2C"><enum>(B)</enum><text>a process by which the Director shall approve or disapprove each application; and</text></subparagraph>

<section id="HBC122B612E2C4EECBD0C573E38B2DF74"><enum>505.</enum><header>Insular Area Technical Assistance Program</header>
<subsection id="H96DE9F776E304FF6809CD9ECD30CB1A8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall establish a program, to be known as the Insular Area Technical Assistance Program, to provide technical assistance to Insular Areas relating to climate change planning, mitigation, adaptation, and resilience. </text></subsection> <subsection id="HF26062F540964232A1E83A7CF6682857"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator to carry out this section $5,000,000 for each of the fiscal years 2022 through 2026.</text></subsection></section></title>
<title id="HEBC47AE9CAFA45DF841DB7B093DA2B3E"><enum>VI</enum><header>Emergency Management</header>
<section id="H474D06A0003749AA81D0BA45C3E17108"><enum>601.</enum><header>Community disaster loans repayment cancellation</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, repayment of a loan made to a local government in an Insular Area under section 417 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5184">42 U.S.C. 5184</external-xref>), including any interest on such loan, shall be canceled.</text></section> <section id="H7B4EC1C8189D44D98EDFED5AEBD3835D"><enum>602.</enum><header>Disaster relief non-Federal cost-share waiver</header><text display-inline="no-display-inline">Funding made available to an Insular Area for disaster relief, long-term recovery, restoration of infrastructure and housing, economic revitalization, and mitigation pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) shall not be subject to a non-Federal share funding requirement.</text></section></title>
<title id="id27355E73B8DC49B8938DFCF705FAC2ED" style="OLC"><enum>VII</enum><header>Sense of Congress regarding the threat of climate change</header>
<section id="idDB2A89B289DA42BDA7286FFFF025252C"><enum>701.</enum><header>Sense of Congress regarding the threat of climate change</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="id777C45ECCFF24D008F4E2FDC60709D3E"><enum>(1)</enum><text>climate change is an existential threat to the Freely Associated States; and</text></paragraph>
<paragraph id="idFB077657900E4895B9C33F880E1CF5E6"><enum>(2)</enum><text>the United States should examine additional ways to help the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau address and mitigate the impacts of climate change and rising sea level through their respective Compacts of Free Association.</text></paragraph></section></title> </legis-body> </bill>
