<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 260</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210204">February 4, 2021</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> (for herself, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, and <cosponsor name-id="S361">Ms. Hirono</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide immigration status for certain battered spouses and children.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idA0A4DB27E1244F299B6ACA3609ADAF15"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Immigrant Victims of Domestic Violence Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id4E222C5758174272BB295BDCA2B790B9"><enum>2.</enum><header>Immigration status for certain battered spouses and children</header><subsection id="idA24E27B058C34678A86288786E5560A4"><enum>(a)</enum><header>Nonimmigrant status for certain battered spouses and children</header><text>Section 101(a)(51) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(51)</external-xref>) is amended—</text><paragraph id="id6BF5F28CC1B14129A1A8D70DFEEA073A"><enum>(1)</enum><text>in subparagraph (F), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="idAED53EA3750C44AAB8DB52C455AABA25"><enum>(2)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="id1BECF37C482B4D689A706627CA2454AF"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0CAAD47763FE479B99673C727A2F97C2"><subparagraph id="idD8D670270DF648A69E87CFA619D352B6"><enum>(H)</enum><text>section 106 as an abused derivative alien.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9DC46E7BFAE04048BEE5F41BFA01F224"><enum>(b)</enum><header>Relief for
 abused derivative aliens</header><paragraph id="idB9B13122DA0C4CF5AF59BA752FCFF40F"><enum>(1)</enum><header>Amendment</header><text>Section 106 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1105a">8 U.S.C. 1105a</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id61F99FB531004E6486E635C4925F2C6D"><section id="idAEBD3CBF9A56405D99109682E2BE517E"><enum>106.</enum><header>Relief for
		  abused derivative aliens</header><subsection id="idC8D6D4247E9D4CF0A534EC9FFDAD1A8F"><enum>(a)</enum><header>Abused
 derivative alien defined</header><text>In this section, the term <quote>abused derivative alien</quote> means an alien who—</text><paragraph id="idF63292FE4D7948BBB96B625E45D34E93"><enum>(1)</enum><text>is a spouse or child admitted under section 101(a)(15);</text></paragraph><paragraph id="id2F66F3E2F96540B0BA24492F079E82D3"><enum>(2)</enum><text>is accompanying or following to join a principal alien admitted under such section; and</text></paragraph><paragraph id="id44744839F91B4F9BACD727F906DDDFCC"><enum>(3)</enum><text>has been subject to battery or extreme cruelty by such principal alien.</text></paragraph></subsection><subsection id="id502844DFAF404EBA9ED670C3BD1E08CB"><enum>(b)</enum><header>Relief for
 abused derivative aliens</header><text display-inline="yes-display-inline">The Secretary of Homeland Security—</text><paragraph id="idA47A76672070450BBEC9AFE69845E064"><enum>(1)</enum><text>shall grant admission to, or extend the period of admission for, an abused derivative alien under the subparagraph of section 101(a)(15) pursuant to which the principal alien was admitted for the period that is the longer of—</text><subparagraph id="id1F0DA60390D04147BB04E3D42E3FE14F"><enum>(A)</enum><text>the same period for which the principal alien was initially admitted; or</text></subparagraph><subparagraph id="id2D6F6146A49E4A7D8740FA0F05DDC0AA"><enum>(B)</enum><text>3 years;</text></subparagraph></paragraph><paragraph id="id05BB0A4F52C14449BBEFEE971FF8507A"><enum>(2)</enum><text>may renew a grant or an extension of status made under paragraph (1);</text></paragraph><paragraph id="id4D5B10CAD829457F97885458C032A56B"><enum>(3)</enum><text>shall grant employment authorization to an abused derivative alien; and</text></paragraph><paragraph id="idEA3B6AC045D74706874D2D9FC40D3608"><enum>(4)</enum><text>may adjust the status of an abused derivative alien to that of an alien lawfully admitted for permanent residence if—</text><subparagraph id="idBF5BFFB773B445C39CE8A5B097777775"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id3A269982963B48F281D01BE8060F7333"><enum>(i)</enum><text>the abused derivative alien is admissible under section 212(a); or</text></clause><clause id="idDD058D5CA38A450CBA3195FFB82581E3" indent="up1"><enum>(ii)</enum><text>the Secretary of Homeland Security determines that the continued presence in the United States of the abused derivative alien is justified—</text><subclause id="idC5ED9043CBAC4D5D8B35AE434A5A4095"><enum>(I)</enum><text>on humanitarian grounds;</text></subclause><subclause id="idADC423251D2448D99F0FB31E274D82B4"><enum>(II)</enum><text>to ensure family unity; or</text></subclause><subclause id="id46B73A0352FA4CBFB330A8BA025F9B75"><enum>(III)</enum><text>is otherwise in the public interest; and</text></subclause></clause></subparagraph><subparagraph id="id976A6DE077D24CCC8A01BEA13E953299"><enum>(B)</enum><text>the status under which the principal alien was admitted to the United States would have potentially allowed for eventual adjustment of status.</text></subparagraph></paragraph></subsection><subsection id="idA301B0D21A3748AEBE7262CC73C96A92"><enum>(c)</enum><header>Effect of
 termination of relationship</header><text>Termination of the relationship with principal alien shall not affect the status of an abused derivative alien under this section if battery or extreme cruelty by the principal alien was one central reason for termination of the relationship.</text></subsection><subsection id="id741B63C3CD184F9EB9D200350E6984B1"><enum>(d)</enum><header>Procedures</header><text>A request for relief under this section shall be handled under the procedures that apply to an alien seeking relief under section 204(a)(1)(B).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idA4BE4670141C400CB708D7C980459905"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents preceding section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>) is amended by striking the item relating to section 106 and inserting the following:</text><quoted-block style="OLC" id="idf858b077-ed19-4636-a483-0ac0c351c0b5"><toc><toc-entry idref="idAEBD3CBF9A56405D99109682E2BE517E" level="section">Sec. 106.
