which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to ensure equitable payment for, and preserve Medicare beneficiary access to, diagnostic radiopharmaceuticals under the Medicare hospital outpatient prospective payment system.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating Innovative Nuclear Diagnostics Act of 2021</short-title></quote>.</text></section><section id="id98b85c519fab4c84b6cfeeaff3b2460a"><enum>2.</enum><header>Separate payment for certain diagnostic radiopharmaceuticals</header><subsection id="id57bd0e2b044b4c9d828827109ee2bffa"><enum>(a)</enum><header>In general</header><text>Section 1833(t)(16) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395(t)(16)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id670DDA710EB945368D9C77A2DBFA5DA1"><subparagraph id="idb0e5156e2bc348a9876e6cb6bd92e00e"><enum>(G)</enum><header>Separate payment for certain diagnostic radiopharmaceuticals</header><clause id="idb3bf5124eacc4463a91ef66f371ff6bb"><enum>(i)</enum><header>In general</header><text>Notwithstanding any other provision of this subsection, with respect to services furnished on or after January 1, 2022, the Secretary shall not package, and shall make a separate payment as specified in clause (ii) for a diagnostic radiopharmaceutical (as defined in clause (v)) with an estimated mean per day product cost equal to or exceeding the threshold specified in clause (iii). </text></clause><clause id="id2b454c270cb444b5ab3190c58a1d0e00" commented="no"><enum>(ii)</enum><header>Separate payment</header><text>For purposes of clause (i), the separate payment specified in this subclause for a diagnostic radiopharmaceutical described in clause (i) shall be equal to— </text><subclause id="id12722900d24544338dcba243216843de" commented="no"><enum>(I)</enum><text>the average sales price for the drug established under section 1847A, to the extent the average sales price is available, as calculated and adjusted by the Secretary to the extent such adjustment is adopted for other specified covered outpatient drugs under paragraph (14)(A); or</text></subclause><subclause commented="no" id="id34EFF81D3580426C8E6D930EF774F876"><enum>(II)</enum><text>if the data necessary to calculate the average sales price for the drug in the year under the section and paragraph specified in subclause (I) is not available, the wholesale acquisition cost (as defined in subsection 1847A(c)(6)(B)), as calculated and adjusted by the Secretary to the extent such adjustment is adopted for other specified covered outpatient drugs under paragraph (14)(A), or, if the wholesale acquisition cost is not available, the mean unit cost data derived from hospital claims data.</text></subclause><continuation-text continuation-text-level="clause">Nothing in this subparagraph shall be construed as affecting eligibility of diagnostic radiopharmaceuticals for pass-through payments under paragraph (6).</continuation-text></clause><clause id="idf7bb4482a2e64010a3174936eb179060"><enum>(iii)</enum><header>Threshold</header><text>For purposes of this subparagraph, the threshold specified in this clause—</text><subclause id="idA1D901F026F041FB8F727E80388949BC"><enum>(I)</enum><text> for 2022, is $500; and </text></subclause><subclause id="idD350E181BD0B45A98E935ADF570AFC09"><enum>(II)</enum><text>for a subsequent year, is the amount specified in this clause for the preceding year increased by the OPD fee schedule increase factor under paragraph (3)(C)(iv) for the year. </text></subclause></clause><clause id="id5b900e679bed4381a35558f3a9d9a78d"><enum>(iv)</enum><header>Budget neutrality</header><text>The Secretary shall make such adjustments as are necessary under paragraph (9)(B) to ensure that the amount of expenditures under this subsection for a year with application of this subparagraph is equal to the amount of expenditures that would be made under this subsection for such year without application of this subparagraph. </text></clause><clause id="idd7207186ffed4510b7429ebee863e70f"><enum>(v)</enum><header>Definition of diagnostic radiopharmaceutical</header><text>For purposes of this subparagraph, the term <term>diagnostic radiopharmaceutical</term> means a drug or biological that is described in section 315.2(a) of title 21, Code of Federal Regulations, or any successor regulation, and is approved by the Food and Drug Administration on or after January 1, 2008.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idc6645c36c0124de1b28a2206127cdb28"><enum>(b)</enum><header>No impact on copayment</header><text>Section 1833(t)(8)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(t)(8)(E)</external-xref>) is amended— </text><paragraph id="idd049f4257fbf44d3bef5a53aeb9b5f85" commented="no"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text style="OLC" level="subparagraph">and separate payments for certain diagnostic radiopharmaceuticals</header-in-text></quote> after <quote><header-in-text style="OLC" level="subparagraph">pass-through adjustments</header-in-text></quote>; and</text></paragraph><paragraph id="idb68cda50b543471e8fd42df32588244e" commented="no"><enum>(2)</enum><text>by inserting <quote>and paragraph (16)(G)</quote> after <quote>such adjustments)</quote>. </text></paragraph></subsection></section></legis-body></bill>
