<section id="HFCB320503FE5426BAC7F1CB7F6142B46"><enum>2.</enum><header>Additional requirements for front-of-package labeling for foods</header>
<subsection id="H349D8692DA8D4342B545EE16B4A88E26"><enum>(a)</enum><header>Summary nutrition labeling information</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H20692BFE8B65472FBFA64D402A8150CE"> <subsection id="HF8C206CCF5EA4910B5911C4741B96F6B"><enum>(z)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HE3F02D26666B4F1F8BD73A33FA08FF17"><enum>(1)</enum><header>Summary nutrition information</header><text display-inline="yes-display-inline">Except as provided in subparagraphs (3), (4), and (5) of paragraph (q), if it is food (other than a dietary supplement) intended for human consumption and is offered for sale and otherwise required to bear nutrition labeling, unless its principal display panel bears summary nutrition information that reflects the overall nutritional value of the food or specified ingredients, as specified in accordance with regulations of the Secretary, and does not contain any summary nutritional information which is in addition to or inconsistent with the information required under this subparagraph.</text></paragraph>
<paragraph id="H5987692E98484070B595713188CECAE2" indent="up1"><enum>(2)</enum><header>Required criteria for implementing regulations</header><text display-inline="yes-display-inline">Final regulations regarding the summary nutrition information required under subparagraph (1) shall meet the following criteria:</text> <subparagraph id="H901AA08D62A445EDA10F5E417CB35714"><enum>(A)</enum><text display-inline="yes-display-inline">There shall be a standardized symbol system that displays calorie information related to the serving size determined under paragraph (q)(1)(A), and information related to the content of saturated and trans fats, sodium, added sugars, and any other nutrients that the Secretary determines are strongly associated with public health concerns.</text></subparagraph>
<subparagraph id="H1A7F7A5D5EFB4DC1BBE333B10E345EBD"><enum>(B)</enum><text>The system shall employ an approach that clearly distinguishes between products of greater or lesser nutritional value. This system shall include—</text> <clause id="H24FB3250050542EC9B20903A8A336845"><enum>(i)</enum><text>a warning symbol or symbols for products high in saturated or trans fats, sodium, added sugars, and any other nutrients the consumption of which should be limited or discouraged; and</text></clause>
<clause id="H8E6429B1C21D4309974C97060F472CC3"><enum>(ii)</enum><text>a stop-light, points, star, or other commonly recognized signaling system to scale or rank foods according to their overall health value.</text></clause></subparagraph> <subparagraph id="H3235BF9607F84FE68B5C5BC19DC5ADDB"><enum>(C)</enum><text display-inline="yes-display-inline">The information shall appear on all products that are required to bear nutrition labeling.</text></subparagraph>
<subparagraph id="HCF8E6B1C9C184A28862364B94F7EDE2C"><enum>(D)</enum><text>The information shall—</text> <clause id="H91B07F1855AE4F4C852BC203687217F2"><enum>(i)</enum><text>appear in a consistent location on the principal display panels across products;</text></clause>
<clause id="H3CFDDA7AC5954920A5EE0D6C1C6D6287"><enum>(ii)</enum><text>have a prominent design that visually contrasts with existing packaging design; and</text></clause> <clause id="H889C1B135C7F40999BF0DD8803FEE50C"><enum>(iii)</enum><text display-inline="yes-display-inline">be sufficiently large to be easily legible.</text></clause></subparagraph></paragraph>
<paragraph id="H9255C024585A437893A51B8CD323492E" indent="up1"><enum>(3)</enum><header>Principles for implementing regulations</header><text>In promulgating regulations regarding the summary nutrition information required under subparagraph (1), the Secretary shall take into account published reports by the Health and Medicine Division of the National Academy of Sciences, Engineering, and Medicine regarding such information, and base regulations on the following principles:</text> <subparagraph id="HA42CD720DD724D75B6EA5B3D334A1831"><enum>(A)</enum><text display-inline="yes-display-inline">Consumers should be able to quickly and easily comprehend the meaning of the system as an indicator of a product’s contribution to a healthy diet without requiring specific or sophisticated nutritional knowledge.</text></subparagraph>
<subparagraph id="H99C2F2BCA45F4EF4BB53BBBD030CC2BF"><enum>(B)</enum><text display-inline="yes-display-inline">The nutrition information should be consistent with the Nutrition Facts Panel and with the recommendations of the Dietary Guidelines for Americans.</text></subparagraph> <subparagraph id="HC7F005CCA88743C5BCAEF465AC8E5B10"><enum>(C)</enum><text display-inline="yes-display-inline">The information should aim to facilitate consumer selection of healthy product options, including among nutritionally at-risk subpopulations.</text></subparagraph>
<subparagraph id="H27D1FA4B35B848F59D74336169F2B37E"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary should periodically evaluate the front-of-package information to assess its effectiveness in facilitating consumer selection of healthy product options and the extent to which manufacturers are offering healthier products as a result of the disclosure.</text></subparagraph> <subparagraph id="H2A2F5F5E5C754EFDBA7762745201EB3F"><enum>(E)</enum><text display-inline="yes-display-inline">The implementation of the information disclosure should be accompanied by appropriate consumer education and promotion campaigns determined by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H1C67492E306D4F24AE3EB45CCFC9E4C8"><enum>(b)</enum><header>Percentage of wheat and grains in grain-Based products, and amount of real fruit, vegetable, and yogurt in products bearing fruit, vegetable, and yogurt claims</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act, as amended by subsection (a), is further amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H78152D8CAF1E43798AD93ABCAFC892D1"> <subsection commented="no" id="HD6E2C58811134106B684EE8E7940D70C"><enum>(aa)</enum><header>Percentage of wheat and grains in grain-Based products</header><text display-inline="yes-display-inline">If, in the case of food other than a dietary supplement, the principal display panel bears—</text>
<paragraph id="H389180A6A392469EA5551D7F8321C1F4"><enum>(1)</enum><text>the term <term>whole wheat</term>, <term>whole grain</term>, <term>made with whole grain</term>, or <term>multigrain</term>;</text></paragraph> <paragraph id="HD649A2A9B80748048424F86C2C37B82C"><enum>(2)</enum><text>a declaration of the whole grain content by weight;</text></paragraph>
<paragraph id="H27302CB8159C4964989B8718A115E320"><enum>(3)</enum><text>the term <term>wheat</term> on a wheat bread, pasta, or similar product that is typically made from wheat; or</text></paragraph> <paragraph id="H3791AA9C8E4842C193B10630EBB461EB"><enum>(4)</enum><text>any similar descriptive phrases, terms, or representations suggesting the product contains whole grains, </text></paragraph><continuation-text continuation-text-level="subsection">unless the amounts of whole grains and refined grains, expressed as a percentage of total grains, are conspicuously disclosed in immediate proximity to the most prominent descriptive phrase, term, or representation using a font color and formatting of equivalent prominence to the descriptive phrase, term, or representation with respect to whole grain content, or unless 100 percent of the grains in the food are whole grains.</continuation-text></subsection>
<subsection id="H20CE1405A51548F4A20FD93CCE9C0BAE"><enum>(bb)</enum><header>Amount of fruit</header>
<paragraph id="H51808D670A4F4F6B97034CB7BC6EE6F6"><enum>(1)</enum><header>In general</header><text>If, in the case of food other than a dietary supplement, the principal display panel bears—</text> <subparagraph id="H4FCA9D2D811F41CDA5113D0E897F3B13"><enum>(A)</enum><text>the term <term>fruit</term>, <term>fruity</term>, <term>froot</term>, <term>frooty</term>, or <term>fruit-flavored</term>;</text></subparagraph>
<subparagraph id="HA07CCDB030104171808E542E15B1D7AF"><enum>(B)</enum><text>representations, depictions, or images of such ingredients; or</text></subparagraph> <subparagraph id="H9281E4D30FCE4C50AADD1E83824568FA"><enum>(C)</enum><text>any similar descriptive phrases, terms, or representations suggesting the product contains fruit or any specific type of fruit, </text></subparagraph><continuation-text continuation-text-level="paragraph">unless the quantity per serving and form of fruit, including only the nutrient-dense forms, is declared on the principal display panel in a common household measure that is appropriate to the food, conspicuously, and in immediate proximity to the most prominent term, representation, depiction, or image of fruit.</continuation-text></paragraph>
<paragraph id="H382C6F7C6E95452EAF55F92EF998DFE8"><enum>(2)</enum><header>Quantities</header><text display-inline="yes-display-inline">The Secretary shall by regulation establish quantities below which such declaration shall state that the food does not contain any full serving of fruit.</text></paragraph> <paragraph id="H10CDF356101342AF83D2D4298C2B18E4"><enum>(3)</enum><header>Nutrient-dense</header><text display-inline="yes-display-inline">In this paragraph, the term <term>nutrient-dense</term>, with respect to the form of an ingredient derived from a fruit, means the whole, cut, dried, pulp, puree, 100-percent juice, or fully reconstituted concentrate form, and not concentrates, powders, and other ingredients that are not whole, cut, dried, pulp, puree, 100-percent juice, or fully reconstituted concentrates.</text></paragraph></subsection>
<subsection id="HFC50BDC26744484C9BF7A97C59BB1E49"><enum>(cc)</enum><header>Amount of vegetables</header>
<paragraph id="HF0C6AFBF693448588B49EDEEF4746146"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If, in the case of food other than a dietary supplement, the principal display panel bears—</text> <subparagraph id="H1A056DB88B6B4319A4FD883032496205"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>vegetable</term> or <term>veggie</term>;</text></subparagraph>
<subparagraph id="HCEE1C645A62B4E728F032F6C62EEF45E"><enum>(B)</enum><text>representations, depictions, or images of such ingredients; or</text></subparagraph> <subparagraph id="HF4D7AF2A36E441E5A106B440481DC619"><enum>(C)</enum><text display-inline="yes-display-inline">any similar descriptive phrases, terms, or representations suggesting the product contains vegetables or any specific type of vegetable,</text></subparagraph><continuation-text continuation-text-level="paragraph">unless the quantity per serving and form of vegetable, including only the nutrient-dense form, is declared on the principal display panel in a common household measure that is appropriate to the food, conspicuously, and in immediate proximity to the most prominent term, representation, depiction, or image of vegetable.</continuation-text></paragraph>
<paragraph id="H971891BABCCE4661A43D375A007D43D8"><enum>(2)</enum><header>Quantities</header><text display-inline="yes-display-inline">The Secretary shall by regulation establish quantities below which such declaration shall state that the food does not contain any full serving of vegetable.</text></paragraph> <paragraph id="HF9EF5A7EF56C4B2B99117A97E62ED341"><enum>(3)</enum><header>Nutrient-dense</header><text display-inline="yes-display-inline">In this paragraph, the term <term>nutrient-dense</term>, with respect to the form of an ingredient derived from a vegetable, means the whole, cut, dried, pulp, puree, 100-percent juice, or fully reconstituted concentrate form, and not concentrates, powders, and other ingredients that are not whole, cut, dried, pulp, puree, 100-percent juice, or fully reconstituted concentrates.</text></paragraph></subsection>
<subsection id="H80E0D2B9630E4449969A6ABA9F6EEF1F"><enum>(dd)</enum><header>Amount of yogurt</header>
<paragraph id="HA3105137EA53457E928D4A1ADFC6959B"><enum>(1)</enum><header>In general</header><text>If, in the case of food other than a dietary supplement, the principal display panel bears the term <term>yogurt</term>, unless—</text> <subparagraph id="H6F42C8CD1B9D464295E3AD2906D5795C"><enum>(A)</enum><text>the quantity per serving of yogurt is declared on the principal display panel in a common household measure that is appropriate to the food, conspicuously, in immediate proximity to the term; or</text></subparagraph>
<subparagraph id="H2EABA05FD09E4E37858417C6FA6FB61C"><enum>(B)</enum><text>the first ingredient is cultured milk, cultured cream, cultured partially skimmed milk, or cultured skim milk.</text></subparagraph></paragraph> <paragraph id="H391A34785DD64B65ABC32BDDBFC0A1D3"><enum>(2)</enum><header>Quantities</header><text display-inline="yes-display-inline">The Secretary shall by regulation establish quantities below which such declaration shall state that the food does not contain any full serving of yogurt.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H7A3044125E2048EB9D48AE13AB5A9B66"><enum>(c)</enum><header>Coloring and flavoring</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act, as amended by subsection (b), is further amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H5CAF726075BC4096A1AFBEB0DEDC56E0"> <subsection id="HD5B21904D1CE424381E120B4213A6C20"><enum>(ee)</enum><header>Coloring and flavoring</header><text display-inline="yes-display-inline">If, in the case of food other than a dietary supplement, it bears or contains any artificial dye, or any added artificial or natural flavoring, unless such fact is prominently stated on the principal display panel of the packaging of the food. For the purposes of this paragraph, the term <term>artificial dye</term> refers to a batch-certified dye certified under part 74 of title 21, Code of Federal Regulations (or any successor regulations).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H03175FA1502C421FA198738FF3974E4A"><enum>(d)</enum><header>Sweeteners</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act, as amended by subsection (c), is further amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE5D548A88BDA443993C13ACB4C902BC1"> <subsection id="HFD747DCEAC174B4C8543CA06FEF23395"><enum>(ff)</enum><header>Sweeteners</header><text display-inline="yes-display-inline">If, in the case of food other than a dietary supplement, it bears or contains any added artificial or natural noncaloric sweetener, unless such fact is prominently stated on the principal display panel of the packaging of the food.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HD090F0EB3703477CA3AB3B54C7FA43F5"><enum>(e)</enum><header>Construction</header><text>Nothing in this section, including any amendment made by this section, shall be construed as—</text> <paragraph id="H50177DD37DC7448895F32334C4564023"><enum>(1)</enum><text>affecting any requirement in regulation in effect as of the date of the enactment of this Act with respect to matters that are required to be stated on the principal display panel of a package or container of food that is not required by an amendment made by this section; or</text></paragraph>
<paragraph id="HCCBF6FB35880455A96DC9364FAFD054B"><enum>(2)</enum><text>restricting the authority of the Secretary of Health and Human Services to require additional information be disclosed on such a principal display panel.</text></paragraph></subsection></section> <section id="H81BE4D2483284BAEB9FBACCE85927C76"><enum>3.</enum><header>Claims for conventional foods</header> <subsection id="H941DF8430A95413682F0E72C43E2BE2D"><enum>(a)</enum><header>Health-Related claims</header> <paragraph id="HF1E60ED83E814682B60795F789D5D6A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 403(r)(1)(B) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(r)(1)(B)</external-xref>) is amended by inserting after <quote>health-related condition</quote> the following: <quote>, describes the effect that a nutrient may have on the structure or function of the human body, characterizes the documented mechanism by which that nutrient acts to maintain such structure or function, or describes general well-being from consumption of that nutrient,</quote>.</text></paragraph>
<paragraph id="H07F92B57DD644CF1A11E4E14E12CCF25"><enum>(2)</enum><header>Substantiation of claim</header><text display-inline="yes-display-inline">Section 403(r) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(r)</external-xref>) is amended—</text> <subparagraph id="H64F6DEEE1AFA401989094A140AA3CCDF"><enum>(A)</enum><text>by redesignating subparagraph (7) as subparagraph (8); and</text></subparagraph>
<subparagraph id="H018A26E83D604D488CD80CA9C5804D67"><enum>(B)</enum><text>by inserting after subparagraph (6) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD254C4A824C64E12984A5592104BE96D"> <paragraph id="HB500EE650D5C40E0BEB02697E3043E8E" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">If the Secretary requests that a claim under subparagraph (1)(B) for food (other than a dietary supplement) be substantiated, then not later than 90 days after the date on which the Secretary makes such request, the manufacturer shall provide to the Secretary all documentation in the manufacturer's possession relating to the claim.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HCE09CEFB36014E459B6819CB9F005783"><enum>(3)</enum><header>Incompatible with maintaining healthy dietary practices</header><text display-inline="yes-display-inline">Section 403(r)(3)(A)(ii) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(r)(2)(B)</external-xref>) is amended by striking <quote>increases to persons in the general population the risk of a disease or health-related condition which is diet related</quote> and inserting <quote>may not be compatible with maintaining healthy dietary practices</quote>.</text></paragraph></subsection> <subsection id="H92C9E829D52443B5A64897936AC40104"><enum>(b)</enum><header>Nutrient content claims</header> <paragraph id="H1B2B6057719E4FE7B7C60B9A4B11A9DA"><enum>(1)</enum><header>In general</header><text>Section 403(r)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(r)(2)</external-xref>) is amended by striking clause (B) and inserting the following:</text>

<subparagraph id="H9F26CC22E329447E9FD1BB63EFDA19D2" indent="up2"><enum>(B)</enum><text>If a claim described in subparagraph (1)(A) is made with respect to a nutrient in a food and the Secretary makes a determination that the food contains a nutrient at a level that may not be compatible with maintaining healthy dietary practices, the label or labeling of such food shall contain, prominently and in immediate proximity to such claim, a statement which indicates the food is high in such nutrient.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HA921063ECE6F4994A89EF7F4BC72A094"><enum>(2)</enum><header>Revisions to regulations</header><text>In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall revise section 101.13(h) of title 21, Code of Federal Regulations, by—</text>
<subparagraph id="H593D0E6737C5440B8388B645070B6455"><enum>(A)</enum><text>updating the level of sodium requiring disclosure to align with the Daily Reference Value for sodium established in the final rule entitled <quote>Food Labeling: Revision of the Nutrition and Supplement Facts Labels</quote> published by the Food and Drug Administration on May 27, 2016 (81 Fed. Reg. 33741);</text></subparagraph> <subparagraph id="H7741CE00433C4D4A9E7F0A81015AB3D3"><enum>(B)</enum><text>including a level of added sugars requiring disclosure based on the Daily Reference Value for added sugars established in the final rule described in subparagraph (A);</text></subparagraph>
<subparagraph id="HF53ED454915D4A329E1436D8E44E6A51"><enum>(C)</enum><text>eliminating the requirement that meal products containing more than 26 grams of fat and main dish products containing 19.5 grams of fat per labeled serving must disclose that fat is present in the food; and</text></subparagraph> <subparagraph id="HE369D32C5621404094F58D08A920BBFC"><enum>(D)</enum><text>authorizing the use of express and implied <quote>low added sugar</quote> claims on products containing 3 grams of added sugars or less per reference amount customarily consumed (or per 50 grams if the reference amount customarily consumed is 30 grams or less or 2 tablespoons or less).</text></subparagraph></paragraph></subsection>
<subsection id="H8E712442C0484F0988CC0924B603D8C2"><enum>(c)</enum><header>Trans fats</header><text display-inline="yes-display-inline">Section 403(r)(2)(A) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(r)(2)(A)</external-xref>) is amended—</text> <paragraph commented="no" id="HAF4A033595D24A44BBDFAC8D92A19B03"><enum>(1)</enum><text>by redesignating subclauses (v) and (vi) as subclauses (vi) and (vii), respectively; and</text></paragraph>
<paragraph commented="no" id="HDCB0DAB06991485596F2597DAE3F2863"><enum>(2)</enum><text>by inserting after subclause (iv) the following new subclause:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE92A59F096C84087A28E6B4117FCEF0B"> <clause commented="no" id="HCD07F972787A4647AFA1498AC67243AD" indent="up2"><enum>(v)</enum><text display-inline="yes-display-inline">may not be made with respect to the level of trans fats in the food, except on the Nutrition Facts Panel, unless the food contains less than one gram of saturated fat per serving or, if the food contains more than one gram of saturated fat per serving, unless the label or labeling of the food discloses the level of saturated fat in the food in immediate proximity to such claim and with appropriate prominence which shall be no less than one-half the size of the claim with respect to the level of trans fats,</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" id="H7421505EDE1547C0B7BC8618F40A3A5C"><enum>(d)</enum><header>Added sugars</header><text display-inline="yes-display-inline">Not more than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate a final rule revising section 101.14 of title 21, Code of Federal Regulations, to include a disqualifying nutrient level for added sugars.</text></subsection></section> <section id="HF1254C87752941439A5148125B6CAF99"><enum>4.</enum><header>Use of specific terms</header> <subsection id="H8AADD45032964F508D74268BD45F5E55"><enum>(a)</enum><header>Use of the term <term>natural</term></header> <paragraph id="H54C58B9649004E199F08F5AAB746F240"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall include regulations—</text>
<subparagraph id="HDFB146CC5045458DBA093F2CFACD62EA"><enum>(A)</enum><text>relating to use of the term <term>natural</term> on the labeling of food (other than a dietary supplement);</text></subparagraph> <subparagraph id="HDD04B03EAACD48D88488AAA5AC978B16"><enum>(B)</enum><text>specifically addressing the use of such term on the principal display panel and the information panel; and</text></subparagraph>
<subparagraph id="HB4534C9925794BEFBE560D5ED95FAE34"><enum>(C)</enum><text>requiring that any such use includes a prominent disclosure explaining what the term <quote>natural</quote> does and does not mean in terms of ingredients and manufacturing processes.</text></subparagraph></paragraph> <paragraph id="H026D2228E64C4CE0924C9B0D54E3DFFD"><enum>(2)</enum><header>Definition</header><text>The regulations promulgated pursuant to paragraph (1) shall define the term <term>natural</term>—</text>
<subparagraph id="H296F0B14EB354A109B7FBFA210B6C43B"><enum>(A)</enum><text>to exclude, at a minimum, the use of any artificial food or ingredient (including any artificial flavor or added color); and</text></subparagraph> <subparagraph id="HB8C1D95509A24F73950C66D1B763E764"><enum>(B)</enum><text>based on data, including data on consumers’ understanding of the term as used in connection with food.</text></subparagraph></paragraph>
<paragraph id="H7CC30BE1DE974072AF0604A00FC97A36"><enum>(3)</enum><header>Process</header><text>In promulgating the regulations required by paragraph (1), the Secretary of Health and Human Services shall—</text> <subparagraph id="H326F8DDAED394E2987D7610239CD1236"><enum>(A)</enum><text>conduct consumer surveys and studies and issue a timely call for relevant public submissions regarding relevant consumer research, including with respect to consumer understanding of the term <term>natural</term> in relation to the term <term>organic</term>; and</text></subparagraph>
<subparagraph id="H4BEDEEDDBDAF4DD894F90867B4E72591"><enum>(B)</enum><text>fully consider the results of such surveys and studies, as well as such public submissions.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="H720EB0D6BFA543A8BD4190806C4893EE"><enum>(b)</enum><header>Use of term <term>healthy</term></header> <paragraph id="HF0874D38A3694077B8813F7E98703485"><enum>(1)</enum><header>Added sugars and whole grains</header> <subparagraph id="HF76BA08184CF4AD3BA8E6FD4C2A2CCBE"><enum>(A)</enum><header>In general</header><text>In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall include regulations to revise the regulations under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) relating to the use of the term <term>healthy</term> on the labeling of a food (other than a dietary supplement) to take into account the extent to which such food contains added sugars or whole grains.</text></subparagraph>
<subparagraph id="H8E9413F566C2436A92EC18BE926D4EE9"><enum>(B)</enum><header>Requirement</header><text>In making the revisions required by subparagraph (A) in the case of a food (other than a dietary supplement) that contains grains, the Secretary of Health and Human Services shall not consider the food to be <term>healthy</term> unless 100 percent of the grains are whole grains.</text></subparagraph></paragraph> <paragraph id="H9E3AF3B65DED440DA003305D7C04C1F6"><enum>(2)</enum><header>Sodium</header><text display-inline="yes-display-inline">In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall revise the regulations under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) relating to the use of the term <term>healthy</term> on the labeling of a food (other than a dietary supplement) to align labeling requirements related to sodium with the daily value for sodium in the most recent Dietary Guidelines for Americans.</text></paragraph>
<paragraph id="H96D0C979375E442884854DA93829769C"><enum>(3)</enum><header>Principles for implementing regulations</header><text>In promulgating regulations under paragraphs (1) and (2) regarding the use of the term <term>healthy</term>, the Secretary of Health and Human Services shall—</text> <subparagraph id="H52929BA572714167B78B96AE7644ADB0"><enum>(A)</enum><text>consider both food and nutrient criteria; and</text></subparagraph>
<subparagraph id="H674116EEFE7F4C81B9BF3BF380DD46A3"><enum>(B)</enum><text>if requiring food labeled as <quote>healthy</quote> to contain healthful ingredients—</text> <clause id="HD14ABEE09BDD4FB59A47E5EC9DF6752F"><enum>(i)</enum><text>consider only ingredients that make up the core of a healthy eating pattern; and</text></clause>
<clause id="H7E59F6A61AFB48C887380E9097458DC7"><enum>(ii)</enum><text>consider these ingredients only in their nutrient-dense forms (as such term in defined in paragraphs (bb) and (cc) of section 403 of the Federal Food, Drug, and Cosmetic Act, as added by section 2(b) of this Act).</text></clause></subparagraph></paragraph></subsection></section> <section commented="no" id="HAF7A7550022940509E4E6772BA895A77"><enum>5.</enum><header>Format of ingredient list</header> <subsection id="HFA5444B64DBE4D5B990C554310989D12"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall include requirements for the format of the information required under section 403(i) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(i)</external-xref>)—</text>
<paragraph id="HEC9EC5198B3A435F832A11AB89D9A8C1"><enum>(1)</enum><text>for the purpose of improving the readability of such information on the label of the food (other than a dietary supplement); and</text></paragraph> <paragraph id="H5E24AF84DF2246E8B50D6E5E9A519D27"><enum>(2)</enum><text>that are, as determined by the Secretary, necessary to assist consumers in maintaining healthy dietary practices.</text></paragraph></subsection>
<subsection id="H31CC082B324949DE821ED2BF3036DAAA"><enum>(b)</enum><header>Format requirements</header><text display-inline="yes-display-inline">The format requirements described in subsection (a) shall include requirements for font size, uppercase and lowercase characters, serif and noncondensed font types, high-contrast between text and background, and bullet points between adjacent ingredients with appropriate exemptions for small packages or other considerations.</text></subsection> <subsection id="HA76F7907F2C64915A95464B4DB4E6691"><enum>(c)</enum><header>Enforcement of ingredient list</header><text>Not later than 2 years after the enactment of this Act, and every 2 years thereafter, the Secretary of Health and Human Services shall submit a report to Congress on the Secretary’s enforcement of—</text>
<paragraph id="HF765589DE730447984920949945FC3EC"><enum>(1)</enum><text>section 403(i) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(i)</external-xref>), including with respect to the regulations described in subsection (a); and</text></paragraph> <paragraph id="HC21EE70BA5DD4781940CDCCB4AEE40E6"><enum>(2)</enum><text>regulations of the Food and Drug Administration on labeling of ingredients in section 101.4 of title 21, Code of Federal Regulations.</text></paragraph></subsection></section>
<section id="HC73B7CE02DDE4E3087556F210005064A"><enum>6.</enum><header>Declaration of phosphorus in the ingredient list</header><text display-inline="no-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>), as amended by section 2(d), is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="H9626F1F133FE413096A69648F6F716A0"> <subsection id="H99285BFDF4314AF0AAC4ECA883AA0457"><enum>(gg)</enum><header>Phosphorus content</header><text>If it is a food intended for human consumption that is offered for sale and contains phosphorus, unless—</text>
<paragraph id="HC9480CF50F524A8996710374A9770D6A"><enum>(1)</enum><text>the phrase <quote>contains phosphorus</quote>, along with the quantity of phosphorus in the product, reported in milligrams per serving, is printed immediately after or is adjacent to the list of ingredients required under paragraphs (g) and (i), in a type size no smaller than the type size used in the list of ingredients; or</text></paragraph> <paragraph id="H8C0CB63C2F6A43238F86967A1683B0E8"><enum>(2)</enum><text>the quantity of phosphorus contained in the product, in milligrams, is reported in the Nutrition Facts Panel.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H3CEB3E9D785D4884B698EC3CCE57EDE6"><enum>7.</enum><header>Caffeine content on information panel</header><text display-inline="no-display-inline">Section 403(i) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(i)</external-xref>) is amended—</text> <paragraph id="HAC7CF6B811344484B4475BDD657B4E0A"><enum>(1)</enum><text>by striking <quote>and (2)</quote> and inserting <quote>(2)</quote>;</text></paragraph>
<paragraph id="H76CAEB85107E4C788FFDA13815676213"><enum>(2)</enum><text>by striking <quote>and if the food purports</quote> and inserting <quote>, (3) if the food purports</quote>; and</text></paragraph> <paragraph id="H26AB67B343694EE1BD364333DEC0DF8F"><enum>(3)</enum><text>by inserting <quote>, and (4) if the food is food other than a dietary supplement and contains at least 10 milligrams of caffeine from all sources per serving, a statement (with appropriate prominence near the statement of ingredients required by this paragraph) of the number of milligrams of caffeine contained in one serving of the food and the size of such serving</quote> after <quote>vegetable juice contained in the food</quote>.</text></paragraph></section>
<section commented="no" id="H48D0BA9EFEE646AC97EBA03F361C1AB7"><enum>8.</enum><header>Food allergen labeling</header>
<subsection id="H1B814184EAA14B19BF7B4F4764CC9DCB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 201(qq) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(qq)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE5983778F0864CB0A0219BE87141E35D"> <paragraph id="H8E7DA3EDFB194ADBB8F2AE48DE33220C"><enum>(3)</enum><text display-inline="yes-display-inline">Any other food ingredient that the Secretary determines by regulation to be a major food allergen, based on the prevalence and severity of allergic reactions to the food ingredient.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HB33ADCB929E441CDB97F9E862EACDD5E"><enum>(b)</enum><header>Update to Compliance Policy Guide</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall update the Food and Drug Administration's Compliance Policy Guide, section 555.250, to conform with applicable laws related to major food allergens and gluten-containing grains, including requirements under sections 9 and 10 of this Act.</text></subsection></section> <section commented="no" id="H3EFB1C3932E04506B36510B792D49479"><enum>9.</enum><header>Information about major food allergens and gluten-containing grains</header> <subsection id="H2A738047E0494544ADEBA37CF4253FA6"><enum>(a)</enum><header>In general</header><text>Section 403(w) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(w)</external-xref>) is amended—</text>
<paragraph id="H589217B85AF346048A79F5C8F4F0D6DF"><enum>(1)</enum><text>in subparagraph (1)(A), by striking <quote>is printed immediately after or is adjacent to the list of ingredients (in a type size no smaller than the type size used in the list of ingredients) required under subsections (g) and (i)</quote> and inserting <quote>is printed as specified in subparagraph (8)</quote>;</text></paragraph> <paragraph id="H574F33FD2D7D40DD9711A4A741328615"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (1)(B), by striking <quote>in the list of ingredients required under subsections (g) and (i)</quote> and inserting <quote>as so printed</quote>;</text></paragraph>
<paragraph id="HC79527745EDE48A7845CC904D93F6D92"><enum>(3)</enum><text>in subparagraph (3), by striking <quote>The information</quote> and inserting <quote>Subject to subparagraph (8)(B), the information</quote>; and</text></paragraph> <paragraph id="HC915D487BCF94607938AA3AA39479136"><enum>(4)</enum><text>by adding at the end the following:</text>

<paragraph id="HED76288805E7400CA476CECB4C45549B" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">The information required by subparagraph (1) to be conveyed to the consumer shall be—</text> <subparagraph id="H9562FD44F8BD4935A2186FCE0596B92A"><enum>(A)</enum><text display-inline="yes-display-inline">printed immediately after or adjacent to the list of ingredients (in a type size no smaller than the type size used in the list of ingredients) required under paragraphs (g) and (i); or</text></subparagraph>
<subparagraph id="HDE651B01DC814593B9A448FD99E8AA34"><enum>(B)</enum><text>in the case of a nonpackaged food being offered for sale at retail, and not subject to the requirements of paragraphs (g) and (i), placed on a sign adjacent to the food (in a type size no smaller than the name of the food item).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HC3819135BA6F481AA98EFF1CCC051C74"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting <quote>or gluten-containing grain</quote> after each reference to <quote>food allergen</quote> in subparagraphs (1), (2), (4), and (7); and</text></paragraph>
<paragraph commented="no" id="H933DC1290B0A4E8F99701FBDF6AB9DCE"><enum>(6)</enum><text>in subparagraph (7)(A)—</text> <subparagraph commented="no" id="HC36C4692582E4D7E9C2F3B9A3FC0481D"><enum>(A)</enum><text>by striking <quote>paragraph (6)</quote> and inserting <quote>subparagraph (6)</quote>; and</text></subparagraph>
<subparagraph commented="no" id="H4893ABB012414DA8A01A9A66DEA15091"><enum>(B)</enum><text>by striking <quote>allergen labeling requirements of this subsection</quote> and inserting <quote>allergen and gluten-containing grain labeling requirements of this paragraph</quote>.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="H1CD15DB949094469BA2BBB9CC3397071"><enum>(b)</enum><header>Hazard analysis and preventive controls</header><text>Section 418 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350g">21 U.S.C. 350g</external-xref>) is amended—</text>
<paragraph commented="no" id="HF7D29ACD20034FB293157E93C7CEA52B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(A), by inserting <quote>gluten-containing grains,</quote> after <quote>allergens,</quote>; and</text></paragraph> <paragraph commented="no" id="H52A63CBFD1DE4572A6BFA6E912B32169"><enum>(2)</enum><text display-inline="yes-display-inline">in subsubsection (o)(3)(D), by inserting <quote>and gluten-containing grain</quote> after <quote>allergen,</quote>.</text></paragraph></subsection>
<subsection commented="no" id="HFF8D1527100E4433A8133390359F01C4"><enum>(c)</enum><header>Inspections relating to food allergens</header><text display-inline="yes-display-inline">Section 205 of the Food Allergen Labeling and Consumer Protection Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/21/374a">21 U.S.C. 374a</external-xref>) is amended by inserting <quote>and gluten-containing grains,</quote> after <quote>allergens</quote> each place it appears.</text></subsection></section> <section id="HC4ACD19371914663AFDB42828B210688"><enum>10.</enum><header>Submission and availability of food label information</header><text display-inline="no-display-inline">The Federal Food, Drug, and Cosmetic Act is amended by inserting after section 403C of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343-3">21 U.S.C. 343–3</external-xref>) the following:</text>

<paragraph id="HFD15E02A13F14DFD9EB4F4A905A39127"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary shall require the manufacturer or importer of any food that is introduced or delivered for introduction into interstate commerce in package form to submit to the Secretary all information to be included in the label of the food, including—</text> <subparagraph id="HF6E3B50BCF424762961E62F0E6B507E7"><enum>(A)</enum><text display-inline="yes-display-inline">the nutrition facts panel;</text></subparagraph>
<subparagraph id="H73994FCE16D04DE2ABF6A236742E538D"><enum>(B)</enum><text>the ingredients list;</text></subparagraph> <subparagraph id="H7765CAFCA5054303AE55B437A3BD6459"><enum>(C)</enum><text>an image of the principal display panel;</text></subparagraph>
<subparagraph id="HA329FC5FEFAA4D478E8C328F95D78B44"><enum>(D)</enum><text display-inline="yes-display-inline"> major allergens and gluten-containing grains;</text></subparagraph> <subparagraph id="H574EBB121297435EA1080CA737E2D223"><enum>(E)</enum><text>claims under section 403(r)(1)(A) (commonly known as <quote>nutrient-content claims</quote>);</text></subparagraph>
<subparagraph id="H919C1B2432D149168C74829FB69053C9"><enum>(F)</enum><text>claims under section 403(r)(1)(B) (commonly known as <quote>health-related claims</quote>); and</text></subparagraph> <subparagraph id="HA116CFAABEA145E187A05E140294B1D4"><enum>(G)</enum><text display-inline="yes-display-inline">other relevant information required by law to be published in the labeling of the food.</text></subparagraph></paragraph>
<paragraph id="H6BC6D367A2224B0397CC1AAE4DD5E538"><enum>(2)</enum><header>Updates</header><text display-inline="yes-display-inline">The Secretary shall require the manufacturer or importer of food to update or supplement the information submitted under paragraph (1) with respect to the food in order to keep the information up-to-date and complete.</text></paragraph> <paragraph id="HE63EA1D610694504A413153DDCDE8A8D"><enum>(3)</enum><header>Civil penalty</header><text display-inline="yes-display-inline">Whoever knowingly violates paragraph (1) with respect to any food shall be liable to the United States for a civil penalty in an amount not to exceed $10,000 for each day on which such violation continues with respect to such food.</text></paragraph></subsection>
<subsection id="H0D7F05B528A04B989A55106FF1A48C69"><enum>(b)</enum><header>Public database</header><text display-inline="yes-display-inline">The Secretary shall establish and maintain a public database containing the information submitted under this section that—</text> <paragraph id="HB58E7E01315544F19ACB6663C7759A02"><enum>(1)</enum><text>is available to the public through the website of the Food and Drug Administration; and</text></paragraph>
<paragraph id="H7F03EFCA44BC4428A7A30D38D58B9710"><enum>(2)</enum><text display-inline="yes-display-inline">allows members of the public to easily search and sort information.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H71B1366E203049E889F490294898781B"><enum>11.</enum><header>Standards of identity</header> <subsection id="H8B82B1536D8745F7AEF3F3C8D2EAA511"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall—</text>
<paragraph id="HBE15F484409E426D960A9EE5D60765B0"><enum>(1)</enum><text>review standards of identity prescribed by regulation which require foods to contain—</text> <subparagraph id="HC7BE5BF4CCFD4CBEA258718CF0CCC362"><enum>(A)</enum><text>minimum levels of nutrients that the Secretary determines are strongly associated with public health concerns; or</text></subparagraph>
<subparagraph id="HBC647E5FAD05403CB60E85D40F22485A"><enum>(B)</enum><text>minimum levels of ingredients containing high levels of such nutrients; and</text></subparagraph></paragraph> <paragraph id="H1EBA9A68DF484871A9EF9E79D7DDCFD4"><enum>(2)</enum><text>report to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate on the findings of such review.</text></paragraph></subsection>
<subsection id="H5B1DA8D9FC234969AA424BCD08DE08C5"><enum>(b)</enum><header>Amendments</header><text>In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall amend standards of identity regulations to—</text> <paragraph id="H70EBA214EE5D44A5AA08B59D2FE1BD57"><enum>(1)</enum><text>provide for the use of salt substitutes where appropriate; and</text></paragraph>
<paragraph id="H0D07BDACC6394B92B6EACE6E46FC60CA"><enum>(2)</enum><text>require that yogurt, lowfat yogurt, and nonfat yogurt contain a minimum level of live and active cultures per gram.</text></paragraph></subsection></section> <section id="HB9C59A6C9AA64581BEB626B6CD09518C"><enum>12.</enum><header>Study on fortification of corn masa flour</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall submit a report to Congress on the effect of the final rule titled <quote>Food Additives Permitted for Direct Addition to Food for Human Consumption; Folic Acid</quote> published by the Food and Drug Administration on April 15, 2016 (81 Fed. Reg. 22176) on folic acid intake in the United States population by race and ethnicity, comparing actual exposure with modeled exposure estimates from the final rule.</text></section>
<section commented="no" id="HD143701FCA21492FBD9E510EC1E1C2AD"><enum>13.</enum><header>Sugar alcohols and isolated fibers</header><text display-inline="no-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>), as amended by section 6, is further amended by adding at the end the following:</text> <quoted-block style="traditional" display-inline="no-display-inline" id="H6DAB28DF0F494FC49639156F8695372A"> <subsection commented="no" id="HB4A4BEC2DF6B4CFE9F43C0661E720086"><enum>(hh)</enum><header>Allulose, polydextrose, sugar alcohols, and isolated fibers</header><text display-inline="yes-display-inline">If it is a food intended for human consumption that is offered for sale and contains allulose, polydextrose, sugar alcohols, or isolated fibers, unless such fact is prominently stated on the principal display panel of the packaging of the food. The Secretary shall by regulation establish quantities above which such labeling shall include a warning that the food contains a level of allulose, polydextrose, sugar alcohols, or isolated fibers per serving determined by the Secretary to cause deleterious health effects.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section commented="no" id="HA983958B5D964E8FB69C0FD43784AEC5"><enum>14.</enum><header>Infant and toddler beverages</header><text display-inline="no-display-inline">In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall revise—</text> <paragraph commented="no" id="H624380A38D484B6C90E9C38CEC200A50"><enum>(1)</enum><text>section 101.3 of title 21, Code of Federal Regulations, to prohibit any beverage in powder or liquid form, other than infant formula, represented or purported to be for use by children more than 12 months old, from being identified as <quote>infant formula</quote> or use the term <quote>formula</quote> in combination with any other term; and</text></paragraph>
<paragraph commented="no" id="HFD36E5DA34F24F62AAAD324D0068516E"><enum>(2)</enum><text>part 102 of title 21, Code of Federal Regulations, so that—</text> <subparagraph commented="no" id="H4BC701534D7748739A5271FD236F1521"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of any powdered or liquid milk-based beverage that claims to be for consumption by children 12 to 36 months of age, such beverage shall—</text>
<clause commented="no" id="HBB31B197CBF94BEE842C8E2A688B92FE"><enum>(i)</enum><text>use as its common or usual name a descriptive term such as <quote>milk-based drink</quote>; and</text></clause> <clause commented="no" id="H16A4A47B5D07469786C7232F4FF0AEC8"><enum>(ii)</enum><text>if the beverage contains added sugars, nonnutritive sweeteners, or flavorings, include in such common or usual name a qualifying term such as <quote>sweetened</quote> or <quote>flavored</quote>; </text></clause></subparagraph>
<subparagraph commented="no" id="H976D7D710A44483EAC3499C19BB6D4CD"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of any powdered or liquid nondairy-milk-based beverage that claims to be for consumption by children 12 to 36 months of age, such beverage shall—</text> <clause commented="no" id="HC29BB3A5E51C4AFFB4B5D67B09BF0B75"><enum>(i)</enum><text display-inline="yes-display-inline">use as its common or usual name an appropriately descriptive term identifying the source of protein, such as <quote>soy-based drink powder for 12–36 month olds</quote>; and</text></clause>
<clause commented="no" id="HA1A23FDCCE91418C856F505EC49C745E"><enum>(ii)</enum><text display-inline="yes-display-inline">if the beverage contains added sugars, nonnutritive sweeteners, or flavorings, include in such common or usual name qualifying terms such as <quote>sweetened</quote> and <quote>flavored</quote> when applicable; and</text></clause></subparagraph> <subparagraph commented="no" id="H3BA9B18663274809957960B5BFAFF1F7"><enum>(C)</enum><text display-inline="yes-display-inline">the labeling of a beverage described in subparagraph (A) or (B) shall—</text>
<clause commented="no" id="H65A196B3D4CB43E593939F03C1D84E13"><enum>(i)</enum><text>contain a disclaimer that—</text> <subclause commented="no" id="HBEC7CD65231E448E868EF77B0E9356CA"><enum>(I)</enum><text>cautions against consumption of the beverage by infants, such as <quote>DO NOT SERVE TO INFANTS UNDER 12 MONTHS OLD</quote>; and</text></subclause>
<subclause commented="no" id="HE9EADD89129E4A56B1F4DFBD982CFFB5"><enum>(II)</enum><text>such beverages are not recommended for children 12 to 24 months of age and such consumption of such beverages is not required for a healthy diet, such as <quote>This product contains added sugars. The Dietary Guidelines for Americans recommend to avoid food and beverages with added sugars for children younger than 24 months of age.</quote>; and</text></subclause></clause> <clause commented="no" id="H65DA4A95A3F9496B9979B0F22C58B154"><enum>(ii)</enum><text>not contain any statement suggesting a recommended intake of such beverages, such as <quote>one cup a day</quote>.</text></clause></subparagraph></paragraph></section>
<section id="H08922DD2F6614036BBFC610D5ECE5A59"><enum>15.</enum><header>Formatting of information on principal display panels</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall—</text> <paragraph id="H5E1E15B36372422FBDFB15127C401695"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this Act, conduct a study on the legibility of food labeling to determine updated recommendations for text size and color contrast that make food labeling information visually accessible to the majority of consumers;</text></paragraph>
<paragraph id="H94ED08CB8B8D490BBB377198BF25B6B4"><enum>(2)</enum><text>not later than 1 year after the completion of the study under paragraph (1), issue proposed regulations revising section 101.2(c) of title 21, Code of Federal Regulations, to—</text> <subparagraph id="HD25C34B6C05E421A9725DF0C7AF13805"><enum>(A)</enum><text>set the scale of text size, taking into consideration the results of the study conducted under paragraph (1); and</text></subparagraph>
<subparagraph id="HFD48E727589045C089A0910147AD8164"><enum>(B)</enum><text display-inline="yes-display-inline">establish new requirements for text and background color contrast, taking into consideration the results of the study conducted under paragraph (1); and</text></subparagraph></paragraph> <paragraph id="HE0B82F1C6E374D3DBC08D582195CC106"><enum>(3)</enum><text>not later than 2 years after the completion of the study under paragraph (1), finalize such proposed regulations.</text></paragraph></section>
<section id="H4A2552CBBE71476C9138AD6E871445DB"><enum>16.</enum><header>Sale of food online</header><text display-inline="no-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>), as amended by section 13, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="H13EDD875FA8040DD88DBCADD69D925C3"> <subsection id="HDC2AE16CE53C47608820A5137AB3DD10"><enum>(ii)</enum><header>Sale of food online</header> <paragraph id="HC1C6712C9E844B9D9D0E098D0E170EC4"><enum>(1)</enum><header>In general</header><text>If it is a food offered for sale online, unless all information required to appear on the label or labeling under this section is available to consumers at the online point of selection prior to purchasing the food.</text></paragraph>
<paragraph id="HFD16546AF1134C65A029F93F26565BC7"><enum>(2)</enum><header>Form and manner</header><text>The Secretary shall by regulation specify the format and manner in which the information required under subparagraph (1) is to be made available online to consumers.</text></paragraph> <paragraph id="HBC5AED8FF41648BFB4901130B6CA56A2"><enum>(3)</enum><header>Exemption</header><text>A food shall be exempt from the requirements of this paragraph if it is a food that is offered for sale by a retailer with annual gross sales of not more than $500,000, or with annual gross sales of foods or dietary supplements to consumers of not more than $50,000, so long as such retailers do not provide nutrition information or make a nutrient content or health claim at the online point of purchase.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H61CA2EF9D6B24C95831014CB71779E39"><enum>17.</enum><header>Definitions</header>
<subsection id="H947E99F5FE874C17B17E35ABAEDC8F4A"><enum>(a)</enum><header>Definitions applicable in this Act</header><text display-inline="yes-display-inline">In this Act, the terms <term>food</term> and <term>dietary supplement</term> have the meanings given to such terms in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></subsection> <subsection id="H0AB9B875036A46F0AA6C1ED22B352CAE"><enum>(b)</enum><header>Definitions applicable in the Federal Food, Drug, and Cosmetic Act</header><text>Section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>) is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H5AA69964D505426AB3035BE2D4D34C06">
<subsection id="H31DA8CB145724CC7A720350938B1BB4E"><enum>(ss)</enum><text display-inline="yes-display-inline">The term <term>artificial</term>, with respect to food or any ingredient of food, means—</text> <paragraph id="HD391B4DBCA6749AA8C01B3C0D5840A28"><enum>(1)</enum><text display-inline="yes-display-inline">food or an ingredient that is synthetically produced whether or not it has the same chemical structure as a naturally occurring food or ingredient;</text></paragraph>
<paragraph id="H2EFA79F739004EE1907128C6E718A926"><enum>(2)</enum><text>food or an ingredient that has undergone chemical changes through the introduction of synthetic chemicals or processing aids (such as corn syrup, high-fructose corn syrup, high-maltose corn syrup, maltodextrin, chemically modified starch, and cocoa processed with alkali), excluding—</text> <subparagraph id="HAD31768F3B534C9F9A70F5A741D0E971"><enum>(A)</enum><text>food or an ingredient that has undergone traditional processes used to make food edible, to preserve food, or to make food safe for human consumption (such as smoking, roasting, freezing, drying, and fermenting processes); or</text></subparagraph>
<subparagraph id="HBB1C627E04B246BE8276FC70CEB68FD0"><enum>(B)</enum><text>food or an ingredient that has undergone traditional physical processes that do not fundamentally alter the raw product or which only separate a whole intact food into component parts (such as grinding grains, separating eggs into albumen and yolk, or pressing fruits to produce juice); or</text></subparagraph></paragraph> <paragraph id="H0D45BD15CEA34341B50CFED8BABB7F72"><enum>(3)</enum><text>any food or ingredient that the Secretary specifies by regulation to be artificial for purposes of this Act.</text></paragraph></subsection>
<subsection id="HAEC52CC73AE54297A882F82CBF5D6BE1"><enum>(tt)</enum><text>The term <term>synthetic</term>, with respect to a substance in food or any ingredient of food, means a substance that is formulated or manufactured by a chemical process or by a process that chemically changes a substance extracted from a naturally occurring plant, animal, or mineral source, except that such term does not apply to a substance created by naturally occurring biological processes.</text></subsection> <subsection id="HBB764A3D859E45EEB33AC074E2D3C6B2"><enum>(uu)</enum><text>The term <term>gluten-containing grains</term> means any one of the following grains (or any crossbred hybrid thereof):</text>
<paragraph id="H06078C53F3EE42DBB1ADC2C838CC4E92"><enum>(1)</enum><text>Wheat, including any species belonging to the genus Triticum.</text></paragraph> <paragraph id="HEECCCF5C7E0C44DD85309EDBF20B0F60"><enum>(2)</enum><text>Rye, including any species belonging to the genus Secale.</text></paragraph>
<paragraph id="HAF431C17615A4D7C89ED875A128A1C71"><enum>(3)</enum><text>Barley, including any species belonging to the genus Hordeum.</text></paragraph></subsection> <subsection id="HB3BE20CD14E34786A7374B93C501E4DB"><enum>(vv)</enum><text display-inline="yes-display-inline">The term <term>gluten</term> means the proteins that—</text>
<paragraph id="HAC3AFD725D9F459996F4CFFD2E9A8B6C"><enum>(1)</enum><text>naturally occur in a gluten-containing grain; and</text></paragraph> <paragraph id="HF44BA1ED53954BDFB8810628E0F43E1A"><enum>(2)</enum><text>may cause adverse health effects in persons with celiac disease.</text></paragraph></subsection>
<subsection id="HEAC3693DE3AE49149549D6A282FB61C9"><enum>(ww)</enum><text>The term <term>online</term> means on or by any system of data communication and transmission, such as the internet.</text></subsection> <subsection id="HE601E3DC54BB429390CF895E2F8FB8E4"><enum>(xx)</enum><text>The term <term>online point of selection</term> means any space in which consumers are allowed to purchase food online, including websites, e-commerce platforms, web applications, and mobile applications.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HF8547A398CF6431889C94764C9B3DB45"><enum>18.</enum><header>Regulations; delayed applicability</header>
<subsection id="H377C35C2658E4027A9D48C2C477170F2"><enum>(a)</enum><header>Regulations</header>
<paragraph id="HF948A94B097A481F8ADE5685A683272E"><enum>(1)</enum><header>Proposed regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall issue proposed regulations to carry out sections 2, 3, 4, 5(a), 6, 7, 9, 10, 11, 13, 14, 16, and 17(b) and the amendments made by such sections.</text></paragraph> <paragraph id="H0EE6D42277234AE6BD7145561E8AA1A7"><enum>(2)</enum><header>Final regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall finalize the regulations proposed pursuant to paragraph (1).</text></paragraph>
<paragraph display-inline="no-display-inline" id="HECB5F2B59EC34AE681B6EA37D2757AE3"><enum>(3)</enum><header>Failure to issue final regulation</header><text>If the Secretary of Health and Human Services does not issue a final regulation as required by paragraph (2) by the deadline specified in such paragraph, the corresponding proposed regulation shall become final on such deadline.</text></paragraph></subsection> <subsection id="H8508E461B8C74B7D856A61F40A9B35F4"><enum>(b)</enum><header>Delayed applicability</header><text display-inline="yes-display-inline">The amendments made by sections 2, 3, 4, 5(a), 6, 7, 9, 10, 11, 13, 14, 16, and 17(b) apply beginning on the date that is 3 years after the date of enactment of this Act.</text></subsection></section>
