<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Greater Insight into Foreign Transactions in Higher Education Act of 2021</short-title></quote> or the <quote><short-title>GIFTs in Higher Education Act</short-title></quote>.</text></section> <section id="id0F34375EE8664B0BB8BD72BB455F8744"><enum>2.</enum><header>Federal oversight of foreign funding in education</header><text display-inline="no-display-inline">Section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>) is amended—</text>
<paragraph id="id93F27CF2ADC1419FA382AAF67D51B518"><enum>(1)</enum><text>in subsection (a), by inserting <quote>, including a member of the faculty, professional staff, or other staff engaged in research and development,</quote> after <quote>Whenever any institution</quote>;</text></paragraph> <paragraph id="id621ACB4CEC7443B0A61909D26AC93FA5"><enum>(2)</enum><text>by redesignating subsections (b) through (g), and subsection (h), as subsections (c) through (h), and subsection (k), respectively;</text></paragraph>
<paragraph id="id764736B3B7FC4EB0A4A7A0068CEAB2E6"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id4ADA875328124DBAB5F7815817C1D381"> <subsection id="idFC71B899E4EB4C2191ECA784C0CF59C1"><enum>(b)</enum><header>Disclosures of gifts and contracts from designated foreign adversary sources</header> <paragraph id="id3DD652682C63469FAE956F4561E1C998"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a), whenever any institution, including a member of the faculty, professional staff, or other staff engaged in research and development, receives a gift from or enters into a contract with a designated foreign adversary source, the value of which is $50,000 or more, considered alone or in combination with all other gifts from or contracts with that designated foreign adversary source within a calendar year, the institution shall file a disclosure report with the Secretary not later than 30 days after the date of the receipt of the gift or entry into the contract.</text></paragraph>
<paragraph id="id2FBF4D2F0E9A45E8AF5D92F3B27C9E0B"><enum>(2)</enum><header>List of designated foreign adversary sources</header><text>In consultation with Congress, the Secretary of State may add countries to the list of adversarial foreign governments in subsection (k) but may not remove countries from that list.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="id61F02A587A5F4529A50B766A3FCE0475"><enum>(4)</enum><text>in subsection (d) (as redesignated), by striking <quote>subsection (b)</quote> and inserting <quote>subsection (c)</quote>;</text></paragraph>
<paragraph id="idF06E4FA1660743988241389AC2E9AAF1"><enum>(5)</enum><text>in subsection (e) (as redesignated), by striking <quote>subsection (a)</quote> each place it appears and inserting <quote>subsection (a) or (b)</quote>;</text></paragraph> <paragraph id="id33A3EDCAEEDB4DFF8D656F9E32B120A9"><enum>(6)</enum><text>in subsection (k) (as redesignated)—</text>
<subparagraph id="id03EC392BD49B4C9A8357A95A5E3CD88B"><enum>(A)</enum><text>by redesignating paragraph (1) and paragraphs (2) through (5) as paragraph 2 and paragraphs (4) through (7), respectively;</text></subparagraph> <subparagraph id="idB124D63028F74142965A811661B013C1"><enum>(B)</enum><text>by inserting before paragraph (2) (as redesignated) the following:</text>

<paragraph id="id15832B3144734488B33A93B31A6D32DE"><enum>(1)</enum><text>the term <term>adversarial foreign government</term> means—</text> <subparagraph id="id3938F496338749E0A5D3F95C6768CF74"><enum>(A)</enum><text>the People's Republic of China;</text></subparagraph>
<subparagraph id="id10FFDB501CB44F60A8CB08568AAD2C4A"><enum>(B)</enum><text>the Russian Federation;</text></subparagraph> <subparagraph id="idB074F993E222470E9353E63E86293EF0"><enum>(C)</enum><text>the Democratic People's Republic of Korea;</text></subparagraph>
<subparagraph id="id5D1B1B3BF645496DB5BCA7E410A8F529"><enum>(D)</enum><text>the Islamic Republic of Iran;</text></subparagraph> <subparagraph id="id54B3E54FFBB04C8EB9F237EB7A7A9F31"><enum>(E)</enum><text>the Republic of Cuba;</text></subparagraph>
<subparagraph id="id05465BE0F0EA4FB68110FEE08E9E08B4"><enum>(F)</enum><text>the Syrian Arab Republic;</text></subparagraph> <subparagraph id="id31C9AA8026164D53A4E9EB4E860D8FFB"><enum>(G)</enum><text>the regime of Nicolás Maduro in Venezuela; and</text></subparagraph>
<subparagraph id="id72BEDA054DD143A5A94F0B54E10F7C95"><enum>(H)</enum><text>the government of any other country designated as an adversarial foreign government for purposes of this section by the Secretary of State, in accordance with subsection (b)(2); </text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="idF2288D2ADC1048108A469A212A743628"><enum>(C)</enum><text>by inserting after paragraph (2) (as redesignated) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="idACD3547A52DF4B4F96F285C0721C8940">
<paragraph id="idF4593F7BCC5E4F548B3053DA22B43B4A"><enum>(3)</enum><text>the term <term>designated foreign adversary source</term> means—</text> <subparagraph id="idD4080087B8D14E4CA9558D1046A23B97"><enum>(A)</enum><text>an adversarial foreign government, including an agency of an adversarial foreign government;</text></subparagraph>
<subparagraph id="id6ED88192720545D38ACEDC998AD79A27"><enum>(B)</enum><text>a legal entity, governmental or otherwise, organized solely under the laws of a country described in paragraph (1);</text></subparagraph> <subparagraph id="id20E2B9DAE10D49FE8C5024EBAECD4724"><enum>(C)</enum><text>an individual who is a citizen or national of such a country; and</text></subparagraph>
<subparagraph id="idB0204114F8844159B150DBF0F4666943"><enum>(D)</enum><text>an agent, including a subsidiary or affiliate of a legal entity of an adversarial foreign government, acting on behalf of an adversarial foreign government;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="id349ED48CE99745EE859F8EC06E70A093"><enum>(7)</enum><text>by inserting after subsection (h) (as redesignated) the following:</text>

<subsection id="idB8C6A9D1015746538BF761A0EC102B0A"><enum>(i)</enum><header>Publication of foreign gift disclosures</header>
<paragraph id="idAD30B16042474222ADDFB5F43FDBBDC0"><enum>(1)</enum><header>Disclosure of gifts or contracts from foreign sources</header><text>Not later than 30 days after the deadline for submission of a disclosure report under subsection (a), the Secretary shall make the contents of the disclosure report available online.</text></paragraph> <paragraph id="id86A58D27189B4FDD82B36089C74B4FC0"><enum>(2)</enum><header>Disclosure of gifts or contracts from designated foreign adversary sources</header><text>Not later than 30 days after receipt of a disclosure report submitted under subsection (b), the Secretary shall make the contents of the disclosure report available online.</text></paragraph></subsection>
<subsection id="idB5F3B92B37334361961ACDC9C3DA77C2"><enum>(j)</enum><header>Agency coordination</header><text>The Secretary shall coordinate with other Federal agencies, as appropriate, to ensure that other Federal agencies have access to disclosure reports submitted under this section and any information or documentation relating to disclosure reports submitted under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="id4B203D60BD8F41A482F27C7266057595"><enum>3.</enum><header>Ensuring compliance with reporting requirements</header> <subsection id="id06B2621F6C874E5AAA32044263C55AD7"><enum>(a)</enum><header>In general</header><text>Each Federal agency shall ensure that no Federal funds under the jurisdiction of that agency are distributed to an institution that is knowingly or willfully in violation of section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>), as determined by the head of the relevant agency.</text></subsection>
<subsection id="id5C799D4CEEBD41389B9EFC3FD37F431F"><enum>(b)</enum><header>Department of Education</header><text display-inline="yes-display-inline">An institution that is knowingly or willfully in violation of section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>), as determined by the Secretary of Education, shall not be eligible to receive Federal funds distributed by the Department of Education, except funds provided under title IV of the Higher Education Act of 1965.</text></subsection> <subsection id="id626569FD47B145A7B709303B6C127CA5"><enum>(c)</enum><header>Definition of institution</header><text>In this section, the term <term>institution</term> has the meaning given that term in section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>).</text></subsection></section>
<section id="id1F9D94732A144549B9EFCD61DBAEB557"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act take effect on June 30 of the year following the year of enactment of this Act.</text></section> </legis-body> </bill>
