which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To help small businesses access capital and create jobs by reauthorizing the successful State Small Business Credit Initiative.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Access to Capital Act of 2021</short-title></quote>.</text></section><section id="id1134B44CA9854DAC9F88097CA824104F"><enum>2.</enum><header>New Tranches of capital for successful State programs</header><text display-inline="no-display-inline">Section 3003 of the Small Business Jobs Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5702">12 U.S.C. 5702</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD721EAD60E5E46B7A39783CF4BA5C4F3"><subsection id="id6C87CA9898334321B0278B4C7CF546DD"><enum>(d)</enum><header>Additional allocation and competitive awards</header><paragraph id="idBBF1156DCC424C2886439134ED3C6CD9"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="id6B8F6300A5D347AAAB47933F900B1458"><enum>(A)</enum><text>the term <term>eligible participating State</term> means a participating State that has certified to the Secretary that the State has expended, transferred, or obligated not less than 80 percent of the second <fraction>1/3</fraction> of the 2010 allocation transferred to the State under subsection (c)(1)(A)(iii); and</text></subparagraph><subparagraph id="id4871EBB5C2E3463CBF34EF15EE3A1346"><enum>(B)</enum><text>the term <term>unused funds</term> means—</text><clause id="idD691DB854DE94F30B26293C8269400EC"><enum>(i)</enum><text>amounts made available to the Secretary under clause (i)(II) or (ii)(II) of paragraph (2)(E); and</text></clause><clause id="idD5BB1026916341E3A8A99B7F73620529"><enum>(ii)</enum><text>amounts made available to the Secretary under paragraph (4)(B)(ii).</text></clause></subparagraph></paragraph><paragraph id="id1F42ABD516F1448897F54A31410CE3CA"><enum>(2)</enum><header>Allocation for 2010 participating States</header><subparagraph id="idB24569E4E1714B079FE6264EBB1FA4A8"><enum>(A)</enum><header>Allocation</header><text>Of the amount made available under paragraph (6)(D), the Secretary shall allocate a total of $5,000,000,000 among eligible participating States in the same ratio as funds were allocated under the 2010 allocation under subsection (b)(1) among participating States.</text></subparagraph><subparagraph id="idFB5E3B435A9F4DE0A1725EC51695C1EC"><enum>(B)</enum><header>Application</header><text>An eligible participating State desiring to receive funds allocated under this paragraph shall submit an application—</text><clause id="idDD54F186B51B4B82819E22798260F9B1"><enum>(i)</enum><text>not later than the date that is 6 months after the date of enactment of the <short-title>Small Business Access to Capital Act of 2021</short-title>; and</text></clause><clause id="id2ACC8176342047C083411436EB8391AB"><enum>(ii)</enum><text>in such manner and containing such information as the Secretary may require.</text></clause></subparagraph><subparagraph id="id1449D716E40148C48CDE329921E806A1"><enum>(C)</enum><header>Availability of allocated amount</header><clause id="id2CE3DA2F0075414B9973959ADD4246F2"><enum>(i)</enum><header>In general</header><text>Notwithstanding subsection (c)(1), after an eligible participating State approved by the Secretary to receive an allocation under this paragraph has certified to the Secretary that the eligible participating State has expended, transferred, or obligated not less than 80 percent of the last <fraction>1/3</fraction> of the 2010 allocation to the eligible participating State, the Secretary shall transfer to the eligible participating State the funds allocated to the eligible participating State under this paragraph.</text></clause><clause id="idFC7AE4D6428E4D9BA85A33B56811835D"><enum>(ii)</enum><header>Effect on agreements</header><text>The allocation or transfer of funds under this paragraph to an eligible participating State shall not be construed to—</text><subclause id="idFECBABF2E1F34646A84AB12C77AAE639"><enum>(I)</enum><text>amend or modify the terms of the allocation agreement entered into by the eligible participating State relating to the 2010 allocation; or</text></subclause><subclause id="id0356E46708AA448F95D6505A5648D68B"><enum>(II)</enum><text>modify or extend the allocation time period, as defined under such allocation agreement.</text></subclause></clause></subparagraph><subparagraph id="idC8707FCE18CE41189B2BD034976F150E"><enum>(D)</enum><header>Use of transferred funds</header><text>An eligible participating State may use funds transferred under this paragraph for any purpose authorized under subparagraph (A) or (B) of subsection (c)(3).</text></subparagraph><subparagraph id="id35A48F14A45E4FDC9575505E0F4B7B9B"><enum>(E)</enum><header>Termination of availability of amounts</header><clause id="idB11619886B564C5F9E4EF6628D72E19E"><enum>(i)</enum><header>In general</header><text>If an eligible participating State has not certified to the Secretary that the State has expended, transferred, or obligated not less than 80 percent of the last <fraction>1/3</fraction> of the 2010 allocation as of the date that is 2 years after the date on which the Secretary approves the eligible participating State to receive an allocation under this paragraph, any amounts allocated to the eligible participating State under this paragraph—</text><subclause id="idF6D98AD21DB04B22966FBF88899E42ED"><enum>(I)</enum><text>may not be transferred to the eligible participating State under this paragraph; and</text></subclause><subclause id="id54F07CDCA8B2469A93A6CAC1621205E1"><enum>(II)</enum><text>shall be available to the Secretary to make awards under paragraph (4).</text></subclause></clause><clause id="id02FF8D5F84A64DC68F0CC3AC6F374CFD"><enum>(ii)</enum><header>Other amounts</header><text>Effective on the date that is 2 years after the date of enactment of the <short-title>Small Business Access to Capital Act of 2021</short-title>, any amounts allocated under this paragraph to a participating State that, as of such date, is not an eligible participating State or to an eligible participating State that did not submit an application under subparagraph (B) or was not approved by the Secretary to receive an allocation under this paragraph—</text><subclause id="id64E883741C154E12B78E0873AFB81C2D"><enum>(I)</enum><text>may not be transferred to an eligible participating State under this paragraph; and</text></subclause><subclause id="idFF1F82D9295E4E589778206FB91909EC"><enum>(II)</enum><text>shall be available to the Secretary to make awards under paragraph (4).</text></subclause></clause></subparagraph></paragraph><paragraph id="id114CC3A8DD9847B08B92050281ED4C7B"><enum>(3)</enum><header>Competitive funding</header><subparagraph id="id1B7DB772FF71498287E6E3177C8998CC"><enum>(A)</enum><header>In general</header><text>Of the amount made available under paragraph (6)(D), the Secretary may award, on a competitive basis, not more than a total of $5,000,000,000 to participating States and consortiums of participating States for use for any purpose authorized under subparagraph (A) or (B) of subsection (c)(3).</text></subparagraph><subparagraph id="id17F2D1094F0A4BBF9C62CFA963AA5AB0"><enum>(B)</enum><header>Application</header><clause id="idFFB87033C5884E21A4B30D005D633C3E"><enum>(i)</enum><header>In general</header><text>A participating State or consortium of participating States desiring to receive an award under this paragraph shall submit an application—</text><subclause id="id99A8F8BF6F92472B92C46B17537C81CF"><enum>(I)</enum><text>not later than the date established by the Secretary, which shall be not later than the date that is 1 year after the date of enactment of the <short-title>Small Business Access to Capital Act of 2021</short-title>; and</text></subclause><subclause id="id8080635CC12D4DFC980D29500B0D6C4C"><enum>(II)</enum><text>in such manner and containing such information as the Secretary may require.</text></subclause></clause><clause id="idFA6CD7EF93D04F55AA342646593778FA"><enum>(ii)</enum><header>Number of applications</header><text>A participating State may submit not more than 1 application on behalf of the participating State and not more than 1 application as part of a consortium of participating States.</text></clause><clause id="id37131EF8E36348B49ADC95CB93BFFB1A"><enum>(iii)</enum><header>States that did not participate</header><text>A State that is not a participating State may apply to the Secretary for approval to be a participating State for purposes of this paragraph and paragraph (4), in accordance with section 3004.</text></clause></subparagraph><subparagraph id="id2F842DBE19D449A5983A8E2BF6477C48"><enum>(C)</enum><header>Factors</header><text>In determining whether to make an award to a participating State or consortium of participating States under this paragraph, the Secretary shall consider—</text><clause id="id27F78BFABCCF415DA8889B42D7B64E41"><enum>(i)</enum><text>how the participating State or consortium of participating States plan to use amounts provided under the award under the approved State program to—</text><subclause id="id4993c6ccf24640558a8790a477ba48b3"><enum>(I)</enum><text>leverage private sector capital;</text></subclause><subclause id="id487b5dabea174be1a41d08e5efec7eb1"><enum>(II)</enum><text>create and retain jobs during the 2-year period beginning on the date of the award;</text></subclause><subclause id="iddeafb449707d46a199e8702acef0a297"><enum>(III)</enum><text>serve businesses that have been incorporated or in operation for not more than 5 years; and</text></subclause><subclause id="idd8592b27cda44617a9418adf4e862cb3"><enum>(IV)</enum><text>serve low- or moderate-income communities;</text></subclause></clause><clause id="idC7C4B056843B498DA74A27976279F610"><enum>(ii)</enum><text>the extent to which the participating State or consortium of participating States will establish or continue a robust self-evaluation of the activities of the participating State or consortium of participating States using amounts made available under this title;</text></clause><clause id="idbd1a4f43e26a444081ee03db98050343"><enum>(iii)</enum><text>the extent to which the participating State or consortium of participating States will provide non-Federal funds in excess of the amount required under subparagraph (E); and</text></clause><clause id="id49cbf898b8c94aee87f78b03124e083e"><enum>(iv)</enum><text>the extent to which the participating State expended, obligated, or transferred the 2010 allocation to the State.</text></clause></subparagraph><subparagraph id="idE7981C6C9ADD49F7A6B9B12253C6E57A"><enum>(D)</enum><header>Award of funds</header><clause id="idC1BF5B06D9664C6483CE8E033816B2FA"><enum>(i)</enum><header>First tranche</header><text>Notwithstanding subsection (c)(1), and not later than 30 days after making an award under this paragraph to a participating State or consortium of participating States, the Secretary shall transfer 50 percent of the amount of the award to the participating State or consortium of participating States.</text></clause><clause id="id958C7C3BED4C4AA0930BA37378CBE13A"><enum>(ii)</enum><header>Second tranche</header><text>After a participating State or consortium of participating States has certified to the Secretary that the participating State or consortium of participating States has expended, transferred, or obligated not less than 80 percent of the amount transferred under clause (i), the Secretary shall transfer to the participating State or consortium of participating States the remaining amount of the award.</text></clause></subparagraph><subparagraph id="id1D1E082B74C74788B1261C9735838D5B"><enum>(E)</enum><header>State share</header><text>The State share of the cost of the activities, excluding administrative expenses, carried out using an award under this paragraph shall be not less than 10 percent. The Secretary may determine what contributions by a State qualify as part of the State share of the cost for purposes of this subparagraph.</text></subparagraph></paragraph><paragraph id="id8F0DCFFCCF3342F281171C4847D32B42"><enum>(4)</enum><header>Award of unused funds</header><subparagraph id="idE17E9B57FDAC47DC99482F7E4DB4D0E3"><enum>(A)</enum><header>In general</header><text>The Secretary may award, on a competitive basis, unused funds to participating States for use for any purpose authorized under subparagraph (A) or (B) of subsection (c)(3).</text></subparagraph><subparagraph id="id3AEE185DDC0E4B8292DCC09AE4BDDD79"><enum>(B)</enum><header>Unused 2010 funds</header><clause id="id0590D966666944F79CDCBBCACAD6B344"><enum>(i)</enum><header>In general</header><text>The Secretary shall determine whether any amounts allocated to a participating State under subsection (b) shall be deemed no longer allocated and no longer available if a participating State has not certified to the Secretary that the State has expended, transferred, or obligated 80 percent of the second <fraction>1/3</fraction> of the 2010 allocation by December 31, 2022.</text></clause><clause id="idFFF9D1F87B22469DBB79420D2FB15AD9"><enum>(ii)</enum><header>Availability</header><text>Effective on the date of the determination under clause (i), any amounts identified in the determination that were deemed no longer allocated and no longer available to the participating State shall be available to the Secretary to make awards under this paragraph.</text></clause></subparagraph><subparagraph id="id8D6B1AEF742F461DB1C53B58E423EE60"><enum>(C)</enum><header>Application</header><text>A participating State desiring to receive an award under this paragraph shall submit an application—</text><clause id="idF3AA3D19932049B09A40C6AFEDDDA8B6"><enum>(i)</enum><text>not later than 3 months after the date on which funds are deemed no longer allocated and no longer available to any participating State; and</text></clause><clause id="id754824023C5340BC995B18EB18FFFA2C"><enum>(ii)</enum><text>in such manner and containing such information as the Secretary may require.</text></clause></subparagraph><subparagraph id="idB4E95F9BA73847598155C08D14B351E9"><enum>(D)</enum><header>Factors</header><text>In determining whether to make an award to a participating State under this paragraph, the Secretary shall consider the factors described in paragraph (3)(C).</text></subparagraph><subparagraph id="idB69579E628C0489AB6BADA4201984D1F"><enum>(E)</enum><header>Minimum amount</header><text>The Secretary may not make an award of less than $5,000,000 under this paragraph.</text></subparagraph></paragraph><paragraph id="idd421cfc3785847f3855e7f3bfcb1cff1"><enum>(5)</enum><header>Compliance and reporting requirements</header><text>During the period beginning on the date on which a participating State first receives funds under paragraph (2), (3), or (4) and ending on the date that is 8 years after the date of enactment of the <short-title>Small Business Access to Capital Act of 2021</short-title>, the participating State shall submit quarterly and annual reports containing the information described in, and in accordance with the deadlines established under, section 3007.</text></paragraph><paragraph id="id09E2250D70A144798BF485DB3C49F54A"><enum>(6)</enum><header>Administration and implementation</header><subparagraph id="idD346EF79D7AE4A85AB559CD97054DE2C"><enum>(A)</enum><header>Administrative expenses for participating States</header><text>A participating State may use not more than 3 percent of the amount made available to the participating State under paragraph (2), (3), or (4) for administrative expenses incurred by the participating State in implementing an approved State program.</text></subparagraph><subparagraph id="idCE590DA15C374E4CB0F459958D57796E"><enum>(B)</enum><header>Contracting</header><text>During the 1-year period beginning on the date of enactment of the <short-title>Small Business Access to Capital Act of 2021</short-title>, and notwithstanding any other provision of law relating to public contracting, the Secretary may enter into contracts to carry out this subsection.</text></subparagraph><subparagraph id="idFA2FB3225B8F4D8F99856D9907F9277C"><enum>(C)</enum><header>Amounts not assistance</header><text>Any amounts transferred to a participating State under paragraph (2), (3), or (4) shall not be considered assistance for purposes of subtitle V of title 31, United States Code.</text></subparagraph><subparagraph id="idCBF0A79642CD42D68C0B3F24B9FD78EF"><enum>(D)</enum><header>Appropriation</header><text>There are appropriated to the Secretary, out of any funds in the Treasury not otherwise appropriated, $10,000,000,000 to carry out this subsection, including to pay reasonable costs of administering the programs under this subsection, to remain available until expended.</text></subparagraph><subparagraph id="id828f4e47dedc4f759e5d0f4fc321d655"><enum>(E)</enum><header>Termination of secretary’s program administration functions</header><text>Notwithstanding section 3009(c), the authorities and duties of the Secretary to implement and administer the program under this subsection shall terminate at the end of the 8-year period beginning on the date of enactment of the <short-title>Small Business Access to Capital Act of 2021</short-title>.</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></section></legis-body></bill>
