which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Governor's Emergency STEM Promotion Fund, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idED83DB245FBB4A658DB8281D034BBC54"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Support for STEM Act</short-title></quote>.</text></section><section id="idee2748a19e5b47c48199af1444377ad6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id4fc81433e8384ad68794c44f45de93e3"><enum>(1)</enum><text>The COVID–19 pandemic has caused tremendous repercussions within the kindergarten through grade 12 education system of the United States.</text></paragraph><paragraph id="iddd3750beb4b642698c8a4f503285f113"><enum>(2)</enum><text>It is imperative to support hands-on learning opportunities in science, technology, engineering, and mathematics (referred to in this section as <quote>STEM</quote>) education through programs that—</text><subparagraph id="id0132C01675E142F285738F9FB952D562"><enum>(A)</enum><text>provide innovative experiences for students;</text></subparagraph><subparagraph id="id1AB4499E36AB493FAB955B735A04D0FC"><enum>(B)</enum><text>have strong track records of success; and </text></subparagraph><subparagraph id="idDE5961EE58204869986D317A99789615"><enum>(C)</enum><text>typically include nonprofit partnerships among the schools, nonprofit organizations, and private businesses.</text></subparagraph></paragraph><paragraph id="idb9aac0fc27234e819d8fa9bcea2740f7"><enum>(3)</enum><text>Due to the severe economic damage caused by the COVID–19 pandemic to organizations offering STEM programs, these programs now face significant funding challenges.</text></paragraph><paragraph id="id02f2369199404d628b1ff03909a69888"><enum>(4)</enum><text>The long-term effects of the COVID–19 pandemic will be felt for years to come without public economic educational support to help these types of STEM opportunities.</text></paragraph><paragraph id="id4515de9a151b428180fd318b6053595a"><enum>(5)</enum><text>Lack of investment in these critical programs will lead to limited innovative learning opportunities in the STEM fields, causing a drastic loss of technical and professional skills training for this generation of students. </text></paragraph></section><section section-type="subsequent-section" id="id081B8A571C6440CA9628ADF795829AF4"><enum>3.</enum><header>Governor's Emergency STEM Promotion Fund</header><subsection id="idCD2B0C47ED8F409AA8F37EBE39D352ED"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id47B7559D756D447AA6B24E54E16AECE1"><enum>(1)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term>, <term>high school</term>, <term>secondary school</term>, and <term>State</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph id="idC66FBF7C204D4862806B526A822E6E07"><enum>(2)</enum><header>Eligible nonprofit program</header><text>The term <term>eligible nonprofit program</term>—</text><subparagraph id="id27A96FF664464247837FF2079EC44526"><enum>(A)</enum><text>means a nonprofit program serving prekindergarten, elementary school, or secondary school students; and</text></subparagraph><subparagraph id="id2D438CB164A34E1A8AD1CE5A7C7926AA"><enum>(B)</enum><text>includes a program described in subparagraph (A) that covers the continuum of education from prekindergarten through high school and is available in every State.</text></subparagraph></paragraph><paragraph id="idD9C3A6D890C24C3193747FB86B05D2BE"><enum>(3)</enum><header>Eligible public school</header><text>The term <term>eligible public school</term> means a public elementary school or secondary school. </text></paragraph><paragraph id="idF0E71A1D4C0B47A8AB213A52AD00C382"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph><paragraph id="id2CD2C63865BB4B519F6E1FA27DF5FE58"><enum>(5)</enum><header>STEM</header><text>The term <term>STEM</term> means science, technology, engineering, and mathematics.</text></paragraph></subsection><subsection id="id5DE39C5190D246A6B73BF4BC94DA92F1"><enum>(b)</enum><header>Grants authorized</header><paragraph id="idA64E48521DEC41D897B938C7363F5F15"><enum>(1)</enum><header>In general</header><text>From amounts made available under subsection (e), the Secretary shall make Emergency STEM Promotion grants to the Governor of each State with an approved application. </text></paragraph><paragraph id="id4C81D881B39B48529DFB69B0161B9E3B"><enum>(2)</enum><header>Timing</header><text>The Secretary shall issue a notice inviting applications not later than 30 days after the date of enactment of this Act and shall award grants by not later than 30 days after the issuance of the notice. </text></paragraph><paragraph id="idC1174F45F2B44FA2B855C05674D6C284"><enum>(3)</enum><header>Amount</header><text>Each State with an approved application shall receive a grant under paragraph (1) in an amount that bears the same relation to the amounts made available under subsection (e) as the number of children aged 5 through 17 in the State bears to the number of such children in all States with approved applications. </text></paragraph></subsection><subsection id="id7D578ACFC3114E2A852B79312ADCC77D"><enum>(c)</enum><header>Use of funds</header><paragraph id="idB0AB81FB332B4E99B1BD5B6400885DEB"><enum>(1)</enum><header>In general</header><text>A State receiving a grant under subsection (b)—</text><subparagraph id="id034B65F91ABF44EB92CD85D5B311E65A"><enum>(A)</enum><text>shall use not less than 90 percent of such grant funds to provide subgrants to eligible public schools or eligible nonprofit programs to support hands-on learning opportunities in STEM education, including via remote learning, after-school activities, and innovative learning opportunities such as robotics competitions; and</text></subparagraph><subparagraph id="id8CAEBE60B2D849F987239EA44DD4A5AA"><enum>(B)</enum><text>may reserve—</text><clause id="idAAA181844C0947ADA23F114B04060D4B"><enum>(i)</enum><text>not more than one-half of 1 percent for administrative costs; and</text></clause><clause id="id6B86294F2A154D05960CED7E4D4E23BF"><enum>(ii)</enum><text>the remainder of any funds not used in accordance with clause (i) or subparagraph (A) for emergency needs, as determined by the State educational agency.</text></clause></subparagraph></paragraph><paragraph id="idBF468735ACDA4C4F918BBBE936449043"><enum>(2)</enum><header>Award basis</header><text>In awarding subgrants under this subsection, a State shall ensure that the majority of subgrant funds provided by the State are to—</text><subparagraph id="idA3BC937449F04F2B9D52D48464C643F3"><enum>(A)</enum><text>eligible public schools that—</text><clause id="idce972469368a4d40a734f2b3bbc4cf6e"><enum>(i)</enum><text>are implementing comprehensive support and improvement activities and targeted support and improvement activities under section 1111(d) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(d)</external-xref>); or </text></clause><clause id="id4559B8D2223E43C8BD9DDC01577BB167"><enum>(ii)</enum><text>serve high percentages of students who are eligible for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) (which, in the case of a high school, may be calculated using comparable data from the schools that feed into the high school); or</text></clause></subparagraph><subparagraph id="idC5684A3B40B54DFD952925702BF1DCF3"><enum>(B)</enum><text> eligible nonprofit programs serving students that attend eligible public schools described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id18B2C719FC0040A8844ED2AC67B6B80D"><enum>(3)</enum><header>Matching funds required</header><subparagraph id="idB6CBF73467954BB4A3E59CD6C1CC5AD0"><enum>(A)</enum><header>In general</header><text>Each eligible public school or eligible nonprofit program receiving a subgrant under this subsection shall provide, toward the cost of the activities assisted under the subgrant, an amount equal to 100 percent of the amount of the subgrant funds. </text></subparagraph><subparagraph id="id946E688A4CE6450EA3604F4A179A580F"><enum>(B)</enum><header>Payment by local educational agency</header><text>The matching funds required under subparagraph (A) for an eligible public school may be provided by the eligible public school or by the local educational agency that serves such school.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id053f34aed5994b809dc529d7c2df0b59"><enum>(d)</enum><header>Reallocation</header><text>A State shall return to the Secretary any funds received under this section that the State does not award within 2 years of receiving such funds and the Secretary shall reallocate such funds to the remaining States in accordance with subsection (b). </text></subsection><subsection commented="no" id="idCC5BD01C59A4497DAC449452449C2E24"><enum>(e)</enum><header>Authorization and appropriations</header><paragraph commented="no" id="id99E9F911312949B2A8002150379D2C4A"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to carry out this section, and there are appropriated, out of any amounts in the Treasury not otherwise appropriated, $200,000,000 for fiscal year 2021. </text></paragraph><paragraph commented="no" id="idB487F5A135C547C881A74851F3017ADF"><enum>(2)</enum><header>Availability</header><text>Amounts made available under this subsection shall remain available until expended.</text></paragraph><paragraph commented="no" id="id200BC08E286E4E7FA50B83A48C546A9D"><enum>(3)</enum><header>Emergency designation</header><subparagraph id="id12423ab322924f588bbbed3aaec748c7"><enum>(A)</enum><header>In general</header><text>The amounts provided by this section are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subparagraph><subparagraph id="id0e4b57ad708a40dc85f1bc6dc05d2dc5"><enum>(B)</enum><header>Designation in Senate</header><text>In the Senate, this section is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
