which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Migratory Bird Treaty Act to clarify the treatment of authentic Alaska Native articles of handicraft containing nonedible migratory bird parts, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idC5FDD1EF146441579F295A1AA9FBF094"><enum>1.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to clarify the treatment of authentic Alaska Native articles of handicraft under—</text><paragraph id="id747CC4741181498D829FB79944A1A50B"><enum>(1)</enum><text>the Convention between the United States and Great Britain for the Protection of Migratory Birds, signed at Washington August 16, 1916 (USTS 628) (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>);</text></paragraph><paragraph id="idD174AE9ADE9349A99C41C8F3F89CC9F8"><enum>(2)</enum><text>the Convention between the United States and Mexico for the Protection of Migratory Birds and Game Mammals, signed at Mexico City February 7, 1936 (USTS 912) (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>);</text></paragraph><paragraph id="id6558DFE4F5CD4D5D9B708848D627BBDF"><enum>(3)</enum><text>the Convention between the United States and Japan for the Protection of Migratory Birds and Birds in Danger of Extinction and Their Environment, signed at Tokyo March 4, 1974 (TIAS 7990) (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>); and</text></paragraph><paragraph id="id8007BA69991D41A188D27F51AFADB40E"><enum>(4)</enum><text>the Convention between the United States and the Soviet Union Concerning the Conservation of Migratory Birds and Their Environment, signed at Moscow November 19, 1976 (TIAS 9073) (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>).</text></paragraph></section><section section-type="subsequent-section" id="id1B55FBCF34DA41E4BC227F3008ACB45E"><enum>2.</enum><header>Clarification for Alaska Native articles containing migratory bird parts</header><subsection id="idB784516F1FEB4EF6B968A9C3AF35593D"><enum>(a)</enum><header>In general</header><text>Section 2 of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD0FE8A2AE5D7464192F14F4C01A2502E"><subsection id="id753c8ba990ed4056a94c3fc8ef59e982"><enum>(c)</enum><header>Clarification for authentic Alaska Native articles of handicraft</header><paragraph id="id899cc1495eb5440c897290c928928d9d"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id059C820EF48D4CDE9B1EA8AC25164733"><enum>(A)</enum><header>Alaska Native</header><text>The term <term>Alaska Native</term> means a member of any Indian Tribe (as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) that is based in the State of Alaska.</text></subparagraph><subparagraph id="idB818C90515D44369BC78B9C6C87CAF61"><enum>(B)</enum><header>Authentic Alaska Native article of handicraft</header><clause id="id347E028CDE01403B89C6663FB3C139C7"><enum>(i)</enum><header>In general</header><text>The term <term>authentic Alaska Native article of handicraft</term> means any item that is—</text><subclause id="id08A3BDBB96ED41448F71AF077B8F1065"><enum>(I)</enum><text>composed, wholly or in a significant respect, of natural materials; and</text></subclause><subclause id="id87FF7E9261C74B55B66370A26EEB002E"><enum>(II)</enum><text>produced, decorated, or fashioned by hand in significant part—</text><item id="id5840E58ABF6A49F5B38F9123883A9C29"><enum>(aa)</enum><text>by an Alaska Native;</text></item><item id="id8C576EEE26F34A0487CF494336E5274B"><enum>(bb)</enum><text>in the exercise of traditional Alaska Native handicrafts; and</text></item><item id="id3AAC95F823204D4C800E72953C2A256E"><enum>(cc)</enum><text>without the use of any mass copying device.</text></item></subclause></clause><clause id="id578ED9499FAA427CA4A4D8BD0EA7F452"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>authentic Alaska Native article of handicraft</term> includes—</text><subclause id="idCF6261FCF2054992AFD5030AED7BEEFE"><enum>(I)</enum><text>any weaving, carving, stitching, sewing, lacing, beading, drawing, or painting that meets the criteria described in clause (i); and</text></subclause><subclause id="id26EE093792194E6DBA8808E739CA6D37"><enum>(II)</enum><text>any item, including clothing, described in subclause (I) that combines the techniques described in that subclause.</text></subclause></clause></subparagraph></paragraph><paragraph id="id46DC6C466EFC4EC99A30DF27B8D235D6"><enum>(2)</enum><header>Clarification for certain authentic Alaska Native articles of handicraft</header><text>Subject to paragraph (3) and notwithstanding any other provision of this Act, nothing in this Act prohibits the possession, offering for sale, sale, offering to barter, barter, offering to purchase, purchase, delivery for shipment, shipment, causing to be shipped or delivered for transportation, transport, causing to be transported, carrying, causing to be carried, or receiving for shipment, transportation, or carriage of any authentic Alaska Native article of handicraft on the basis that the authentic Alaska Native article of handicraft contains a nonedible migratory bird part.</text></paragraph><paragraph id="id3869BAC6D84B45F4AE5E96C586636B40"><enum>(3)</enum><header>Limitation</header><text>This subsection does not apply to an authentic Alaska Native article of handicraft containing a part of a migratory bird that was taken in a wasteful manner.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id243E0536C0FB4061B6C142F7FE73A5D3"><enum>(b)</enum><header>Technical amendment</header><text>Section 2(a) of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref>) is amended by inserting a comma after <quote>March 4, 1972</quote>.</text></subsection></section></legis-body></bill>
