which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title VI of the Civil Rights Act of 1964 to protect students from racial hostility, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Students From Racial Hostility Act</short-title></quote>.</text></section><section id="id676E0FF4B8984AABA248505E2DD3CA67"><enum>2.</enum><header>Discrimination</header><text display-inline="no-display-inline">Section 601 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref>) is amended—</text><paragraph id="idA65948461CEB4B44AEA561C5DFE76AE9"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCF68ADF58CDF4EF8A0540B7AF705ABE3"><subsection id="id50E519D9F9F046A9A0FABD277F2324CE"><enum>(a)</enum><text>No</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id0BBAC5D0FFBE4AB0BF169A5139988326"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBB6FF68C9A614B09A24A3BA26F1180A1"><subsection id="id986EFDBA4E194451AFFAEBF271BF9C9A"><enum>(b)</enum><text>For purposes of subsection (a), use of a curriculum, or teaching or counseling, that promotes a divisive concept under a program or activity described in subsection (a) relating to elementary, secondary, or postsecondary education and that results in a racially hostile environment in an educational setting shall be considered to be discrimination under that program or activity. </text></subsection><subsection id="idFE220D547FC741B49B074085A9EF24C6"><enum>(c)</enum><text>Any intimidation, threat, coercion, or discrimination against any individual for the purpose of interfering with any right or privilege secured by this section, or because the individual has made a complaint, testified, assisted, or participated in any manner in an investigation, proceeding or hearing under this section, shall be considered to be discrimination under the program or activity involved. </text></subsection><subsection id="idD459F4AC62364A3598FB6051A95A7869"><enum>(d)</enum><text>In this section:</text><paragraph id="id0D7B09316CA946AE8212DE0F24BCF3C6"><enum>(1)</enum><text>The term <term>promotion</term>, used with respect to a divisive concept, means race stereotyping or race scapegoating, or promotion of one or more of the following concepts:</text><subparagraph id="id8e86821e27a94752b89746b0aa4cb17a"><enum>(A)</enum><text>One race is inherently superior to another race.</text></subparagraph><subparagraph id="id7011e40e2d9f4d5bbef0b4c5e1577155"><enum>(B)</enum><text>The United States is fundamentally racist.</text></subparagraph><subparagraph id="id0fab2175a60b4eab8e7ae82ab221c8ea"><enum>(C)</enum><text>An individual, by virtue of the individual's race, is inherently racist or oppressive, whether consciously or unconsciously.</text></subparagraph><subparagraph id="id978c57192c7443cca074112093ac8aeb"><enum>(D)</enum><text>An individual should be discriminated against or receive adverse treatment solely or partly because of the individual's race.</text></subparagraph><subparagraph id="id3f6585ff4665480c8be52f8cd6422fec"><enum>(E)</enum><text>Members of one race cannot and should not attempt to treat others without respect to race.</text></subparagraph><subparagraph id="id1c0efbb8faa64d4a821759d0567b0587"><enum>(F)</enum><text>An individual’s moral character is necessarily determined by the individual's race.</text></subparagraph><subparagraph id="idc06aba0c63c14ba3b3db32919c84dc8e"><enum>(G)</enum><text>An individual, by virtue of the individual's race, bears responsibility for actions committed in the past by other members of the same race.</text></subparagraph><subparagraph id="ide2499e5f666e4739bb80d3f473561f0e"><enum>(H)</enum><text>Any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of the individual's race.</text></subparagraph><subparagraph id="id30ccac1b6f6842928c08c962ceaa22bf"><enum>(I)</enum><text>Meritocracy or traits such as a hard work ethic are racist, or were created by a particular race to oppress another race.</text></subparagraph></paragraph><paragraph id="id254AB4A9CDA048819D2C11E855BBA59D"><enum>(2)</enum><text>The term <term>race scapegoating</term> means assigning fault, blame, or bias to a race, or to members of a race because of their race.</text></paragraph><paragraph id="id8B07A0B254134538A6028263D7A70D7D"><enum>(3)</enum><text> The term <term>race stereotyping</term> means ascribing character traits, values, moral and ethical codes, privileges, status, or beliefs to a race, or to an individual because of the individual's race.</text></paragraph><paragraph id="idC31AA0C8CA4A4B9BBC20BCCDA85B71D3"><enum>(4)</enum><text>The term <term>racially hostile environment</term> means—</text><subparagraph id="idE88A9A1FAF2E4F139FFEEBB4E6D2468B"><enum>(A)</enum><text>a situation of racial discrimination that has occurred and created an adverse setting;</text></subparagraph><subparagraph id="idE2DDAC8EA75E44AC8B8DD61745E8E608"><enum>(B)</enum><text>a racially intimidating or racially offensive environment that causes a person to be fearful; or</text></subparagraph><subparagraph id="id0729B06E3137452EAE97B86771836755"><enum>(C)</enum><text>a setting that denies, limits, or interferes with, on the basis of race, a person's ability to participate in or benefit from a program or activity.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idA44813E9541640C9AE0A38D46AA371D3"><enum>3.</enum><header>Reports</header><text display-inline="no-display-inline">Section 602 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-1">42 U.S.C. 2000d–1</external-xref>) is amended—</text><paragraph id="idC0049A814F534BC1A65A68C941BCE5AA"><enum>(1)</enum><text>by striking <quote>Each</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA3914D5D9D0F42C3BD96EFBBCB433B3C"><subsection id="idDC0C64304C994284A75869C91D5354E1"><enum>(a)</enum><text>Each</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id83BE936A969540B09491291A92423D36"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id915DB2372F4D4CA390035636C27530DB"><subsection id="id17087ABB9CDC4D14A4209E4758A788F4"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id2206CB2B437449BDA4A78DED8CF72DCA"><enum>(1)</enum><text>Any State educational agency that is the subject of a complaint under this title, or that receives information about a complaint from an entity under paragraph (2)(A), shall report the complaint involved to the Attorney General of the State. Any State higher education agency that is the subject of a complaint under this title, or that receives information about a complaint from an entity under paragraph (2)(B), shall report the complaint involved to the Attorney General of the State. </text></paragraph><paragraph indent="up1" id="id1B83B5797FB9462BAA3EB7F1DE197ABC"><enum>(2)</enum><text>Any division of a State, a local government in the State, or an entity in the State covered by any of paragraphs (1) through (4) of section 606, that is the subject of a complaint under this title shall—</text><subparagraph id="id10CF5C803D7B45A4BEF92BAA04F84A5C"><enum>(A)</enum><text>if engaged in the business of providing elementary or secondary education, inform the State educational agency of the complaint; and</text></subparagraph><subparagraph id="idB756281A03F14B0CAA8A37D2CF2BC970"><enum>(B)</enum><text>if engaged in the business of providing postsecondary education, inform the State higher education agency of the complaint. </text></subparagraph></paragraph><paragraph id="id0F2B12151E594907B6192A56D449B319" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>State educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection><subsection id="idEDEA13735380489BA33E24F227D67571"><enum>(c)</enum><text>The Secretary of Education shall annually prepare and submit a report to Congress on the nature of any complaints received under section 601 and described in section 601(b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
