which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require online platforms to provide a mechanism for the deletion of user accounts, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Click to Quit Act</short-title></quote>.</text></section><section id="idEBEAD541134F493FBA311E6B8A034C23"><enum>2.</enum><header>Requirements for online platforms regarding account deletion</header><subsection id="id9E114DE64AC8447E858D82959D01FCF3"><enum>(a)</enum><header>Mechanism for deletion</header><paragraph id="id40F1EEF46491480FA7076DE177F2FCF9"><enum>(1)</enum><header>In general</header><text>Beginning 1 year after the date of enactment of this section, an online platform shall provide a mechanism by which a user may delete or otherwise terminate the account of such user on the online platform.</text></paragraph><paragraph id="idA08AAD786A524C5EA7BA5CDB899D8CA5"><enum>(2)</enum><header>Requirements</header><text>The mechanism described in paragraph (1) shall be—</text><subparagraph id="idC7DE295E2D4D40B99966DEACDA5BB46D"><enum>(A)</enum><text>in the form of a tab, link, button, or other easy-to-use process; </text></subparagraph><subparagraph id="idD27F453E4F4547EBAD8121D5D2C3B14D"><enum>(B)</enum><text>in easily understandable, concise, accurate, and clear language; and</text></subparagraph><subparagraph id="id3DF5EF6F7BF2401A9F5F34C9E2A4328E"><enum>(C)</enum><text>located in a conspicuous position (as determined by the Commission).</text></subparagraph></paragraph></subsection><subsection id="idb5a1399403dd4361a34b913b2b4d9bc4"><enum>(b)</enum><header>Enforcement by the Commission</header><paragraph id="id184a14d53aa54b24a80cab33c88202c3"><enum>(1)</enum><header>Unfair or deceptive acts or practice</header><text>A violation of subsection (a) or a regulation promulgated thereunder shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id70fbe54210cf4d3fa536816db8a76f15"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph id="id89cb5ab16a5c419681a477d5367c506c"><enum>(A)</enum><header>In general</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph id="id7c7115814606449bb60e0edbcb34a42b"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates subsection (a) or a regulation promulgated thereunder shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="id79bae93464d9465daa8b69c0826554e2"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph></paragraph><paragraph id="id7cc6bdb08ecc422587dc828eda9f3a2f"><enum>(3)</enum><header>Rulemaking</header><text>The Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this section.</text></paragraph></subsection><subsection id="id1F3373D82EF14B868D7C1D67E3CE8986"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id19FB9BF42A474BD59589337B6B499792"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="idEFDE5ED537C746ACB3A55F87C02DA7D6"><enum>(2)</enum><header>Online platform</header><text>The term <term>online platform</term> means any public-facing website, web application, or digital application (including a social network, ad network, or search engine) that allows a user to create an account on the website or application, including by using information from an account associated with another website or application to register with, sign in to, or otherwise access the website or application involved.</text></paragraph></subsection></section></legis-body></bill>
