<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2571</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210730">July 30, 2021</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, and <cosponsor name-id="S284">Ms. Stabenow</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the inclusion on the Vietnam Veterans Memorial Wall of the names of the soldiers who died on Flying Tiger Flight 739 on March 16, 1962.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flying Tiger Flight 739 Act</short-title></quote>.</text></section><section id="id1A6929C22F1D4B2E866C6C2F8A87ED5F"><enum>2.</enum><header>Inclusion on the Vietnam Veterans Memorial Wall of the names of the soldiers who died on Flying Tiger Flight 739 on March 16, 1962</header><subsection id="idEDB290B016494B26ABA36B64B15884E5"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Defense (referred to in this Act as the <quote>Secretary</quote>) shall authorize the inclusion on the Vietnam Veterans Memorial Wall in the District of Columbia of the names of the 93 soldiers who died on Flying Tiger Flight 739 when the flight crashed in the Pacific Ocean en route to Vietnam on March 16, 1962.</text></subsection><subsection id="idF59A85FD35444A3BA905E2E08AFA4CC4"><enum>(b)</enum><header>Required consultation</header><text>The Secretary shall consult with the Secretary of the Interior, the American Battle Monuments Commission, and other applicable authorities with respect to any adjustments to the nomenclature and placement of names pursuant to subsection (a) to address any space limitations on the placement of additional names on the Vietnam Veterans Memorial Wall.</text></subsection><subsection id="id85085EF82F1C4A9C8F2B77E9C1E4B81B"><enum>(c)</enum><header>Nonapplicability of Commemorative Works Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/89">Chapter 89</external-xref> of title 40, United States Code (commonly known as the <quote>Commemorative Works Act</quote>), shall not apply to any activities carried out under subsection (a) or (b).</text></subsection></section></legis-body></bill>
