which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>November 15, 2022</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with amendments and an amendment to the title</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend the Forest and Rangeland Renewable Resources Planning Act of 1974 and the Federal Land Policy and Management Act of 1976 to provide that a land resource management plan or land use plan approved, amended, or revised under those Acts shall not be considered to be a continuing Federal agency action or constitute a discretionary Federal involvement or control for a distinct Federal purpose, and for other purposes.</official-title></form><legis-body changed="not-changed"><section id="id63717B9ED32C4D2BB679E6DF88E767B6" section-type="section-one"><enum>1.</enum><header><deleted-phrase reported-display-style="strikethrough">Treatment of</deleted-phrase><added-phrase reported-display-style="italic">Consultation under</added-phrase> certain land and resource management plans and land use plans</header><subsection id="id3B2810B913974384BEC0FAB2AAE4C890" changed="deleted" committee-id="SSEG00" reported-display-style="strikethrough"><enum>(a)</enum><header>National Forest System land and resource management plan</header><text display-inline="yes-display-inline"><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">Section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>) is amended by adding at the end the following:</deleted-phrase></text><quoted-block style="OLC" display-inline="no-display-inline" id="id1B24A82F5642487D943841C189C6E811" changed="deleted" committee-id="SSEG00" reported-display-style="strikethrough"><subsection id="id3f80424d632f4dc49cb4383de5097ef1"><enum>(n)</enum><header>Completed Federal action</header><text>A land and resource management plan for a unit of the National Forest System approved, amended, or revised under this section shall not—</text><paragraph id="id9076D8B7A6184A898E09E930A9396D64"><enum>(1)</enum><text> be considered to be a continuing Federal agency action; or </text></paragraph><paragraph id="id99fe0a22a21a4e798ff5908de0f50afd"><enum>(2)</enum><text>constitute a discretionary Federal involvement or control for a distinct Federal purpose.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idF49352DD6393466A9B16CBA358492B34" changed="added" committee-id="SSEG00" reported-display-style="italic"><enum>(a)</enum><header>National Forest System land and resource management plans</header><text><added-phrase committee-id="SSEG00" reported-display-style="italic">Section 6(d) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604(d)</external-xref>) is amended by striking paragraph (2) and inserting the following: </added-phrase></text><quoted-block style="OLC" display-inline="no-display-inline" id="idceb792cff85b4e699169bfd1254912b5" changed="added" reported-display-style="italic"><paragraph id="id941f7ad8e31e464d8471381a299ee958"><enum>(2)</enum><header>No additional consultation required after approval of land management plans</header><text>Notwithstanding any other provision of law, the Secretary shall not be required to reinitiate consultation under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>) or section 402.16 of title 50, Code of Federal Regulations (or a successor regulation), on a completed land and resource management plan that has no on-the-ground effects when— </text><subparagraph id="idC01D4C206CA34F6AB259642DC6E4A479"><enum>(A)</enum><text>a new species is listed or a new critical habitat is designated under that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or </text></subparagraph><subparagraph id="id558BDAAA32F049A893B184A9E55A3B82"><enum>(B)</enum><text>new information reveals effects of the land and resource management plan that may affect a species listed or critical habitat designated under that Act in a manner or to an extent not previously considered.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1336AA0D782F4FD3AC7EA029DE484412"><enum>(b)</enum><header>Bureau of land management land use plans</header><text display-inline="yes-display-inline">Section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCDA004AB25D6411998FFE7A7CE43EFC6"><subsection id="id23c636d8777d45d9a0229eb59a5a71d0" changed="deleted" reported-display-style="strikethrough"><enum>(g)</enum><header>Completed Federal action</header><text>A land management plan approved, amended, or revised under this section shall not—</text><paragraph id="idAB71E6C6A739499AB9B9C4715633FCB8"><enum>(1)</enum><text> be considered to be a continuing Federal agency action; or </text></paragraph><paragraph id="idB0C3CA22449645C0882AA40D73DE38C4"><enum>(2)</enum><text>constitute a discretionary Federal involvement or control for a distinct Federal purpose.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block><quoted-block style="OLC" display-inline="no-display-inline" id="id7B3E9E595AD2493DB9C22439EAD0BFA2"><subsection id="id33726C657D454873A468A2C35AD6510D" changed="added" reported-display-style="italic"><enum>(g)</enum><header>No additional consultation required after approval of land use plans</header><text>Notwithstanding any other provision of law, the Secretary shall not be required to reinitiate consultation under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>) or section 402.16 of title 50, Code of Federal Regulations (or a successor regulation), on a completed land use plan that has no on-the-ground effects when—</text><paragraph id="id53AEA207460543B594184D52E658A0B2"><enum>(1)</enum><text>a new species is listed or a new critical habitat is designated under that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);
