which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to protect beneficiaries with limb loss and other orthopedic conditions by providing access to appropriate, safe, effective, patient-centered orthotic and prosthetic care, to reduce fraud, waste, and abuse with respect to orthotics and prosthetics, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA5F92443179D40109F460781374C4CA6"><section section-type="section-one" id="H345BD511E7A44F37A9C0C168E299EBCA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Orthotics and Prosthetics Patient-Centered Care Act</short-title></quote>.</text></section><section id="HFCF268FFA307459E80565D6822664F07"><enum>2.</enum><header>Increasing protections for beneficiaries receiving orthotic and prosthetic care under the Medicare program</header><subsection id="HCE839DFE59DB46C4B95C2A493E9D1162"><enum>(a)</enum><header>Distinguishing orthotists and prosthetists from suppliers of durable medical equipment and supplies</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended—</text><paragraph id="H6F795D775F9C459CA936FD06B4B929D0"><enum>(1)</enum><text>in subsection (j)(5), by striking subparagraph (C) and redesignating the subsequent subparagraphs accordingly; and</text></paragraph><paragraph id="H78FAABB4A4DD47848FB1F6FE654C6E8F"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HAB8880E1CE3E4122AA6A55191CBDF3F7"><subsection id="H5EFDFFD146C1428FA0622978F8EAC54B"><enum>(z)</enum><header>Requirements for orthotists and prosthetists</header><paragraph id="H354C4F9924984AF3A8500E4307084979"><enum>(1)</enum><header>Issuance and renewal of supplier number</header><subparagraph id="H36C3C2A9840E4E07979B022E39B90303"><enum>(A)</enum><header>Payment</header><clause id="H13A54AE3745A46CF8DD8B81143232857"><enum>(i)</enum><header>In general</header><text>No payment may be made under this part to an orthotic or prosthetic supplier unless such orthotic or prosthetic supplier obtains (and renews at such intervals as the Secretary may require) a supplier number.</text></clause><clause id="HA94DAEE1097A4EFCB1591940CD31CD72"><enum>(ii)</enum><header>Clarification regarding providers under part A</header><text>Nothing in clause (i) shall prohibit a provider otherwise permitted to receive payment for orthotics and prosthetics under part A from continuing to receive payment under such part without interruption.</text></clause></subparagraph><subparagraph id="HD5F9A3EBF0244B0B92545220EC241FF6"><enum>(B)</enum><header>Standards for possessing a supplier number</header><text>An orthotic or prosthetic supplier may only obtain a supplier number if the supplier meets standards prescribed by the Secretary that include requirements that the orthotic or prosthetic supplier (and, where applicable, the orthotist or prosthetist)—</text><clause id="H48A90A3EAD7A436D8A09F078C9A35943"><enum>(i)</enum><text>licensure and accreditation—</text><subclause id="H430938CDE0254E01BB382A0EFFE0EA9F"><enum>(I)</enum><text>complies with all applicable State and Federal licensure and regulatory requirements; and</text></subclause><subclause id="HB0B3301C0E0347668BF56F5FA8047FAA"><enum>(II)</enum><text>acquires accreditation from the American Board for Certification in Orthotics, Prosthetics and Ped­orth­ics, Inc. or the Board of Certification/Accreditation, International, or other accreditation entity that the Secretary determines has standards that are equivalent to the standards of such Boards;</text></subclause></clause><clause id="H60E3A0FCCFB740B098373E15848C74F5"><enum>(ii)</enum><text>maintains a physical facility on an appropriate site;</text></clause><clause id="H3253039042B849779B0B3F84211FFAEB"><enum>(iii)</enum><text>has proof of appropriate liability insurance; and</text></clause><clause id="H587B12EAA9864A148B3E74BFF208DC09"><enum>(iv)</enum><text>meets such other requirements as the Secretary shall specify.</text></clause></subparagraph><subparagraph id="H97D4F2D7E9D248FC8EFB5559E8C16048"><enum>(C)</enum><header>Prohibition against multiple supplier numbers</header><text>The Secretary may not issue more than one supplier number to any orthotic or prosthetic supplier unless the Secretary finds that the issuance of more than one number is appropriate to identify other entities under the ownership or control of the orthotic or prosthetic supplier.</text></subparagraph></paragraph><paragraph id="H219F923AF6F24A229D0B46BA5D2878BE"><enum>(2)</enum><header>Order for orthotics or prosthetics</header><subparagraph id="H274EF077EF014DD1ACD70525DBFE4D66"><enum>(A)</enum><header>Information provided by orthotists and prosthetists on detailed written orders for orthotics and prosthetics</header><text>An orthotist or prosthetist may distribute to physicians, physician assistants, nurse practitioners, clinical nurse specialists, or individuals entitled to benefits under this part, a detailed written order for orthotics or prosthetics (as defined in paragraph (5)) for commercial purposes that contains the following information:</text><clause id="HA5FE2D2735474126A9086E99DEB16FA4"><enum>(i)</enum><text>The identification of—</text><subclause id="H899A1174FCEF4E07815B559F63AF243E"><enum>(I)</enum><text>the orthotic or prosthetic supplier; and</text></subclause><subclause id="H70786C305DE0415F8403ED9B23C07B52"><enum>(II)</enum><text>the individual to whom the orthotics or prosthetics are furnished.</text></subclause></clause><clause id="H15091F9BF41749169AC75C94D032814D"><enum>(ii)</enum><text display-inline="yes-display-inline">The identification of the treating physician, physician assistant, nurse practitioner, or clinical nurse specialist.</text></clause><clause id="H7F2517194EEF46858E5782ECB943FCDC"><enum>(iii)</enum><text>A description of the orthotics or prosthetics ordered.</text></clause><clause id="H3F244C1BDF7343CBBEEFEFD08A1E7EAA"><enum>(iv)</enum><text>The date of the order described in this subparagraph.</text></clause></subparagraph><subparagraph id="H7726533356F2438CA906F595D0DC50A8"><enum>(B)</enum><header>Information on coding and descriptors of components provided</header><text>If an orthotist or prosthetist distributes a detailed written order for orthotics or prosthetics described in subparagraph (A), the orthotist or prosthetist shall also list on the order the summary descriptors of the items and services being recommended prior to submission of the order to the treating physician for approval.</text></subparagraph><subparagraph id="HBAAC8CDAB4C1487F8EAFB3FF050A2A1B"><enum>(C)</enum><header>Signature by treating physician</header><text>A detailed written order for orthotics or prosthetics described in subparagraph (A) shall be signed by the treating physician.</text></subparagraph></paragraph><paragraph id="H69636DB258174E8CA03E9257DF70C32A"><enum>(3)</enum><header>Limitation on patient liability</header><text>Except as provided in paragraph (4), if an orthotist or prosthetist—</text><subparagraph id="H4256FCEFBA9B45F6A7AF1598E7FDD827"><enum>(A)</enum><text>furnishes an orthosis or prosthesis to a beneficiary for which no payment may be made under this part; or</text></subparagraph><subparagraph id="H23703251E0E14105B00BD42A94545946"><enum>(B)</enum><text>subject to section 1879, furnishes an orthosis or prosthesis to a beneficiary for which payment is denied under section 1862(a)(1),</text></subparagraph><continuation-text continuation-text-level="paragraph">any expenses incurred for the orthosis or prosthesis furnished to an individual by the orthotist or prosthetist not on an assigned basis shall be the responsibility of such orthotist or prosthetist. The individual shall have no financial responsibility for such expenses and the orthotist or prosthetist shall refund on a timely basis to the individual (and shall be liable to the individual for) any amounts collected from the individual for such items and services. The provisions of subsection (a)(18) shall apply to refunds required under the previous sentence in the same manner as such provisions apply to refunds under such subsection. </continuation-text></paragraph><paragraph id="H578A96D6C3284F1CA67CCB88AEA05052"><enum>(4)</enum><header>Patient liability</header><text>If an orthotist or prosthetist furnishes an orthosis or prosthesis to a patient for which payment is denied in advance under subsection (a)(15), expenses incurred for such orthosis or prosthesis furnished to the individual by the orthotist or prosthetist shall be the responsibility of the individual.</text></paragraph><paragraph id="HDE9E4F0A487D4653A651F5DAA415E65D"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H49B96F232BC54694BA799DDE6F8E694F"><enum>(A)</enum><header>Detailed written order for orthotics or prosthetics</header><clause id="HA5CD6C5114484AF1ABD30D2E9F879A35"><enum>(i)</enum><header>In general</header><text>The term <term>detailed written order for orthotics or prosthetics</term> means a form or other document prepared by an orthotist or prosthetist and signed by the physician (as defined by section 1861(r)) that contains information required by the Secretary to show that an orthosis or prosthesis is reasonable and necessary for the treatment of an illness or injury or to improve the functioning of a malformed body member.</text></clause><clause id="H606D892FFE164CFCA4C94CE75BA58653"><enum>(ii)</enum><header>Clarification</header><text>The detailed written order for orthotics or prosthetics shall not be considered alone for purposes of determining the reasonableness, medical necessity, and functional level (applicable to prosthetics) of orthotics and prosthetics.</text></clause></subparagraph><subparagraph id="H8BDAEE4936BC4B6789E3B6AF0D68D70A"><enum>(B)</enum><header>Orthotics and prosthetics</header><text>The term <term>orthotics and prosthetics</term> has the meaning given that term in section 1834(h)(4)(C).</text></subparagraph><subparagraph id="HF4F593C4F4F94481A78A343145C793BD"><enum>(C)</enum><header>Orthotist or prosthetist</header><text>The term <term>orthotist or prosthetist</term> means an individual who is specifically trained and educated in the provision of, and patient care management related to, prosthetics and custom-fabricated or custom-fit orthotics, and—</text><clause id="H9C962135353745E8879D13283260A4C8"><enum>(i)</enum><text>in the case of a State that provides for the licensing of orthotists and prosthetists, is licensed by the State in which the orthotics or prosthetics were supplied; or</text></clause><clause id="HB606A013DE8D403085D0E88DE9AB7C2B"><enum>(ii)</enum><text>in the case of a State that does not provide for the licensing of orthotists and prosthetists, is certified by the American Board for Certification in Orthotics, Prosthetics and Pedorthics, Inc. or by the Board of Certification/Accreditation, International, or is certified and approved by an entity that the Secretary determines has certification and approval standards that are essentially equivalent to the certification and approval standards of such Boards.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA6D0DDA865F04D229479D34EA694F518"><enum>(b)</enum><header>Prohibiting payment for certain orthotics and prosthetics</header><text display-inline="yes-display-inline">Section 1834(h)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0785CBC71DEF40D88B7A410D011B4AC1"><subparagraph id="HE78ED4D523B6455D8C9D12B7DD5A69BB"><enum>(I)</enum><header>Special payment rules for orthotics or prosthetics</header><clause id="HDE3C5F97B88F4597B554DEC63139CC7D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">No payment shall be made under this subsection for—</text><subclause id="H409263D36C71476AB7FBEB4E7C0FB1E1"><enum>(I)</enum><text display-inline="yes-display-inline">a prosthesis (excluding prosthetic supplies) that is delivered by drop shipment;</text></subclause><subclause id="H21C6340B3B114B19950D26E9E21D546E"><enum>(II)</enum><text>a custom-fabricated or custom-fitted orthosis (excluding orthotic supplies) described in subparagraph (F)(ii) that is delivered by drop shipment; and</text></subclause><subclause id="HB75A500057A942E5993C37E2907AF799"><enum>(III)</enum><text>an orthotic item that is not otherwise competitively bid that is delivered by drop shipment.</text></subclause></clause><clause id="H0C4365ED8499450BA2BA6707984D5CCD"><enum>(ii)</enum><header>Drop shipment defined</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>drop shipment</term> means the shipping of an orthosis or prosthesis to a beneficiary without receiving from a trained, educated, and certified or licensed health care practitioner, orthotist, or prosthetist direct patient care with respect to assessing, adjusting, and training in the care and use of the orthosis or prosthesis.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA416198162FF4122A76AAAF6F50AC815"><enum>(c)</enum><header>Standardizing the definitions of orthotics and prosthetics</header><text>Section 1834(h)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(4)</external-xref>) is amended—</text><paragraph id="HDF95468CE0284293AB71833B5B2BE389"><enum>(1)</enum><text>in subparagraph (B), by striking at the end <quote>and</quote>;</text></paragraph><paragraph id="HAE9AE1D052CD4BFF88247933208F98E1"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph id="HE23C51D2E429497F8F82C587C3F1C903"><enum>(A)</enum><text>by striking <quote>the term <term>orthotics and prosthetics</term> has the meaning given such term</quote> and inserting <quote>the terms <term>orthotics and prosthetics</term> and <term>orthoses and prostheses</term> have the meaning given such terms</quote>; and</text></subparagraph><subparagraph id="HD47C93F41D454375A98EE2DDEE098B4D"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph></paragraph><paragraph id="H114C558B6BC74A0FB14CACCB85594A4C"><enum>(3)</enum><text>by inserting after subparagraph (C), as amended by paragraph (2), the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE50CC939440C4B0E9D757490136DFBB9"><subparagraph id="HBA7A6B833A1F4DB0A9E14C0FB4B9D29D"><enum>(D)</enum><text display-inline="yes-display-inline">the terms <term>prosthetics</term> and <term>prostheses</term> refer to a device (including the clinical services associated with such device) that replaces all or part of a limb.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4B849DC4901242B7AA047D97391C10A2"><enum>(d)</enum><header>Limitation of competitive acquisition for off-the-Shelf orthotics</header><text>Section 1847(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)</external-xref>) is amended—</text><paragraph id="H54AACE2C7EFF4D978E7AC642E76F045D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(C), by inserting <quote>by the patient (and not by another person)</quote> after <quote>minimal self-adjustment</quote>; and</text></paragraph><paragraph id="H722ACB290703406CB135B32169B48C98"><enum>(2)</enum><text>in paragraph (7)(A)(i)—</text><subparagraph id="HA91C6B3002FA44848341EFCFD3BEC7A1"><enum>(A)</enum><text>by inserting <quote>, orthotist or prosthetist (as defined in section 1834(z)(5)(C)),</quote> after <quote>by a physician</quote>;</text></subparagraph><subparagraph id="HE7C244A2CD374BEF90A2956D07706E6C"><enum>(B)</enum><text>by inserting <quote>, orthotist’s or pros­thetist’s,</quote> after <quote>to the physician’s</quote>; and</text></subparagraph><subparagraph id="H0B3E76473C7B45EAA079D87F31C5C3E1"><enum>(C)</enum><text>by inserting <quote>, orthotist’s or pros­thetist’s,</quote> after <quote>of the physician’s</quote>.</text></subparagraph></paragraph></subsection><subsection id="H82442ABECCC145AB864352A943DDE11C"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall promulgate final regulations to implement the provisions of, and amendments made by, this Act.</text></subsection></section></legis-body></bill>
