which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require that certain agencies only procure cut flowers and cut greens grown in the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC51216D3ADB2484EB84A759C944F51D1"><section section-type="section-one" id="H0F0ADD976DCC4AFD863674AA86AB8A4D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Grown Act</short-title></quote>.</text></section><section id="H7C673E151974453799ECD951F8F91B16"><enum>2.</enum><header>Limitation on procurement</header><subsection id="HDE8EA830ED284EC58D2BEBA0B66BB014"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H15A13C8FA80E47ECBEBFD1E9B7BF9309"><enum>(1)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means—</text><subparagraph id="id2F589087DB5D45E69A4257AD00FFBE9D"><enum>(A)</enum><text>the Executive Office of the President;</text></subparagraph><subparagraph id="idD7B253B96A804337BCBFC438729C7399"><enum>(B)</enum><text>the Department of Defense; and</text></subparagraph><subparagraph id="idA37A36B82AF940A38A905ADDCD4528DD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the Department of State.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF8D302F21CDF40B19915F6B23E3B2728"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text><subparagraph id="id576F5D0F1B7A4AC0BBDA1D16D51F75CC"><enum>(A)</enum><text>a foreign government; and</text></subparagraph><subparagraph id="idB030F76BBCE84412A4F7C47E980AB9D5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>an agent of a foreign principal (as defined section 1 of the Foreign Agents Registration Act of 1938, as amended (22 U.S.C 611)). </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H242BBDFDB55C460B8E6F89BA191CC991"><enum>(3)</enum><header>Cut flower</header><text display-inline="yes-display-inline">The term <term>cut flower</term> means a flower removed from a living plant for decorative use.</text></paragraph><paragraph id="H91453AFCF7854859912495D5C3995E3C"><enum>(4)</enum><header>Cut green</header><text>The term <term>cut green</term> means a green, foliage, or branch removed from a living plant for decorative use.</text></paragraph><paragraph id="idF7768BE5B38747B199E49D541B5E9F70"><enum>(5)</enum><header>Qualifying area</header><text>The term <term>qualifying area</term> means—</text><subparagraph id="idC43CF39F6B4244668EE3C39874E20792"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="id9893DA3E344D425C853E557AF088928A"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="id3AE2934712854FCCA95757E061BE7C62"><enum>(C)</enum><text>a territory or possession of the United States; or</text></subparagraph><subparagraph id="id88D3E653619D4C0DBD4FD04798FAB822"><enum>(D)</enum><text>an area subject to the jurisdiction of a federally recognized Indian Tribe. </text></subparagraph></paragraph></subsection><subsection id="idAB9003C5AD42471DA40C3085BEA2B31B"><enum>(b)</enum><header>Requirement</header><paragraph id="idED4B04847BE141B1896EF6C92A909F2E"><enum>(1)</enum><header>In general</header><text>Funds appropriated or otherwise available to a covered agency may only be used for the procurement of a cut flower or cut green if the cut flower or cut green is grown in a qualifying area.</text></paragraph><paragraph id="HEC026A08F3BC4915889E7B70A6E378AA"><enum>(2)</enum><header>Applicability</header><text>This subsection shall apply to a procurement made or contracted for—</text><subparagraph id="id7626610701794C6DAB33B4CBC76618B9"><enum>(A)</enum><text>in the United States; and</text></subparagraph><subparagraph id="id2B84EE3A35B44A7E814F9FDA1D71CFE6"><enum>(B)</enum><text>on or after the date that is 1 year after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="id45A722852ADA4D3AB4C4C27EE6C7836F"><enum>(c)</enum><header>Gifts for display</header><paragraph id="idD8E9F4793633415CB3471C3B4A5D7413"><enum>(1)</enum><header>In general</header><text>A covered agency may only accept a gift of a cut flower or cut green that is not grown in a qualifying area from a covered entity for the purpose of displaying the cut flower or cut green if—</text><subparagraph id="id4BDB3C4459D241D295D80C0E90BA318E"><enum>(A)</enum><text>the origin of the cut flower or cut green is clearly displayed at the time of delivery; and</text></subparagraph><subparagraph id="idCBD4234E872A4CA8B004CD87BC483E8B"><enum>(B)</enum><text>at the time of delivery, the covered agency procures an additional cut flower or cut green that is grown in a qualifying area to display during the period of display of the gift.</text></subparagraph></paragraph><paragraph id="idAC762CE17AFF4FD39F9285989DC68760"><enum>(2)</enum><header>Requirement</header><text>A covered agency that accepts a gift of a cut flower or cut green from a covered entity under paragraph (1) shall clearly display the origin of the cut flower or cut green during the period of display of the cut flower or cut green.</text></paragraph></subsection></section></legis-body></bill>
