<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2536</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210729">July 29, 2021</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S391">Mr. Young</cosponsor>, <cosponsor name-id="S303">Mr. Thune</cosponsor>, and <cosponsor name-id="S236">Mr. Inhofe</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Government Accountability Office to submit a report on the public health mitigation messaging and guidance of the Centers for Disease Control and Prevention.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore Public Health Institution Trust Act of 2021</short-title></quote>.</text></section><section id="idF427A8467B344B1CA575AECA6A75ABB0"><enum>2.</enum><header>Report on CDC public health mitigation messaging and guidance</header><subsection id="idF0BCCDA1BF6F4E8580DB81C6C9BF2DC9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Government Accountability Office shall submit to the appropriate committees of Congress a report on the public health mitigation messaging, decision making, and guidance of the Centers for Disease Control and Prevention (referred to in this section as the <quote>CDC</quote>). Such report shall—</text><paragraph id="idDC626A0577F745588D90721FA1B22485"><enum>(1)</enum><text display-inline="yes-display-inline">consider—</text><subparagraph id="idca2cce78a8614089971b5718acb3ac33"><enum>(A)</enum><text>the data being used by the CDC to make recommendations;</text></subparagraph><subparagraph id="id7c8f2cd09d284d2b95feb734c36fd7b7"><enum>(B)</enum><text>the impact that inconsistent messaging has had on—</text><clause id="id6F98807AACBD47218E1A7A28886A113A"><enum>(i)</enum><text>the level of trust Americans have in the CDC; and</text></clause><clause id="id67C21652D194436E8AD68789AAC7A6A7"><enum>(ii)</enum><text>the willingness of Americans to follow CDC guidance, including with respect to COVID-19 vaccine uptake; and</text></clause></subparagraph><subparagraph id="id9c5e70c53ee64fadba33eb5dde12845d"><enum>(C)</enum><text>the degree to which outside entities (such as teachers unions) were in a position to impact recommendations made by the CDC; and</text></subparagraph></paragraph><paragraph id="id8E074B5BDC64400AAFFEE5EBBC7EA57E"><enum>(2)</enum><text>contain recommendations to improve the approach of the CDC relating to messaging, decision making, and the issuance of guidance in the future. </text></paragraph></subsection><subsection id="id85CB4AD08F8848709B72FA0D5C2566EC"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="idDAC4267420944B6387963191408ABB22"><enum>(1)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></paragraph><paragraph id="id3847E885B50643AE90B6E0C7CD5364C4"><enum>(2)</enum><text>the Committee on Small Business of the Senate;</text></paragraph><paragraph id="idD210E1358E0C4995BEEF7E56223CBA43"><enum>(3)</enum><text>the Committee on Appropriations of the Senate;</text></paragraph><paragraph id="id7F22C7C319A1460CA606B5C928720948"><enum>(4)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></paragraph><paragraph id="idC26BBCBB544D43B59E80DD449AB2146A"><enum>(5)</enum><text>the Committee on Education and Labor of the House of Representatives;</text></paragraph><paragraph id="idC9A1B9F656964FBC86AC63FA16D123AE"><enum>(6)</enum><text>the Committee on Small Business of the House of Representatives;</text></paragraph><paragraph id="idAFB3658825264FD18EA8500B51B45562"><enum>(7)</enum><text>the Committee on Appropriations of the House of Representatives; and </text></paragraph><paragraph id="id5D50B200EEA94DF0BC1D6FB9E55A7B4C"><enum>(8)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></paragraph></subsection></section></legis-body></bill>
