<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2534</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210729">July 29, 2021</action-date><action-desc><sponsor name-id="S414">Mr. Ossoff</sponsor> (for himself, <cosponsor name-id="S415">Mr. Warnock</cosponsor>, and <cosponsor name-id="S413">Mr. Padilla</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to provide assistance for increasing the frequency and availability of public transportation service, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanded Transit Service Act</short-title></quote>.</text></section><section id="idf79dd35177e9400bb014fcad63fcd02d"><enum>2.</enum><header>Urbanized area formula grants</header><text display-inline="no-display-inline">Section 5307(a) of title 49, United States Code, is amended—</text><paragraph id="id8c420ac769c44bdb8b4707374154e356"><enum>(1)</enum><text>in paragraph (1), by striking subparagraph (D) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0231f9b83edb4fbc8f80bf88ca40716f"><subparagraph id="ida48ab094d0df49d4afb1cdc5e1e77881"><enum>(D)</enum><text>operating costs of equipment and facilities for use in public transportation—</text><clause id="id74ece34b896c48b0a0e488a18af1a012"><enum>(i)</enum><text>in an urbanized area with a population of fewer than 200,000 individuals, as determined by the Bureau of the Census; or</text></clause><clause id="id157bac038e5149e282c6937c2067266b"><enum>(ii)</enum><text>as provided under paragraph (2), (3), or (4).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id151ecd2a21124c9a9d1194a78b790387"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida8e1019e36254e8c9fada18e1938d947"><paragraph id="idaef50cb9cecd4b2baaab8c443d5ecf9a"><enum>(4)</enum><header>Exception for increasing the frequency and availability of transit service</header><subparagraph id="id3f6c18c1ea5b4a088395b608250bbddc"><enum>(A)</enum><header>In general</header><text>A recipient in an urbanized area with a population of not fewer than 200,000 individuals may use not more than 10 percent of the amounts made available to the recipient under this section for operating costs that increase the frequency and availability of public transportation service.</text></subparagraph><subparagraph id="id77e34579f20b4f9d9bab82382cf3e87d"><enum>(B)</enum><header>Measurement</header><text>Operating costs described in subparagraph (A) shall be related to increasing or maintaining the frequency and availability of public transportation service as measured by a comparison of—</text><clause id="idd79ea06d6e0e408eb8a209f3246c98dc"><enum>(i)</enum><text>the planned number of vehicle revenue hours of service provided by the recipient in the current fiscal year; to</text></clause><clause id="id1e83ad7896414a02b295342b213a2b11"><enum>(ii)</enum><text>the number of vehicle revenue hours of service provided by the recipient in—</text><subclause id="idc74b4e78e9be43728d0c599e8cd79424"><enum>(I)</enum><text>the fiscal year preceding the first fiscal year in which the recipient uses amounts under this paragraph; or</text></subclause><subclause id="id22f3bf8ea2514454994d6ec44d72d47a"><enum>(II)</enum><text>a different fiscal year, as determined by the Secretary, in the case of emergency or disaster.</text></subclause></clause></subparagraph><subparagraph id="idcd31d0e7de07413ab4673886827fd242"><enum>(C)</enum><header>Eligibility</header><text>Eligible operating costs under this paragraph include costs associated with—</text><clause id="id0d3e733cc78d430d913d25726c14a24a"><enum>(i)</enum><text>decreasing headways;</text></clause><clause id="id872d5419da0749769b67029721cf64b8"><enum>(ii)</enum><text>expanding service hours or days;</text></clause><clause id="id238c0afcef4d4527aca6c1dc6044eca6"><enum>(iii)</enum><text>providing service to new routes; or</text></clause><clause id="id7e39d0d8314949a199ced46407027b56"><enum>(iv)</enum><text>expanding routes.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
