which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XIX and XXI of the Social Security Act to give States the option to extend the Medicaid drug rebate program to the Children's Health Insurance Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id8E6673345E634086B847971B4B44D072"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Drug Prices for Kids Act</short-title></quote>.</text></section><section id="idDBE13FD1E2F34705B5E7094BEDD29FC1"><enum>2.</enum><header>Reducing prescription drug costs for children's medicine</header><subsection id="id17B49C7EF85C43EE8415DA796ED29402"><enum>(a)</enum><header>In general</header><text>Section 1927(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEE497F57E4744B79B01E9A83EDE0BE56"><paragraph id="id5C34D23ECB1542B384BE309CEF3C3BF2"><enum>(8)</enum><header>State option to apply rebate requirements to the State child health plan</header><subparagraph id="idFEEEC5990AC14B68A011D94458BF7C17"><enum>(A)</enum><header>In general</header><text>A State may elect to apply the requirements of this section and regulations promulgated to carry out this section to covered outpatient drugs for which payment is available under the State child health plan under title XXI in the same manner as such requirements apply to the State plan under this title, subject to such guidance as the Secretary shall establish.</text></subparagraph><subparagraph id="idD0A2A34495C04854AED182F0807790DF"><enum>(B)</enum><header>Application rules</header><text>If a State makes an election under subparagraph (A), then, in applying this section with respect to that State—</text><clause id="id02F0A598A2F94EF5B8E99CD1B3BA7E2E"><enum>(i)</enum><text>paragraph (1) of this subsection shall be applied as if <quote>or section 2105 (if the State has elected to apply this section to the State child health plan under title XXI)</quote> were inserted after <quote>1903(a)</quote>;</text></clause><clause id="id5FA3C14C4AD84EEC84E8C3A4653A42AA"><enum>(ii)</enum><text>paragraph (7)(A) of this subsection shall be applied—</text><subclause id="id5AF2916F8FCB410DB553E3249EFDB3B4"><enum>(I)</enum><text>as if <quote>or section 2105 (if the State has elected to apply this section to the State child health plan under title XXI)</quote> were inserted after <quote>1903(a)</quote>; and</text></subclause><subclause id="idFDBD4142BF8B48ADBF08EA15ACC5FD41"><enum>(II)</enum><text>as if <quote>(or, if the State has elected to apply this section to the State child health plan under title XXI, on or after the date this section first applies to the State)</quote> were inserted after <quote>January 1, 2006</quote>;</text></subclause></clause><clause id="idF9F013F82B074AA4ADDFB9524F1F8B7E"><enum>(iii)</enum><text>paragraph (7)(B)(ii) of this subsection shall be applied—</text><subclause id="idF152FA1FDBC04A70AE0A32081F82D247"><enum>(I)</enum><text>as if <quote>or section 2105 (if the State has elected to apply this section to the State child health plan under title XXI)</quote> were inserted after <quote>1903(a)</quote>; and</text></subclause><subclause id="idF4FB829CA46542FD99F635D8ADE5F778"><enum>(II)</enum><text>as if <quote>(or, if the State has elected to apply this section to the State child health plan under title XXI, on or after the date this section first applies to the State)</quote> were inserted after <quote>January 1, 2008</quote>;</text></subclause></clause><clause commented="no" id="idD074BCF3ACC641B79D8166B7FFD76C3B"><enum>(iv)</enum><text>subsection (b)(1)(A) shall be applied as if <quote>(or, if the State has elected to apply this section to the State child health plan under title XXI, on or after the date this section first applies to the State, to each State child health plan for which payment was made under such State child health plan for such period)</quote> were inserted after <quote>such period</quote>;</text></clause><clause id="id803993D27AAF4EABA6EE71796BCFC4F1"><enum>(v)</enum><text>subsection (b)(1)(B) shall be applied as if <quote>(or a reduction in the amount expended under the State child health plan in the quarter for child health assistance or pregnancy-related assistance for purposes of section 2105 if the State has elected to apply this section to the State child health plan under title XXI)</quote> were inserted after <quote>1903(a)(1)</quote>; and</text></clause><clause id="id7F8525D39F0D4E7288C237F58399209B"><enum>(vi)</enum><text>paragraphs (2)(A)(i) and (3)(A)(ii) of subsection (c) shall each be applied as if <quote>(or, if the State has elected to apply this section to the State child health plan under title XXI, on or after the date this section first applies to the State)</quote> were inserted after <quote>December 31, 1990</quote> each place it appears.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0B01CE9FA92B4143A7CA726DB0C90417"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id11793DBC62FD45179B6AED43B1D616CF"><enum>(1)</enum><text>Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended—</text><subparagraph id="id2AF77FD22F6A4294A304115079FFF465"><enum>(A)</enum><text>by redesignating subparagraphs (D) through (S) as subparagraphs (E) through (T), respectively; and</text></subparagraph><subparagraph id="idB31F0F52B194408794DFB1D26F48B73D"><enum>(B)</enum><text>by inserting after subparagraph (C) the following new subparagraph:</text><quoted-block style="OLC" act-name="" id="idC323318B1291494EAB36BF786FABBCC6"><subparagraph id="idB94FB1657EF44EBF8BDD403E07182B87"><enum>(D)</enum><text>Section 1902(a)(54) (relating to compliance with the requirements of section 1927 but only if the State has elected to apply such requirements to the State child health plan under this title).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id33CCD5AE24554D4B8EF0933C1C29E60E"><enum>(2)</enum><text>Section 2110(a)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(a)(6)</external-xref>) is amended by inserting <quote>and, if the State has elected to apply the requirements of section 1927 to the State child health plan under this title, covered outpatient drugs, as defined in section 1927(k)(2),</quote> after <quote>Prescription drugs and biologicals</quote>.</text></paragraph></subsection></section></legis-body></bill>
