<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 252</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210204">February 4, 2021</action-date><action-desc><sponsor name-id="S259">Mr. Reed</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title VI of the Social Security Act to provide additional funding for States, Tribal governments, and local communities due to the Coronavirus Disease 2019 (COVID–19) public health emergency, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State &amp; Local Emergency Stabilization Fund Act of 2021</short-title></quote>.</text></section><section id="id7B8EB9631E104125A127FB75CDFCD2D9"><enum>2.</enum><header>Additional funding for coronavirus relief for States, Tribal governments, and local communities</header><text display-inline="no-display-inline">Title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref> et seq.) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idDB04F445DC6B43D69E22369F932C23F6"><section id="H84BA718D070E4287BC03F361F5EABC80"><enum>602.</enum><header>Additional funding for coronavirus relief for States, Tribal governments, and local communities</header><subsection id="HF70084214955401B91B89575FD450AB5"><enum>(a)</enum><header>Appropriation</header><paragraph id="H20051972E3074EABAF54CA2A705DC2B8"><enum>(1)</enum><header>In general</header><text>Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated for making payments under this section to States, Tribal governments, and local communities described in subsection (c)(6), $600,000,000,000 for fiscal year 2021. The amount appropriated under this paragraph and paid in accordance with this section shall be in addition to the amount appropriated under subsection (a) of section 601 and paid to States, Tribal governments, and units of local government under that section.</text></paragraph><paragraph id="H59A928A74C4B4745AAA09A305E23089E"><enum>(2)</enum><header>Reservation of funds</header><text>Of the amount appropriated under paragraph (1), the Secretary shall reserve—</text><subparagraph id="H821D6B76664D42AFB9C6DC46D206775E"><enum>(A)</enum><text>$3,000,000,000 of such amount for making payments to United States Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, and American Samoa under subsection (c)(7);</text></subparagraph><subparagraph id="H754921B31FC64A3D8E168BDA8820027E"><enum>(B)</enum><text>$10,000,000,000 of such amount for making payments to Tribal governments under subsection (c)(8); </text></subparagraph><subparagraph id="idC90A77C3B1434F34A2A7D40EF7F82122"><enum>(C)</enum><text>$59,000,000,000 of such amount for the portion of the payments made to the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico that is determined under subsection (c)(5); and</text></subparagraph><subparagraph id="id10FAD9E554E34DDBAAF2605B7FDF8AC7"><enum>(D)</enum><text>$205,000,000,000 of such amount for making payments to local communities under subsection (c)(6). </text></subparagraph></paragraph></subsection><subsection id="HD0DB6BF9896244EF96FAD38729D6D195"><enum>(b)</enum><header>Deadline for payments</header><text>The Secretary shall make the payments determined under subsection (c) not later than 15 days after the date of enactment of this section.</text></subsection><subsection id="HA5615495FFFE4198930A47D7619A748F"><enum>(c)</enum><header>Payment amounts</header><paragraph id="H28C56C92CFBF45DBB646ABF5C282FB94"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amount paid under this section for fiscal year 2021 to a State that is 1 of the 50 States, the District of Columbia, or the Commonwealth of Puerto Rico, shall be the sum of—</text><subparagraph id="HB27E843B02AD4825B7ECC6BFC006D801"><enum>(A)</enum><text>the relative population proportion amount determined for the State under paragraph (3) for such fiscal year; and</text></subparagraph><subparagraph id="H8C29554CE80C493F9FCF4C11E8A60F6C"><enum>(B)</enum><text>the relative coronavirus infection rate proportion amount determined for the State under paragraph (5) for such fiscal year.</text></subparagraph></paragraph><paragraph id="H8615B731E2DA419F8781A5B78592DA4B"><enum>(2)</enum><header>Minimum payment</header><subparagraph id="HE12C798C9C9845C99CA0A3686C38B7A8"><enum>(A)</enum><header>In general</header><text>No State that is 1 of the 50 States, the District of Columbia, or the Commonwealth of Puerto Rico, shall receive a payment under this section for fiscal year 2021 that is less than $5,000,000,000.</text></subparagraph><subparagraph id="H94AE0ED46F5C4EE5A20500F4F710CD99"><enum>(B)</enum><header>Pro rata adjustments</header><text>The Secretary shall adjust on a pro rata basis the amount of the payments for each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico, determined under this subsection without regard to this subparagraph to the extent necessary to comply with the requirements of subparagraph (A).</text></subparagraph></paragraph><paragraph id="H2AE23137E76948358DF4B5927B37CFED"><enum>(3)</enum><header>Relative population proportion amount</header><text>For purposes of paragraph (1)(A), the relative population proportion amount determined under this paragraph for a State for fiscal year 2021 is the product of—</text><subparagraph id="HDC2F5606A46046B18A288365E3647E22"><enum>(A)</enum><text>the amount appropriated under subsection (a)(1) for fiscal year 2021 that remains after the application of the reservations made under subsection (a)(2); and</text></subparagraph><subparagraph id="H65CCB4776DD84644B9691E7BCC7B2FDA"><enum>(B)</enum><text>the relative State population proportion (as defined in paragraph (4)) determined for such fiscal year.</text></subparagraph></paragraph><paragraph id="H1EA16B2BBB714314876DE716628F6994"><enum>(4)</enum><header>Relative State population proportion defined</header><text>For purposes of paragraph (3)(B), the term <term>relative State population proportion</term> means, with respect to each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico, the quotient of—</text><subparagraph id="HFDCBB2448E9441049277922245E6BB2E"><enum>(A)</enum><text>the population of the State, District of Columbia, or Commonwealth of Puerto Rico (as applicable); and</text></subparagraph><subparagraph id="H0048D2185B2F499787942B1E42483D87"><enum>(B)</enum><text>the sum of the populations of each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph id="H7BAC0FA2EE6448528F5D373B41DD9C42"><enum>(5)</enum><header>Relative coronavirus infection rate proportion amount</header><text>For purposes of paragraph (1)(B), the relative coronavirus infection rate proportion amount determined under this paragraph for each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico, for fiscal year 2021 is the product of—</text><subparagraph id="HDE02C6A0985A4D13A9869E3DDF22BFF2"><enum>(A)</enum><text>the amount reserved under subsection (a)(2)(C); and</text></subparagraph><subparagraph id="HF29DD234E1904AD0BEF1365B22C05F6A"><enum>(B)</enum><text>the quotient of—</text><clause id="HFDB4DF1759F04F929F3041B99F23FD4B"><enum>(i)</enum><text>the coronavirus infection rate determined for the State, District of Columbia, or Commonwealth of Puerto Rico (as applicable); and</text></clause><clause id="HC37B695939994976B8B4280BC64B6F69"><enum>(ii)</enum><text>the sum of the coronavirus infection rates determined for each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico. </text></clause></subparagraph></paragraph><paragraph id="idd2bb5d659f5145d5a4c7a14d0d78112d"><enum>(6)</enum><header>Payments to local communities</header><subparagraph id="id7DD03F49D999438085970EDA702CC1A7"><enum>(A)</enum><header>In general</header><text>From the amount reserved under subsection (a)(2)(D), the Secretary shall pay—</text><clause id="id19dce35e8d104880a52b341f8554df78"><enum>(i)</enum><text>70 percent of the amount so reserved directly to the metropolitan cities and urban counties (as those terms are defined in section 102 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302</external-xref>)) in the State that received allocations under section 106(b) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306(b)</external-xref>) for fiscal year 2020, pursuant to the same formula used to make such allocations under that section for such fiscal year; and</text></clause><clause id="id94fe164328904f3aacbd8a46abc60ba1"><enum>(ii)</enum><text>subject to subparagraph (C), 30 percent of the amount so reserved directly to each of the 50 States, to be distributed by such States upon receipt on a pass-through basis, and without requiring any application, to units of general local government in nonentitlement areas (as such terms are defined in such section 102) in such States, in amounts equal to the relative sum of the populations of such units of general local government in each such State as a proportion of the total population of all such units of general local government in all of the 50 States.</text></clause></subparagraph><subparagraph id="idA02FD8EF5CF641DDAC9A0F788A95AE6D"><enum>(B)</enum><header>Units of general local government in nonentitlement areas with overlapping populations or consolidated governments</header><text>If 2 or more units of general local government in nonentitlement areas have overlapping populations or have formed a consolidated government—</text><clause id="id8DDE5760D1174438908FAF2B12655F94"><enum>(i)</enum><text>the aggregate population of the overlapping units of general local government or the aggregate population of such consolidated government (as applicable) shall be the population used for purposes of determining the amount to be paid directly to a State under clause (ii) of subparagraph (A); and</text></clause><clause id="idE51A07AA6A6E4D59AF14A27DC5301432"><enum>(ii)</enum><text>the chief executive officer of the State shall distribute the portion of such payment that is based on such population among the units of general local government with such overlapping populations or that are part of such consolidated government, in amounts equal to the relative populations of such units of general local government as a proportion of such payment portion, unless—</text><subclause id="id3B843C1F4DD84DEFB11CDBD788A60684"><enum>(I)</enum><text>the units of general local government involved notify such chief executive officer of their agreement regarding how such payment portion is to be distributed among them, based on the aggregate population of such units of general local government, in which case such chief executive officer shall make distributions in accordance with that agreement; or</text></subclause><subclause id="idD753546F24C54DFA872B9A4C8811C39C"><enum>(II)</enum><text>in the case of a consolidated government, the consolidated government notifies such chief executive officer of a determination of the consolidated government regarding how such payment portion is to be distributed among the units of local government represented by the consolidated government, based on the aggregate population of such units of general local government, in which case such chief executive officer shall make distributions in accordance with that determination.</text></subclause></clause></subparagraph><subparagraph id="ide4dfd3b02dd34dacad9dad8bb2fb3036"><enum>(C)</enum><header>Treatment of states not acting as pass-through agents</header><text>In the case of a State that is 1 of the 50 States and that has not elected to distribute amounts allocated under section 106(d)(1) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306(d)(1)</external-xref>), the Secretary shall act in place of the State for purposes of determining the amount of, and distributing on a pass-through basis, and without requiring any application, payments to units of general local government in nonentitlement areas in that State under subparagraph (A)(ii). </text></subparagraph></paragraph><paragraph id="id7A4569037932490EBD34898F1D468E73"><enum>(7)</enum><header>Payments to territories</header><text>The amount paid under this section to the United States Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, or American Samoa, shall be the amount equal to the product of—</text><subparagraph id="id3662F3CE7A8E4A2790F1907F4C90271A"><enum>(A)</enum><text>the amount reserved under subsection (a)(2)(A); and</text></subparagraph><subparagraph id="idC87C524AACC24014BB9007669CB363E5"><enum>(B)</enum><text> each such territory's share of the combined total population of all such territories, as determined by the Secretary. </text></subparagraph></paragraph><paragraph id="id98D280F9FD3B440B8B4704845340FC7E"><enum>(8)</enum><header>Payments to tribal governments</header><text>The amounts paid under this section to Tribal governments from the amount reserved under subsection (a)(2)(B) shall be determined in the same manner as the amounts paid to Tribal governments under section 601(c)(7), except that in determining such amounts, the most recent number of enrolled Tribal members or other appropriate measure may be used. </text></paragraph><paragraph id="id2570AA68A48745708AE6447116C3BB5F"><enum>(9)</enum><header>Data</header><text>For purposes of determining—</text><subparagraph id="id26D71C8474E843949904B0CECFC954E5"><enum>(A)</enum><text>the population of each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, and units of general local government, the Secretary shall use the most recent year for which data are available from the Bureau of the Census; and</text></subparagraph><subparagraph id="id1B6203EEB6C549E1A0B35ECD3EC7AED4"><enum>(B)</enum><text>the relative coronavirus infection rate proportion amounts under paragraph (5), the Secretary shall use the most recent daily updated data on the number of COVID–19 cases published on the Internet by the Centers for Disease Control and Prevention. </text></subparagraph></paragraph></subsection><subsection id="idD820E0D8BA684363BEE99C3BE857E239"><enum>(d)</enum><header>Other provisions</header><paragraph id="idEC9AA0108D5D4282815582A8715546D3"><enum>(1)</enum><header>In general</header><text>The amounts paid under this section shall be subject to—</text><subparagraph id="id64878D39FD014242BD0C0ABF1A933B5E"><enum>(A)</enum><text>the use of funds and oversight requirements of subsections (d) and (f) of section 601 in the same manner as such requirements apply to the amounts paid under that section; and</text></subparagraph><subparagraph id="idB42F15F59C504E2BAA0C8BA7761A243C"><enum>(B)</enum><text>the definitions of each paragraph of section 601(g) other than paragraph (2) of that section.</text></subparagraph></paragraph><paragraph id="idA242C6C2596F4D8781DFD24AE32593DE"><enum>(2)</enum><header>IG funding authority</header><text>Notwithstanding section 601(f)(3), the Inspector General of the Department of the Treasury may use the amount appropriated under that section to carry out oversight and recoupment activities under this section in addition to the oversight and recoupment activities carried out under section 601(f).</text></paragraph><paragraph id="idD1E9425128794B319ED8F9289D87362F"><enum>(3)</enum><header>Nonapplication</header><text>Except as otherwise provided in this section, the requirements applicable to the amount appropriated for fiscal year 2020 under section 601(a)(1) (as added by section 5001 of <external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) shall not apply to the amount appropriated under subsection (a) of this section for such fiscal year.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id701EE5487F444B07AA8410B4F8DB12A4"><enum>3.</enum><header>Additional authority to use payments to make up revenue shortfalls</header><subsection id="idB801A99AF32E4945B5990866F3891D9B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (d) of section 601 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF02D60BBE237495EB4C85C1DC21A8C6D"><subsection id="id1C52DE5082C3437ABBE78E6D5FBA346B"><enum>(d)</enum><header>Use of funds</header><paragraph id="idB21E19B6C35B4F3DB80291A29C0E9618"><enum>(1)</enum><header>In general</header><text>A State, Tribal government, and unit of local government may use the funds provided under a payment made under this section for any expenditures during the period that begins on January 1, 2020, and ends on June 30, 2022—</text><subparagraph id="idB41A2764D3754191BF2C55D1088A8F44"><enum>(A)</enum><text>to prevent, prepare for, or respond to the public health emergency with respect to the Coronavirus Disease 2019 (COVID–19) or the declaration by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) of a major disaster or emergency with respect to COVID–19; or</text></subparagraph><subparagraph id="id96637F79ED4C40FFBEC1D411811F327F"><enum>(B)</enum><text>to provide services, benefits, or assistance, or support programs, projects, and operations, accounted for in the budget for the State, Tribal government, or unit of local government approved for any fiscal year occurring during the period that begins on January 1, 2020, and ends on June 30, 2022 (without regard to any relation to the Coronavirus Disease 2019 (COVID–19)).</text></subparagraph></paragraph><paragraph id="idEC8665E8ED4E40E991D0A3595D62D0DA"><enum>(2)</enum><header>Non-Federal funding</header><text>For the purpose of meeting the non-Federal share requirement of any Federal grant-in-aid program or other form of Federal assistance, including assistance provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.) and the Medicaid program established under title XIX, funds provided under a payment made under this section to a State, Tribal government, or unit of local government are deemed to be non-Federal funds.</text></paragraph><paragraph id="idC30FA56FD36B4073A44693C0BDF1C074" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Limitation</header><text>A State, Tribal government, or unit of local government may not use funds provided under a payment made under this section to provide any kind of tax cut, rebate, deduction, credit, or any other tax benefit, or to reduce or eliminate any fee imposed by the State, Tribal government, or unit of local government, during the period described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" commented="no" id="id1151F7B5F3804CAD9AA09E852EF6F0A9"><enum>(b)</enum><header>Effective date</header><text>The amendment made to subsection (d) of section 601 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref>) by subsection (a) shall take effect immediately upon the enactment of this Act and shall not be subject to any interpretation, guidance, rulemaking, or any other administrative action that limits, interferes with, delays, or impedes, or has the effect of limiting, interfering with, delaying, or impeding, the flexible spending authorities set forth in subsections (d)(1)(A) and (d)(1)(B) of section 601 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref>), as so amended.</text></subsection></section><section id="ida6985869d8cb41ebbb67a72b7854dc39"><enum>4.</enum><header>Emergency designation</header><subsection id="id310d60fe5c434d2783914e0357b8d833"><enum>(a)</enum><header>In general</header><text>The amounts provided under this Act and the amendments made by this Act are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subsection><subsection id="idecc573ebbac54291bbab174c911cca75"><enum>(b)</enum><header>Designation in senate</header><text>In the Senate, this Act is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018. </text></subsection></section></legis-body></bill>
