<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 251</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210204">February 4, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S399">Mr. Hawley</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, and <cosponsor name-id="S348">Mr. Paul</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that for purposes of determining compliance with title IX of the Education Amendments of 1972 in athletics, sex shall be recognized based solely on a person's reproductive biology and genetics at birth.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H07873CE2796F4729A22E28E7A479F73D"><section section-type="section-one" id="H6813E99E677E4EE2A64B3EC9A15AF009"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protection of Women and Girls in Sports Act of 2021</short-title></quote>.</text></section><section id="H4D827FF121104FD7AC093A3B2DC06F2A"><enum>2.</enum><header>Amendment</header><text display-inline="no-display-inline">Section 901 of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8887AC12F771434DA94EE13C4B28859D"><subsection id="H0AAA8316385349D2B7F53FE8C3185A22"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id33F7DB68EA0D44DA95A657739AE661AE"><enum>(1)</enum><text display-inline="yes-display-inline">It shall be a violation of subsection (a) for a recipient of Federal funds who operates, sponsors, or facilitates athletic programs or activities to permit a person whose sex is male to participate in an athletic program or activity that is designated for women or girls.</text></paragraph><paragraph id="id3E9BE48A37944F4782E6D1A61767E7F7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection, sex shall be recognized based solely on a person's reproductive biology and genetics at birth.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
