which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Defense to disclose testing and results of testing for perfluoroalkyl or polyfluoroalkyl substances and to provide additional requirements for testing for such substances, and for other purposes.</official-title></form><legis-body><section id="id0CCA05D05F034F2E84D063E703E950ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military PFAS Testing Disclosure Act</short-title></quote>.</text></section><section id="H3E3A96CD643C479AB1BAEAF0EEDC24EA"><enum>2.</enum><header>Public disclosure of testing and results of Department of Defense testing for perfluoroalkyl or polyfluoroalkyl substances and additional requirements for testing</header><subsection id="HFBF22CF2960F47808EE9E211C236E31E"><enum>(a)</enum><header>Public disclosure of PFAS testing results</header><text display-inline="yes-display-inline">Not later than 10 days after receipt of validated testing results, the Secretary of Defense shall publicly disclose the validated results of any testing for perfluoroalkyl or polyfluoroalkyl substances (commonly referred to as <quote>PFAS</quote>) conducted on or at areas surrounding military installations of the Department of Defense in the United States or facilities of the National Guard, as authorized under section 2707(e) of title 10, United States Code, including—</text><paragraph id="H21235D8ED4114C38A7A9B4E16C65E035"><enum>(1)</enum><text>the results of all such testing conducted by the Department; and</text></paragraph><paragraph id="H0432A1D62C144BD0AFDA97C25DCD1F5E"><enum>(2)</enum><text>the results of all such testing conducted by a non-Department entity (including any Federal agency or any public or private entity) under contract by or pursuant to an agreement with the Department.</text></paragraph></subsection><subsection id="H68085A2072B846438561C1863817AD72"><enum>(b)</enum><header>Public disclosure of planned PFAS testing</header><text>Not later than 60 days after the date of the enactment of the Act, and every 90 days thereafter, the Secretary of Defense shall disclose the expected timing and general location of any planned testing for perfluoroalkyl or polyfluoroalkyl substances conducted on or at areas surrounding military installations of the Department of Defense in the United States or facilities of the National Guard, as authorized under section 2707(e) of title 10, United States Code, including—</text><paragraph id="H459A3887491946B8814C11182959F1BA"><enum>(1)</enum><text>all such testing to be conducted by the Department; and</text></paragraph><paragraph id="HB7F0D5BE633A445E89F3C0BBC40C0623"><enum>(2)</enum><text>all such testing to be conducted by a non-Department entity (including any Federal agency and any public or private entity) under contract by or pursuant to an agreement with the Department.</text></paragraph></subsection><subsection id="HC26DDEED331D4875AD10FD3BA431C623"><enum>(c)</enum><header>Nature of disclosure</header><text>The Secretary of Defense may satisfy the disclosure requirements under subsections (a) and (b) by publishing the information, datasets, and results relating to the testing described in such subsections—</text><paragraph id="H52965ADD93E3400CB7481BBFF3267119"><enum>(1)</enum><text>on the publicly available website established under section 331(b) of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2701">10 U.S.C. 2701</external-xref> note);</text></paragraph><paragraph id="HD53C69CB7AB94256BB3E6EA63A5A3C6D"><enum>(2)</enum><text>on another publicly available website of the Department of Defense; or</text></paragraph><paragraph id="H1826FBBEA6E642E7B110EFCA80AAEB84"><enum>(3)</enum><text>in the Federal Register.</text></paragraph></subsection><subsection id="H5E504656DB0848A2A082B8421F3DC887"><enum>(d)</enum><header>Requirements of information To be disclosed</header><text>The information required to be disclosed by the Secretary of Defense under subsections (a) and (b) and published under subsection (c)—</text><paragraph id="HBDF14453F18A4A70BC84213F56B07396"><enum>(1)</enum><text>shall constitute a record for the purposes of chapters 21, 29, 31, and 33 of title 44, United States Code;</text></paragraph><paragraph id="H81949CEE92994790AB394D7E5A48AE7C"><enum>(2)</enum><text>shall include any underlying datasets or additional information of interest to the public, as determined by the Secretary; and</text></paragraph><paragraph id="id5D7FC0CC5845477E971041F8514BED90"><enum>(3)</enum><text>may exclude information as authorized by law.</text></paragraph></subsection><subsection id="H73DBF38842A04B9BB10CF66699EFE6BE"><enum>(e)</enum><header>Local notification</header><text>Prior to conducting any testing for perfluoroalkyl or polyfluoroalkyl substances, including any testing not previously planned and reported, the Secretary of Defense shall provide notice to—</text><paragraph id="HD7CFD0FD3E8548E5987BD0EF409A19C3"><enum>(1)</enum><text>the managers of the public water system serving the areas located immediately adjacent to the military installation where such testing is to occur;</text></paragraph><paragraph id="H37D6327DB4574EA59CEC0068EB1D09B0"><enum>(2)</enum><text>the municipal government serving the areas located immediately adjacent to the military installation where such testing is to occur; and</text></paragraph><paragraph id="HAAEDB26381734577A150DCDA51AF44FE"><enum>(3)</enum><text>all members of the Restoration Advisory Board for the military installation where such testing is to occur, as applicable.</text></paragraph></subsection><subsection id="HC2E3BCCACD424EBA85A42B603341EAF1"><enum>(f)</enum><header>Type of testing</header><text display-inline="yes-display-inline">When testing for perfluoroalkyl or polyfluoroalkyl substances, the Secretary of Defense shall test for all perfluoroalkyl or polyfluoroalkyl substances included in that method of measuring the amount of such substances in drinking water that has been validated by the Administrator of the Environmental Protection Agency.</text></subsection><subsection id="H04F475E0259B4C759117E6D8CFDF36AF"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFD7DD786E71746AA9AD1E6EB69905AAD"><enum>(1)</enum><text>The term <term>military installation</term> has the meaning given such term in section 2801(c)(4) of title 10, United States Code.</text></paragraph><paragraph id="H5D80ED48CBFC4DEBAE7BE255DD0545E4"><enum>(2)</enum><text>The term <term>perfluoroalkyl or polyfluoroalkyl substance</term> means any man-made chemical with at least one fully fluorinated carbon atom.</text></paragraph><paragraph id="id4daf8390e9b448e7b205e1912b5c1521"><enum>(3)</enum><text>The term <term>public water system</term> has the meaning given such term under section 1401(4) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f(4)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
