which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To lift the trade embargo on Cuba, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="ID934015F0B50942C6803FE7E343BD25E5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States-Cuba Trade Act of 2021</short-title></quote>.</text></section><section id="ID6D92712273C74D5EA0C0CDB3689CFAF8"><enum>2.</enum><header>Removal of provisions restricting trade and other relations with Cuba</header><subsection id="ID07C0E059B1524C63B6188FAD7B3B4E12"><enum>(a)</enum><header>Authority for embargo and sugar quota</header><paragraph id="idE70CA3734F3B4DCF8219BBEC3860A7BA"><enum>(1)</enum><header>In general</header><text>Section 620(a) of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2370">22 U.S.C. 2370(a)</external-xref>) is repealed.</text></paragraph><paragraph id="id11eaf949738b43da927879ed29600129"><enum>(2)</enum><header>Conforming amendment</header><text>Section 1610(f)(1)(A) of title 28, United States Code, is amended by striking <quote>section 620(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2370">22 U.S.C. 2370(a)</external-xref>),</quote>.</text></paragraph></subsection><subsection id="id80a5fcb2dc81439eab1b0ada6c7d49fb"><enum>(b)</enum><header>Trading with the Enemy Act</header><paragraph id="idb66d5ca1c5d44f14984705ce3b8aeed6"><enum>(1)</enum><header>In general</header><text>The authorities conferred upon the President by section 5(b) of the Trading With the Enemy Act (<external-xref legal-doc="usc" parsable-cite="usc/50/4305">50 U.S.C. 4305(b)</external-xref>), which were being exercised with respect to Cuba on July 1, 1977, as a result of a national emergency declared by the President before that date, and are being exercised on the day before the effective date of this Act, may not be exercised on or after such effective date with respect to Cuba.</text></paragraph><paragraph id="id6eebe69c3ed1467d9a994a29d2ec6c99"><enum>(2)</enum><header>Regulations</header><text>Any regulation in effect on the day before the effective date of this Act pursuant to the exercise of authorities described in paragraph (1) shall cease to be effective on such effective date.</text></paragraph></subsection><subsection id="IDA2C83149218443F682F3D248872BC9B5" commented="no"><enum>(c)</enum><header>Exercise of authorities under other provisions of law</header><paragraph id="ID1E1AB19BB6764E4196B11833C13165EC" commented="no"><enum>(1)</enum><header>Removal of prohibitions</header><text>Any prohibition on exports to Cuba that is in effect on the day before the effective date of this Act under the <act-name parsable-cite="EAA79">Export Administration Act of 1979</act-name> (<external-xref legal-doc="public-law" parsable-cite="pl/96/72">Public Law 96–72</external-xref>; 93 Stat. 503) or the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref> et seq.) shall cease to be effective on such effective date.</text></paragraph><paragraph id="ID8E8BA6A7FD4840B7ADCE268F09644072" commented="no"><enum>(2)</enum><header>Authority for new restrictions</header><text>The President may, on and after the effective date of this Act—</text><subparagraph id="ID46DED185FB91458CB13DF83295004F25" commented="no"><enum>(A)</enum><text>impose export controls with respect to Cuba under the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref> et seq.); and</text></subparagraph><subparagraph id="ID897B57027ACA4EBD8C674FA72B101BED" commented="no"><enum>(B)</enum><text>exercise the authorities the President has under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) with respect to Cuba pursuant to a declaration of national emergency required by that Act that is made on account of an unusual and extraordinary threat to the national security, foreign policy, or economy of the United States, that did not exist before the date of the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="ID420D5625C8E2452CB9FFFAF7B8564C7D"><enum>(d)</enum><header>Repeal of Cuban Democracy Act of 1992</header><text>The Cuban Democracy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/6001">22 U.S.C. 6001</external-xref> et seq.) is repealed.</text></subsection><subsection id="IDC0F5632703644557B1E3E1B4FCFE20F4"><enum>(e)</enum><header>Repeal of Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996</header><paragraph id="IDB4DFC97F1099415D874EECA140295BBD"><enum>(1)</enum><header>Repeal</header><text>The Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/22/6021">22 U.S.C. 6021</external-xref> et seq.) is repealed.</text></paragraph><paragraph id="ID7BC0423149A144A4AEB7ACF42B1BF445"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="id4162348db8774241b76b1757baaf2547"><enum>(A)</enum><header>Visa revocation</header><text>Section 428(c)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/236">6 U.S.C. 236(c)(2)</external-xref>) is amended—</text><clause id="idb7168412626f4ece80edbc50d2365ace"><enum>(i)</enum><text>by striking subparagraph (K); and</text></clause><clause id="id9ac5829b8c48464bbe52ebc1bf8c07a1"><enum>(ii)</enum><text>by redesignating subparagraphs (L) through (P) as subparagraphs (K) through (O), respectively.</text></clause></subparagraph><subparagraph id="ide676cc7f6b914e6bb0943b51c5debe20"><enum>(B)</enum><header>Effect of determination</header><text>Section 606 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is repealed.</text></subparagraph><subparagraph id="IDCB69A591A8A04D818D8FEA984F8B08F3"><enum>(C)</enum><header>Property immune from attachment</header><text>Section 1611 of title 28, United States Code, is amended by striking subsection (c).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4E5281DD8B4C4A6DB37E7E691CA3CCC3"><enum>(D)</enum><header>International claims</header><text>Sections 514 and 515 of the International Claims Settlement Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/22/1643l">22 U.S.C. 1643l</external-xref> and 1643m) are repealed.</text></subparagraph></paragraph></subsection><subsection id="idABE0430CA0494960A0787B5B1CABFD40"><enum>(f)</enum><header>Repeal of provisions imposing certain restrictions on assistance to former Soviet countries</header><paragraph id="idB88EAAFC15FA4738B6DC7D8EE308B81A"><enum>(1)</enum><header>In general</header><text>Section 498A of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2295a">22 U.S.C. 2295a</external-xref>) is amended—</text><subparagraph id="ID72FFB4F723BF4B97909CF061E67637B5"><enum>(A)</enum><text>in subsection (a)(11), by striking <quote>and intelligence facilities, including the military and intelligence facilities at Lourdes and Cienfuegos,</quote> and inserting <quote>facilities,</quote>;</text></subparagraph><subparagraph id="ID2580890A1C5549178459173148565187"><enum>(B)</enum><text>in subsection (b)—</text><clause id="ID936F2D554AFB46EE97EEF6F38417C8DE"><enum>(i)</enum><text>in paragraph (4), by inserting <quote>or</quote> after the semicolon;</text></clause><clause id="ID16735BC792524C15A54F92D13F78B87B"><enum>(ii)</enum><text>by striking paragraph (5); and</text></clause><clause id="ID00BC1F9C647D4EE78B109E3DB8555FD9"><enum>(iii)</enum><text>by redesignating paragraph (6) as paragraph (5); and</text></clause></subparagraph><subparagraph id="ID3818DEA25F82431C9B07E6F443CF86CE"><enum>(C)</enum><text>by striking subsection (d).</text></subparagraph></paragraph><paragraph id="ID6BDC51A113AB46D200961201B7CE2753"><enum>(2)</enum><header>Definitions</header><text>Section 498B(k) of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2295b">22 U.S.C. 2295b(k)</external-xref>) is amended by striking paragraphs (3) and (4).</text></paragraph></subsection><subsection id="IDBBAEFC17DC2848458026D6CFC21D58C9"><enum>(g)</enum><header>Trade Sanctions Reform and Export Enhancement Act of 2000</header><text>The Trade Sanctions Reform and Export Enhancement Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7201">22 U.S.C. 7201</external-xref> et seq.) is amended—</text><paragraph id="ida681df4a91404ae89f78808e1a55d58a"><enum>(1)</enum><text>in section 906(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/22/7205">22 U.S.C. 7205(a)(1)</external-xref>), by striking <quote>Cuba,</quote>;</text></paragraph><paragraph id="id10ecbc156f474ea2a6ab306e2bb195f5"><enum>(2)</enum><text>in section 908 (<external-xref legal-doc="usc" parsable-cite="usc/22/7207">22 U.S.C. 7207</external-xref>)—</text><subparagraph id="id5733cf7696db4cbbb6ec35e758295ebe"><enum>(A)</enum><text>by striking subsection (b);</text></subparagraph><subparagraph id="ID8AA0BEC2CB7D4B12008C076051690097"><enum>(B)</enum><text>in subsection (a)—</text><clause id="HF3C4079E1B6149EBBB83C6AD3306D7D0"><enum>(i)</enum><text>by striking <quote><header-in-text level="subsection">Prohibition</header-in-text></quote> and all that follows through <quote>(1) <header-in-text level="paragraph">In general.—</header-in-text>Notwithstanding</quote> and inserting <quote><header-in-text level="subsection">In general.—</header-in-text>Notwithstanding</quote>;</text></clause><clause id="ID1B674B83228349D483E880E09E47FB87"><enum>(ii)</enum><text>by striking <quote>for exports to Cuba or</quote>;</text></clause><clause id="ID7A27F3FFEFFA4E84B54FCBD3060091D4"><enum>(iii)</enum><text>by striking paragraph (2); and</text></clause><clause id="ideabb33ea66884b09a6c6138536df8270"><enum>(iv)</enum><text>by redesignating paragraph (3) as subsection (b) and by moving such subsection, as so redesignated, 2 ems to the left; and</text></clause></subparagraph><subparagraph id="HF2EE570E28E84FEDB456D18994B2EFD7"><enum>(C)</enum><text>in subsection (b), as redesignated by subparagraph (B)(iv), by striking <quote>paragraph (1)</quote> and inserting <quote>subsection (a)</quote>;</text></subparagraph></paragraph><paragraph id="idd98664cd814f46ab82fdaf904fa9e74b"><enum>(3)</enum><text>by striking section 909 (<external-xref legal-doc="usc" parsable-cite="usc/22/7208">22 U.S.C. 7208</external-xref>);</text></paragraph><paragraph id="ID4FC4C004213D4394B3A5DC783E901F9E"><enum>(4)</enum><text>by striking section 910 (<external-xref legal-doc="usc" parsable-cite="usc/22/7209">22 U.S.C. 7209</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD672A8E53F004D40B31B12444D1C807E"><enum>(5)</enum><text display-inline="yes-display-inline">by redesignating section 911 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–72) as section 909.</text></paragraph></subsection><subsection id="ID03C90201EE964A45B451CE9C7800D076"><enum>(h)</enum><header>Repeal of prohibition on transactions or payments with respect to certain United States intellectual property</header><text>Section 211 of the Department of Commerce and Related Agencies Appropriations Act, 1999 (as contained in section 101(b) of division A of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; 112 Stat. 2681–88) is repealed.</text></subsection><subsection id="ID6725E07008DF4E89AC973FD41E0074A9"><enum>(i)</enum><header>Sugar quota prohibition under Food Security Act of 1985</header><text>Subsection (c) of section 902 of the Food Security Act of 1985 (<external-xref legal-doc="public-law" parsable-cite="pl/99/198">Public Law 99–198</external-xref>; 99 Stat. 1444) is repealed.</text></subsection></section><section id="ID2F779E68C2E442E999C6963912CC2F64"><enum>3.</enum><header>Telecommunications equipment and facilities</header><text display-inline="no-display-inline">Any common carrier, as defined in section 3 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>), is authorized to install, maintain, and repair telecommunications equipment and facilities in Cuba, and otherwise provide telecommunications services between the United States and Cuba. The authority of this section includes the authority to upgrade facilities and equipment.</text></section><section id="ID203AE73E0AB04095A55EFFC699B5926E"><enum>4.</enum><header>Travel</header><subsection id="ID57E4388DFFBF4F58927C749FDB75D5E1"><enum>(a)</enum><header>In general</header><text>Travel to and from Cuba by individuals who are citizens or residents of the United States, and any transactions ordinarily incident to such travel, may not be regulated or prohibited if that travel would be lawful in the United States.</text></subsection><subsection id="ID4BF592694DDA459AA37E59EEE4AF7BB8"><enum>(b)</enum><header>Transactions incident To travel</header><text>Transactions ordinarily incident to travel that may not be regulated or prohibited under subsection (a) include the following:</text><paragraph id="ID902067BD003B4DB2ADF425F8F8F41F03"><enum>(1)</enum><text>Transactions ordinarily incident to travel or maintenance in Cuba.</text></paragraph><paragraph id="ID194A27603F1C4B1DB810D46C4339D006"><enum>(2)</enum><text>Normal banking transactions involving foreign currency drafts, traveler’s checks, or other negotiable instruments incident to that travel.</text></paragraph></subsection></section><section id="IDF82EBB4000354809ADDE84899895ECAF"><enum>5.</enum><header>Negotiations with Cuba</header><subsection id="IDF3EB6C4BBC434BFDAE01A700F803CB61"><enum>(a)</enum><header>Negotiations</header><text>The President should take all necessary steps to advance negotiations with the Government of Cuba—</text><paragraph id="IDABDF44B3F34647E5BD491F17B94B7C2E"><enum>(1)</enum><text>for the purpose of settling claims of nationals of the United States against the Government of Cuba for the taking of property by such government; and</text></paragraph><paragraph id="ID5AC0B0237C6B490B00E115A6C14E7180"><enum>(2)</enum><text>for the purpose of securing the protection of internationally recognized human rights.</text></paragraph></subsection><subsection id="ID7B4B88066D234CEA00C0A5F8D5F21799"><enum>(b)</enum><header>Definitions</header><text>In this section, the terms <term>national of the United States</term> and <term>property</term> have the meanings given those terms in section 502 of the International Claims Settlement Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/22/1643a">22 U.S.C. 1643a</external-xref>).</text></subsection></section><section id="ID0DA2AFF50F4A4D33954D00ABB32B86F0"><enum>6.</enum><header>Extension of nondiscriminatory trade treatment</header><subsection id="IDEF4BC8F417744268ABE5002F4748FE12"><enum>(a)</enum><header>Sense of Congress</header><paragraph id="IDD0D5013251344C2C9DFE2ED8D9EB53C6"><enum>(1)</enum><header>In general</header><text>It is the sense of the Congress that—</text><subparagraph id="ID9E4DE7D705004D6FB0AA1DC03875E475"><enum>(A)</enum><text>the United States should promote democratic change and economic reform by normalizing trade relations with Cuba; and</text></subparagraph><subparagraph id="ID5BF630A7867B4045A05FFBBC162739E9"><enum>(B)</enum><text>upon the enactment of this Act, it will no longer be necessary for the United States to continue to use article XXI of the GATT 1994 with respect to Cuba, understanding that the President retains full authority to invoke article XXI of the GATT 1994 and comparable provisions in other Uruguay Round Agreements in the future in all appropriate circumstances.</text></subparagraph></paragraph><paragraph id="ID7D1B70514A7241AFB5B12600E9236880"><enum>(2)</enum><header>Definitions</header><text>In this section, the terms <term>GATT 1994</term> and <term>Uruguay Round Agreements</term> have the meanings given those terms in section 2 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501</external-xref>).</text></paragraph></subsection><subsection id="ID6149FBC233BE47BDB77E3DFCDB30A409"><enum>(b)</enum><header>Extension of nondiscriminatory treatment to the products of Cuba</header><paragraph id="IDB13DA5129B3F4F71007B71BF11CA13EC"><enum>(1)</enum><header>Harmonized tariff schedule amendments</header><text>Subdivision (b) of general note 3 of the Harmonized Tariff Schedule of the United States is amended—</text><subparagraph id="IDE8794F26FDA24EEDB5E2FA627376D197"><enum>(A)</enum><text>by striking <quote>to section 401 of the Tariff Classification Act of 1962,</quote>; and</text></subparagraph><subparagraph id="ID1B09480A3F6242AABBAD263CE600A47B"><enum>(B)</enum><text>by striking <quote>Cuba</quote>.</text></subparagraph></paragraph><paragraph id="IDD7D668A6CC0344E5BF8C001B0799F476"><enum>(2)</enum><header>Repeal of Section 401 of the Tariff Classification Act of 1962</header><text>Section 401 of the Tariff Classification Act of 1962 (<external-xref legal-doc="public-law" parsable-cite="pl/87/456">Public Law 87–456</external-xref>; 76 Stat. 78) is repealed.</text></paragraph><paragraph id="ID0454D11F6BBA417C9900DECCB3A85B80"><enum>(3)</enum><header>Termination of application of title IV of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> to Cuba</header><subparagraph id="IDE3FFF0E2070A4D55ADBCC9C544445EB9"><enum>(A)</enum><header>Extension of nondiscriminatory treatment</header><text>Nondiscriminatory treatment (normal trade relations treatment) shall apply to the products of Cuba.</text></subparagraph><subparagraph id="ID0637B2D6171F41A296CC6E5215E899A0"><enum>(B)</enum><header>Termination of application of title IV</header><text>Title IV of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2431">19 U.S.C. 2431</external-xref> et seq.) shall cease to apply to Cuba.</text></subparagraph></paragraph><paragraph id="ID396503E8D45241D48DA55BC98757FB5F"><enum>(4)</enum><header>Effective date</header><text>This section, and the amendments made by this section, shall apply with respect to goods entered, or withdrawn from warehouse for consumption, on or after the 15th day after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="IDC8D8A6CFB4D045BB9E538969D7E337F3"><enum>(c)</enum><header>Report to Congress</header><text>The President shall submit to Congress, not later than 18 months after the date of the enactment of this Act, a report on trade relations between the United States and Cuba.</text></subsection></section><section id="ID802E5C18B5C1435DB98EC833712C4625"><enum>7.</enum><header>Prohibition on limiting annual remittances</header><subsection id="ID648413665CAB4F5A8B4C6B705278A083"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), the Secretary of the Treasury may not limit the amount of remittances to Cuba that may be made by any person who is subject to the jurisdiction of the United States, and the Secretary shall rescind all regulations in effect on the date of the enactment of this Act that so limit the amount of those remittances.</text></subsection><subsection id="ID1474A7110BDD47B984D1A2E2A0DCA700"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in subsection (a) may be construed to prohibit the prosecution or conviction of any person committing an offense described in section 1956 of title 18, United States Code (relating to the laundering of monetary instruments), or section 1957 of such title (relating to engaging in monetary transactions in property derived from specific unlawful activity).</text></subsection></section><section id="idBA2B6F243DBC4587847BBD1D46795497"><enum>8.</enum><header>Requirement to report to Congress prior to  denial of foreign tax credit with respect to certain
 foreign countries</header><subsection id="idD2B8F583C07047F1A145D0E5DBB48C8B"><enum>(a)</enum><header>In general</header><text>Subclause (II) of <external-xref legal-doc="usc" parsable-cite="usc/26/901">section 901(j)(2)(B)(i)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>such country becomes</quote> and inserting <quote>the date on which the President reports to Congress that such country has been determined to be</quote>.</text></subsection><subsection id="idF82DDEB7573748959048FBCC35A58D89"><enum>(b)</enum><header>Effective date</header><paragraph id="id4EB57F728D384B24BDB3C6EDB56CA47A"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendment made by this section shall apply to any determination regarding whether a foreign country is described in subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/26/901">section 901(j)(2)</external-xref> of the Internal Revenue Code of 1986 which is made after the date of the enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60096EFB57284D89BC58C5FD7950A550"><enum>(2)</enum><header>Non-application to countries subject to denial of foreign tax credit</header><text>Nothing in this section, or the amendment made by this section, shall be construed to alter, amend, or otherwise affect the application of subsection (j) of section 901 of such Code to any country which has been determined to be a country described in paragraph (2)(A) of such subsection on or before the date of the enactment of this Act.</text></paragraph></subsection></section><section id="IDEFCA8D92AED440869552D9670049A7C1"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided in sections 6 and 8, this Act and the amendments made by this Act shall take effect on the date that is 60 days after the date of the enactment of this Act.</text></section></legis-body></bill>
