<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 2490</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To establish the Blackwell School National Historic Site in Marfa, Texas, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blackwell School National Historic Site Act</short-title></quote>.</text></section><section id="ide8d0976ccc404c88aa415f442fcf931c" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idcfe7a59cc959486c8dd7d0fd6032d78b" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the Blackwell School, located at 501 South Abbott Street, in Marfa, Presidio County, Texas, is—</text><subparagraph id="id0A5FD963383D47C288AAFFE0737AF1D8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">associated with the period of racial segregation in Marfa public schools; and </text></subparagraph><subparagraph id="id4953C40CF5574990BE295BB9D94E1829" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the only extant property directly associated with Hispanic education in Marfa since the other buildings were torn down after the Blackwell School closed in 1965;</text></subparagraph></paragraph><paragraph id="id4bc92c4055d443d98718b211f9ee4ebf" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the Blackwell School is a tangible reminder of the period during which the doctrine of <quote>separate but equal</quote> dominated education and social systems;</text></paragraph><paragraph id="idBCDFCD65B76C4BB6A3CD605A7A134196" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">despite being categorized as <quote>white</quote> by Texas law, Mexican Americans were regularly excluded from commingling with Anglo individuals at barbershops, restaurants, funeral homes, theaters, churches, and schools;</text></paragraph><paragraph id="iddff0bff0ba914fd28cef9da408efabc3" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the spectrum of experiences of students and teachers at the Blackwell School are an important record of life in a segregated school in the context of the history of Texas and the United States;</text></paragraph><paragraph id="id69bd084201aa40b1a86450dea418d496" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Mexican and Mexican American culture and history in Marfa is tied to the Blackwell School, which for more than 50 years served as a leading feature of the Hispanic community, illustrating the challenge of maintaining cultural identity in a dominant Anglo society;</text></paragraph><paragraph id="idD423B682145942EBB78FDEC6C1D04814" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">Hispanic influences continue to be seen in social and religious organizations, business and government institutions, and shared experiences of language, food, and music in Marfa, Texas;</text></paragraph><paragraph id="id3a7d45219025498c86393d7103117fdf" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">the historic Blackwell School building is a physical record of—</text><subparagraph id="id4C0BF0FE4A2A478583AC566F0F9DF76B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the longevity and beauty of the distinctive design and craftsmanship informed by traditional techniques and materials; and </text></subparagraph><subparagraph id="id1958213F62CD482DB8066F45F674991B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the transition from the purely vernacular to the period of materials, design, and workmanship made available after the arrival of the railroad;</text></subparagraph></paragraph><paragraph id="idE8EE113CD089485DB1480A49A5946FA5" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">the original historic school building and grounds on which the Blackwell School building stands provide an authentic setting to commemorate and interpret the history of the Blackwell School;</text></paragraph><paragraph id="idf47d561e11d04189a67f5ca913687fe8" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">the Blackwell School is closely associated with the broad patterns of local, State, and national history in the area of school segregation; and</text></paragraph><paragraph id="idC7CA9592B7724902853CF70A4F724907" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">Mexicans and other members of the Latin American diaspora have placed a high value on education as a means of economic, social, and political advancement, but Hispanics and Latinos have not always had equitable opportunities and access to quality educational facilities in the United States.</text></paragraph></section><section id="idde52091bfdda4ad2b6c08db9fe89b99f" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0bbd230b6daa4a9a96214017cbdf55a0" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map entitled <quote>Blackwell School National Historic Site Proposed Boundary</quote>, numbered 593/178387, and dated February 2022.</text></paragraph><paragraph id="idc99ffc02ff9d48d9b4742f8d5843b2b1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">National historic site</header><text display-inline="yes-display-inline">The term <term>National Historic Site</term> means the Blackwell School National Historic Site established by section 4(a)(1).</text></paragraph><paragraph id="idf7684702c6b74839a3ebe79af3676ad2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></section><section id="id3258475dda644c1da06fe1a31d15ac79" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Establishment of the Blackwell School National Historic Site</header><subsection id="id5c45f68632b54ac6abe2db241e3b86fc" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph id="id5a93bd77132749d793a06b44a4960c46" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), there is established the Blackwell School National Historic Site in the State of Texas as a unit of the National Park System to preserve, protect, and interpret for the benefit of present and future generations the Blackwell School, including—</text><subparagraph id="id1E6A86893931477980D649157377E375" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the role of the Blackwell School as an academic and cultural cornerstone in Marfa, Texas; and </text></subparagraph><subparagraph id="id2446DF6F6F1F4C4999C440E8A6A626C6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the function of the Blackwell School within a segregated system of education in Texas and the United States from the period of 1885 through 1965.</text></subparagraph></paragraph><paragraph id="id1d3da599102c4bbe989c796e8211709f" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Determination by Secretary</header><text display-inline="yes-display-inline">The National Historic Site shall not be established until the date on which the Secretary determines that—</text><subparagraph id="ide146c99dfe624f99b08e55e3e0ffa54a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline"> a written agreement has been entered into by the Secretary with the Marfa Unified School District providing that the Blackwell School shall be donated to the United States or co-managed with the Secretary for inclusion in a national historic site to be managed consistently with the purposes of a national historic site; and</text></subparagraph><subparagraph id="id8a86aa0468cf4601a30511359d2dfb26" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline"> a sufficient quantity of land or an interest in land within the boundaries of the National Historic Site has been acquired to constitute a manageable unit.</text></subparagraph></paragraph></subsection><subsection id="idc24da3e7fc354c8cb9f3ec610643d20d" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Map</header><paragraph id="idB8FB2824B76A4DFF95D7E3735870B509" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Boundaries</header><text display-inline="yes-display-inline">The boundaries of the National Historic Site shall be the boundaries generally depicted on the map.</text></paragraph><paragraph id="ide50a1c4b0fa44246a8491e731357fd87" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Availability of map</header><text display-inline="yes-display-inline">The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></paragraph></subsection><subsection id="id9284537d301a4c24a651549d6d096e31" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Acquisition of authority</header><text display-inline="yes-display-inline">The Secretary may only acquire any land or interest in land located within the boundary of the National Historic Site by—</text><paragraph id="id205fda00dcda47ba87a0c6937e50d230" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">donation;</text></paragraph><paragraph id="id977599c8b7eb4d649a5f161ce29b2585" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">purchase with donated funds; or</text></paragraph><paragraph id="id77e983e33bfc41d9ac9c0c4da605dbef" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">exchange.</text></paragraph></subsection><subsection id="id9d0b5f2c97bc459282825765bda66153" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Administration</header><paragraph id="id035d5285ff1445849a3d6982bcffe603" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall administer the National Historic Site in accordance with—</text><subparagraph id="idae6c7b860ff24994bd245628ac45ce1a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">this Act; and</text></subparagraph><subparagraph id="id9076b1b8e7484f5285884848d02a1877" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the laws generally applicable to units of the National Park System.</text></subparagraph></paragraph><paragraph id="idde1aee2e61004dd78bfee31c09b4a7e9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Management plan</header><subparagraph id="idbb912b7bbfdc473ca4cfdc1fee291e2b" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which funds are first made available to the Secretary to prepare a general management plan for the National Historic Site, the Secretary shall prepare a general management plan for the National Historic Site in accordance with section 100502 of title 54, United States Code.</text></subparagraph><subparagraph id="id1d8018cccce74e23baa0f136bc03eea2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Submission</header><text display-inline="yes-display-inline">On completion of the general management plan under subparagraph (A), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives the general management plan prepared under that subparagraph.</text></subparagraph></paragraph></subsection><subsection id="id2a888b1ed619470089fb54e855ecda18" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Cooperative agreements</header><text display-inline="yes-display-inline">The Secretary shall enter into cooperative agreements with the Blackwell School Alliance and other local, regional, State, academic, and nonprofit partners for interpretive and educational programming, technical assistance, and rehabilitation relating to the National Historic Site.</text></subsection><subsection id="idced700d481964d90a95348010726526f" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Written consent of owner</header><text display-inline="yes-display-inline">No private property or non-Federal public property shall be included within the boundaries of the National Historic Site or managed as part of the National Historic Site without the written consent of the owner of the property. </text></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
