and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to expand the credit for expenditures to provide access to disabled individuals, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disabled Access Credit Expansion Act of 2021</short-title></quote>.</text></section><section id="idede66636c67641e4b5a103ebc2bbe87e"><enum>2.</enum><header>Expansion of credit for expenditures to provide access to disabled individuals</header><subsection id="id84C5F3F9EE80434F9F743F0D8421DAFC"><enum>(a)</enum><header>Increase in dollar limitation</header><paragraph id="id88863229FCD7401282341C09EBFC37EA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/44">section 44</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$10,250</quote> and inserting <quote>$20,500</quote>.</text></paragraph><paragraph id="id24296596729A418298B506519737CD08"><enum>(2)</enum><header>Inflation adjustment</header><text display-inline="yes-display-inline">Section 44 of such Code is amended by redesignating subsection (e) as subsection (f) and by inserting after subsection (d) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9A55098860424AC79176091B83ECC3D5"><subsection id="id28E2CEC572CF4883858E15C01441A10B"><enum>(e)</enum><header>Inflation adjustment</header><paragraph id="id88F2138B36F94AEDAB56A264A380E964"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any taxable year beginning after 2022, the $20,500 amount in subsection (a) shall be increased by an amount equal to—</text><subparagraph id="idEE30C24E82C94EB3ACDBC41732FA9A3F"><enum>(A)</enum><text display-inline="yes-display-inline">such dollar amount, multiplied by</text></subparagraph><subparagraph id="id0E13A60A46EB42AF9B771D2BBC92033C"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2021</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></subparagraph></paragraph><paragraph id="id2EEEB2DF90984A54B58D22C30F2A4D50"><enum>(2)</enum><header>Rounding</header><text display-inline="yes-display-inline">Any amount determined under paragraph (1) which is not a multiple of $50 shall be rounded to the next lowest multiple of $50.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2768532559894FC7B32E3EEFD7AB64BF"><enum>(b)</enum><header>Removal of expenditure floor</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/44">section 44</external-xref> of the Internal Revenue Code of 1986, as amended by subsection (a)(1), is further amended by striking <quote>exceed $250 but</quote>.</text></subsection><subsection id="idC26D633E2DA84B768E4312741B842154"><enum>(c)</enum><header>Increase in gross receipts limitation</header><text display-inline="yes-display-inline">Subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/26/44">section 44(b)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$1,000,000</quote> and inserting <quote>$2,500,000</quote>.</text></subsection><subsection id="id9F1F639F3C3141E18D86E8BF2504647A"><enum>(d)</enum><header>Eligible access expenditures</header><text>Subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/26/44">section 44(c)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>(including any digital, Internet, or telecommunications services provided by the business)</quote> after <quote>business</quote>.</text></subsection><subsection id="id5DE934B206894D01AEE9BC34F226DCA8"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after December 31, 2021.</text></subsection></section><section id="idF2B223E7F76149E1BDCD781B831A52A1"><enum>3.</enum><header>Alternative means of dispute resolution involving disability rights</header><subsection id="id58250DCE41B0421DBA13DF970F0C03AF"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="idb322dd1e68fa4e3088ae3c0e3fe0fc36"><enum>(1)</enum><text>Congress does not directly appropriate funds for the ADA Mediation Program of the Disability Rights Section of the Civil Rights Division of the Department of Justice.</text></paragraph><paragraph id="idac73616cbbed4e0f8f7989089785a612"><enum>(2)</enum><text>Voluntary mediation, under section 514 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12212">42 U.S.C. 12212</external-xref>), of disputes between individuals and entities covered by the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) requires specific expertise.</text></paragraph><paragraph id="idf77f17eb5b1f436798729fca8c835791"><enum>(3)</enum><text>Though over 7,000 cases have been referred to the ADA Mediation Program since its inception, with over 70 percent being successfully resolved, complainants have experienced slow response times and a lack of effective engagement with the program.</text></paragraph><paragraph id="id08e2be2fc1164bbb875fb03df4ce4f21"><enum>(4)</enum><text>There is little transparency, oversight, or accountability regarding the administration of the ADA Mediation Program, or the experience of mediators or parties participating in mediation. </text></paragraph><paragraph id="idaec8bfb6f61b4ae18275ea3f91ab24ca"><enum>(5)</enum><text>To best serve the disability community, and entities covered by that Act, the ADA Mediation Program should be able to use funds to increase personnel and provide training concerning the program.</text></paragraph></subsection><subsection id="id6C2D7D27A36B4F48AE388ACE5E4B4FF7"><enum>(b)</enum><header>ADA Mediation Program</header><paragraph id="id7EC53CA4B48B4A6BA926D46C55C33276"><enum>(1)</enum><header>In general</header><text>The Attorney General shall carry out an ADA Mediation Program (referred to in this section as the <quote>Program</quote>).</text></paragraph><paragraph id="id5F66E4ECAAE249BEA32E1311218A0692"><enum>(2)</enum><header>Duties and authorities</header><text>In carrying out the Program, the Attorney General—</text><subparagraph id="id68DB25CC0F504ABB8CC00BB7A92C1FDF"><enum>(A)</enum><text>shall facilitate voluntary mediation to resolve disputes arising under the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>);</text></subparagraph><subparagraph id="id7B4DD1CF259748CB86A99C24E66538E3"><enum>(B)</enum><text>may hire or enter into contracts with personnel for the Program, including increasing the number of such personnel beyond the number of individuals who provided services through the Program on the date of enactment of this section; and</text></subparagraph><subparagraph id="idE8C9DF45435E40B8A46205EFEDD0023E"><enum>(C)</enum><text>provide training for mediators who provide services through the Program.</text></subparagraph></paragraph><paragraph id="id570C6CCF7D0C4687A7AF645ED8BCB921"><enum>(3)</enum><header>Authorization of appropriations</header><subparagraph id="id2918BFB66B4A4A66864EEEC73A2BBDCD"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to the appropriations account of the Department of Justice appropriated under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Fees and Expenses of Witnesses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Legal Activities</header-in-text></quote>, to carry out this section, $1,000,000 (in addition to any other amounts appropriated to that account) for fiscal year 2022.</text></subparagraph><subparagraph id="id25479E9A3DD3424CB3C6D58BE16BC356"><enum>(B)</enum><header>Availability of funds</header><text>Funds appropriated under subparagraph (A) may be used to pay for obligations incurred through the Program prior to the date of enactment of this section.</text></subparagraph></paragraph></subsection><subsection id="idc278f5f52cef421382dd4c163a4e0540"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, and every 2 years thereafter, the Attorney General shall submit a report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives including information for the previous fiscal year regarding:</text><paragraph id="id9003c60d7eb3489f8ffaed389ab8efd7"><enum>(1)</enum><text>the minimum, maximum, and median time between the initial filing of complaints and contact with the ADA Mediation Program; </text></paragraph><paragraph id="ide4d8e5873138426aa8983102a4fa7f6c"><enum>(2)</enum><text>the minimum, maximum, and median time between the initial filing of complaints and the first date of mediation; </text></paragraph><paragraph id="ida907934097344338bc473dd1d5d04393"><enum>(3)</enum><text>the minimum, maximum, and median time required to resolve disputes from the initial filing of complaints; </text></paragraph><paragraph id="id92d638889bd248ce8ea40067c2a0039d"><enum>(4)</enum><text>the number of staff (full-time equivalents) dedicated to the program, including the number of mediators and caseworkers; </text></paragraph><paragraph id="id910ca2e9ee1343ee873053e2bb199901"><enum>(5)</enum><text>the caseload for mediators and caseworkers involved in carrying out the program;</text></paragraph><paragraph id="id93bb2110539640ea8746488ec9f32cc0"><enum>(6)</enum><text>the percentage of cases successfully resolved through mediation;</text></paragraph><paragraph id="idb69048e46e26489ea4a4ea076da44121"><enum>(7)</enum><text>the percentage of cases referred to investigation and litigation within the Department of Justice;</text></paragraph><paragraph id="id5ea8ce542888451583d13f2e4fafade9"><enum>(8)</enum><text>the percentage of cases referred to other Federal agencies (and which agencies);</text></paragraph><paragraph id="id62115ceb88a34e9f89d8f42fde5f7619"><enum>(9)</enum><text>trends in the nature of complaints and resolutions;</text></paragraph><paragraph id="ida671fb4be87642178ee366fbaaca60af"><enum>(10)</enum><text>whether there were repeated or numerous complaints against a single or specific entity or institution, and whether those cases were investigated or litigated; </text></paragraph><paragraph id="id3b40c8ee8b924f76afcd942fd5dddb05"><enum>(11)</enum><text>the number of complaints directed at the program, such as lack of accommodation or lack of responsiveness and engagement; and </text></paragraph><paragraph id="id664c7559289e4dd39b3ff9388367bf86"><enum>(12)</enum><text>other information deemed relevant by the Attorney General. </text></paragraph></subsection></section><section id="id860AC7DDD3624A9E8E4F01B480B4978C"><enum>4.</enum><header>ADA Information Line data collection report</header><subsection id="id8624574998004A78B7A48D039646E14A"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="id2FACA0952EB54A019384168531319249"><enum>(1)</enum><text>The ADA Information Line receives hundreds of calls per week, and does not typically collect data about the kinds of calls it receives.</text></paragraph><paragraph id="idF3E94DBBA054427E85B963BDFB4644E8"><enum>(2)</enum><text>The ADA Information Line takes calls from a variety of individuals and entities interested in the Americans with Disabilities Act of 1990, including—</text><subparagraph id="id6457DCA2757E48BD87A156463F231599"><enum>(A)</enum><text>employers covered by such Act;</text></subparagraph><subparagraph id="idF1FE243B94D64436BFFCCF6AE7603783"><enum>(B)</enum><text>architects and others who work with such employers;</text></subparagraph><subparagraph id="id4F6751EEC2F04157AB803EE35CB4E4F3"><enum>(C)</enum><text>public entities, such as schools and public service providers;</text></subparagraph><subparagraph id="id1DF6B588B51F400A9560C87F28D35536"><enum>(D)</enum><text>individuals with disabilities; and</text></subparagraph><subparagraph id="idDB58014F220B48028E648EC5B6218833"><enum>(E)</enum><text>entities that provide public accommodations.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD2E21E42A0F4FCDB208CF9D8F5C3EE9"><enum>(3)</enum><text>ADA.gov provides many resources to individuals and entities, public or private, looking for information on such Act.</text></paragraph></subsection><subsection id="id656AC22F01A9419BA65849A0FD38D8D4"><enum>(b)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" id="id1CA39F72C8DA4566BC52AD7AD984758E"><enum>(1)</enum><text>the term <term>ADA Information Line</term> means the toll-free line operated by the Attorney General to provide information and materials to the public about the requirements of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), including regulations issued under the Act and technical assistance in accordance with section 507 of the Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12206">42 U.S.C. 12206</external-xref>); and</text></paragraph><paragraph id="idD886140057514BF6BA6D3FE650290565"><enum>(2)</enum><text>the term <term>disability</term>, with respect to an individual, has the meaning given such term in section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph></subsection><subsection id="id5C4FB728A1D24833BC1110321354728B"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Attorney General shall submit a report to each committee of Congress—</text><paragraph id="idEB13E6B0D57842E1A4683D35BB3807D6"><enum>(1)</enum><text>outlining the kinds of calls the ADA Information Line receives;</text></paragraph><paragraph id="idD7DC3112775943199C72E13341F4719B"><enum>(2)</enum><text>detailing the efforts of the Department of Justice to educate individuals and entities about the existence of the ADA Information Line; and</text></paragraph><paragraph id="id315D7966753245EEA077EFB75D188B7A"><enum>(3)</enum><text>providing recommendations on improvements that can be made to provide additional support to individuals with disabilities, and entities covered by the Americans with Disabilities Act of 1990, seeking information on such Act.</text></paragraph></subsection></section></legis-body></bill>
