which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow for use of grants funds in order to promote safety in tourist areas located in the United States, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tourism District Protection Act</short-title></quote>.</text></section><section id="id568CE62433FD418790873FECC7085D54"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Attorney General of the United States should provide whatever assistance possible within the authority of the Department of Justice to help combat crime in areas of the United States that are dependent economically on tourism. </text></section><section id="id2039FF0F843444FEAA0A3E22C087CC09"><enum>3.</enum><header>Use of grant funds</header><subsection id="id2103E18D62C04D77AA06A3C157AD7E88"><enum>(a)</enum><header>Priority of COPS grants</header><text display-inline="yes-display-inline">Section 1701(c) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381(c)</external-xref>) is amended—</text><paragraph id="id3279D01173DD496AB8E3D88CF541BAED"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(C), by striking <quote>or</quote> at the end; </text></paragraph><paragraph id="id687A2990E086493EADC44A802F632BF9"><enum>(2)</enum><text>in paragraph (3)(B), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="idC3F8EF570A514A95B76F43FF347BF32F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC020170CD10248298AEB886B1BA952A4"><paragraph id="idC41C6F7CAE8745C78F1D4F64345AC2DF"><enum>(4)</enum><text>from an applicant in a State that provides evidence to the Attorney General that crime is increasing in tourist areas within the jurisdiction of the applicant and that the grant amounts will be used by the application for permissible purposes that will reduce crime in tourist areas.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id65DE0D67FCEA4FF2888CC7C632C8068C"><enum>(b)</enum><header>Expanded eligibility for Federal Emergency Law Enforcement Assistance program</header><text>Section 609N of the Justice Assistance Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/50102">34 U.S.C. 50102(3)</external-xref>) is amended by inserting before <quote>except that</quote> the following: <quote>including a significant increase in crime, which threatens to become serious and for which the State and local resources are inadequate to protect the lives and property of citizens or enforce the law, in tourist areas,</quote>. </text></subsection><subsection id="idC51BB28E323847E69E89F30EA73E526D"><enum>(c)</enum><header>Use of Byrne JAG grant funds</header><text>Section 506(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10157">34 U.S.C. 10157(b)</external-xref>) is amended—</text><paragraph id="id06BC09015988436DBBA469671AADC460"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>may reserve</quote> and inserting <quote>shall reserve</quote>;</text></paragraph><paragraph id="id85A56E8094B343F791623436F843C3BE"><enum>(2)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end; </text></paragraph><paragraph id="id2321A5B71ECB4D5A8599E7AE77EC8C62"><enum>(3)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="idD92B0E53A47143A6A426381BD3E38553"><enum>(4)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69FBD2C7DB2C45709AC4E7A617544982"><paragraph id="id2A533E5F94434625ACC267E07AC040F8"><enum>(2)</enum><text>to combat, address, or otherwise respond to significant increases in crime in tourist areas; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1A0262188C0046CCA5C60F071BA5BBC9"><enum>(d)</enum><header>Limitation on supplanting of State and local funds</header><text>Amounts made available to a State or unit of local government under this Act or an amendment made by this Act may not—</text><paragraph id="idB6F9C21A10DD42DA8F05F2063232500E"><enum>(1)</enum><text>supplant State or local funds designated for use in combatting crime in areas of the State, county, or city; or</text></paragraph><paragraph id="idD8F9FF64C6DB48899AC8553CD2030A79"><enum>(2)</enum><text>be used for the costs of activities incurred before the date of enactment of this Act. </text></paragraph></subsection><subsection id="id0F85B71F17604DC89677C4627FAAE90A"><enum>(e)</enum><header>Limitation on use of funds</header><text>None of the amounts made available under this Act or an amendment made by this Act may be used to purchase technology or equipment prohibited by the State and local laws governing the grant recipient. </text></subsection><subsection id="idAAAF243D6E484282AA252376BE3A9458"><enum>(f)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Attorney General shall promulgate rules establishing the criteria for an entity to qualify for the assistance authorized by this Act and the amendments made by this Act. </text></subsection></section></legis-body></bill>
