referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to divert certain parents of minor children, expectant parents, and other caregivers from incarceration and into comprehensive programs providing resources, services, and training to those individuals and their families.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Finding Alternatives to Mass Incarceration: Lives Improved by Ending Separation Act of 2021</short-title></quote> or the <quote><short-title>FAMILIES Act</short-title></quote>.</text></section><section id="id0E4A6668C94144D8B2F47E1A0A7B9236"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to divert parents of minor children, expectant parents, and other caregivers from incarceration if those individuals, and society, would be better served by the individuals entering into a comprehensive community supervision program that would provide resources, services, and training to them and their families.</text></section><section id="id6FCCB72B62304774B64FACE20B2F7869"><enum>3.</enum><header>FAMILIES diversion program</header><subsection id="id3D9C5503BE294C2A9244732BD345C1F7"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">Chapter 227</external-xref> of title 18, United States Code, is amended—</text><paragraph id="id25F96D5F94FA4726A26FDC475678A397"><enum>(1)</enum><text>in subchapter A—</text><subparagraph id="id92D4BD51919B4D1888C1B8147966B3A2"><enum>(A)</enum><text>in section 3551—</text><clause id="id103A4BD9FE9E4D1F9A0E14B1BC80C4E4"><enum>(i)</enum><text>in subsection (b)—</text><subclause id="idB3663DC977C84435AF6BF7B5978A45AD"><enum>(I)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></subclause><subclause id="id0211AB2259934DE193D0C280988ED698"><enum>(II)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; or</quote>;</text></subclause><subclause id="id7086A66ADF06433BBCBB4E5EA379CC99"><enum>(III)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4AB1DA33FFE84719B528BF183FDDAADD"><paragraph id="id1753C162CF1D4B65826EDF95F800EFB6"><enum>(4)</enum><text>participation in the FAMILIES Program as authorized by subchapter E, as a condition of a term of supervised release imposed under section 3583</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="id47F6B03DDC744E27AFFA97D219AB1313"><enum>(IV)</enum><text>in the undesignated matter following paragraph (4), as so added—</text><item id="idE127F98982CD4C1CA8E1FA598F776254"><enum>(aa)</enum><text>by striking <quote>A sentence</quote> and inserting <quote>Subject to subsection (d), a sentence</quote>; and</text></item><item id="idCA285EFFB09045FD8676872355FBEE47"><enum>(bb)</enum><text>by striking <quote>A sanction</quote> and inserting <quote>Subjection to subsection (d), a sanction</quote>; and</text></item></subclause></clause><clause id="id32234D653C2B4F0C85E269D282CCE9FE"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEF9A7333086D44B9974C957CD6A08E78"><subsection id="id5F462CF80C894424AF8BD1496A0FE9A9"><enum>(d)</enum><header>Imposition of fines and sanctions in addition to participation in FAMILIES Program</header><paragraph id="id99FD4E499330456C8EE8923257D26DC2"><enum>(1)</enum><header>In general</header><text>If the court sentences an individual to participation in the FAMILIES Program under subchapter E, the court may not impose a sentence to pay a fine, or impose a sanction under section 3554 (relating to criminal forfeiture), 3555 (relating to notice to victims), or 3556 (relating to restitution), unless the court considers the factors under paragraph (2) of this subsection.</text></paragraph><paragraph id="idB9607D0AF0E44A2F86F82850D617DD69"><enum>(2)</enum><header>Considerations</header><text>Before imposing a sentence to pay a fine, or imposing a sanction under section 3554, 3555, or 3556, on an individual described in paragraph (1) of this subsection, the court shall—</text><subparagraph id="id429F1978924A4C7EA089FE77562E7FC9"><enum>(A)</enum><text>weigh the importance of the fine or sanction against—</text><clause id="idE288C66163EC436993703D55418D451E"><enum>(i)</enum><text>the ability of the individual to afford the fine, forfeiture, cost of giving notice, or restitution, as applicable; and</text></clause><clause id="id069EE3A32D094F6F97C56E788B5B6E67"><enum>(ii)</enum><text>the impact of the fine or sanction on the ability of the individual to succeed in the FAMILIES Program; and</text></clause></subparagraph><subparagraph id="idEE489B70C03741C0BD12F26F9523FFD3"><enum>(B)</enum><text>take all necessary steps to ensure that the success of the individual in the FAMILIES Program is not hindered by financial obstacles.</text></subparagraph></paragraph><paragraph id="idD5EA5459941D4621A86DD6F8C5851BE7"><enum>(3)</enum><header>No mandatory restitution</header><text>Notwithstanding section 3663A, an order of restitution under that section with respect to an individual described in paragraph (1) of this subsection shall be at the discretion of the court and shall be subject to the requirements of this subsection.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id6FA6CEEE3545489F8869B08DAE7D132B"><enum>(B)</enum><text>in section 3553—</text><clause id="id31CBE9EFC5B8479896FE9E38C8FA8C09"><enum>(i)</enum><text>by redesignating subsections (b) through (g) as subsections (c) through (h), respectively;</text></clause><clause id="idFFA60B359D62488F8A91885D535CAE41"><enum>(ii)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id032B83F6B3484DF7BA418796B669A3D8"><subsection commented="no" id="idAE958E0B94D341CC9011B59D949FAC55"><enum>(b)</enum><header>Consideration of diversion to FAMILIES Program</header><paragraph commented="no" id="id0F077832773E40D19B5F43CA02BE86E0"><enum>(1)</enum><header>Determination</header><text>Notwithstanding any other provision of this section, other than subsection (c), and notwithstanding any minimum term of imprisonment required to be imposed under any other provision of law, in the case of a defendant who is an eligible individual (as defined in section 3590), the court shall determine, in accordance with paragraph (2), whether the defendant, and society, would be best served by diverting the defendant into the FAMILIES Program under subchapter E instead of sentencing the defendant to a term of probation under subchapter B or a term of imprisonment under subchapter D.</text></paragraph><paragraph commented="no" id="idE88B694BF5224234822C7BD335E55ECF"><enum>(2)</enum><header>Factors</header><subparagraph commented="no" id="id6C77C9649EF0404F92D28FFF66465A0F"><enum>(A)</enum><header>In general</header><text>In making the determination under paragraph (1), the court shall consider, in addition to other factors the court determines relevant—</text><clause id="id1d64f36dac5149dc80907d7f6f381348"><enum>(i)</enum><text>whether the defendant has significant caregiver responsibilities, including significant expected parental responsibilities in the case of an individual who is pregnant or the spouse or dating partner of such an individual;</text></clause><clause id="id467C5B7524784030B67EF4D60F32EB3B"><enum>(ii)</enum><text>whether the defendant has significant caregiving responsibilities with respect to an adult dependent;</text></clause><clause id="idac1cf896fb744804a667b0402c4b01bf"><enum>(iii)</enum><text>whether the defendant poses no apparent risk of harm to any identifiable child with respect to whom the defendant has significant parental responsibilities;</text></clause><clause id="idEEA86E2403B749A7AD4DDEA8714FE97E"><enum>(iv)</enum><text>whether the defendant poses no apparent risk of harm to any identifiable adult dependent with respect to whom the defendant has significant caregiving responsibilities;</text></clause><clause id="id2AD7E261967A48ECA9C37DF2EF7CA6FF"><enum>(v)</enum><text>a statement, if available, regarding the impact that a sentence of probation or imprisonment would have on the family of the defendant;</text></clause><clause id="idfc00f077625d436289b85b0b217d5ebb"><enum>(vi)</enum><text>the nature of the offense as it relates to the future rehabilitation of the defendant;</text></clause><clause id="id8dca04949cba4084994b8598c7556fdc"><enum>(vii)</enum><text>the defendant's ties to the community;</text></clause><clause id="id0cdc0b1ce1e642a38b06ea72fd1d17a8"><enum>(viii)</enum><text>a statement from the victim regarding the impact of the offense on the victim; and</text></clause><clause id="idf649cd66414c4444b469bf4416bb0aca"><enum>(ix)</enum><text>any prior criminal history of the defendant.</text></clause></subparagraph><subparagraph id="id592CFA8EBCB94781B8134C8E960638F9"><enum>(B)</enum><header>Rule of construction</header><text>The court shall not be required to find that each factor described in subparagraph (A) weighs in favor of the participation of the defendant in the FAMILIES Program in order to determine that the defendant, and society, would be best served by diverting the defendant into the FAMILIES Program.</text></subparagraph></paragraph><paragraph id="id6001862EFD494C79B92F502E3B6A20C0"><enum>(3)</enum><header>Findings of fact</header><text>At the time of sentencing a defendant who is an eligible individual (as defined in section 3590), the court, in stating in open court the reasons for its imposition of the particular sentence under subsection (c), shall include its determination under paragraph (1) of this subsection as to whether the defendant, and society, would be best served by diverting the defendant into the FAMILIES Program under subchapter E, including findings of fact supporting that determination.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id0CC76A5ECB284ECEA655469690852951"><enum>(iii)</enum><text>in subsection (c), as so redesignated, by striking <quote>or (c)</quote> and inserting <quote>or (d)</quote>;</text></clause><clause id="id522F3D939C7B45EF8AAA96A9CDC94CE7"><enum>(iv)</enum><text>in subsection (d), as so redesignated, by striking <quote>or (b)</quote> and inserting <quote>or (c)</quote>; and</text></clause><clause id="idC5660F73D6354CA9AA76378ABC602F8D"><enum>(v)</enum><text>in subsection (e)(3), as so redesignated, by striking <quote>subsection (c)</quote> and inserting <quote>subsection (d)</quote>; </text></clause></subparagraph></paragraph><paragraph id="id843CA7AEDD1C4617AB83D86D45639F87"><enum>(2)</enum><text>in subchapter (D), in section 3583(a)—</text><subparagraph id="id1B89056AE9C94575AB7189C30871D27B"><enum>(A)</enum><text>by inserting <quote>or a sentence of participation in the FAMILIES Program under subchapter E</quote> after <quote>term of imprisonment</quote>; and </text></subparagraph><subparagraph id="idBAEB5A45771F43D7B8265DDACBC962C0"><enum>(B)</enum><text>by inserting <quote>or as a requirement of participation in the FAMILIES Program, as the case may be,</quote> after <quote>after imprisonment</quote>; and </text></subparagraph></paragraph><paragraph id="idFF845937C7A9433EB8BE5AED45D5A73C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id986CD2CA7B9840EA9B5EAD0C274A3591"><subchapter id="id262545B8C8B94F57A6B5ADF5E3EA46A8" style="OLC"><enum>E</enum><header>FAMILIES Program</header><section id="id1F07BAA5BCC442F2BFAD398E1E4ED263"><enum>3590.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter—</text><paragraph id="id01A38955D5184B5794E540232FF62B42"><enum>(1)</enum><text>the term <term>child abuse and neglect</term> has the meaning given the term in section 3 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/93/247">Public Law 93–247</external-xref>);</text></paragraph><paragraph id="idEDFBDF8F610A44ED8A3B5EE12A19BB6E"><enum>(2)</enum><text>the term <term>dating partner</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>); </text></paragraph><paragraph id="idF0A45DE900694992ACFE2ACCE1CD9CAA"><enum>(3)</enum><text>the term <term>domestic violence</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>);</text></paragraph><paragraph id="id466FDE9AA4AA45F5A1524B7572BEA628"><enum>(4)</enum><text>the term <term>electronic means</term> includes telephone, teleconference, and videoconference;</text></paragraph><paragraph id="id38AD4016F912478688F4D1C4F178F8F9"><enum>(5)</enum><text>the term <term>eligible individual</term> means an individual who is—</text><subparagraph id="idE564B5342A2B41E9A79B2316C048BE4F"><enum>(A)</enum><text>a parent of a minor child;</text></subparagraph><subparagraph id="id2979B83DB6C64F4CA6863933A69F4E08"><enum>(B)</enum><text>pregnant;</text></subparagraph><subparagraph id="id73b52d865bd74538b05894eed5434b82"><enum>(C)</enum><text>a caregiver for a minor child or other minor relative;</text></subparagraph><subparagraph id="id254fc48c8ee7466a8992e2c03b850b9a"><enum>(D)</enum><text>a caregiver for an individual with disabilities;</text></subparagraph><subparagraph id="id05640160cd6848129fde68657e1a8533"><enum>(E)</enum><text>a caregiver for an elderly family member; or </text></subparagraph><subparagraph id="idB0F39FD28C8D4D57A7A395B1D2DF9CC9"><enum>(F)</enum><text>the spouse or dating partner of an individual who is—</text><clause id="id9F8520F8BB0544C6853F21536D98B7B1"><enum>(i)</enum><text>a parent of a minor child; or</text></clause><clause id="idA6F2D6C378524F99859E785A457C1273"><enum>(ii)</enum><text>pregnant;</text></clause></subparagraph></paragraph><paragraph id="id7182FD2AF1BC42BEB25971DDFDBDBB73"><enum>(6)</enum><text>the term <term>FAMILIES Program</term> means the program established under section 3590B;</text></paragraph><paragraph id="idADB0649CD2234BCF8E5BB9652C4E4FF9"><enum>(7)</enum><text>the term <term>minor</term>, with respect to an individual, means the individual is under the age of 18;</text></paragraph><paragraph id="idB739F6548ACC47D0AF28466B642D11C5"><enum>(8)</enum><text>the term <term>Office</term> means the Office of Probation and Pretrial Services of the Administrative Office of the United States Courts;</text></paragraph><paragraph id="idDB62856BAFCC489D8DF00570FD9F9B35"><enum>(9)</enum><text>the term <term>participant</term> means an eligible individual who is participating in the FAMILIES Program;</text></paragraph><paragraph id="idB800A21B3020419BB78A0C4CEDAA1804"><enum>(10)</enum><text>the term <term>Secretary</term> means the Secretary of Health and Human Services; and</text></paragraph><paragraph id="id4787F956BB7C4526B0AC7029A589ED6E"><enum>(11)</enum><text>the term <term>trauma-informed decision making</term> means decision making—</text><subparagraph id="id7AABC3FE2C244117837946EB5D47E42B"><enum>(A)</enum><text>informed by an organizational structure and treatment framework that involves understanding, recognizing, and responding to the effects of all types of trauma; and</text></subparagraph><subparagraph id="id80EB5594CDBC446B90A00D68FEAC4C4C"><enum>(B)</enum><text>in accordance with recognized principles of a trauma-informed approach and trauma-specific interventions to address the consequences of trauma and facilitate healing.</text></subparagraph></paragraph></section><section id="idB25F7EF298F84837B07AC1950DA65B66"><enum>3590A.</enum><header>Sentencing</header><subsection id="idDCCA43EADEE14FBB903E2A6D90F4653F"><enum>(a)</enum><header>Imposition of sentence</header><text>If an eligible individual is found guilty of an offense and the court makes an affirmative determination under section 3553(b)(1), the court shall impose a sentence for the offense that includes participation in the FAMILIES Program instead of a term of probation under subchapter B or a term of imprisonment under subchapter D.</text></subsection><subsection id="id3617b796e25d4ab2918fac3a134a45c2"><enum>(b)</enum><header>Consideration of special FAMILIES Program and expungement procedures</header><text>In imposing a sentence under subsection (a), the court shall consider whether to utilize the procedures under section 3590D in light of the personal history of the defendant and whether a record of the arrest, criminal proceedings, or conviction for the offense and the associated collateral consequences would harm the defendant and the ability of the defendant to perform caregiving duties.</text></subsection><subsection id="id718A20A7D35A4823AF1909BDA2B87228"><enum>(c)</enum><header>Identifying programs and services</header><paragraph id="idDFB236C5205343C48F489E6C673BFEBC"><enum>(1)</enum><header>In general</header><text>In imposing a sentence under subsection (a), the court, in collaboration with the Office and the Secretary, shall identify the programs and services that the defendant shall be required to complete in order to successfully complete the FAMILIES Program.</text></paragraph><paragraph id="id24AD467EDA6A4E51BE9DE618087C2861"><enum>(2)</enum><header>User fees and other costs</header><subparagraph id="idE4CCB13A6AA140A0BE25CB9277153213"><enum>(A)</enum><header>In general</header><text>In identifying the programs and services that a defendant shall be required to complete under the Families Program, the court may not impose on the defendant any user fee or other cost relating to those programs and services unless the court considers the factors under subparagraph (B).</text></subparagraph><subparagraph id="idC95742C6310D4DB1A744ECAECFA32CF2"><enum>(B)</enum><header>Considerations</header><text>Before imposing any user fee or other cost relating to programs and services under the Families Program on a defendant, the court shall—</text><clause id="idE649D89DC58445D79C17040794D25DFC"><enum>(i)</enum><text>weigh the importance of the fee or other cost against—</text><subclause id="id869991E423D74A71A97D701605C98F68"><enum>(I)</enum><text>the ability of the defendant to afford the fee or other cost; and</text></subclause><subclause id="id74C6C3F885C141C5A55C0B90493E1DDE"><enum>(II)</enum><text>the impact of the fee or other cost on the ability of the defendant to succeed in the FAMILIES Program; and</text></subclause></clause><clause id="id5B0B61467E504DE8BC503D9DE718C689"><enum>(ii)</enum><text>take all necessary steps to ensure that the success of the defendant in the FAMILIES Program is not hindered by financial obstacles. </text></clause></subparagraph></paragraph></subsection><subsection id="id695D5C32C56D46FB9C82B59C392673BB"><enum>(d)</enum><header>Training for judges</header><text>The Secretary, in collaboration with the Attorney General, the United States Sentencing Commission, and the Chief of the Defender Services Office of the Administrative Office of the United States Courts shall develop training for judges of the district courts on how to implement the FAMILIES Program, which shall include training on—</text><paragraph id="idA7ED30E747E0484F930C5404CE9A8BA7"><enum>(1)</enum><text>trauma-informed decision making;</text></paragraph><paragraph id="id478475153FD3444F8F6D530F1A022279"><enum>(2)</enum><text>child development, family dynamics, and the effects of parental separation;</text></paragraph><paragraph id="id2F0907E1CABD48B2954FF9487D7167F8"><enum>(3)</enum><text>domestic violence;</text></paragraph><paragraph id="id9D9DE0CE571F45B7936BB31BF67B5537"><enum>(4)</enum><text>child abuse and neglect;</text></paragraph><paragraph id="ide4af2dcf6c6b4d15993ab3861fc48540"><enum>(5)</enum><text>substance abuse and addiction;</text></paragraph><paragraph id="idDC97EC4336DC413F8AC446B8029AD51C"><enum>(6)</enum><text>mental health;</text></paragraph><paragraph id="id03B9CA41325549749AADF9C89AEB24EC"><enum>(7)</enum><text>cultural competence; and</text></paragraph><paragraph id="id0FE4496D167F4BA195EBE368FE80F45F"><enum>(8)</enum><text>examining bias.</text></paragraph></subsection></section><section id="id1782B6DA662E45F4A55295F8180071DA"><enum>3590B.</enum><header>FAMILIES Program</header><subsection id="id386F4FEBD01F49E1BF947DDB6E18E335"><enum>(a)</enum><header>Establishment</header><text>The Office, in cooperation with the Director of the Administrative Office of the United States Courts, the Attorney General, the Secretary, and the Chief of the Defender Services Office of the Administrative Office of the United States Courts, shall establish and operate the FAMILIES Program for purposes of this subchapter.</text></subsection><subsection id="id7E8D415BF57843399BF3B2F41D5C7B9E"><enum>(b)</enum><header>Contents</header><text>The FAMILIES Program shall include—</text><paragraph id="idfa392c138635413f9e8f55d71a2e249a"><enum>(1)</enum><text>education programs, including—</text><subparagraph id="idB1FFF14142094D099EE34A8D5B37D25F"><enum>(A)</enum><text>general educational development (commonly known as <quote>GED</quote>) programs; and</text></subparagraph><subparagraph id="id7AA2205B54E0451A8F970C1CE4422680"><enum>(B)</enum><text>postsecondary education programs, including enrollment in community college coursework;</text></subparagraph></paragraph><paragraph id="ideb1e616806f2449f8ebde6c18dd5ed1f"><enum>(2)</enum><text>employment counseling and job-seeking activities;</text></paragraph><paragraph id="id4a2f4f69c0f44b3c884cc9589b31fd30"><enum>(3)</enum><text>subsidized jobs programs;</text></paragraph><paragraph id="id6cf7ddf47d814a429f34ad9ccfd7307e"><enum>(4)</enum><text>in-home parenting and skill-based programs;</text></paragraph><paragraph id="id47227858474b47ccae36b5c823197873"><enum>(5)</enum><text>substance abuse and mental health treatment programs, including medication-assisted treatment programs that make available not less than 2 drugs that have been approved under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) or section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) for the treatment of an opioid use disorder; and</text></paragraph><paragraph id="idc7df311968854cc6afeed06a758001cb"><enum>(6)</enum><text>two-generation model programs that address needs of both the parent and the child.</text></paragraph></subsection><subsection id="id1D0B2F730AA1451095BEEDD4B7DF12D8"><enum>(c)</enum><header>Collaboration with State and local governments</header><text>The Office, the Director of the Administrative Office of the United States Courts, the Attorney General, and the Secretary shall collaborate with State and local governmental agencies and nonprofit organizations to offer comprehensive community supervision programs and services to a participant under the FAMILIES Program in areas close to the place of residence of the participant.</text></subsection><subsection id="idDC7DC24871024DE8892996521B908DF4"><enum>(d)</enum><header>Connection to services</header><text>The court that sentences an eligible individual to participate in the FAMILIES Program, to the extent practicable, shall connect the eligible individual to services and programs that will meet the basic needs of the individual and the family of the individual, as appropriate, including—</text><paragraph id="idC1E404204D1F47439FD8490703BB78A1"><enum>(1)</enum><text>health care services, including assistance with enrollment in health insurance;</text></paragraph><paragraph id="idEDBFF0D881B946068594C87F2B41FDF5"><enum>(2)</enum><text>housing assistance;</text></paragraph><paragraph id="idE48F2BBFE74A422792F3DEF82B8441FE"><enum>(3)</enum><text>services to help the individual enroll in—</text><subparagraph id="id95F02F0077E9483880A9714CF9B7CCF4"><enum>(A)</enum><text>the special supplemental nutrition program for women, infants, and children established by section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) (commonly known as the <quote>WIC Program</quote>);</text></subparagraph><subparagraph id="id0B8196569D7147B09C3721E79A6EA807"><enum>(B)</enum><text>the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) (commonly known as the <quote>SNAP Program</quote>);</text></subparagraph><subparagraph id="idF717CB2258F9454289F4A5FAFF933111"><enum>(C)</enum><text>the program of block grants for States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>) (commonly known as the <quote>TANF Program</quote>);</text></subparagraph><subparagraph id="id0156D4DA4FF54AC0B4765AC428868180"><enum>(D)</enum><text>disability insurance benefits under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>), or other benefits payable under such title on the basis of a disability; and</text></subparagraph><subparagraph id="id2875E06FE1054475BA5269C0ECFDE8A2"><enum>(E)</enum><text>supplemental security income benefits under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></subparagraph></paragraph><paragraph id="idE6A9717A8F0B494A8DFCC85AA18B6237"><enum>(4)</enum><text>evidence-based substance use disorder treatment, including medication-assisted treatment described in subsection (b)(5), and harm reduction services; and</text></paragraph><paragraph id="idB2BA95948CFD45A289C0FDBC038E7E52"><enum>(5)</enum><text>any other service or program that the court determines necessary to meet the basic needs of the individual and the family of the individual, including family therapy or counseling services.</text></paragraph></subsection><subsection id="id9417DA638C0C4BD892C92D2AC91C6C3D"><enum>(e)</enum><header>Operation during emergencies</header><paragraph id="id181656A0DD844DFE9745181B40AF0A69"><enum>(1)</enum><header>In general</header><text>To the extent practicable, during a period of a national or State public health emergency, including the COVID–19 pandemic, the FAMILIES Program may be conducted solely by electronic means.</text></paragraph><paragraph id="id9900D97BBC79417BBCB8BBBC7FAFE13A"><enum>(2)</enum><header>Inability to participate</header><text>During a period described in paragraph (1), if an element of the FAMILIES Program is not available by electronic means—</text><subparagraph id="idE30A1716F5434C298E6B8CD94E8B2402"><enum>(A)</enum><text>a participant shall not be penalized for being unable to participate in the unavailable element; and</text></subparagraph><subparagraph id="id2EC54429306B4B39897819B7D2F7007E"><enum>(B)</enum><text>the Office may offer a participant described in subparagraph (A) the opportunity to participate in other elements of the FAMILIES Program that can be conducted solely by electronic means.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8c407df9-6f68-11ea-9975-a701de0c24c0"><enum>3590C.</enum><header display-inline="yes-display-inline">Continuation or revocation of participation</header><subsection commented="no" display-inline="no-display-inline" id="id25BAE43FEA9A4DF7B73C4EC3A71A4CAA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the defendant violates a condition of participation in the FAMILIES Program at any time prior to completion of the program, the court may, after conducting a hearing, considering the factors set forth in section 3553(a) to the extent that they are applicable, and considering whether the programmatic requirements of the sentence need to be modified in order for the defendant to be successful— </text><paragraph id="id8c407dfb-6f68-11ea-9975-a701de0c24c0"><enum>(1)</enum><text>continue the participation of the defendant in the FAMILIES Program, with or without extending the term or modifying or enlarging the conditions; or</text></paragraph><paragraph id="id8c407dfc-6f68-11ea-9975-a701de0c24c0"><enum>(2)</enum><text>revoke the sentence and resentence the defendant under subchapter A.</text></paragraph></subsection><subsection id="id6768DBF2777B485BAC80308E65179AD6"><enum>(b)</enum><header>Right to counsel</header><paragraph id="id5EA5E2AC930F4198992D7CA98B0EAB63"><enum>(1)</enum><header>In general</header><text>At a hearing conducted under subsection (a), the defendant shall have the right to be represented by counsel.</text></paragraph><paragraph id="idEE8EAA68D02C4E5C9D2A5744F0554860"><enum>(2)</enum><header>Court-provided counsel</header><subparagraph id="id1AC3ECD6C15B4C32B0FD1F9F6D005646"><enum>(A)</enum><header>In general</header><text>If the defendant is financially unable to obtain representation by counsel for the hearing under subsection (a), the court shall appoint counsel to represent the defendant in the hearing.</text></subparagraph><subparagraph id="idBBFDAAD0A6864936BB449DFE95FE28C2"><enum>(B)</enum><header>Appointment; compensation</header><text>Appointment and compensation of counsel under subparagraph (A) shall be in accordance with section 3006A.</text></subparagraph></paragraph></subsection><subsection id="id29CC69DDCE5448189EB01DAD854B53E9"><enum>(c)</enum><header>Substance use disorder relapse</header><text>If a defendant participating in the FAMILIES Program who is recovering from a substance use disorder suffers a relapse, the court—</text><paragraph id="id15288E4A260243CA852C1D0E6FE416D9"><enum>(1)</enum><text>shall notify each service provider that is working with the defendant under the FAMILIES Program; and</text></paragraph><paragraph id="idD30F36B2EA3D4D70BEE766DC95AD6D6C"><enum>(2)</enum><text>may not revoke the sentence of the defendant or otherwise penalize the defendant under subsection (a) solely because of the relapse.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8c4b055b-6f68-11ea-9975-a701de0c24c0"><enum>3590D.</enum><header display-inline="yes-display-inline">Pre-judgment sentence and expungement procedures</header><subsection commented="no" display-inline="no-display-inline" id="id8c4b055c-6f68-11ea-9975-a701de0c24c0"><enum>(a)</enum><header>Pre-Judgment sentence</header><paragraph commented="no" display-inline="no-display-inline" id="id23B645679C3A4691A1288EFB17F81663"><enum>(1)</enum><header>In general</header><text>If an eligible individual is found guilty of an offense and the court makes an affirmative determination under sections 3553(b)(1) and 3590A(b), the court may, with the consent of the individual, sentence the individual to participation in the FAMILIES Program for a term to be determined by the court without entering a judgment of conviction.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id894227E7D8B548AAB571A2825646E4D0"><enum>(2)</enum><header>Early discharge</header><text>At any time before the expiration of the term of the sentence under paragraph (1), if the individual has not violated a condition of participation in the FAMILIES Program, the court may, without entering a judgment of conviction, dismiss the proceedings against the individual and discharge the individual from the FAMILIES Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE5DC197740FC447E99534F58C40E161E"><enum>(3)</enum><header>Timely discharge</header><text>At the expiration of the term of the sentence under paragraph (1), if the individual has not violated a condition of participation in the FAMILIES Program, the court shall, without entering a judgment of conviction, dismiss the proceedings against the individual and discharge the individual from the FAMILIES Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA40F421F6CB14A30897F9250EB106B8C"><enum>(4)</enum><header>Revocation</header><text>If the individual violates a condition of participation in the FAMILIES Program, the court shall proceed in accordance with the provisions of section 3590C.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id58B175BBD59D489F9E85F853F79AEDBC"><enum>(b)</enum><header>Collateral consequences</header><text>A disposition under subsection (a), or a conviction that is the subject of an expungement order under subsection (c), shall not be considered a conviction for the purpose of a disqualification or a disability imposed by law upon conviction of a crime, or for any other purpose.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8c4b2c70-6f68-11ea-9975-a701de0c24c0"><enum>(c)</enum><header>Expungement of record of disposition</header><paragraph commented="no" display-inline="no-display-inline" id="idD57A77D29BCA4F7FA7B802865CC44875"><enum>(1)</enum><header>In general</header><text>If the case against an individual is the subject of a disposition under subsection (a), and the individual was less than 21 years old at the time of the offense, the court shall enter an expungement order upon dismissing the proceedings against the individual and discharging the individual from the FAMILIES Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id495712579287427F8EC345D17857CA29"><enum>(2)</enum><header>Contents of order</header><text>An expungement order entered under paragraph (1) shall direct that there be expunged from all official records all references to the arrest of the individual for the offense, the institution of criminal proceedings against the individual, and the results thereof.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE9C8116246A4A4CAA8498E35F2B78BD"><enum>(3)</enum><header>Effect</header><text>The effect of an expungement order entered under paragraph (1) shall be to restore the individual, in the contemplation of the law, to the status the individual occupied before the arrest or institution of criminal proceedings.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0A84117AC65419DBE86FF55F598462E"><enum>(4)</enum><header>Protection from perjury laws</header><text>An individual concerning whom an expungement order has been entered under paragraph (1) shall not be held thereafter under any provision of law to be guilty of perjury, false swearing, or making a false statement by reason of the failure of the individual to recite or acknowledge the arrests or institution of criminal proceedings for the offense, or the results thereof, in response to an inquiry made of the individual for any purpose.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4177608C917D4105B124AFEC6849EDF7"><enum>(b)</enum><header>Technical and conforming amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">Chapter and</text></clause><clause id="id58D2DF3B928A4DB6A4C366944076203B"><enum>(iii)</enum><text>how program services can be better directed to eligible individuals who would otherwise be sentenced to a term of probation or a term of imprisonment; and</text></clause></subparagraph><subparagraph id="id3652FA92708C4B3393CE65FB6E1C168C"><enum>(B)</enum><text>examine access to the FAMILIES Program for Black, Latinx or Hispanic, Native American, Asian American, and Pacific Islander communities.</text></subparagraph></paragraph></subsection><subsection id="id9213D95567104A96BE34B9C3313F623A"><enum>(e)</enum><header>Appropriations</header><paragraph id="id4BA05C99040F42EBB8C1D08716206A3F"><enum>(1)</enum><header>Implementation</header><text>Out of amounts in the Treasury not otherwise appropriated, there is appropriated to the Office of Probation and Pretrial Services of the Administrative Office of the United States Courts to carry out the FAMILIES Program established under section 3590B of title 18, United States Code, as added by subsection (a) of this section, $100,000,000 for fiscal year 2022, to remain available until expended.</text></paragraph><paragraph id="id28AFFAC17959469BBD8C7DE278D6ED55"><enum>(2)</enum><header>Training</header><text>Out of amounts in the Treasury not otherwise appropriated, there is appropriated to the Secretary of Health and Human Services to develop training for judges under section 3590A(d) of title 18, United States Code, as added by subsection (a) of this section, $5,000,000 for fiscal year 2022, to remain available until expended.</text></paragraph></subsection></section></legis-body></bill>
