which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide grants for the construction, improvement, and acquisition of middle mile infrastructure.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Middle Mile Broadband Deployment Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id5559B3EF6D7144228F90EBBC430BDCB0"><enum>2.</enum><header>Enabling middle mile broadband infrastructure</header><subsection id="id3ee9a9df0df345d5b89e7740cfe7d5f9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id2b4a642fa59043d8b89713381e873bda"><enum>(1)</enum><header>Anchor institution</header><text>The term <term>anchor institution</term> means a school, library, medical or healthcare provider, community college or other institution of higher education, or other community support organization or entity.</text></paragraph><paragraph id="idabdf622477ab4b96b77f125ea6805d46"><enum>(2)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph id="id0c5a57b141dd4c5caac714ad098e139e"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="id7d0d13c29bee4d5cbd387397a3007d26"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id249EA776133645388AF108A5B56FE75F"><enum>(A)</enum><text>a State, political subdivision of a State, Tribal government, technology company, electric utility, utility cooperative, public utility district, telecommunications company, telecommunications cooperative, nonprofit foundation, nonprofit corporation, nonprofit institution, nonprofit association, regional planning counsel, Native entity, or economic development authority; or</text></subparagraph><subparagraph id="idAA16B5EDF80F4A38A2C07A0AEC7D91C0"><enum>(B)</enum><text>a partnership of 2 or more entities described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idf135501d89b14b53aca88358277a0e3f"><enum>(5)</enum><header>FCC fixed broadband map</header><text>The term <term>FCC fixed broadband map</term> means the map created by the Commission under section 802(c)(1)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/642">47 U.S.C. 642(c)(1)(B)</external-xref>).</text></paragraph><paragraph id="idEF085EF80A4C4BD99D6CEF5980E83141"><enum>(6)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idee087878eb144fe38d9e46269a567b38"><enum>(7)</enum><header>Interconnect</header><text>The term <term>interconnect</term> means the physical linking of 2 networks for the mutual exchange of traffic on non-discriminatory terms and conditions.</text></paragraph><paragraph id="id9589bad56b6e4e9b9e8889cdcf3721c4"><enum>(8)</enum><header>Internet exchange facility</header><text>The term <term>internet exchange facility</term> means physical infrastructure through which internet service providers and content delivery networks exchange internet traffic between their networks. </text></paragraph><paragraph id="idafe37388203c4b4fb6a9216e1f5fbf7d"><enum>(9)</enum><header>Middle mile infrastructure</header><text>The term <term>middle mile infrastructure</term>—</text><subparagraph id="id3f23e55a26474723bd2cae3fb46adab0"><enum>(A)</enum><text>means any broadband infrastructure that does not connect directly to an end-user location, including an anchor institution; and</text></subparagraph><subparagraph id="id4d3e74474be94a55b407340670aca456"><enum>(B)</enum><text>includes—</text><clause id="idadf995f4f2ba4adea503a2eb98a1cffa"><enum>(i)</enum><text>leased dark fiber, interoffice transport, backhaul, internet exchange facilities, carrier-neutral submarine cable landing stations, undersea cables, transport connectivity to data centers, special access transport, and other similar services; and</text></clause><clause id="id4d7bb422c308412594420e2c1445b594"><enum>(ii)</enum><text>wired or private wireless broadband infrastructure, including microwave capacity, radio tower access, and other services or infrastructure for a private wireless broadband network, such as towers, fiber, and microwave links.</text></clause></subparagraph></paragraph><paragraph id="idBF2D45C57AEB4EB8B071691F72E246B5"><enum>(10)</enum><header>Middle mile grant</header><text>The term <term>middle mile grant</term> means a grant awarded under subsection (c).</text></paragraph><paragraph id="idba02edafb986486995a2f1322bde677d"><enum>(11)</enum><header>Native entity</header><text>The term <term>Native entity</term> means—</text><subparagraph id="idC466CA7FB8D540309497003E581B1AED"><enum>(A)</enum><text>an Indian Tribe;</text></subparagraph><subparagraph id="idE30E8AB9A6AD4CEA975724318572E282"><enum>(B)</enum><text>an Alaska Native Corporation;</text></subparagraph><subparagraph id="idF2A9A7C9DF7F4A6B817083F0362A9337"><enum>(C)</enum><text>a Native Hawaiian organization (as defined in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>));</text></subparagraph><subparagraph id="idAAEE5EE8958D446795AFBE6C07A748F5"><enum>(D)</enum><text>the Department of Hawaiian Home Lands; and</text></subparagraph><subparagraph id="id3BFE58E4DC854F2791B905CC3E802EE6"><enum>(E)</enum><text>the Office of Hawaiian Affairs. </text></subparagraph></paragraph><paragraph id="id05ba7d460fab463d94956a93234e9abb"><enum>(12)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph><paragraph id="id771ed736834d4e1dacaa8f4146970f5e"><enum>(13)</enum><header>Submarine cable landing station</header><text>The term <term>submarine cable landing station</term> means a cable landing station, as that term is used in section 1.767(a)(5) of title 47, Code of Federal Regulations (or any successor regulation), that can be utilized to land a submarine cable by an entity that has obtained a license under the first section of the Act entitled <quote>An Act relating to the landing and operation of submarine cables in the United States</quote>, approved May 27, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/47/34">47 U.S.C. 34</external-xref>) (commonly known as the <quote>Cable Landing Licensing Act</quote>). </text></paragraph><paragraph id="id54bc2477ae72439cab260bf01041e857"><enum>(14)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="id9f7c8f4ac96a44fc96bdf6ef9e56758a"><enum>(15)</enum><header>Trust land</header><text>The term <term>trust land</term> has the meaning given the term in section 3765 of title 38, United States Code.</text></paragraph><paragraph id="ide47c936dd4c84349a3ebfc787aaec15a"><enum>(16)</enum><header>Underserved</header><text>The term <term>underserved</term>, with respect to an area, means an area—</text><subparagraph id="id5cec34dd5a354a8b89eae99e61ef1997"><enum>(A)</enum><text>that is designated as a Tribally underserved area through the process described in subsection (g); or</text></subparagraph><subparagraph id="id162c9bbbe8c4436d83d456e3e15e9dc7"><enum>(B)</enum><text>that—</text><clause id="idfaef4c5b69b34f5b9b7356b924e0887d"><enum>(i)</enum><text>is of a standard size not larger than a census block, as established by the Commission;</text></clause><clause id="idac04afc0a7d84fceb2427a1d0e8f49d0"><enum>(ii)</enum><text>is not an unserved area; and</text></clause><clause id="id67c8237dffe2479db2dc1c49cbfaad15"><enum>(iii)</enum><text>as determined in accordance with the FCC fixed broadband map, does not have access to broadband service with—</text><subclause id="id34ed8eb2d30348c6a301f647370a2eba"><enum>(I)</enum><text>except as provided in subclause (II)—</text><item id="id0993845cb7ea46549395d5c2655b06a5"><enum>(aa)</enum><text>a download speed of not less than 100 megabits per second; and</text></item><item id="id2cec193cdede42c0a33d2ef19f918ae5"><enum>(bb)</enum><text>an upload speed of not less than 20 megabits per second; or</text></item></subclause><subclause id="idf97b46accb764b9fbad2ce5276842944"><enum>(II)</enum><text>minimum download and upload speeds established as benchmarks by the Commission for purposes of this Act after the date of enactment of this Act, if those minimum speeds are higher than the minimum speeds required under subclause (I).</text></subclause></clause></subparagraph></paragraph><paragraph id="id8b37192eae9746b0bbc189c04b95e82e"><enum>(17)</enum><header>Unserved</header><text>The term <term>unserved</term>, with respect to an area, means an area—</text><subparagraph id="idc58630b481244189841b5ca5f7785b56"><enum>(A)</enum><text>that is designated as a Tribally underserved area through the process described in subsection (g); or</text></subparagraph><subparagraph id="ideea4d41e66cb4e6d87851f8e27e515aa"><enum>(B)</enum><text>that—</text><clause id="idbd93b6f8af294446892107ce4b570874"><enum>(i)</enum><text>is of a standard size not larger than a census block, as established by the Commission; and</text></clause><clause id="id3813495e0ce04dce90656669cd804761"><enum>(ii)</enum><text>as determined in accordance with the FCC fixed broadband map, does not have access to broadband service—</text><subclause id="id5199EF67CB944CF4BBB92994DAACB4FD"><enum>(I)</enum><text>except as provided in subclause (II)—</text><item id="id28359D512D4949D191AE249B25BE6A5F"><enum>(aa)</enum><text>a download speed of not less than 25 megabits per second; and</text></item><item id="id68C04B315D594D02B9F51CC3BDEE5E9F"><enum>(bb)</enum><text>an upload speed of not less than 3 megabits per second; or</text></item></subclause><subclause id="id7DC0532A5BDF459EBBC7800D0513E0FA" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>minimum download and upload speeds established as benchmarks by the Commission for purposes of this Act after the date of enactment of this Act, if those minimum speeds are higher than the minimum speeds required under subclause (I).</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id7e78eaac389841229d110252ddf7d44d"><enum>(b)</enum><header>Purpose; sense of Congress</header><paragraph id="idba25fbf066fa4a649aada0a1138a0837"><enum>(1)</enum><header>Purpose</header><text>The purposes of this section are—</text><subparagraph id="idab15e1b2403e401dafcc39bfd709e88e"><enum>(A)</enum><text>to encourage the expansion and extension of middle mile infrastructure to reduce the cost of connecting unserved and underserved areas to the backbone of the internet (commonly referred to as the <quote>last mile</quote>); and</text></subparagraph><subparagraph id="idc2cff4fe23ad477292e263853280fa2a"><enum>(B)</enum><text>to promote broadband connection resiliency through the creation of alternative network connection paths that can be designed to prevent single points of failure on a broadband network.</text></subparagraph></paragraph><paragraph id="ide7239ce2969140319adb20d078af4967"><enum>(2)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><subparagraph id="id659ead3799bd4664b98fc5b8e4b34eb6"><enum>(A)</enum><text>in awarding middle mile grants, the Assistant Secretary should give priority to—</text><clause id="idad1d7f47db1e485288f7ef9890c15303"><enum>(i)</enum><text>projects that leverage existing rights-of-way, assets, and infrastructure to minimize financial, regulatory, and permitting challenges;</text></clause><clause id="ide63ff41b723844ada775f1285a037cb2"><enum>(ii)</enum><text>projects in which the eligible entity designs the route of the middle mile infrastructure to enable the connection of unserved anchor institutions, including Tribal anchor institutions; and</text></clause><clause id="id9283285f4ee846baa3fe2ac8966b4cf2"><enum>(iii)</enum><text>projects that—</text><subclause id="id1C1D23A001514C7FB8774F7C6885AD91"><enum>(I)</enum><text>improve the redundancy and resiliency of existing middle mile infrastructure, including those projects that facilitate interconnection with existing infrastructure, including add/drop capabilities at existing amplification sites and the ability to add splice cases with adequate fiber slack to build laterals that support future carrier-neutral interconnection facilities and connections to anchor institutions; and</text></subclause><subclause id="idC4B0309970F4470392F5EBE877DEF03F"><enum>(II)</enum><text>reduce regulatory and permitting barriers to promote the construction of new middle mile infrastructure; and</text></subclause></clause></subparagraph><subparagraph id="idfb1e5f22e4ef43c49e6dcae0627c6b72"><enum>(B)</enum><text>a regulated utility should use funds received from a middle mile grant as a supplement to the core utility capital investment plan of the regulated utility to—</text><clause id="idA05B923B8E6D4305BDF0EF9F965DA31C"><enum>(i)</enum><text>facilitate increased broadband resiliency or redundancy of existing middle mile infrastructure; or</text></clause><clause id="idB136589A49864871B2B8168A58F52523"><enum>(ii)</enum><text>provide connectivity to unserved areas and underserved areas within the service territory of the utility and nearby communities.</text></clause></subparagraph></paragraph></subsection><subsection id="idf0edb56e40cc49c0973b60bd5814def1"><enum>(c)</enum><header>Middle mile grants</header><text>The Assistant Secretary shall establish a program under which the Assistant Secretary makes grants on a technology-neutral, competitive basis to eligible entities for the construction, improvement, or acquisition of middle mile infrastructure.</text></subsection><subsection id="ide79f215a5d694e58878a08a0f23f912f"><enum>(d)</enum><header>Applications for grants</header><paragraph id="idf35e593e2d864395a1684e5900a4baaa"><enum>(1)</enum><header>In general</header><text>The Assistant Secretary shall establish an application process for middle mile grants in accordance with this subsection.</text></paragraph><paragraph id="id6e17ee965abe4af1b6b0b6ca3ac27bf2"><enum>(2)</enum><header>Evaluation of applications</header><text>In establishing an application process for middle mile grants under paragraph (1), the Assistant Secretary shall give priority to an application from an eligible entity that satisfies 2 or more of the following conditions:</text><subparagraph id="idb7b9a38070cf41d6bb2069998c6cbd8f"><enum>(A)</enum><text>The eligible entity adopts fiscally sustainable middle mile strategies.</text></subparagraph><subparagraph id="id18b4599e2848485baa14f56976be945d"><enum>(B)</enum><text>The eligible entity commits to offering non-discriminatory interconnect to terrestrial and wireless last mile broadband providers and any other party making a bona fide request.</text></subparagraph><subparagraph id="id17883a382cb8424d8fea566c892fa0b7"><enum>(C)</enum><text>The eligible entity identifies specific terrestrial and wireless last mile broadband providers that have—</text><clause id="id36a15e8bddd14a8a8a2823a329b57509"><enum>(i)</enum><text>expressed written interest in interconnecting with middle mile infrastructure planned to be deployed by the eligible entity; and</text></clause><clause id="ide21e73f173864ea6828703acb4724775"><enum>(ii)</enum><text>demonstrated sustainable business plans or adequate funding sources with respect to the interconnect described in clause (i).</text></clause></subparagraph><subparagraph id="idcd48abc9193d4f078ffc4f2f60810e1c"><enum>(D)</enum><text>The eligible entity has identified supplemental investments or in-kind support (such as waived franchise or permitting fees) that will accelerate the completion of the planned project.</text></subparagraph><subparagraph id="id99266f7f44304ffd99d4d5530b560159"><enum>(E)</enum><text>The eligible entity has demonstrated that the middle mile infrastructure will benefit national security interests of the United States and the Department of Defense.</text></subparagraph></paragraph><paragraph id="id2c77279bc8ed4b8dbf7f8ba34b8ea56b"><enum>(3)</enum><header>Grant application competence</header><text>The Assistant Secretary shall include in the application process established under paragraph (1) a requirement that an eligible entity provide evidence that the eligible entity is capable of carrying out a proposed project in a competent manner, including by demonstrating that the eligible entity has the financial, technical, and operational capability to carry out the proposed project and operate the resulting middle mile broadband network.</text></paragraph></subsection><subsection id="id1f7a875a255342aca27fd07f9cdb7160"><enum>(e)</enum><header>Eligibility</header><paragraph id="id3219bf9d4cde437ba2c1627647e29a7f"><enum>(1)</enum><header>Prioritization</header><text>To be eligible to obtain a middle mile grant, an eligible entity shall agree, in the application submitted through the process established under subsection (d), to prioritize—</text><subparagraph id="id0dd03c55cd704a7bbccd0b00097f0b72"><enum>(A)</enum><text>connecting middle mile infrastructure to last mile networks that provide or plan to provide broadband service to households in unserved areas; </text></subparagraph><subparagraph id="id6f2919d7f13944508870476bc8f2325b"><enum>(B)</enum><text>connecting non-contiguous trust lands; or</text></subparagraph><subparagraph id="id05d0934c14b3482491946751df5a0737"><enum>(C)</enum><text>the offering of wholesale broadband service at reasonable rates on a carrier-neutral basis.</text></subparagraph></paragraph><paragraph id="idc31f8f1ad1b04a6682338116b12c8eda"><enum>(2)</enum><header>Buildout timeline</header><text>Subject to paragraph (5), to be eligible to obtain a middle mile grant, an eligible entity shall agree, in the application submitted through the process established under subsection (d), to complete buildout of the middle mile infrastructure described in the application by not later than 5 years after the date on which amounts from the grant are made available to the eligible entity.</text></paragraph><paragraph id="id43959b2f7fab490e8f9dec715aecc097"><enum>(3)</enum><header>Project eligibility requirements</header><subparagraph id="id227c2bf1853946459dfc5879dfaf3c5a"><enum>(A)</enum><header>Capability to support retail broadband service</header><text>A project shall be eligible for a middle mile grant if, at the time of the application, the Assistant Secretary determines that the proposed middle mile broadband network—</text><clause id="id6DCB524344434EDAA0501288213C34A1"><enum>(i)</enum><text>will be capable of supporting retail broadband service that meets speed, latency, reliability, consistency in quality of service, and related criteria, as the Assistant Secretary shall determine; and</text></clause><clause id="id8534c468cf384590940d6910467f2d4c"><enum>(ii)</enum><text>will be able to easily scale speeds over time to—</text><subclause id="idA66DCE36612B48B1A8C30395DB69BD4B"><enum>(I)</enum><text>meet the evolving connectivity needs of households, businesses, and anchor institutions; and</text></subclause><subclause id="id31913DC41C5E4CD49FD7E70D6667464B"><enum>(II)</enum><text>support the deployment of 5G, successor wireless technologies, and other advanced services.</text></subclause></clause></subparagraph><subparagraph id="id71ec71a4115542bcbf80f9096d3b7ed5"><enum>(B)</enum><header>Mapping data</header><clause id="id1bf0fd05f52547abaf1028b55232002d"><enum>(i)</enum><header>Use of most recent data</header><text>In mapping out gaps in broadband coverage, an eligible entity that uses a middle mile grant to build out terrestrial or fixed wireless middle mile infrastructure shall use the most recent broadband mapping data available from one of the following sources:</text><subclause id="iddab883fd1e6e492db4a7b0c7c4706065"><enum>(I)</enum><text>The FCC fixed broadband map.</text></subclause><subclause id="idca3c10bdcc3e468389dbeb4a78731489"><enum>(II)</enum><text>The State in which the area that will be served by the middle mile infrastructure is located, or the Tribal government with jurisdiction over the area that will be served by the middle mile infrastructure (if applicable).</text></subclause><subclause id="iddafdcf81134b4521ab51903d839b6ab2"><enum>(III)</enum><text>Speed and usage surveys of existing broadband service that—</text><item id="id8CB9D156033B430EA82C1C4677649695"><enum>(aa)</enum><text>demonstrate that more than 25 percent of the respondents display a broadband service speed that is slower than the speeds required for an area to qualify as unserved; and</text></item><item id="id5A89B4403D904106945B21286C8A8CE8"><enum>(bb)</enum><text>are conducted by—</text><subitem id="id739E1FA4BB754220BEBF0346F1F60DBA"><enum>(AA)</enum><text>the eligible entity;</text></subitem><subitem id="id7F14DF35741C4E49A7661D8261C226D0"><enum>(BB)</enum><text>the State in which the area that will be served by the middle mile infrastructure is located; or</text></subitem><subitem id="id147EDD822CBC4477B3F308692628E4A5"><enum>(CC)</enum><text>the Tribal government with jurisdiction over the area that will be served by the middle mile infrastructure (if applicable).</text></subitem></item></subclause></clause><clause id="id7ed9f4cafe5b4bfcb81190d44d21caa7"><enum>(ii)</enum><header>Sharing facility locations</header><subclause id="id1a98f2c4aa444eab862dd44de09b0724"><enum>(I)</enum><header>Definition</header><text>In this clause, the term <term>covered recipient</term>, with respect to an eligible entity, means—</text><item id="id5A824CC1E3C843BB9C33F8AA021185F8"><enum>(aa)</enum><text>the Assistant Secretary;</text></item><item id="id95D76B9BB220422881BC7F0FEE68BD21"><enum>(bb)</enum><text>the Commission;</text></item><item id="id4E18E728DD1C4B1E917B7EBC9B1480AA"><enum>(cc)</enum><text>the Tribal government with jurisdiction over the area that will be served by the middle mile infrastructure (if applicable); and</text></item><item id="id223E8DCD0E5347599F04ABF7A509EB63"><enum>(dd)</enum><text>the State broadband office for the State in which the area that will be served by the middle mile infrastructure is located.</text></item></subclause><subclause id="idd9f20192e1d24960a0ebf1a7fa60647b"><enum>(II)</enum><header>Provision of information</header><text>Subject to subclauses (III) and (IV), an eligible entity that constructs, improves, or acquires middle mile infrastructure using a middle mile grant shall share with each covered recipient the location of all the middle mile broadband infrastructure.</text></subclause><subclause id="id019c7461a4b3484e96fe347517e422a1"><enum>(III)</enum><header>Format</header><text>An eligible entity shall provide the information required under subclause (II) to each covered recipient in a uniform format determined by the Assistant Secretary.</text></subclause><subclause id="id8e415c87acd44de497bf874b2e5c6853"><enum>(IV)</enum><header>Protection of information</header><item id="id40f0d434ab484eb8b743cd42859ba17b"><enum>(aa)</enum><header>In general</header><text>The information provided by an eligible entity under subclause (II) may only be used for purposes of carrying out the grant program under subsection (c) and any reporting related thereto.</text></item><item id="idc5e008802cff4f28817c94e1344480f1" commented="no"><enum>(bb)</enum><header>Legal defenses</header><subitem id="idb4afa345201d411590fb5c665d99319c" commented="no"><enum>(AA)</enum><header>In general</header><text>A covered recipient may not receive information under subclause (II) unless the covered recipient agrees in writing to assert all available legal defenses to the disclosure of the information if a person or entity seeks disclosure from the covered recipient under any Federal, State, or local public disclosure law.</text></subitem><subitem id="id7ab0602dbdca439a93cea4c7c66b954b" commented="no"><enum>(BB)</enum><header>Rule of construction</header><text>Nothing in subitem (AA) is intended to be or shall be construed as a waiver of Tribal sovereign immunity.</text></subitem></item></subclause></clause></subparagraph><subparagraph id="id4eabe82dace34ad888d5a9b943862f5f"><enum>(C)</enum><header>Connection to anchor institutions</header><text>To the extent feasible, an eligible entity that receives a middle mile grant to build middle mile infrastructure using fiber optic technology shall—</text><clause id="ida13b20c2f61f475ebcfe86336a880841"><enum>(i)</enum><text>ensure that the proposed middle mile broadband network will be capable of providing broadband to an anchor institution at a speed of not less than—</text><subclause id="id408A8794CDAE4758A341677E3455038A"><enum>(I)</enum><text>1 gigabit per second for downloads; and</text></subclause><subclause id="idA50ADF96B26A454688B5D7E565BE54DE"><enum>(II)</enum><text>1 gigabit per second for uploads to an anchor institution; and</text></subclause></clause><clause id="ide58f435dd83b49438c5063693e747c13"><enum>(ii)</enum><text>include direct interconnect facilities that will facilitate the provision of broadband service to anchor institutions located within 1,000 feet of the middle mile infrastructure.</text></clause></subparagraph><subparagraph id="id77baeb149ef74cefaa4384e40fda7ba5"><enum>(D)</enum><header>Interconnection and nondiscrimination</header><clause id="id19AC4FEBE1FE49EA8EC2E76BB7C8F04B"><enum>(i)</enum><header>In general</header><text>An eligible entity that receives a middle mile grant to build a middle mile project using fiber optic technology shall offer interconnection in perpetuity, where technically feasible without exceeding current or reasonably anticipated capacity limitations, on reasonable rates and terms to be negotiated with requesting parties.</text></clause><clause id="id8C047980E90B49AFA70F0249F87098D6"><enum>(ii)</enum><header>Nature of interconnection</header><text>The interconnection required to be offered under clause (i) includes both the ability to connect to the public internet and physical interconnection for the exchange of traffic.</text></clause><clause id="id19D2705DCC7A4428BC7891677205A470"><enum>(iii)</enum><header>Inclusion in application</header><text>An applicant for a middle mile grant shall disclose the applicant's proposed interconnection, nondiscrimination, and network management practices in the application submitted through the process established under subsection (d).</text></clause></subparagraph></paragraph><paragraph id="id150edfa4120549a6b7ce2341fbf7bcef"><enum>(4)</enum><header>Accountability</header><text>The Assistant Secretary shall—</text><subparagraph id="id5c4422172be94af09a8ab8d0dc013e1b"><enum>(A)</enum><text>establish sufficient transparency, accountability, reporting, and oversight measures for the grant program established under subsection (c) to deter waste, fraud, and abuse of program funds; and</text></subparagraph><subparagraph id="id4468fce7274c4226881522beb357370d"><enum>(B)</enum><text>establish—</text><clause id="id313A510ADEE049A0A285538A069D0EB7"><enum>(i)</enum><text>buildout requirements for each eligible entity that receives a middle mile grant, which shall require the completion of a certain percentage of project miles by a certain date; and</text></clause><clause id="idfe17d8e0f1534677b54d766833837c82"><enum>(ii)</enum><text>penalties, which may include rescission of funds, for grantees that do not meet requirements described in clause (i) or the deadline under paragraph (2).</text></clause></subparagraph></paragraph><paragraph id="id7fdd9fb80e13428b9b6ac624d9ad4df8"><enum>(5)</enum><header>Extensions</header><subparagraph id="id4075b81aef094a31ba0ee9dfaa324843"><enum>(A)</enum><header>In general</header><text>At the request of an eligible entity, the Assistant Secretary may extend the buildout deadline under paragraph (2) by not more than 1 year if the eligible entity certifies that— </text><clause id="id12572c9f23e44ca78f6e654141144f36"><enum>(i)</enum><text>the eligible entity has a plan for use of the middle mile grant;</text></clause><clause id="id1a1f308ce65b4d2ca6df9b15b31b721c"><enum>(ii)</enum><text>the project to build out middle mile infrastructure is underway; or</text></clause><clause id="idc72764cae4454d6dad672bef229926e9"><enum>(iii)</enum><text>extenuating circumstances require an extension of time to allow completion of the project to build out middle mile infrastructure.</text></clause></subparagraph><subparagraph id="id05a31ee043594250833dafef46e67a9b"><enum>(B)</enum><header>Effect on interim buildout requirements</header><text>If the Assistant Secretary grants an extension under subparagraph (A), the Assistant Secretary shall modify any buildout requirements established under paragraph (4)(B)(i) as necessary.</text></subparagraph></paragraph></subsection><subsection id="idaeab62e78e5c49c2827bbe021ec14d2c"><enum>(f)</enum><header>Federal share</header><text>The amount of a middle mile grant awarded to an eligible entity may not exceed 70 percent of the total project cost.</text></subsection><subsection id="id32f4713fbe7c42008f6ddbebd63e1bae"><enum>(g)</enum><header>Special rules for Tribal governments</header><paragraph id="id65c7fc54e9ae4df58b6b956b0775657c"><enum>(1)</enum><header>Waivers; alternative requirements</header><text>The Assistant Secretary, in consultation with Tribal governments and Native entities, may waive, or specify alternative requirements for, any provision of subsections (c) through (f) if the Assistant Secretary finds that the waiver or alternative requirement is necessary—</text><subparagraph id="ide3c5db2f1c0f45bab560471df4159df4"><enum>(A)</enum><text>for the effective delivery and administration of middle mile grants to Tribal governments; or</text></subparagraph><subparagraph id="id412fcabc4a13411482f9734bf397a5c3"><enum>(B)</enum><text>the construction, improvement, or acquisition of middle mile infrastructure on trust land.</text></subparagraph></paragraph><paragraph id="id27a08bf0194c414a99d0de0340a1cbf9"><enum>(2)</enum><header>Tribally unserved areas; Tribally underserved areas</header><text>The Assistant Secretary, in consultation with Tribal governments and Native entities, shall develop a process for designating Tribally unserved areas and Tribally underserved areas for purposes of this section.</text></paragraph></subsection><subsection id="id7b657d364225418d859b55392957b67b"><enum>(h)</enum><header>Maintenance of standards</header><text>Section 602 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3212">42 U.S.C. 3212</external-xref>) shall apply to any entity that receives assistance, whether directly or indirectly, under any program—</text><paragraph id="id00750146ba5141c08f80e4485b09f8bd"><enum>(1)</enum><text>that pertains to deploying broadband service; and</text></paragraph><paragraph id="idf9d92f3385494c0ca5ef9d607215ab7b"><enum>(2)</enum><text>for which the Assistant Secretary has administrative responsibility as provided by law or by delegation of authority pursuant to law.</text></paragraph></subsection><subsection id="idd56b07f9960244e8bda4ae471af1f6f8"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $2,000,000,000 for fiscal years 2022 through 2026. </text></subsection></section></legis-body></bill>
