<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2472</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210726">July 26, 2021</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> (for himself and <cosponsor name-id="S366">Ms. Warren</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the non-consensual release of claims by States, municipalities, federally recognized Tribes, or the United States against non-debtors, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H57B98905D0F24037A41434D4485D2ADD"><section section-type="section-one" id="H097AAEDFF5B741D78F00F555DF37E0E5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop shielding Assets from Corporate Known Liability by Eliminating non-debtor Releases Act</short-title></quote> or the <quote><short-title>SACKLER Act</short-title></quote>.</text></section><section id="H0E726950D1D844378DF4CAC21B7D6F38"><enum>2.</enum><header>Non-debtor releases</header><subsection display-inline="no-display-inline" id="H1F0C5BF91E8F4C59A9FF78E1AC067460"><enum>(a)</enum><header>Prohibition on certain non-Debtor releases</header><text>Section 105(b) of title 11, United States Code, is amended by striking <quote>a court may not</quote> and all that follows, and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HE409522AC913445B930F1D73791574B0"><text>a court may not—</text><paragraph id="H72F6A983E538434788A0744AA50A3EE8"><enum>(1)</enum><text>appoint a receiver in a case under this title; or</text></paragraph><paragraph id="H54C56DBC11AA40618766491932BA5276"><enum>(2)</enum><text>except as provided by section 524(g) of this title, enjoin or release a claim against a non-debtor by a State, municipality, federally recognized Tribe, or the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H707377E2A0884A248407863FA114779D"><enum>(b)</enum><header>Temporary stay on actions against non-Debtors</header><text>Section 105 of title 11, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2604C0668D024B67972B94F6735A25FF"><subsection id="H81D778001E844DCBA93A6B00BABA9CA5"><enum>(e)</enum><text>Notwithstanding subsection (b)(2), a court may issue an order staying, for a period not to exceed 90 days, the commencement or continuation, including the issuance or employment of process, of a judicial, administrative, or other action or proceeding by a State, municipality, federally recognized Tribe, or the United States against a non-debtor that was or could have been commenced before the commencement of the case under this title, or to recover a claim against a non-debtor that arose before the commencement of the case under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
